March 1, 2022 City Council directed the NusrEt team to work collaboratively with the property owners for the 190 N. Cañon Drive building to find a solution and return to City Council with that solution prior to an extension being granted for the NusrEt temporary outdoor dining tent beyond March 31, 2022.
At the time of the writing of this report, the two parties of NusrEt restaurant and 190 N.
Cañon Drive property owners were still coordinating meetings and discussions. As such, a verbal update will be provided at the City Council meeting on March 15, 2022 regarding progress made on finding a solution.
After receiving the update, the City Council may select from one of the following options:
Options for Extension of Temporary Outdoor Dining Tent for NusrEt Option A: No additional time (ends March 31, 2022)
Option B: An additional 9 months (ends December 31, 2022) Option C: Other timeframe as recommended by the City Council The City Council previously approved the extension of the street closure and the temporary outdoor dining tent for Spago in the 100 block of N. Cañon Drive through December 31, 2022. If the NusrEt tent is reduced in size, or removed entirely, the street closure would still remain in place through December 31, 2022 per the City Council’s prior direction.
If Option A is selected and no extension is granted, the NusrEt tent is currently approved for outdoor dining operation through March 31, 2022. Approximately two weeks would then be provided for the removal of the tent with a date of April 15, 2022 recommended for the full removal to be complete. This option would not require any change to the traffic configuration of the intersection of North Cañon Drive/Clifton Way. It would, however, expand the valet area and temporary parking area for bank ATM parking.
FISCAL IMPACT
The fiscal impact of providing the extension of the OpenBH permit for the temporary outdoor dining tent for NusrEt restaurant is built into the existing 85 business model below. If the permit is not extended, the waived permit fees estimate would be reduced by $2,901 (essentially 3 x $967). The meter loss revenue would remain untouched as the traffic configuration and street closure will still remain through December 31, 2022.
