2. Resolution

INTRODUCTION
Senate Bill (SB) 1383 (Short-lived Climate Pollutants) establishes methane emissions reduction targets Statewide to reduce emissions of short-lived climate pollutants in various sectors of California’s economy. This legislation establishes targets to achieve a 50% reduction in the statewide disposal of organic waste, based on 2014 levels, by the year 2020 and a 75% reduction by 2025. SB 1383 also establishes an additional target that not less than 20% of edible food that is currently disposed of be recovered for human consumption by the year 2025. SB 1383 required CalRecycle to adopt regulations for local governments to achieve those targets and required the regulations to take effect on January 1, 2022. The SB 1383 regulations require the City (and other jurisdictions in the State, including Counties) to impose specific requirements on generators, haulers and commercial edible food generators within the jurisdiction by January 1, 2022.

On October 5, 2021, Governor Newsom signed Senate Bill (SB) 619 to provide local jurisdictions relief from SB 1383 non-compliance penalties for violations that commence during the 2022 calendar year. To receive relief, local jurisdictions must submit a Notification of Intent to Comply (NOIC) with SB 1383 regulations to CalRecycle no later than March 1, 2022.

At the December 7, 2021, City Council Study Session, staff informed City Council of the SB 619 NOIC and the City’s intention to file. If approved and implemented, the NOIC provides administrative penalty relief for the City for the violations disclosed in the NOIC. CalRecycle will not approve a NOIC unless it is submitted with a Resolution that the NOIC has been duly adopted by the local governing body.

Meeting Date: February 15, 2022

DISCUSSION
Senate Bill 1383 authorized CalRecycle to impose penalties on local governments that are found to be non-compliant with the regulations, beginning on January 1, 2022.

CalRecycle adopted final regulations in November 2020, which include the following requirements for local governments:  Provide organic waste collection to all residents and businesses;  Establish and edible food recovery program that recovers edible food from waste stream;  Conduct outreach and education to all affected parties, including generators;  Procure recycled organic waste products like compost, mulch and renewable natural gas; and
 Inspect and enforce compliance with SB 1383. Under SB 619, a local jurisdiction facing continuing violations commencing during the 2022 calendar may submit an NOIC. The NOIC must be formally adopted by resolution of the City Council and submitted to CalRecycyle no later than March 1, 2022. The NOIC must describe the City’s continuing violations of the SB 1383 regulations, the actions the City plans to take to come into compliance and a timeline for completing those actions.

The City is also required to describe how the COVID-19 pandemic has impacted the City’s efforts to come into compliance. Upon approval of the NOIC by CalRecycle and the City’s implementation of the NOIC, SB 619 provides the City may be eligible for (1) administrative penalty relief for the 2022 calendar year and (2) a corrective action plan pursuant to 14 CCR Section 18996.2. Participation in the NOIC process authorized by SB 619 may provide the City additional time to implement the requirements established by SB 1383 without incurring administrative penalties for continuing violations. This includes additional time to fully roll out the commercial and multi-family organics collection containers distribution and services and meet the City’s mulch and compost procurement target. SB 1383 Regulations Due to the complexity of the regulations, the rulemaking process for SB 1383 was slightly delayed from the original timeline to adopt the regulations in late 2019. Further delays due to the State and local pandemic response shifted the final adoption of the regulations to November 3, 2020, leaving only thirteen months for jurisdictions to prepare before the regulations went into effect on January 1, 2022. The additional time potentially provided by SB 619 will help the City fully implement the standards prescribed by SB 1383.

Community Outreach
Prior to the pandemic, staff began planning for SB 1383 by coordinating with the City’s franchise hauler (Athens Services) with in-person site visits to assess the commercial generator’s waste material and provide educational outreach to businesses regarding existing and upcoming regulations. SB 1383 was still in the rule-making process. When the pandemic hit, the in-person outreach project was placed on hold. The project has since restarted in March 2021, and was completed in November 2021. However, due to the pandemic, normal waste generation pre-pandemic was not realized due to many businesses’ employees working remotely and businesses’ service limitations and reduced capacity.

In addition, newsletters have gone out to our residents and businesses and the SB 1383 requirements and Mandatory Organic Waste Reduction Ordinance was presented to the Public Works Commission and adopted by City Council on December 21, 2021.

Staff understands that community engagement plays a major role in the success of the organics recycling program. Staff has developed a community outreach plan that consists of various methods of communication including the following: website page, direct mailer, social media posts, virtual community meeting and community group presentations. Next Steps This item is included in the City Council formal meeting agenda on February 15, 2022. Staff is recommending City Council move to adopt a resolution formally adopting a NOIC and directing staff to submit an SB 619 compliant NOIC to CalRecycle. FISCAL IMPACT Late last year, during the solid waste enterprise rate study, staff anticipated the need for a regular commercial organic cart rate in anticipation of the regulations becoming finalized.

Staff addressed some of the elements of AB 1826 (Mandatory Commercial Organics Recycling) and SB 1383 in the new solid waste franchise agreement. However, due to the extensive requirements of SB 1383 and impacts across departments and direct service providers, staff will need to evaluate the implementation of this new program with existing resources and how the routing may adjust through the onboarding of the new organics program. Staff will follow up with updates if costs are affected.

