Attachment: 1. Fiscal Year 2022-23 Proposed Operating Budget
INTRODUCTION
This report provides a brief summary to accompany the Fiscal Year 2022-23 Proposed Operating Budget and a more detailed presentation will be provided by staff at the Study Session meeting scheduled for May 24, 2022. In spite of the pandemic’s ongoing but waning presence, there have been continued improvements to economic activity and tourism, which have significantly improved the City’s revenue and financial position. While the City’s outlook is looking much better than it did one year ago, there have been new national and international developments including the Russian invasion of Ukraine, inflation rising to decades-level highs, and rising interest rates all mounting concerns about the likelihood of a recessionary period. The City and staff will need to continue to monitor these factors and shift back towards a longer-term view and forecast of the City’s financial picture in the upcoming years as a result. This document serves to provide a very high level summary with transmittal of the proposed budget.
The Fiscal Year 2022-23 Proposed Operating Budget can be found at the following online location:
https://www.beverlyhills.org/departments/finance/financialdocuments/budgetdocuments/.
The budget message found therein has been written to serve as a clear, one-stop source for understanding the budget, and it is strongly recommended as the primary focus.
Meeting Date: May 24, 2022
DISCUSSION
As the City emerges from a prolonged period of economic decline due to the pandemic, forecasted revenues have increased and most one-time budget balancing measures have been eliminated.
This enabled significant budget enhancements to be incorporated to support City Council priorities, primarily with respect to public safety and community service initiatives. Through City Council action during fiscal year 2021-22, $3.3 million in fiscal year 2022-23 enhancements have been pre-approved across all funds ($0.2 million one-time and $3.1 million recurring). In addition, the proposed budget includes new enhancements totaling $19.2 million across all funds ($6.7 million one-time and $12.5 million recurring).
Full summaries by fund and details for all enhancements can be found in the proposed budget document in the Budget Enhancements section and in the Supplemental Information section under Budget Enhancement Details.

Meeting Date: May 24, 2022
For fiscal year 2022-23, General Fund revenues are projected to be $293.0 million, which amounts to an increase of $42.9 million, or 17.2% over the adopted fiscal year 2021-22 budget of $250.1 million.
1 While three of the City’s four major revenues declined significantly in fiscal year 2019-20 and fiscal year 2020-21 due to the pandemic, three have also significantly recovered in the current fiscal year, in some cases exceeding pre-pandemic levels, and this recovery is expected to continue into next fiscal year.
The proposed General Fund budget for fiscal year 2022-23 provides for total expenditures of $295.6 million, which amounts to an increase of $28.3 million, or 10.6%, compared to $267.3 million1for the fiscal year 2021-22 adopted budget. Within this increase are one-time General Fund budget enhancements totaling $6.4 million and ongoing enhancements totaling $3.9 million.
1 At the direction of the City’s independent auditors, bad debt expense has been reclassified to a contra-revenue for all years presented in the budget document. Therefore, amounts may differ slightly from the prior year’s budget document.
Meeting Date: May 24, 2022
The proposed Citywide appropriations for fiscal year 2022-23 are $571.5 million for all funds.
Based on projected Citywide revenue of $560.7 million, it is recommended to use reserves and fund balances of $10.8 million to fund the full expenditure budget. For additional details, please refer to the budget message of the proposed budget.
Meeting Date: May 24, 2022
Additionally, the Fiscal Year 2022-23 Proposed Capital Improvement Budget of $75.0 million is included in the proposed operating budget results.
No Cost Executive Compensation Plan Update
Executive-level employees are not in a represented bargaining group and their benefits are maintained in the Executive Compensation Plan (Plan), which does not have a defined term (i.e. no end date) and is brought forward by the City Manager to the Council when appropriate for any updates or changes in terms. The Executive Compensation Plan was last updated June 1, 2021 as part of the budget adoption process. Due to additional reorganization taking place, there is a need to revisit positions contained within the Plan.
For the City’s represented employees (those in a bargaining group covered by a negotiated Memorandum of Understanding), the City Council follows a process set forth in the City Ordinance Regarding the Procedure for Adopting or Amending a Memorandum of Understanding Between the City and an Exclusively Recognized Employee Organization, often referred to as the COIN Ordinance (Civic Openness in Negotiations). The Ordinance provides that that the City Council may adopt or amend a Memorandum of Understanding (MOU) only after conducting two public meetings and that the proposed MOU and related fiscal analysis be posted on the City’s website at least two weeks before the Council meeting at which the proposed MOU is considered for adoption. Though not required for the Plan, this process has been the established as a best practice and applied to the process for amendments to the Plan. As such, this item represents the first of two public meetings. The fiscal analysis has been completed and will be reviewed by an outside consultant, and costing estimates will be posted two weeks prior to the June 14, 2022 meeting where the Plan will be considered for adoption.
