City Councilmembers, and Mr. Campen,
I represent the property owner of 17440-17450 Bellflower Boulevard and appellant for the public nuisance abatement costs appeal.
First, I would like to point out that the City’s agenda does not list my client’s appeal. Instead, Item 12.A. is described as:
ConsideraƟon and possible acƟon to conduct a public hearing to consider adopƟng ResoluƟon No. 26-37 – A ResoluƟon to record a NoƟce of Special Assessment for Nuisance Abatement for the property located at 17440-17450 Bellflower Boulevard (APN 7161-008-011).
RecommendaƟon to City Council: 1) Open the public hearing; take tesƟmonial and documentary evidence; and aŌer considering the evidence, adopt ResoluƟon No. 26-37 imposing a public nuisance abatement lien and special assessment on the property located 17440-17450 Bellflower Boulevard (APN 7161-008-011) to recover the City’s costs abatement; or 2) AlternaƟvely, discuss and take other acƟon related to this item.
There is no menƟon of my client’s appeal or the appeal hearing. Rather, the item is idenƟfied solely as a resoluƟon to record a special assessment.
Pursuant to the Brown Act, the agenda must specify the Ɵme and locaƟon of the meeƟng and a “brief general descripƟon” of each item of business to be transacted or discussed. Government Code § 54954.2(a)(1). Agenda descripƟons should give enough informaƟon to permit a person to make an informed decision about whether they want to aƩend or parƟcipate in a discussion on an issue. The California Municipal Law Handbook (Cal. CEB 2024) §2.20, ciƟng San Diegans for Open Gov’t v City of Oceanside (2016) 4 Cal. App. 5th 637, 643. Agendas must also describe each disƟnct acƟon to be taken by the legislaƟve body. San Joaquin Raptor Rescue Ctr. v County of Merced (2013) 216 Cal. App. 4th 1167, 1177 (when CEQA acƟon was disƟnct item of business, failure to separately list CEQA acƟon associated with agendized acƟon on project approval violated Brown Act). See also Hernandez v Town of Apple Valley (2017) 7 Cal. App. 5th 194, 209 (agenda must provide noƟce of each related item of business to be voted on at council meeƟng).
Please accept this email as a demand pursuant to SecƟon 54960.2 to cease and desist the aforemenƟoned Brown Act violaƟons, namely the improper consideraƟon and acƟon of an item not appropriately described on the September 28, 2026 agenda.
Second, the agenda supporƟng materials do not provide our appeal, our appeal addendum, or the City’s demands.
Rather, the City only provides a tabular list of costs without detail. As our appeal hinges on (1) the delay in the City’s co st demand, (2) and unsubstanƟated costs and fees, the documents themselves are necessary for a fair and impar Ɵal consideraƟon of the appeal.
2 Therefore, I have aƩached the following to this email for the Council’s consideraƟon:
1) The City’s IniƟal Demand
2) Appeal
3) Appeal Addendum
4) The City’s Revised Demand (with addiƟonal details for the City staff enforcement costs only)
Lastly, because the City’s demand is unƟmely – Appellant disputes the City’s enƟtlement to any costs. However, because the City has provided documentaƟon for some hearing officer and enforcement staff costs, Appellant is willing to pay $19,444.36 in full saƟsfacƟon of the City’s fees and costs. Mr. Campen may contact me directly if the City desires to accept this compromise in advance of the hearing.
Thank you,
~Livia

Re ABATEMENT COST DEMAND LETTER
17440-17450 Bellflower Blvd., Bellflower, CA 90706
APNs 7162'011-011
Dear Mr. Brown:
As you are aware, this law firm serves as the City Attorney's Office for the City of Bellflower ("City"), and I serve as its Assistant City Attorney. I am writing here with notice of the City's determination of the City's costs related to its abatement efforts to bring the above-referenced property at 1744O-17450 Bellflower Blvd. (the "Property") into compliance with the Bellflower Municipal Code ("BMC").
While the parties agreed to consider abatement of the Property to be in substantial compliance with the BMC for purposes of the administrative hearing officer's involvement with this matter, there were still some elements regarding the exterior of the structure remaining for fullcompliance. With those remaining elements now satisfied, the City considers its nuisance abatement action with the Property completed and is presenting to you this abatement cost demand.

