identified both interior and exterior character-defining features for the property to help guide ongoing planning efforts.

Whittier Public Library, Whittier CA. Senior Architectural Historian. Alison was the lead author of the Historic Resources Assessment which determined that the library is significant as an individual resource under National Register Criteria A and C. Constructed in 1958, the property is significant for its association with MidCentury Modernism, postwar period institutional properties, and architect William Henry Harrison. Alison assembled the construction history for the library and the Whittier Civic Center. She created a detailed character-defining features analysis identifying significant and contributing features at the property’s interior, exterior, and site. Alison coordinated with the project architect to ensure that the project met the Secretary of the Interior’s Standards (SOI) in order to meet community’s contemporary needs while respecting the building’s historic character. Alison authored and oversaw the production of a HABS report to document the library building prior to selective demolition and project construction.

Benjamin Franklin Elementary School Historic Resource Evaluation and Mitigated Negative Declaration, San Diego, CA. Senior Architectural Historian.

Alison conducted an HRA for the 1930s, 40s, and 50s-designed elementary school campus. The property was found to be a historic district eligible for its association with the post-war development of the Kensington neighborhood, and for its association with two master San Diego architects. The proposed project was reviewed for compliance with the Secretary of the Interior’s Standards, and a CEQA analysis was performed, resulting in the Mitigation Measures and design considerations for future construction within the district. Alison authored and oversaw the production of a HABS report to document the campus and its buildings prior to project construction.
1202 3rd Street Promenade Preservation Consulting, Santa Monica, CA. Senior Architectural Historian. Constructed in 1949 as a JC Penny department store, the commercial building was designed in the Late Moderne style. ESA previously worked to produce a Landmark Assessment Report, and today, the property is recognized as a City of Santa Monica Landmark. Alison conducted a SOI Standards conformance review of a proposed tenant improvement project for a Certificate of Appropriateness.
1221 Hermosa Avenue Preservation Consulting, Hermosa Beach, CA. Senior Architectural Historian. ESA serves as a historic preservation consultant to the City of Hermosa Beach, and has a longstanding relationship with the building at 1221 Hermosa Boulevard, known as the Bijou Building. The building is a former historic theatre and bank designed in the NeoClassical Revival style, constructed in 1923.

Alison evaluated proposed tenant improvement modifications including the removal of non-original features and the retention of original features related to original theatre and bank uses. Alison has conducted design reviews which included an understanding of all modifications to the space over time, characterdefining features analyses, and reviews of proposed plans against CEQA thresholds and the SOI Standards for compliance. Alison is currently participating with overseeing the construction monitoring efforts for the theatre space as part of this ongoing project.

Universal Hilton Historic Resources Technical Report and Environmental Impacts Report for 555 W Universal Terrace Parkway, Los Angeles, CA. Senior Architectural Historian. The Universal Hilton Hotel was designed by master architect, William L. Pereira in 1983 in the Postmodern style. As one of Pereira’s final commissions, the hotel building was originally part of a master plan and was designed to accommodate visitors to the expanding Universal Theme Parks.

Alison conducted in-depth architect and postmodern style research, and evaluated the property for historic significance as part of the Historic Resources Technical Report.

Los Cerritos Wetlands Restoration Plan Program, Cultural Resource Assessment, Seal Beach, CA. Senior Architectural Historian. The Los Cerritos Wetlands Restoration EIR project will reinstate historic wetlands to a previously developed oil rig/production site that has been in operation since the early 20th century. As part of the larger restoration plan program, ESA was hired to conduct a cultural resources study to observe, document, and prepare preliminary mitigation measures related to identified built environment resources. Alison collaborated with the archeology team during a field visit to identify potential sites for later investigative studies. She reviewed historic aerial photographs, and conducted research to determine the companies and general ages of oil-industry related infrastructure including oil rigs, operations sheds, and decommissioned tank farms. Mitigation recommendations presented for the structures included Historic Resource Assessment reports to be conducted in the future. 3325 Monterey Road CEQA Impacts Analysis and Design Review, San Marino, California. Senior Architectural Historian. A two-story Art Deco style single-family residence, constructed in 1927 in San Marino, California was determined to be a historic resource. Proposed modifications to the residence included a two-story rear addition and building rehabilitation. Alison assisted with preservation design consultation and conducted a plan review for conformance with the SOI Standards for the proposed project. She coordinated with the project architect to better convey preservation components of the proposed work into the drawing set for city review. The review required a character-defining features analysis to determine the level of significance of the remaining features.