Proposed Changes
As part of the continued restructuring of the Beverly Hills Police Department, under the leadership of the new Chief of Police, there are initiatives underway to civilianize particular functions and duties to better leverage the use of existing sworn personnel for sworn duties. As such, there are several additional civilian positions proposed under the enhancement list provided above. One particular enhancement is for the addition of a newly created Deputy Director of Police Special Projects as an Executive position. This position will manage the Office of the Chief’s civilian administrative staff, coordinate the day-to-day activities therein, and manage the Community Relations Unit. This position is recommended by the Police Department for placement in Senior Management Band “A” of the Executive Compensation Plan (salary range of $133,906 to $203,441).
Additionally, with the recently announced retirement of the Assistant City Clerk in June, this classification is recommended to be eliminated from the Executive Compensation Plan. This change will result in a removal of a position from the same Senior Management Band “A” of the Plan, resulting in a no cost change to the overall Plan structure. The associated budget for the Assistant City Clerk position will be reduced from the proposed budget when it is brought back for adoption on June 14th.
Lastly, there are two language updates being proposed. These changes do not have any associated costs being they are administrative in nature. First, the Plan includes information regarding the health benefit options available to employees that are offered by CalPERS. Last year, CalPERS made some structural changes to their plans including the names of the various plans offered. As such, it is recommended the Plan language be updated to align with the current plan names as provided by PERS. Secondly, the Plan includes language regarding the conversion of accrued sick leave to deferred compensation to fund the “catch up” contributions.
The Plan includes language that limits the number of times this can occur to no more than three Meeting Date: May 24, 2022
consecutive years, which used to be included in the MOUs for our represented labor groups but was removed during the last round of negotiations. There is an interest in aligning the administration of this particular provision for the Executive group with that of the city’s labor groups by removing the three consecutive year limit from the Plan, and consistent with the labor groups, have contribution amounts and deferral limits be governed by IRS Code restrictions.
Additional Items
Police Department Mental Evaluation Team Bonus Pay
One additional item has surfaced since the printing of the Fiscal Year 2022-23 Proposed Operating Budget for which staff is seeking City Council direction. The Mental Evaluation Team (MET) will play a critical role in the City’s proactive approach to responding to psychiatric emergencies, including contact with persons experiencing homelessness and/or exhibiting signs of mental illness to provide immediate access to mental health treatment including emergency assessments, hospitalizations, and linkage to vital ongoing supportive services. This program will partner two dedicated Beverly Hills Police Officers with mental health clinicians assigned from the Los Angeles County Department of Mental Health. In order to attract interest among members of the department eligible to apply for the MET assignment, the Chief of Police has recommended a 5.5% bonus pay for the two officers selected for the assignment. The assignment pay will result in an additional cost of approximately $13,000 per year, and with City Council concurrence this amount will be incorporated into the budget brought forward to the City Council for adoption in June.
Request to Continue Overhire Authority of Five Police Officers The Beverly Hills Police Department currently has 145 authorized full-time sworn positions (including Police Officers, Sergeants, Lieutenants, Captains, and Chief) and on October 13, 2020 the City Council provided authorization to overhire up to five additional Police Officer positions if full staffing were achieved. The additional overhire of five Police Officers will provide flexibility for staffing to meet community expectations, allow greater options in responding to crime trends, and maintain the Department’s commitment to a three-minute response time or less to emergency calls for service. This initial authorization to overhire is set to expire on June 30, 2022 unless additional action is taken to extend the overhire authority. As such, the request is being made to extend the overhire authorization for an additional year to June 30, 2023.
Meeting Date: May 24, 2022
FISCAL IMPACT
Projected General Fund revenues of $293.0 million exceeds General Fund base operating expenditures of $258.8 million, yielding a base operating surplus of $34.2 million. When factoring in ongoing enhancement requests of $3.9 million, this decreases the surplus to $30.3 million.
After providing for transfers out of $26.5 million and one-time enhancement requests of $6.4 million, the surplus is fully exhausted, ultimately resulting in a deficit position of $2.6 million, which is proposed to be balanced through the use of unassigned reserves (in particular from a portion of the forecasted fiscal year 2021-22 surplus of $15.3 million, which was presented to the City Council as part of the third quarter financial update on May 10, 2022).
Beverly Hills is fortunate to have strong reserves due to the fiscal prudence of the current and prior City Councils. Leaning on reserves during times of financial stress and for one-time relief is a primary function of the reserves, and the City Council has previously indicated willingness to use some of these reserves. The good news is that after two years through the pandemic and periods of civil unrest, neither the Economic/Contingency Reserve nor the Budget Stabilization Reserve have been needed and remain intact.

RECOMMENDATION
It is recommended that the City Council provide direction regarding the Fiscal Year 2022-23 Proposed Operating Budget, on proposed no cost changes to the Executive Compensation Plan resulting from additional reorganization of the Police and City Clerk Departments, on the MET bonus provision, and on extending the authorization to overhire up to five Police Officers, such that staff can prepare and finalize any changes to be brought forward for final adoption of the budget at the scheduled meeting on June 14, 2022.
