Agenda Title: Commercial Cannabis Study Session
Agenda Action: Discussion & Direction
Recommendation
It is recommended that the City Council consider the information presented in this report and provide direction to staff.

Strategic Focus Area
Economic Development and Housing
Background
At its November 3, 2021, Study Session, the City Council provided feedback to staff regarding the possibility of allowing the establishment of cannabis businesses within the City of Belmont and also provided general comments about potential setbacks from sensitive uses. Based on that feedback, staff presents for the Council’s consideration the below suggested map of potentially allowable locations for cannabis businesses.

Analysis
Although the map provided in the attachment details potentially allowable locations, staff recommends incorporating a process that requires the adoption of supplemental findings in order to ensure that any proposed cannabis business would be appropriately situated. An overview of those draft findings is provided below.

Sample Draft Supplemental Findings

1. The Cannabis facility is situated in an appropriate location that meets all of the following standards:
• At least 600 feet in radial distance or 600 feet as measured by a right-of-through-travel from schools; and
• At least 100 feet from operational childcare centers, parks, and other retail dispensaries • Public entrance shall not be located on a frontage immediately adjacent to other youth-oriented uses
• Appropriate measures have been taken to address nuisances related to odor, noise, exhaust, and waste.

2. The cannabis facility is suitably designed to be secure and aesthetically compatible with the surrounding area.

3. The cannabis facility will not place a burden on the provision of public services disproportionate to other retail uses.

Request for Policy Direction:

City staff requests direction from the City Council on the following questions and recommendations:
o Does the City Council desire to see the same map of allowed locations apply to both retail dispensaries as well as distribution facilities?
o Does Council desire to see any changes to the draft zoning map? o Does Council desire to have input into the selection process or shall staff take the lead role? o Recommendation: Administrative Use Permit (issued by staff) to be the preferred land use entitlement
o Recommendation: Incorporate all draft use permit findings referenced above into process o Recommendation: a maximum of two or three retail dispensaries and up to 4 distribution facilities
Next Steps:

1. Planning Commission and City Council Consideration of a Zoning Ordinance Amendment to Create a Commercial Cannabis Combining District (Zoning Overlay)

2. Council consideration of Commercial Cannabis Regulatory Ordinance:
a. General Administration
b. Legal Authority
c. Operating Requirements and,
d. Enforcement

3. Public Hearing to Adopt Fee Schedule

4. Staff develops all applications materials & website etc.