To the City Clerk:
This is an appeal of the City's "Abatement Cost Demand Letter" ("Demand"), dated August 19, 2026, for the real property located at 17440 and 17450 Bellflower Blvd., Bellflower, CA 90706 (APN 7161-008-011) (the "Property"), consisting of two vacant commercial buildings. The City issued a Notice of Public Nuisance and Intention to Abate with City Personnel on March 10, 2023. The City listed a variety of purported nuisances, and the property owner timely appealed the notice. The first appeal hearing was heard on May 23, 2023. The fmal hearing officer order was dated April 15, 2026 and mailed to the Appellant on April 22, 2026.
The appeal is made by the Property's owner, 17450 Bellflower Blvd., LLC ("Appellant"), on the following grounds:
A. The Demand Fails to Comply with the Time Limits of BMC § 8.36.180 BMC § 8.36.180(B) mandates that the City "shall serve a statement of abatement costs on the responsible persons within 20 calendar days of the City's completion of nuisance abatement actions." BMC § 8.36.180(B).
Here, the City served its Demand on August 24, 2026 — more than four months after the hearing officer's final order. See Exhibit 1, Final Order Dated April 15, 2026. Notably, the hearing officer found "the administrative public nuisance action" was deemed concluded. Id, p. 5. The City Attorney's fmal cost entry is dated April 22, 2026. Demand, p. 10. Likewise, the City enforcement officer's final cost entry is dated April 22, 2026. Id., p. 14.
Moreover, notwithstanding that any purported nuisance was abated long ago, exterior painting was complete on April 8th, and an awning was installed July 1St. No additional exterior work has been undertaken since that time. Therefore, to the extent the City attempts to argue painting and installation of an awning constitute nuisance abatement actions, they were likewise complete months ago.
Docusign Envelope ID: C330F414-0749-8952-82DD-A0E0D623AB28 Appeal of Abatement Cost Demand Letter
Re: 17440 and 17450 Bellflower Blvd.
Because the City failed to comply with the procedural requirements of Bellflower Municipal Code Section 8.36.180(B), the Demand is untimely and on that basis alone should be denied in its entirety.
B. The Demand Fails to Provide a Detailed Accounting
In addition to being untimely, the Demand fails to provide sufficient detail to enable an assessment of reasonableness. While the hearing officer's statements provide entries with dates and substantive tasks, the City Attorney's office and City enforcement staff entries do not. The entries consist of names, time spent, and rates. Many of the City Attorney entries include names unfamiliar to Appellant and therefore Appellant has no way of knowing their relationship to the nuisance abatement process.
More importantly, the entries do not detail the tasks undertaken and therefore Appellant cannot verify they are related to the nuisance abatement process.
Because the Demand fails to provide the requisite detail, Appellant cannot contest the numerous City Attorney and City enforcement staff entries.
Based on the foregoing, Appellant appeals the City's Demand and requests a timely hearing thereon.

17440 and 17450 Bellflower Blvd
FINAL ORDER RE
PUBLIC NUISANCE ABATEMENT
Owner: 17450 BellflowerBlvd., LLC
t.
INTRODUCTION
This matter was first heard by the undersigned on May 23,2023, with respect to a public nuisance determination regarding real property located at 17440-17450 Bellflower Blvd. ("Property") in the City of Bellflower ("City"). The purpose of the hearing was to consider an administrative appeal by the owner of the Property from a Notice of Public Nuisance and lntention to Abate duly served on it. Following a finding of public nuisance and order of abatement, eight additional administrative status hearings were held with all parties before the undersigned to oversee progress with the Property owner's compliance with my original and subsequent abatement orders. On or about April 8, 2026, the undersigned was presented with current photographs of the Property and representations by the City that the Property was in substantial compliance with all administrative abatement orders. This is the Final Order regarding this administrative action, finding the Property is in substantial compliance with all administrative abatement orders and order for the Property owner to pay the City's enforcement-related costs in this matter pursuant
to Bellflower Municipal Code ('BMC') Chapter 8.36. All prior Orders of Abatement and attachments thereto for this matter are fully incorporated herein by reference. il.
