RECOMMENDATION
It is recommended that the City Council take the actions necessary to call and give notice of the City of Beverly Hills’ Regular Municipal Election on Tuesday, June 7, 2022 and request consolidation with the statewide direct primary election to be conducted on the same date by the County of Los Angeles, by adopting the above-referenced three resolutions. Those resolutions take the following actions:
(a) calling and giving notice of the City of Beverly Hills’ Regular Municipal Election to be held on Tuesday, June 7, 2022;
F-2
Meeting Date: February 8, 2022

Page 2 of 3 ends

(b) requesting that the Board of Supervisors of the County of Los Angeles consent to the consolidation of the election with the statewide direct primary election on the same date and direct the Los Angeles County Registrar-Recorder/County Clerk to administer, manage, oversee, and canvass the results of the election; (c) adopting regulations for candidate statements, approve a candidate statement wordcount and also waive translation and printing costs IF the candidate agrees to the City’s Contribution Limits and Volunteer Expenditure Ceiling.

INTRODUCTION
The City of Beverly Hills will be holding a Regular Municipal Election on Tuesday, June 7, 2022 to elect three (3) Members of the City Council, one (1) City Treasurer and a ballot measure regarding Term Limits on City Elected Official Service.

The City will again be requesting that its election be consolidated with the primary election being conducted by the County of Los Angeles. Under the consolidation request resolution, the County would conduct the election and canvass the results, with the City of Beverly Hills covering costs associated with said election logistics by the County of Los Angeles.

The election filing period for nomination papers and candidates’ statements is Monday, February 14 to Friday, March 11, 2022 at 5PM.

If an incumbent does not file, then the extended filing deadline for non-incumbents is Wednesday, March 16, 2022. The write-in candidate period is from Monday, April 11 to Tuesday, May 24, 2022 at 5PM.

Per the Los Angeles County Registrar-Recorder/County Clerk’s guidelines, candidate statements can be either 200 or 400 words. The City of Beverly Hills has historically approved a 200-word maximum for election-related candidate statements. Staff will continue with this recommendation, unless the City Council would like to direct otherwise.

DISCUSSION
The June 7, 2022 Regular Municipal Election will be held to fill three (3) seats for the Beverly Hills City Council presently held by Mayor/Councilmember Robert Wunderlich, Councilmember John A. Mirisch and Councilmember Lester J. Friedman. There will also be an election for City Treasurer for the seat that is presently held by Treasurer Howard S. Fisher. The Term Limit ballot measure was previously authorized by the City Council at the Formal Meeting on Tuesday, February 16, 2021. The following resolutions request City Council direction and approval:

Resolution A
The Election Code requires the City Council take formal action to call and give notice to hold an election.

Resolution B
This is a request to consolidate with the County’s election and request the services of the County of Los Angeles for the administration of the election, data processing, street index/roster preparation, precinct consolidation verification, signature verification and canvass of the results. The City will cover costs associated with the consolidation of the election.

Meeting Date: February 8, 2022

Page 3 of 3 ends

Resolution C
This resolution sets forth the rules for candidate statements, the candidate statement word-count and requires the candidates to pay the costs of printing and translating statements if they do not accept the City’s Contribution Limits and Volunteer Expenditure Ceiling.

Candidates are permitted to submit brief statements of their background and qualifications for inclusion in the sample ballot package. It is optional, and not required.

State and federal law require the translation of election materials into Spanish. The City has directed election materials be provided in Farsi upon request, if available with the Secretary of State and Los Angeles County Registrar-Recorder/County Clerk’s office.

Should the candidate accept the City’s Contribution Limits and Volunteer Expenditure Ceiling, then the cost to file Candidate Statements with the Los Angeles County Registrar’s office are waived; the City will absorb the costs.

FISCAL IMPACT
Costs for the election have been budgeted in the City Clerk's Office operating budget and are estimated to be $129,156 for a consolidated election administered by the County of Los Angeles.