Golden Gate Village Historic Resource Evaluation, Marin City, CA. Architectural Historian. The highly-intact Golden Gate Village low-income housing complex was constructed in 1958 to house many of the former Marinship workers and their families. Designed by prominent mid-century designers including Aaron G. Green, John Carl Warnecke, and Lawrence Halprin, the property serves as an example of a well-designed housing complex, significant as a product of post-war urban development and for its prominent mid-century designers. Alison performed the site visit and conducted research through local and private archival repositories, plan analysis, and interviews, to produce the report narrative and historic evaluation for the property. Today, the property is listed on the National Register of Historic Places.

McDonnell Hall/Our Lady of Guadalupe Chapel Historic Structure Report, San Jose, CA. Architectural Historian. Constructed as a parish church in 1914, the building moved to its current location in 1953. Here, the building served as a Alison Garcia Kellar, M.S.

newly formed Catholic Mission, the Center of Our Lady of Guadalupe. The property is associated with civil rights activist and labor rights leader Cesar Chavez, and the mid-20th century Mexican American civil rights movement. Alison assisted with the research, production, and design recommendations, including bringing the building back to its appearance during its period of significance, which required a meticulous analysis of the building’s historic integrity. The property today is listed as a National Historic Landmark.

Historic YMCA Hotel Preservation Consulting in the Embarcadero, San Francisco, CA. Senior Architectural Historian, Project Manager. Built in the early 20th century, the building was formerly a YMCA hotel used by young navy men and is currently a hotel along the waterfront with an adjacent YMCA recreational center. The hotel was proposing modifications which included rehabilitation work and reconfiguring the interior lobby space. Alison researched and documented the interior evolution by reviewing old plans, movies filmed on-location, post cards, and existing fabric. She established the building’s construction chronology with a focus on the building’s public spaces at the interior, overseeing the entire production of the report and created recommendations to update the client’s proposed plans which included acceptable sensitive modifications to historic features and recommendations for potential future demolition.

Palo Alto History Museum Historic Preservation Consulting, Palo Alto, CA.

Architectural Historian. The Spanish Revival style Roth Building was the original location of the Palo Alto Medical Foundation. The former medical building is undergoing a conversion into a local history museum with gallery space, interpretive areas, and archival and study rooms. Alison assisted with secondary research efforts of both the medical foundation and the building, upon modifications to the museum’s scope of work. She conducted a Part 2 Federal historic rehabilitation tax credit application review which included recommendation to best comply with the Secretary of the Interior’s Standards for Historic Preservation.

Half Moon Bay Barn and Jail Museum Historic Resource Evaluation and Preservation Consulting, Half Moon Bay, CA. Senior Architectural Historian. The City of Half Moon Bay was working with a local historical society to implement a history museum at the site of its early 20th century jail and adjacent barn. Alison conducted an in-depth historic resource assessment then reviewed proposed plans for buildings and site modifications to accommodate gallery space, offices, and archival storage. Coordinating with project architects, she assisted with the creation of recommendations for project compliance with the Secretary of the Interior’s Standards for Rehabilitation.

Toscano Hotel Preservation Consulting, Sonoma State Historic Park, Sonoma, CA. Senior Architectural Historian. The two-story wood framed Toscano Hotel was constructed in the 1850s and is a contributing resource to the Sonoma Plaza National Historic Landmark District and the Sonoma Plaza National Register Historic District. Alison conducted a Secretary of the Interior’s Standards reviews of proposed changes to the interior of the building. Proposed changes included the conversion of a portion of the building from a hotel saloon museum display area into a retail concession area for the California State Parks. Project recommendations included sensitive design solutions to maintain original features.