RECOMMENDATION
This item is for informational purposes only and is included on the City Council Formal Meeting agenda on February 15, 2022, for City Council consent action.

(b) A detailed explanation of the reasons for noncompliance, supported by documentary evidence, if applicable.(See attachment) Regulation Section Regulation Violations Explained
1 14 CCR Section 18984.2 1. Organic waste collection service for required commercial businesses not fully rolled out to all customers because the City was not able to begin charging for organic waste services until January 1, 2022. On January 12, 2021, the City Council approved an increase in solid waste rates beginning on January 1, 2022 and each July 1 thereafter until July 1, 2025. See Attachment A. The effective date of this rate increase was delayed to January 1, 2022 due to concerns for increasing the rate during the COVID-19 pandemic. See Attachment B.

Rollout of collection services is also delayed because commercial businesses will need in person technical services, which have been impacted by the COVID-19 pandemic.

2. Organic waste collection service for required multi-family properties not fully rolled out to all customers.

The multifamily properties will be rolled out after the commercial businesses. 2 14 CCR Section 18984.5 Container monitoring has not been implemented for residential and commercial customers due to the incomplete roll out of organic waste collection services to all required commercial businesses and multi-family properties.
3 14CCR Section 18984.6 Recordkeeping requirements for container contamination minimization required customers have not been implemented due to the incomplete roll out of organic waste collection services to all required commercial businesses and multi-family properties. 4 14 CCR Section 18984.8 Container labeling requirements is not completed due to the incomplete roll out of organic waste collection services to all required commercial businesses and multi-family properties. 5 14 CCR Section 18984.11 Determination of which generators are eligible for waivers is not completed due to the incomplete roll out of organic waste collection services to all required commercial businesses and multi-family properties. Initial waste assessment for all commercial accounts were completed in November 2021 by the City’s waste hauler Athens Services, but during the pandemic commercial businesses’ waste volumes have not been normal due to the pandemic, presenting a challenge in accurately assessing waste volumes for SB 1383 waiver determination. 6 14 CCR Section 18993.1 Recovered organic waste product procurement target will not be reached in 2022 due to lack of availability of SB 1383 eligible recovered organic waste products, specifically SB 1383 eligible electricity from biomass conversion and renewable gas.
(c) A description, if any, of the impacts of the COVID-19 pandemic on compliance.

COVID-19 Pandemic
The COVID-19 pandemic continues to impact City’s staffing and resources. The most recent omicron surge has been impacting staffing levels on a day to day basis with normal collection operations. The pandemicoverall has delayed supply chain for deliveriessuch as container purchases.

For the commercial businesses the waste generation volumes have not been normal and presents a challenge in accurately assessing waste volumes for SB 1383 compliance. There have also been delays in response or contact with person(s) responsible for making decisions for the businessin service setup that has delayed implementation.

As described in Section (b) above, on January 12, 2021, the City Council approved an increase in solid waste rates beginning on January 1, 2022 and each July 1 thereafter until July 1, 2025. The effective date of this rate increase was delayed to January 1, 2022 due to concerns for increasing the rate during the COVID-19 pandemic. Thus the City was not able to charge for organic waste collection services before January 1, 2022, which delayed the implementation of the organic waste collections services. AGENDA REPORT
Meeting Date: January 12, 2021
Item No.:

To: Honorable Mayor and City Council
From: Laurence S. Wiener, City Attorney
Subject: AN ORDINANCE OF THE CITY OF BEVERLY HILLS TO INCREASE SOLID WASTE RATES BEGINNING JANUARY 1, 2022, AND EACH
JULY 1 THEREAFTER THROUGH JULY 1, 2025
Attachments: 1. Ordinance

RECOMMENDATION
It is recommended that the City Council move to waive the full reading and adopt the ordinance entitled: “AN ORDINANCE OF THE CITY OF BEVERLY HILLS TO INCREASE SOLID WASTE RATES BEGINNING JANUARY 1, 2022, AND EACH JULY 1 THEREAFTER THROUGH JULY 1, 2025”.

FISCAL IMPACT
At its meeting of December 8, 2020, the City Council considered various rate option scenarios for moving forward with the solid waste rates ordinance. City Council selected Option 4, which would delay the first rate implementation to January 1, 2022 and would implement an administrative rate change for multi-family cart customers. Subsequent rate adjustments would be implemented on July 1 of each year through July 1, 2025.

This option will draw down reserves below the 50% policy target to $11,119,000 by FY2024/25, which represents a reserve ratio of 47%. The reserve balance will recover to $13,366,000 by FY2025/26, which represents a reserve ratio of 54%.

INTRODUCTION
At its meeting of December 8, 2020, the City Council considered various rate option scenarios for moving forward with the solid waste rates ordinance. The Council chose option 4, changed the start date to January 1, 2022, and introduced the ordinance, as amended.

DocuSign Envelope ID: 69484A2C-8E67-4EE3-B47A-D5E5BE39A724

2. Organic waste collection service for required multi-family properties not fully rolled out to all customers.

DocuSign Envelope ID: 69484A2C-8E67-4EE3-B47A-D5E5BE39A724 COVID-19 Pandemic

Meeting Date: January 12, 2021
Item No.:

To: Honorable Mayor and City Council