BACKGROUND
Property is located in the City's General CommercialZone; title is held through an LLC. The Property consists of two vacant 2-story buildings with a shared wall and roof. lnspections by the City commencing in August 2022 revealed trespassers had broken in, partial roof failure with resulting water damage and electrical system damage with resultant fire danger. There was evidence of fire damage to portions of the roof and confirmed evidence of mold groMh due to water intrusion. The roof was structurally unstable and required replacement. Numerous other conditions to the interior and exterior of the Property also required remediation and abatement, including exterior blight of the building's condition.
On May 23,2023, a duly noticed public nuisance abatement hearing, pursuant to BMC Chapter 8.36, was held. Representatives of both the City and the Property were presented and presented evidence that was duly considered. On May 31 , 2023, the undersigned issued a "First Order re Abatement," finding that the Property was being maintained as a public nuisance as set forth specifically in the City's Notice of Public Nuisance and lntention to Abate with City Personnel served on the Property owner, and ordered that the nuisances be abated by the owner of the Property. Because of the substantial amount of abatement required, eight additional administrative status hearings were conducted by the undersigned with representatives of all parties present. The purpose of these status hearings was to monitor abatement efforts by the Property owner and ensure compliance with the undersigned orders.
A tenth administrative hearing was set to be heard on April 10, 2026, with the expectation that full abatement would be achieved by that date. On or about April 8, 2026, the undersigned was presented with current photographs of the Property and -2-
representations by the City that the Property was in substantial compliance with all administrative abatement orders. Accordingly, the undersigned took the tenth administrative hearing off calendar and proceeded with this Final Order.
Iil.
DISCUSSION AND C CLUSIONS OF LAW
Based on presentation of current photographs showing substantial compliance with abatement of the remaining elements of the Property subject to abatement and representations by the City that based on its inspection of the same, the undersigned determined that the Property was in substantial compliance with all administrative abatement orders matter is concluded.
The City is entitled to recover its administrative, investigative and enforcement costs retated to the abatement of the Property pursuant to BMC $ Section 8.36.020 of the BMC, which defines compensable "Code Enforcement Fees" aS resources expended in "identifying, inspecting, investigating, seeking or causing the abatement" of a violation. "Abatement costs" is further defined as "all costs, fees and expenses, incidental or otherwise, incurred by the City in abating a public nuisance." Recovery of abatement-related costs are recoverable by the City even where the owner eventually complies before the City engages in any direct abatement. BMC S 8.36.230 further provide a basis for recovery and states, in relevant part, as follows:
S 8.36.230. Gode Enforcement Fees
A. Pursuantto California Health and Safety Code Section 17951, responsible persons who cause, allow or maintain a violation in, or upon, residential properties, shall be charged code enforcement fees by the City to defray its costs of code enforcement actions. Such fees shall not exceed the amount reasonably required to achieve this objective and are chargeable whether the City's code enforcement actions occur in the _?-
absence of formal administrative or judicial proceedings, as well as priorto, during, or subsequent to, the initiation of such proceedings.
B. The fees imposed pursuant to this section shall be in addition to any other fees or charges that responsible persons may owe in accordance with any other provision of this Code, or which are imposed pursuant to county, State or Federal laws or regulations.
C. Code enforcement fees shall be recoverable in conjunction with any civil, administrative or criminal action to abate, cause the abatement or cessation of, or otherwise remove a violation or a public nutsance
Additionally, as advised in the Notice of Public Nuisance and Intention to Abate to the Property, the City is further entitled to recover its attorney fees associated with public nuisance abatement efforts pursuant to BMC S 8.36.240(C), which provides as follows:" S 8.36.240. Judicial Remedies - Recoverv of Attornevs' Fees C. The City is the prevailing party when an administrative or judicial determination is made or affirmed by which a person is found to be responsible for one or more conditions or activities that constitute a public nuisance. A person is the prevailing party only when a final administrative or judicial determination completely absolves that person of responsibility for all conditions or activities that were alleged in that action or proceeding to constitute a public nuisance. An administrative or judicial determination that results in findings of partial responsibility and partial non-responsibility on the part of a person for conditions or activities that were alleged in that action or proceeding to constitute a public nuisance nevertheless result in the City being the prevailing party.