Re: PEER REVIEW ASSESSMENT: Historical Resources Assessment - 1001 North Roxbury Drive Overview
At the request of the City of Beverly Hills Community Development Department, Planning Division, Ostashay & Associates Consulting (OAC) conducted a peer review of a historic resources assessment report prepared for the property referenced above. The assessment report entitled “1001 North Roxbury Drive, Historical Resources Assessment” is dated October 2021 and was prepared as a draft document by Environmental Science Associates (ESA) of Los Angeles, California. The ESA report is intended to provide an historic assessment of the subject property to support a “Certificate of Ineligibility” application submitted by the applicant (property owner/owner representative).

This peer review performed by OAC is conducted on behalf of the City to help consider the processing of the “Certificate of Ineligibility” application for the subject property. It addresses the overall adequacy of the ESA assessment report; the development of appropriate historic contexts for the property; application and interpretation of local City of Beverly Hills Landmark Designation Criteria; and the evaluators’ findings and conclusions for local landmark eligibility. The consideration of a property’s eligibility for potential National Register of Historic Places (National Register) and California Register of Historic Resources (California Register) eligibility are irrelevant in the processing of a “Certificate of Ineligibility” application.

Our processin conducting the peer review included an examination of the ESA report and observation of the project site. We also performed additional archival research and reviewed building permits, Sanborn fire insurance maps, historic aerial photographs, prior survey assessments of the area (as applicable), and other primary and secondary sources were collected and reviewed relevant to the property and associated historic contexts and themes.

As stipulated in the City’s Municipal Code, Title 10, Chapter 3, Article 32, Historic Preservation (BHMC 10-3-3212, herein cited as Ordinance), the designation (significance) criteria for recognizing potential landmark eligibility consists of two parts, Part A and Part B, each with their own subset of significance criteria. A property must satisfy all four criteria requirements under Part A and must satisfy at least one of the six criteria under Part B. The ESA report concludes that the 1001 North Roxbury Drive property is ineligible for City of Beverly Hills Landmark designation due to the fact that it does not satisfy Landmark Designation Criteria A.2, A.3, A.4 and B.1, B.2, B.3. B.4, B.5, and B.6.

PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 2 Introduction
Generally, peer reviews of historic resources assessment reports are conducted to reassure lead agencies requesting the assessments that the identification and evaluation efforts performed are adequate, that the eligibility determinations made are logical and well supported, and that the document will, if necessary, facilitate regulatory compliance under the provisions of CEQA and the local municipal code. Review of historic resources documents for quality control is an essential part of the environmental review process.

As a primer, historic resources fall within the jurisdiction of several levels of government. Federal laws provide the framework for the identification, evaluation, designation, and in certain instances, protection of historic resources. States and local jurisdictions play active roles in the identification, recordation, landmarking, and protection of such resources within their communities primarily through their regulatory codes and policies.

The National Historic Preservation Act of 1966, as amended, promulgated standardized practices and guidelines for identifying, evaluating, and documenting historic properties (Secretary of the Interior’s Standards and Guidelines [Preservation Planning, Identification, and Evaluation]). The State Office of Historic Preservation (OHP) and most local governments in California recognize these practices and guidelines and recommend their use in order to maintain objectivity and consistency in the preparation of historic preservation documents and survey assessments.

Methodology
To complete this peer review memo, Ms. Ostashay completed the following tasks:
• Reviewed the “Certificate of Ineligibility” application (November 18, 2021) and also reviewed the “draft” historic resources assessment report prepared for the subject property by ESA dated October 2021.
• Reviewed the City’s Historic Preservation Ordinance (BHMC 10-03-32) and prior citysponsored historic resources surveys, survey updates, and historic context statements. As applicable, OAC also reviewed other related survey material prepared in association with SurveyLA, which was a City of Los Angeles sponsored project. • Conducted additional archival research on the history of the subject property; its original owner and builder; physical alterations; past owners and occupants, and immediate the neighborhood. The extent of the research conducted by OAC was limited to what was necessary to assess the validity of the historic context developed and evaluation findings presented in the ESA assessment report. Background research performed included a review of many on-line resources locally and globally from a multitude of diverse research, archival, library, museum, and academic repositories and collections, including the Avery Index to Architectural Periodicals.
• Reviewed relevant National Park Service (NPS) guidance documents on evaluating the significance of potential historic properties. Also searched the National Register online database, the City’s online sources, and OAC’s in-house library for any properties with similar contexts or evaluated under similar criteria as those discussed in the ESA assessment report PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 3 (i.e. association with single-family residential development patterns, architecture and aesthetics, listing in the City’s List of Local Master Architects, etc.). • Considered and analyzed the assessment findings and research presented in the submitted assessment report for validity, clarity, and conformance with the basic professional principles and best practices for identifying and evaluating the significance of potential historic properties.
• Summarized the results of all of the tasks listed above within this memo.

