RECOMMENDATION
It is recommended that the City Council and the Board of Parking Authority conduct a public hearing and consider adopting the resolution amending the City’s Schedule of Taxes, Fees, and Charges and Parking Facility rate schedule for Fiscal Year (or “FY”) 2022-2023.

INTRODUCTION
The City levies a range of permit fees, charges, rental and use fees, taxes and other fees or payments, which are listed in a comprehensive schedule called “Schedule of Taxes, Fees & Charges” (hereinafter “Schedule of Taxes, Fees & Charges” or “Schedule”). The Schedule contains the following sections:

E-1
Meeting Date: April 12, 2022
 Section 1 – Ambulance & Alarm Fees
 Section 2 – Appeals
 Section 3 – Business Permits
 Section 4 – Copies, Reports, etc.
 Section 5 – Facilities Use Fees
 Section 6 – Inspections, Permits, & Reviews
 Section 7 – Library Services
 Section 8 – Parking Citations
 Section 9 – Parking Rates
 Section 10 – Recreation Fees & Animal Licenses
 Section 11 – Special Events & Filming
 Section 12 – Taxes
 Section 13 – Utility Rates & Fees
Maintaining a comprehensive book with all the various taxes, fees, and charges ensures that the City provides the public with one document that contains all City fees rather than providing the information in several documents or in piecemeal form. In addition, the Schedule is available on the City’s website. Although the City reviews the Schedule yearly, there are times when revisions are made to certain fees during the year.

In accordance with section 3-1.1001 of the Beverly Hills Municipal Code and Ordinance No. 79-O-1749, City fees and charges are adjusted annually, based upon the increase in the Consumer Price Index (CPI) for the preceding twelve months, and rounded to the nearest dollar.

The State Constitution generally mandates fees for services not exceed the “costs reasonably borne” by the City in the delivery of such services. In compliance with the Constitution, the City periodically performs a full cost study to confirm current costs of services and to recommend cost recovery levels for these fee based programs. The City last performed a full cost study in FY 2018-19.

The following proposed adjustments to the Schedule of Taxes, Fees, and Charges for Fiscal Year 2022-23 are to reflect the following:

1. CPI Adjustments – Most fees and charges will be adjusted by six percent (6.0%), which is the CPI for Fiscal Year 2022-23 (Anaheim – Los Angeles – Riverside County area for November 2020 to November 2021).

2. Special Circumstances – In some instances, staff recommends a fee that is lower than full cost recovery, often times to remain competitive or to round for ease of collection.

3. Phasing In Fees – During the last full cost study, certain fees were recommended to be phased in over several years to reach full cost recovery.

Exhibit A to the City resolution (Attachment 1) contains the comprehensive Schedule of Taxes, Fees, and Charges for Fiscal Year 2022-2023 that are recommended for adoption.

Attachment 1 contains a redline document of fees that are recommended for revision.

Strikeouts indicate deletion of text that is no longer relevant and/or clean up. Except as otherwise indicated, all fees are scheduled to become effective July 1, 2022.

Meeting Date: April 12, 2022
Exhibit A to the Parking Authority resolution (Attachment 2) contains the comprehensive Parking Authority’s Schedule of Parking Facility Rates for Fiscal Year 2022-2023 that are recommended for adoption. Attachment 2 contains a redline document of rates/fees that are recommended for revision. Strikeouts indicate deletion of text that is no longer relevant and/or clean up. Except as otherwise indicated, all fees are scheduled to become effective July 1, 2022.

DISCUSSION
The following is a discussion of the proposed changes for each section of Attachment 1 – Redlined Schedule of Taxes, Fees & Charges.

Ambulance and Alarm Fees (Section 1)
 Most Ambulance fees are recommended to increase by the CPI and rounded to the nearest dollar.
 The non-resident surcharge will remain at 10%.
 The False Alarm Response fees are recommended to increase by the CPI and are rounded to the nearest dollar.
 The DUI Collision Emergency Response fee is recommended to be removed, as it is not being collected.

Appeals (Section 2)
 The fees for Appeals are recommended to increase by the CPI and rounded to the nearest dollar.
 Taxicab Hearing of Taxicab Franchise and Taxi Vehicle Appeals as well as the Valet Attendant/Taxi Driver Appeal fees are being recommended to be removed.