Re: Addendum to Appeal of Abatement Costs; Request for Hearing 17440 and 17450 Bellflower Blvd., Bellflower, CA 90706
To the City Clerk:
This is an addendum to the appeal of the City’s “Abatement Cost Demand Letter” (“Demand”), dated August 19, 2026, for the real property located at 17440 and 17450 Bellflower Blvd., Bellflower, CA 90706 (APN 7161-008-011) (the “Property”), consisting of two vacant commercial buildings. The City issued a Notice of Public Nuisance and Intention to Abate with City Personnel on March 10, 2023. The City listed a variety of purported nuisances, and the property owner timely appealed the notice. The first appeal hearing was heard on May 23, 2023. The final hearing officer order was dated April 15, 2026 and mailed to the Appellant on April 22, 2026.
The addendum to the appeal is made by the Property’s owner, 17450 Bellflower Blvd., LLC (“Appellant”). Upon further detailed review of the City’s supporting documents and invoices, it appears the City has overcharged Appellant for $13,800 worth of administrative hearing officer costs by double-charging, including duplicate time and line entries, and including invoices for hearings not associated with the Property:
Duplicate Invoices and Entries
Hearing Officer Invoice dated November 9, 2023 appears twice. (6.2 hours, $1,550) Hearing Officer Invoice dated September 11, 2023 appears twice. (2.9 hours, $725) Line items on both invoices are duplicate entries (see highlight on invoice dated November 9, 2023 for hearing, draft third report and order, and revise report) (1.8, .8, and .3 hours) and compare to September 11, 2023 invoice entries for same hearing, report, and order) (1.8, .9, and .2 hours).
Total overcharge: $3,000
Unrelated Invoices/Hearings
Hearing Officer Invoice dated February 14, 2024 for Nuisance Abatement at 9103-9121 Artesia Blvd (7.4 hours, $1,850)
Addendum to Appeal of Abatement Cost Demand Letter
Re: 17440 and 17450 Bellflower Blvd.
Hearing Officer Invoice dated November 15, 2023 for Nuisance Abatement at One Stop Paint Shop, Inc. (17.9 hours, $4,475)
Duplicate Hearing Officer Invoice dated November 15, 2023 for Nuisance Abatement at One Stop Paint Shop, Inc. (17.9 hours, $4,475)
Total overcharge: $10,800
Thus, the City’s true administrative costs total $6,950 ($20,750 - $13,800).
Based on the City’s failure to provide a timely and accurate accounting, Appellant adds the foregoing as an independent basis to appeal the City’s Demand.
Sincerely,
17450 Bellflower Blvd., LLC

Hearing held on 6/5/24 @ 10am. Those present were hearing officer Ricard Terzian, Building Official Bill Hayes, City Attorney Tim Campen, Code Enforcement Supervisor David Fawcett, property owner Attorney Livia Borak Baudin, on the phone propject manager Mark Norton, and CE Inspector Esmeralda Erdelyan. Per Livia, demo completed and requesting inspection for next week. Roof inspection will also be conducted. Electrical plans are still with Southern Califomia Edison. Per Mark, Alliance had to do additional assessment during demo which caused a 2 week delay due to air test and material. Demo has been completed. Second roof quote received.
Tentative timeline for roof: If slurry a few weeks. If reroof, months. Plans needed and have not been drafted. Edison, corrections were issued and pending feedback about 2 weeks. Per Mark, Requesting Inspection for Wednesday, June 12th, 2024. No time has been given at this time.
Security is still in place and will provide log. Universal Site Services provides the board up service after security calls it in. Per Livia, ownership is looking for potential tenants. Ownerships plan is to accommodate building for new tenant.
Inspected by E. Erdelyan and D. Fawcett 5/6/24, demo has commenced a the site. No inspections have been conducted by building at this time. Permit is active for 17440-50 Bellflower Blvd for the following: INTERIOR DEMOLITION, REMOVE NON-BEARING WALLS, RAISED
FLOOR, FINISHES, SUSPENDED CEILING, HARD LID, SOFFITS, MEPS Brian and I cleaned up the trash that was dumped in the trash enclosure.