Peer Review Assessment
This peer review performed by OAC was conducted to ensure that the current identification and evaluation efforts of the subject property for potential local landmark eligibility are adequate and that the findings are sound and well justified. The recommended approaches to the identification and evaluation of historic resources as discussed above have also been considered and utilized in conducting this peer review.

General Content and Format
In addition to reviewing and assessing evaluation findings, an important element of peer reviews is the assessment of the clarity of presentation, the adequacy of the research and context development, the understanding and application of significance criteria, and the consideration of historical integrity for which the report findings are based.

OAC found the report to be rather clear and logically organized despite some narrative inadequacies and contextual misinterpretation of research data, discrepancies with the site-specific assessment of historical integrity, and the non-relevant application of National Register and California Register criteria and consideration of the property as a historical resource under the California Environmental Quality Act (not applicable for consideration of an Ineligibility Certificate Application). Nonetheless, much of the overall format and presentation of the material in the report are professionally sound, technically correct, and well organized.

Analysis of Integrity Findings
It is standard practice to assess a property’s integrity as part of a historic evaluation. Integrity is a property’s ability to convey its historic significance through its physical features. The NPS publication entitled National Register Bulletin 15 defines seven aspects of integrity: location, design, setting, materials, workmanship, feeling, and association. Integrity is the authenticity of a property’s physical identity which is clearly indicated by the retention of characteristics (character-defining features) that existed during the property’s period of significance. The aspects of integrity that are essential vary depending on the significance of the property. However, in assessing a property’s integrity, the National Register criteria does recognize that properties change over time, therefore, it is not necessary for a property to retain all its historic physical features or characteristics. The property must retain, however, the essential physical features that enable it to convey its historic identity.

PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 4 OAC has assessed the subject property’s historic integrity as follows:

Location: The place where the historic property was constructed or the place where the historic event occurred.

The property remains at its original location and, therefore, retains this aspect of integrity.

Design: The combination of elements that create the form, plan, space, structure, and style of a property.

The single-family residence has experienced minimal exterior alterations along those primarily elevations visible from the public right-of-way (its front facade). The modifications made to the rear of the structure and within the backyard area, which are considered secondary elevations and features, have not compromised the overall Regency Revival design, style, and aesthetics of the dwelling. The ESA report also states that “most of the changes have occurred on the rear of the subject property, which is not visible from the public right-of-way. The home’s primary elevation has undergone minimal changes over time and original materials and character-defining features of the home remain largely intact.”1 Those character-defining features that define its historic character, function, aesthetics, style and design, which are primarily located on the front façade, remain substantially intact. Therefore, OAC finds the property retains sufficient integrity of design.

Setting: The physical environment of a historic property.

As seen from the public right-of-way (along Roxbury Drive), the single-family residence under review maintains the original topographic features and spatial relationships between the residence, garage, driveway, front yard landscape, and open spaces as evident from its period of significance (date of completion, 1942). Despite changes to the backyard and rear of the building, which are not visible from the public right-of-way, the basic physical conditions under which the house was built and the functions it was intended to serve remain sufficiently evident. OAC contends the property retains sufficient integrity of setting.

As considered within in its neighborhood surroundings, the property’s residential setting adjacent large affluent single-family homes has been retained. The property’s historic setting within the neighborhood has been moderately altered over time by the demolition of older housing stock for the construction of new larger homes. Nonetheless, the majority of residences that infill the parcels along this block of Roxbury have construction dates prior to World War II, despite some being altered over the years. The overall neighborhood character of the thoroughfare along this tree lined portion of Roxbury share consistent setbacks, landscaped easements and sidewalks, circulation patterns, and varying architectural styles that were established and consistent with the early years of development.