ADOPTING REGULATIONS PERTAINING
TO CANDIDATES’ STATEMENTS
B0785-0001\2618035v1.doc
RESOLUTION NO. 22-R-_____

RESOLUTION OF THE COUNCIL OF THE CITY OF

BEVERLY HILLS, CALIFORNIA, ADOPTING REGULATIONS
PERTAINING TO CANDIDATES’ STATEMENTS

SUBMITTED TO THE VOTERS AT THE REGULAR

MUNICIPAL ELECTION TO BE HELD ON TUESDAY, JUNE
7, 2022.

WHEREAS, §13307 of the Elections Code of the State of California provides that the governing body of any local agency adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs of the candidates statement;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BEVERLY

HILLS, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:

Section 1. GENERAL PROVISIONS. Pursuant to §13307 of the Elections Code of the State of California, each candidate for elective office to be voted for at an Election to be held in the City of Beverly Hills on June 7, 2022 may prepare a candidate’s statement on an appropriate form provided by the City Clerk. The statement may include the name, age and occupation of the candidate and a brief description of no more than 200 words of the candidate’s education and qualifications expressed by the candidate himself or herself. In addition, a candidate’s photograph may be included in the statement. The photograph must be recent (taken within six months of the candidate filing) and be of the head and shoulders only, submitted in digital format. The statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. Pursuant to §13308 of the Elections Code, the statement also shall not in any way make reference to other candidates for that office or to another candidate’s qualifications, character or activities. The statement shall be filed in typewritten form in the office of the City Clerk at the time the candidate’s nomination papers are filed. The statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next working day after the close of the nomination period.

Section 2. FOREIGN LANGUAGE POLICY. Pursuant to the Federal Voting Rights Act and state law, the City may be required to translate a candidate’s statements into any language at the candidate’s request and at the candidate’s expense. In addition, the City Clerk is directed to make Spanish and Farsi translations of candidates’ statements available on a “by request” basis. Unless requested by a candidate, that candidate’s statement shall be printed in the main voter pamphlet in English only.

B0785-0001\2618035v1.doc
Section 3. PAYMENT.
(a) Translations and Printing:
1) The candidate shall not be required to pay for the cost of translating the candidates’ statement into Spanish or Farsi for the “by request” translation established above.
2) Except as provided in Beverly Hills Municipal Code Section 1-8- 4E, the candidate shall be required to pay for the cost of printing the candidate’s statement in English in the main voter pamphlet.
3) Except as provided in Beverly Hills Municipal Code Section 1-8- 4E, the candidate shall be required to pay for the cost of printing the candidate’s statement in a foreign language requested by the candidate per Section 2 above, in the main voter pamphlet mailed to all voters.
(b) Estimated Costs. The City Clerk shall estimate the total cost of printing, handling, translating, and mailing the candidates’ statements filed pursuant to this section, including costs incurred, if any, as a result of complying with the Voting Rights Act of 1965 (as amended). If a candidate does not elect to file a statement of acceptance pursuant to Beverly Hills Municipal Code Section 1-8-4B the City Clerk shall require that candidate filing a statement to pay to the City at the time of filing his or her estimated pro rata share of having his or her statement included in the voter’s pamphlet. In the event the estimated payment is required, the estimate is just an approximation of the actual cost that varies from one election to another election and may be significantly more or less than the estimate, depending on the actual number of candidates filing statements. Accordingly, the City Clerk is not bound by the estimate and may, on a pro rata basis, bill the candidate for additional actual expense or refund any excess paid depending on the final actual cost. In the event of underpayment, the City Clerk may require the candidate to pay the balance of the cost incurred. In the event of overpayment, the City Clerk shall prorate the excess amount among the candidates and refund the excess amount paid within 30 days of the election. If the candidate alleges that he or she is indigent and unable to pay the costs, the provisions of Elections Code Section 13309 shall apply.

Section 4. No candidate will be permitted to include additional materials in the sample ballot package.

Section 5. The City Clerk shall provide each candidate or the candidate’s representative a copy of this Resolution at the time nominating petitions are issued.

Section 6. All previous resolutions establishing City Council policy on payment for candidates’ statements are repealed.

Section 7. This resolution shall apply at the next ensuing municipal election and at each municipal election after that time.