Received the following email from Michael McNeff 4/17124 responding to the Building Official:
Thanks for your time today Bill. Sorry I called the city mainline instead of your cell —just now realized that. Anyway, I just spoke with my client and they will reach out to you to re -inspect the roof structure(s) after all of their demo work is complete. In the meantime, attached are 3 pics I took during my December visit, that show portions of the smaller building roof framing that were visible (north and east sides of the space). In one of the pictures, you can see the kraft paper that was previously obscuring some of the roof joists. As I understand it, this old "ceiling finish" has since been removed, sometime after my visit. Michael A McNeff, S.E. President McNeff Engineering & Consulting Corp. P.O. Box 230091 Encinitas CA 92023 (760) 889-0936 www.mcneffengineering.com
Received email from the Building Official 4/17/24: "I just spoke with the engineer, Michael McNeff.
He went through the history of his involvement, which started late last year. He told me that he never has done an official "structural report". He inspected the building in December '23 and wrote an "advisory letter" that justified that the roof can be recoated per the building code. I explained to him that Jamie's and Walter's inspection took place after his inspection and after the bad rains we had this winter. He understood that the rains could've had an effect on the roof. We agreed that once the ceiling is removed, I would go inspect the roof for myself. Michael also volunteered to inspect it once it is opened up. Also, the demo plans and permit were approved today. The contractor said they should be starting within a week. " Per Planning Department, plans have been submitted for Interior demo (non-bearing walls, raised floor, finishes, suspended & hard lid ceilings, soffits, plumbing, electrical, & mechanical).
Mold reports received 2/27/24. Inspection for 2/28/24 has been rescheduled for Monday 3/4/24.
Building is getting re -keyed by lock smith.
Inspection of 17450 Bellflower conducted by Building and Code Enforcement. Met with Alonzo from Alliance Environmental Group. All mold has been removed from the building and the building has been tested. Attempted to inspect 17440 Bellflower Blvd, however, contractor was not able to gain entry due to key not working. New inspection date is 2/28/24 @ 9am. https://clients.comcate.com/xer/multifieldreport.php

City of Bellflower - CE Field Report
Erdelyan, Esmeralda Order received from Terzian and invoice.
Erdelyan, Esmeralda Inspected by E. Erdelyan and R. Rodriguez 2/6/24, upon arrival we observed a work crew inside the building and a generator. While attempting to make contact with a worker, I could see what leaking into the building as well as several puddles. It has rained for two days. I spoke with James Shelton, Superintendent from Reeve -Knight Construction Inc. #659107. Per James, they were removing some drywall and tomorrow, the scaffolding will be installed for the removal of the mold.
James did advised that both buildings were flooded and actively leaking. James is also making sure the property is staying secure while he is working on prepping the site.
Erdelyan, Esmeralda Hearing held 2/1/24, per Terzian 5th judgement will be completed. Additional hearing is scheduled for 5/31/24 @ 10am. During hearing, PO indicated that the conveyor belt was removed and placed a scaffolding to remove the remaining mold. Estimated completion on date is for week of 2/5/24 - 2/9/24. Area will be tested by Rescom 2/9/24. Roof permit Is expected to be obtained in the next couple weeks. PO plans to recoat the roof with report from engineer. Also intends to demo in a few weeks. No description of demo needed or if its the remediation.
Electrical will have to be underground and will need its owns scope of work. PO is working with Edison to have this completed. Lastly, PO is still on track to complete the work at the end of September. ********
Erdelyan, Esmeralda Hearing was moved up to 2/1/24 @ 11am. Demo permit has not been finalized.
Erdelyan, Esmeralda Inspected by E. Erdelyan 1/9/23, location is secure. No construction observed at this time.
Erdelyan, Esmeralda Inspection scheduled for 12/13/23 @ 2pm with Alliance. Remediation is complete.
Erdelyan, Esmeralda Inspected by E. Erdelyan and D. Fawcett 11/27/23, per Alliance worker, still working on the hardtimes building, lower level. During my visit, the area was getting dosed off.