OAC, therefore, believesthe surrounding neighborhood setting is relatively retained.

Materials: The physical elements that were combined or deposited during a particular period of time and in a particular pattern or configuration to form a historic property.

As the ESA report notes “the home’s primary elevation has undergone minimal changes over time and original materials and character-defining features of the home remain largely intact.”2 They also
note that the window panes of the house have been replaced with dual pane glass, the roof has been replaced (re-roofed), some additional chimneys have been added to the multi-gable roofing system, 1 1001 North Roxbury Drive, Historical Resources Assessment, ESA, October 2021, p. 94. 2 Ibid, p. 94.

PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 5 and the brick veneer has been painted. The window panes were replaced within the original metal window frames, which maintained the visual profile and depth of read of the original framing and glazing system. For safety and general maintenance needs it is common to have the roof replaced and such work was done in-kind and per code. The addition of chimneys occurred primarily along the back half of the house and do not adversely compromise those important characteristics that define the Regency Revival architectural style of the house. The noted concern regarding the painting of the brick veneer is also questionable as it is unknown at this time whether the brick was originally painted white or not (as was also typical of the period and style). These modifications, many of which are rehabilitation or on-going general maintenance items, appear to have been conducted in-kind as to avoid adversely impacting the overall architectural quality and signature character-defining features of the residence. Those character-defining features including the recessed wood paneled front entrance door with rectilinear transom window, arched shaped window openings and associated wood louvered shutters, broken pediments over the entry and window openings, gable roof with a series of wall and roof dormers, polygonal projecting bay windows with standing seam metal roofs, multi-pane fenestration, balconettes with iron railings, and mixed cladding of brick, horizontal wood siding, and smooth plaster sheathing from its period of significance that identify as a Regency Revival style property are still visually and physically evident from the public right-of-way. Therefore, OAC finds the property retains integrity of materials.

Workmanship: The physical evidence of the crafts of a particular culture or people during any given period in history or prehistory.

Due to the retention of notable historic fabric and associated character-defining features, the property visually and physical retains sufficient integrity of workmanship. Its period craftsmanship, stylistic expression, and 1940s construction techniques continue to be conveyed through intact architectural features, as noted above.

Feeling: A property’s expression of the aesthetic or historic sense of a particular period of time.

As a readily recognizable example of Regency Revival architecture, the subject property is a direct expression of the moneyed architectural aesthetic of the idiom that defined the residential development of Beverly Hills, particularly in the area north of Sunset Boulevard, prior to World War II.

The dwelling has experienced few inappropriate alterations to its main, front elevation, which is highly visible from the public right-of-way, and continues to express the original aesthetic and historic sense from its period of significance. Thus, OAC finds the property retains this element of integrity.

Association: The direct link between an important historic event or person and a historic property.

According to NPS guidance, a property possesses integrity of association if it retains the essential physical features that made up its character or appearance during the period of association with an important event or person. While a number of noted individuals owned and occupied the subject property over the years, it was not directly associated with their productive lives when they achieved prominence or significance. The property has sufficient physical and historical integrity; however, it was not found to be significant for its association with historic events or personages, so integrity of association does not apply.

In conclusion, OAC does not concur with the findings made in the ESA report that the property lacks integrity of workmanship, materials, and setting; and that it does not retain integrity to convey the appearance of its original construction intact. In assessing the subject property’s construction history, PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 6 permit history, and historical integrity, it is OAC’s professional opinion that the residence retains the essential physical features (character-defining) that visually and physically conveys the property’s historic character and well-executed Regency Revival architectural style from its period of significance.

Therefore, it retains integrity of location, design, materials, workmanship, association, feeling, and setting.