The Police Department is no longer issuing Taxicab IDs or permits because these services were centralized by LADOT.
 Appeal of an affordable housing placement application is proposed to be exempted from the fee that applies to all “Appeals to City Council, Commission or Board of Any Administrative Decision.” The “Affordable Housing Application Appeal Fee Exemption” report on the April 12, 2022 consent calendar provides background justifying the proposed exemption, and if the City Council concurs, a notation will be added that an appeal of an affordable housing placement application is exempt.

Business Permits (Section 3)
 Most fees under Business Permits are recommended to increase by the CPI and are rounded to the nearest dollar.
 Bingo permit fees are set by State law and will not be increased.  Valet Parking Attendant ID Card fee is being moved up so it is listed in alphabetical order and it is not a new fee.
 Some clean-up to the language in this section is recommended.  Taxicab fees are recommended to be removed. The Police Department is no longer issuing Taxicab IDs or permits because these services were centralized by LADOT.

Meeting Date: April 12, 2022
 Vehicle Permits fees are recommended to be removed as the Police Department no longer does these inspections as Taxicab operations are regulated by City of Los Angeles.

Copies, Reports, etc. (Section 4)
 Many fees are simply set at actual cost. These fees will vary based on the size and/or frequency of the document being requested.
 Most fees are recommended to be increased by the CPI. Some are rounded to the nearest nickel instead of dollar if they are less than ten dollars.  Fees for standard copies and clerical costs for Subpoenas and Discovery Motions, and Concealed Weapon Permit fees are set by State Law and are not increasing.  Repossession Fee is set by State law and will not be increased.  The Amended Application fee for Concealed Weapon Permits is recommended to be adjusted below the current rate. This fee is set by State Law.

Facility Use Fees (Section 5)
Library
 Most Library fees are recommended to increase by the CPI and rounded to the nearest dollar.

Community Services
 Most fees are recommended to increase by the CPI and rounded to the nearest dollar.
 Long-term parking is recommended to remain unchanged.

Community Development
 All fees are recommended to increase by the CPI and rounded to the nearest dollar.

Police Department
 Pay to Stay and Bail Bond Advertising fees are being removed since the program is no longer being offered.

Public Works
 Most fees in this section are recommended to increase by the CPI and are rounded to the nearest dollar. The fees listed below are set at a flat rate and are not recommended to increase. This not only promotes City marketing and ridership but also allows for our seniors and disabled participants utilizing the transit programs to pay the same fee.
o The Trolley Fares and Promotional Fares
o Monthly MTA Bus Pass
o Taxi Coupon book
 All Bike Share Fees and related charges and passes are being removed since the program is suspended and not currently being offered.

Meeting Date: April 12, 2022
Cable Television
 All fees are recommended to increase by the CPI and rounded to the nearest dollar.

Inspections, Permits & Reviews (Section 6)
Community Development
 Most fees for services of the Community Development Department are recommended to increase by the CPI; however, some fees are simply set at actual cost or set by State law.
 Some clean-up to the language in this section is recommended.  Administrative Citation Fines for Sidewalk Vending Without a Valid Current Permit were added due to adoption in BHMC 4-2-2217B,C.
 Construction related Parking Permit fees are recommended to be restructured.

Restructuring this fee and adding additional smaller valuation thresholds will allow for a more equitable charge for smaller projects.
 There are 28 planning fees that were recommended to be phased in per City Council Resolution 19-R-13256 adopted on November 5, 2019. These increases were recommended above CPI for permits such as the Accessory Dwelling Unit Use Permit: Staff and Commission Level; Annexation Request; Architectural Review: Revision-Commission Level; Boundary Line Adjustments; Conformity Review; Covenant Processing/Recording Fee; Design Review: RevisionCommission Level; Development Plan Review: Revision-Staff and Commission Level; Formal Planning Interpretation; Master Plan of Street Amendment; Minor Accommodation Permit: Staff and Commission Level; Overnight Stay Permit: Staff Level; Planned Development Review; Planning Inspection Fees; R-1 Single Family Reviews; R-4 Multi-Family Reviews: Commission Level; Resolution of Convenience and Necessity; Tree Removal Review; Variance Application; View Restoration Permit Application Fee: Cost for Owner to Address on Foliage Owner; Wireless Communication/Satellite Dish Antenna Review: Staff and Commission Level; and Zoning Conformance Letters.
o However, the following four fees are no longer being recommended to increase as previously recommended in order to incentivize more housing development, applicable to projects with affordable units:
 Accessory Dwelling Unit Use Permit: Commission and Staff Level Review are recommended to only increase by CPI.
 Development Plan Review: Commission and Staff Level Review are recommended to only increase by CPI.