Erdelyan, Esmeralda Inspected by E. Erdelyan 11/13/23, storage containers were getting removed. Observed some trash and was advised that a separate company will be removing the items. Scheduled to return the following day. Returned 11/14/23, all the containers were removed and the remaining trash was getting removed. During my inspection, I could hear work being done at 17450 Bellflower Blvd. Alliance was on site.
Erdelyan, Esmeralda Hearing held 11/7/23 at 11:OOam. New hearing date scheduled for 2/8/23 @ 11am. Standing by for order from Terzian.
Erdelyan, Esmeralda Inspected by E. Erdelyan and J. Charon, observed Alliance still working on the property. Storage containers were still on site.
Erdelyan, Esmeralda Per Frank P, called advising that Alonzo from Alliance called regarding the shipping containers. I advised him to have them contact me with any questions. City attorney is in contact with PO's attorney regarding the containers.
Erdelyan, Esmeralda Inspected by E. Erdelyan and D. Fawcett 10/31/23, spoke with project manager for Alliance. Per Juan, work began yesterday 10/30/23 for 17450 Bellflower Blvd. He again confirmed that the containers are not being used by their company. He stated that the "movers" are using them to store the pool tables that have been taken out of 17450 Bellflower Blvd. He stated that work should be completed in 2 weeks. 17440 Bellflower Blvd is pending asbestos report that should be received today or tomorrow. He stated that once that is received, he will call for an inspection with the city. Updated city attomey and building official of new time frame.
Erdelyan, Esmeralda Received call from Drew Miles Brown who left me a voicemail regarding the demo permit requirement. I called him back around 3:30pm and explained that a permit was required for the remediation. Drew explained that he was advised that a demo permit was not required by city staff and that he was confused as to why we are stopping work. I explained that we did advised his attomey in the Sept. 11th hearing that a remediation permit was going to be needed. He explained that Alliance is only removing portions of the drywall and treating where needed. I then advised him that per Alliance today, they intended on removing 5,000sq ft of drywall and later removing the asbestos. I explained that a demo permit is pretty standard and AQMD info is needed since we do not have access to their database. Drew stated that he feels that the city is making it difficult to comply and that our attorney advised his attorney that there is no code requirement for demo. I explained again that a demo permit is pretty standard and that the building official needs to verify where all the contaminated material and debris is being transferred and disposed. I explained the importance of communication since we were not notified that work was going to commence. I encourage him to share my information to their vendor so I can direct them to the proper person. I advised Drew that our attorney emailed his attomey regarding the demo. Drew received the email during our conversation and began reading some of the language and stated that they are not removing plumbing, mechanical, electrical therefore the permit is not needed. I advised him that I couldn't contribute more to the conversation and recommended he talk to his attomey. He did advise me that he went to law school. He was not upset with me, however, he is upset with the city and the special requirements that he feels is being requested. I reiterate that I can help coordinate with the vendor and our building department so there is no further confusion.
Erdelyan, Esmeralda Inspected by E. Erdelyan 10/11/23, observed 4 storage containers in the parking lot. Also observed two work vehicles for a company called Alliance Environmental Remediation https://www.alliance-enviro.com/ who started preparing for remediation. Upon arrival, I spoke with a worker who stated that the plan for the day is to remove 5,000 sq ft of drywall. Per Alliance, dumpster would be getting dropped off on 10/11/23. Asbestos is schedule to be removed this week. I explained that a demo permit is needed. Updated city attomey Erdelyan, Esmeralda Received the following update from PO's attorney 7/14/23, Hello Tim, Jamie, Esmeralda, and David, Per our discussion at the hearing last week, I'm emailing to provide an update on my client's efforts. RestCon completed the asbestos inspection yesterday and they expect to have the asbestos report by the end of next week. The owner is also coordinating with RestCon and two remediation vendors for a walk-through with Andrew (Drew) Brown the first week of August.
I'II forward any documents/reports once we receive them and keep you apprised of any changes.
Please let me know if you have any questions or concerns. Thank you and have a nice weekend, —Livia
Erdelyan, Esmeralda Received complaint for broken glass at front of the property. Contacted property management and advised of issue. Per management, they had a vendor out yesterday to replace the glass. https://clients.comcate.com/xer/multifieldreport.php 2/7