Evaluation Findings
The City’s Historic Preservation Ordinance establishes historic significance criteria and the process for evaluating (and designating) properties as local landmarks for listing in the City of Beverly Hills Register of Historic Properties (BHMC 10-3-3212). As stipulated in the Ordinance, the significance designation criteria for recognizing potential landmark eligibility consists of two parts, Part A and Part B, each with their own subset of significance criteria. A property must satisfy all four criteria requirements under Part A and must satisfy at least one of the six criteria under Part B. The local City of Beverly Hills Landmark Designation Criteria requirements consist of the following:

A. A landmark must satisfy all of the following requirements:

1. It is at least 45 years (45) years of age, or is a property of extraordinary significance;

2. It possesses high artistic or aesthetic value, and embodies the distinctive characteristics of an architectural style or architectural type or architectural period;

3. It retains substantial integrity3 from its period of significance; and

4. It has continued historic value to the community such that its designation as a landmark is reasonable and necessary to promote and further the purposes of this article.

B. In addition to the requirements set forth in Paragraph A above, a landmark must satisfy at least one of the following requirements:

1. It is listed on the National Register of Historic Places;

2. It is an exceptional work4 by a master architect;5

3. It is an exceptional work that was owned and occupied by a person of great importance, and was directly connected to a momentous event in the person’s endeavors or the 3 In BHMC 10-3-3202, the Ordinance defines “substantial integrity” as “integrity that is considerable in importance, value, degree, amount, or extent, and that continues to exist, or would have continued to exist, but for work done without appropriate permits after the enactment of this architect.” 4 In BHMC 10-3-3202, the Ordinance defines “exceptional work” as “a remarkably superior example of architectural work that has been recognized as such by members of the architectural community. At a minimum, the work’s exceptional quality shall have been documented by at least one of the following: a) it was the subject of a major architectural award; b) it was substantially discussed (i.e. not just mentioned) and photographically depicted in at least two (2) publications (e.g. a book, treatise, trade magazine article, film, or set of photographs made available to the public by an institutional archive) authored by acknowledged experts in the field of architecture. A monograph or publication made available to the public solely in electronic form and without any reasonable expectation of compensation to the author, or substantially authored by the architect of the work, shall not count toward this minimum.”
5 In BHMC 10-3-3202, the Ordinance defines “master architect” as “an architect of widely recognized greatness in the field of architecture whose individual genius influenced his or her age.” BHMC 10-3-3202, the Ordinance also defines “List of Local Master Architects,” as “a list maintained by the city that includes master architects as defined in this article who have designed properties in the city.” PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 7 history of the nation. For purposes of this paragraph, personal events such as birth, death, marriage, social interaction, and the like shall not be deemed to be momentous;

4. It is an exceptional property that was owned and occupied by a person of great local prominence;

5. It is an iconic property;6 or

6. The landmark designation procedure is initiated, or expressly agreed to, by the owner(s) of the property.

The ESA report evaluated the subject property against City of Beverly Hills Landmark Designation Criteria to establish historical significance or lack thereof sufficient enough in processing a “Certificate of Ineligibility” application. ESA found the property ineligible for designation as a City of Beverly Hills landmark as it failed to satisfy all of the requirements under Landmark Designation Criteria part A and any one of the requirements under part B (BHMC 10-3-3212). OAC’s peer review of the evaluation findings for local landmark eligibility is as follows:

A. A landmark must satisfy all of the following requirements:

Criterion A.1. It is at least 45 years (45) years of age, or is a property of extraordinary significance.

OAC concurs with ESA’s finding that the subject property is over 45 years of age and satisfies Landmark Criteria A.1.

Criterion A.2. It possesses high artistic or aesthetic value, and embodies the distinctive characteristics of an architectural style or architectural type or architectural period.

OAC does not concur with ESA’s finding that the subject property does not satisfy Landmark Criteria A.2. The ESA report states the residence is a large example of the Regency Revival style, but otherwise is a non-distinct, fair example of the idiom. The ESA report also states that the property lacks integrity to convey its original construction appearance because of the alterations made to the rear (south secondary, non-visible elevation) of the building. The report goes on to argue that because the window panes within the existing window frames along the primary (front) elevation have been replaced (with dual pane, in-kind glazing) and the roof has been re-roofed (for maintenance purposes), as well as the brick veneer being painted white (which we do not know if it was originally painted white or not) the property sufficient lacks integrity to satisfy this criterion.

