Subject: Longfellow Drive Permanent Encroachment Agreement Hello Ms Patel.

My husband and I received a letter regarding the request to approve a retaining wall encroachment within the pubic right-of-way on Longfellow Drive (APN 043 222 350) We live on Longfellow Drive.

Here are a few main issues:
1) Driving up Bay Court to make a left-hand turn on Longfellow Drive, it is actually taking one's life in one's hands. The street is narrow, with a steep slope and often you will find vehicles parked all along the incline on Longfellow Dr near Bay Court.

If the applicant is asking for encroachment to the right-of-way, right near the junction of Longfellow and Bay Court, this will add even more danger to the traffic coming to and fro near that intersection and will be a very high risk with accidents waiting to happen. Please have someone from your staff check this out before approving the encroachment. 2) Any construction on this street in the area highlighted in the plan exposes the existing residents to a high risk of navigating in this already tight through street. 3) The hill where the approval has been given to construct the house is very dangerous and prone to mudslide and poses a risk to existing houses. Please look into this.

Thank you,
Vivek Mungali

Hi,
Why is this public hearing on the most important night of Presidential debate 2024? If they went and did an elaborate plan, why not give more to the road on an already narrow, winding LongFellow-Bay Ct with insane angles and already troubled by construction and no parking with 0 planning from the city around all adjacent streets? Have you seen what we had to undergo in the fire-rain seasons because of the angles? How can a responsible planning commission even accept this? Respect the fauna, flora, people. If a firetruck can't get through now, do not make it narrower. Preempt and get them to submit a proper plan. Why do you even suggest anything "permanent encroachment" ? Use the land they have bought to achieve what they want with minimal impact to flora, fauna, neighborhood.

Thanks.

Subject: Public Comments for Belmont CC Meeting on 9.10.2024 Agenda Item 10-C (relating to APN 043-222-350; 0- Longfellow Drive Application for Approval of Permanent Encroachment Agreement) My husband and I received a letter from the Department of Public Works dated August 30, 2024 regarding a request to approve a retaining wall encroachment on 0-Longfellow Drive (APN 043-222- 350), referred to below as "The Application".

We are the property owners at 3203 Longfellow Drive, CA 94002, which is located directly opposite the vacant lot at 0-Longfellow Drive. We would like to request that the Belmont City Council not to approve The Application. Our comments are as follow:
.

We have lived at 3203 Longfellow Drive for over 25 years. We have recently witnessed a substantial increase in construction and development of vacant land lots in our neighborhood, creating impediment, nuisance and possible endangerment to the residents. In particular, the development of lots and the construction and remodeling of properties on Longfellow Drive (which are on steep slopes) have caused a very significant increase in traffic, noise, dust, and on-road parking, often blocking or closing roads around us.

The lot at 0- Longfellow Drive (APN 043-222-350) is situated at the corner of Longfellow Drive and Bay Court. As there is no sidewalk on either side of Bay Court and Longfellow Drive, we are obliged to rely on public venues and the Public Right-of-Way to provide us with safe space for our passage and activities. Longfellow Drive and Bay Court are already very busy and, at times, hazardous, as traffic must attempt to navigate around cars and construction equipment parked in the area. For your reference, I attach two photos in support of the road conditions mentioned above.

The Public Right-of-Way in Belmont is for public use, and as such, should be available for legal public use without any encumbrances or encroachment. Users of the Public Right-of-Way should not be required to risk injury or to circumnavigate obstacles when using a public Right-of-Way. Belmont City owns the Public Right-of-Way and has always maintained its public space (including Public Rights-of-Way) in so as to prioritize the protection of the welfare, safety, health and the enjoyment of their residents and pedestrians. We believe that the owner should be able to make adjustments and revision to the design of the garage to avoid any permanent encroachment on public land such as is currently requested in The Application. We do not perceive appreciable public benefit in The Application, but even allowing for such a possibility, the danger, risks and permanent detriment caused by the proposed encroachment on the Public Right-of-Way clearly outweighs any foreseeable benefit.

We respectfully ask that the Belmont City Council deny The Application, and decline the adoption of the required Resolution (per the Attachment B of the Agenda Item 10-C for the Belmont City Council's Meeting on Sept 10, 2024).

Sincerely,
Anita Yelland and Phillip Yelland