This recommendation is consistent with the City’s General Plan, Program Policy # 12.2, ‘Reduce Fees for Affordable Housing.’
 The Housing Project Preliminary Application Fee is also not being increased by CPI to further incentive housing development.
 Some fees such as the New Open Air Dining Commission Level (50% subsidized) and In Public Right-of-way Renewal (75% subsidized), Design Review: RevisionStaff Level (50% subsidized) are not being increased by CPI to promote these kinds of activities.
 Deposit Levels and the Water Well Application Fee are not being recommended to increase.

Meeting Date: April 12, 2022
Engineering
 Most fees are recommended to be increased by the CPI. Some are rounded to the nearest nickel instead of dollar if they are less than ten dollars.  Some clean-up to the language in this section is recommended.  The non-recurring Wireless Facility Application fees are being recommended to be revised to include the fully burdened hourly rates for all personnel involved in the review/processing not covered by the Application fee.
 Most pass through, fees set by statute, actual cost and deposits in this section are remaining unchanged.

Fire Department
 Most Fire Department fees are increasing by the CPI and rounded to the nearest dollar.
 Nominal CPI adjustment for the Annual Permits for Liquefied Petroleum Gas (LPG) – Gas use event, special event (per appliance) fee is not being recommended.
 Fees that are set at actual cost are remaining at actual cost and not recommended to change.
 The Vegetation Management initial inspection with no violation found fee is remaining at no charge.
 Some of the fees in this section are effective January 1, 2023.

Police Department
 The Correctable Citation Sign-off fee will remain unchanged. This is the same amount the Sheriff is charging.

Public Works
 The Southern California Edison Street Light shield Installation fee is paid directly to Southern California Edison.
 Many of the fees are pass through rates from LA County or are set at actual cost.

All other fees are generally increasing by CPI and rounded to the nearest dollar.  Some clean-up to the language in this section is recommended.  Most Industrial Waste Discharge Fees are increased by a total of 8% (6% CPI plus 2% to recoup from last year’s adjustment the County made later in FY 22).  The Violation/Compliance Inspection, Wastewater Sampling, and Inspection, Closure, Industrial Waste fees are set at actual cost.
 Language and fee update relating to the parking meter post installation is being recommended. Rather than charging a fixed fee, staff would like to charge actual cost to recoup the cost charged by the City’s vendors.

Library Services (Section 7)
 The Library Non-Resident card is being recommended for a reduction to align with other local libraries.
 Some clean-up to the language in this section is recommended.  Three overdue charges are recommended to be removed.
 Some fees are set by federal law and remain unchanged.

Meeting Date: April 12, 2022

 The low range of the Daily Parking Passes is being decreased to correctly reflect the current practice.
 Monthly Recurring Credit Card and Automated Payment Discount is being removed, as it is no longer being offered.

Recreation Fees & Animal Licenses (Section 10)
Community Services
 Some of the Recreation Fees are recommended to be increased by the CPI and rounded to the nearest nickel instead of dollar if they are less than ten dollars.  Some fees are recommended to remain the same for the ease of collection.  Some fees have been prorated to each participant in the past and will continue to be prorated.

Community Development
 Fees for Animal Control are set at the rate of the Los Angeles City Fees.  Trapping fees are set by the contractor.
 Dead animal on the street fee is recommended to be increased by CPI.

o After Hours Service Fee: Intended to recover the associated costs involved with staff responding in real-time to those activities that cause after-hours actions.
 Most of the fees under this section are recommended to increase by the CPI and rounded to the nearest dollar.

 Some language clean-up as well as corrections to some parking facility addresses is being recommended.
 The Monthly Recurring Credit Card and Automated Payment Discount is being removed as it is not something that is being offered.
 All rates except the low range for vehicles entering after 6 p.m. at 450 North Crescent Drive, the Daily Parking Passes, and the high range for the Valet Parking are being recommended to remain the same.

FISCAL IMPACT
Estimating additional revenues as a result of the recommended fee increases is difficult during normal times, and extremely challenging in our current environment. Fee based activities can vary from year to year, and during the pandemic there has been a significant impact to fee activity in many areas. The inflationary increases prevent erosion of cost recovery as City costs for providing the services increase over time.