As discussed above under Analysis of Integrity Findings herein this memo, the subject property retains the essential physical features that enable it to convey its historic identity. The 1001 North Roxbury Drive residence is a very good, classic example of Regency Revival architecture. It embodies the distinctive characteristics of the idiom through its retention of associated character-defining features, including the recessed wood paneled front entrance door with transom window, arched shaped window openings and associated wood louvered shutters, broken pediments over the front entry and window openings, gable roof with a series of wall and roof dormers, polygonal projecting bay windows with standing seam metal roofs, multi-pane fenestration, balconettes with iron railings, and 6 In BHMC 10-3-3202, the Ordinance defines “iconic property” as “a property that has been visited and photographed so often by residents and visitors to the city that it has become inextricably associated with Beverly Hills in the popular culture and forms part of the city’s identity to the world at large.” PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 8 mixed cladding of brick, horizontal wood siding, and smooth plaster sheathing from its period of significance (1942). In reviewing the permit history, construction of the property began in October 1941 and was completed in early 1942. Those architectural elements that identify the dwelling as a Regency Revival designed structure from the early 1940s are still clearly visually and physically evident from the public right-of-way. It is OAC’s professional opinion that the property satisfies this criterion.

Criterion A.3. It retains substantial integrity7 from its period of significance.

The ESA report states that the property lacks integrity for inappropriate changes made to the rear of the dwelling and its backyard space as well as because of minor maintenance changes to the front facade. OAC does not concur with ESA’s interpretation and analysis of integrity and their finding that the subject property does not satisfy Landmark Criteria A.3. Over the years, the subject property has experienced modifications to its rear elevation and within the enclosed backyard area of the very large parcel. Nonetheless, those elevations that are visually and physically evident from the public right-of-way retain the classic character-defining features of the original design intent and Regency Revival architectural style as envisioned by its designer Carlton Burgess, who is included in the City’s List of Local Master Architects. As discussed in the above paragraphs for Criterion A.2 and under the Analysis of Integrity Findings section of this memo, as seen from the street the property retains the quintessential form, plan, space, and style of Regency Revival residential architecture dating from the early 1940s. Therefore, OAC concludes that subject property sufficiently satisfies Landmark Criterion A.3, as defined in the Ordinance (BHMC 10-3-3202).

Criterion A.4. It has continued historic value to the community such that its designation as a landmark is reasonable and necessary to promote and further the purposes of this article.

OAC does not concur with ESA’s finding that the subject property does not satisfy Landmark Criterion A.4. Despite changes made to the subject property along its rear (secondary) elevation and within the backyard area, those elevations visually and physically evident from the public right-of-way are still intact and continue to convey the property’s historic character from the pre-World II era, distinctive Regency Revival style, and magnitude of design and form. Because of its notable corner location, large deep parcel (double lot), association with master builder and designer Carlton Burgess, and placement along a broad gracefully curved street within in a highly affluent Beverly Hills neighborhood north of Sunset Boulevard the property reflects the rich varied architectural heritage so closely tied to the history of the community. Therefore, it is OAC’s professional opinion that the 1001 North Roxbury Drive property has continued historic value and meets this requirement.

B. In addition to the requirements set forth in Paragraph A above, a landmark must satisfy at least one of the following requirements:

Criterion B.1. It is listed on the National Register of Historic Places.

OAC concurs with ESA’s finding that the subject does not satisfy Landmark Criterion B.1.

Criterion B.2. It is an exceptional work8 by a master architect. 7 In BHMC 10-3-3202, the Ordinance defines “substantial integrity” as “integrity that is considerable in importance, value, degree, amount, or extent, and that continues to exist, or would have continued to exist, but for work done without appropriate permits after the enactment of this architect.” PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 9 OAC does not concur with ESA’s reasoning that the subject property does not satisfy Landmark Criterion B.2. OAC, however, does conclude that the 1001 North Roxbury Drive property does not satisfy this particular criterion as it is not considered an “exceptional work,” as defined in the Ordinance. While Carlton L. Burgess is currently included in the City’s List of Local Master Architects and is considered a master builder who also designed many of his own projects, research undertaken for this peer review, including a review of the Avery Index to Architectural Periodicals, has not found evidence that the property was ever the subject of a major architectural award or was substantially discussed or photographically depicted in a monograph or any other known publications.

Criterion B.3. It is an exceptional work that was owned and occupied by a person of great importance, and was directly connected to a momentous event in the person’s endeavors or the history of the nation. For purposes of this paragraph, personal events such as birth, death, marriage, social interaction, and the like shall not be deemed to be momentous.

OAC concurs with ESA’s finding that the subject does not satisfy Landmark Criterion B.3. To clarify, the property does not satisfy this criterion because it is not considered an “exceptional work,” as defined in the Ordinance. In addition, the property does not qualify under this criterion as it does not satisfy the definition of “person of great importance,” as defined in the Ordinance. The research conducted as part of this peer review did not identify any individuals associated with the property whose activities had a substantial impact on the history of the nation, whose name and exploits were widely known across America during his/her lifetime, and whose fame continues through to the present day.

Criterion B.4. It is an exceptional property that was owned and occupied by a person of great local prominence.

OAC concurs with ESA’s finding that the subject does not satisfy Landmark Criterion B.4. To clarify, the property does not satisfy this criterion because it does not meet the definition of “person of great local prominence,” as defined in the Ordinance. No documentation was found to indicate that any of the owners and occupants of the 1001 North Roxbury Drive property had a substantial impact on the City, and none of them have public streets or parks named after them.

Criterion B.5. It is an iconic property.

OAC concurs with ESA’s finding that the subject does not satisfy this criterion. 8 In BHMC 10-3-3202, the Ordinance defines “exceptional work” as “a remarkably superior example of architectural work that has been recognized as such by members of the architectural community.
PEER REVIEW ASSESSMENT: Historical Resources Assessment – 1001 North Roxbury Drive 10 Criterion B.6. The landmark designation procedure is initiated, or expressly agreed to, by the owner(s) of the property.

OAC concurs with ESA’s finding that the subject does not satisfy Landmark Criterion B.6.

The ESA assessment report also evaluated the subject property for National Register and California Register eligibility. As the consideration of the property’s National Register and California Register eligibility are irrelevant in the processing of the “Certificate of Ineligibility” application, they were not addressed or assessed as part of this peer review.

Conclusion
OAC has completed a professional peer review of a (draft) historic resources landmark assessment report prepared by ESA for the 1001 North Roxbury Drive property. The peer review was conducted by OAC to ensure that the current identification and evaluation findings of the subject property for City of Beverly Hills Landmark eligibility or ineligibility are adequate and that the findings of the ESA report are sound and well justified.

Despite some narrative discrepancies, limited in-depth contextual research on some subject matters, and the misinterpretation and application of historic integrity and the City’s Landmark Designation Criteria, OAC ultimately concurs with the report’s conclusion that the residence located at 1001 North Roxbury Drive does not satisfy the required mandates of the City of Beverly Hills’ Landmark Designation Criteria (BHMC 10-3-3212).

Based on our review of the ESA report and consideration of the additional research material collected and reviewed on the subject property, designer/builder, past and present owners and occupants, and associated historic contexts and themes, OAC findsthe subject property satisfies all four requirements of Beverly Hills Landmark Designation Criteria part A. However, under part B of the Landmark Designation Criteria it is not considered an “exceptional work” by master builder/designer Carlton Burgess (as defined in BHMC 10-3-3202). While Burgess is included in the City’s List of Local Master Architects, the property itself has not been photographically depicted or featured in at least two scholarly works on architecture (or popular journals) nor has it been recognized or won any type of architectural award. The property is also ineligible under Landmark Designation Criteria B.3 and B.4 as it is does not meet the definition of an “exceptional work” and was not owned and occupied by a person of great national or local importance/prominence. In addition, the subject property under review does not satisfy the definition of an “iconic property” (Landmark Designation Criterion B.5) and the property owner has not initiated or expressly agreed to designate the improvement (Landmark Designation Criterion B.6). Please keep in mind that OAC has not considered or evaluated the property for National Register and California Register eligibility. In addition, OAC has not assessed the property for CEQA compliance. Such evaluation assessments are irrelevant to the processing of a “Certificate of Ineligibility” application.
