Subject: RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY

HILLS ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR
2022-23 FUNDED BY SB 1: THE ROAD REPAIR AND
ACCOUNTABILITY ACT OF 2017
Attachments: 1. Resolution

RECOMMENDATION
Staff recommends that City Council move to approve the Resolution to adopt a list of projects for Fiscal Year 2022/23 funded by Senate Bill 1: The Road Repair and Accountability Act of 2017.

FISCAL IMPACT
The Road Maintenance and Rehabilitation Account (RMRA) funding is an additional revenue source for the maintenance of local streets and roads as a result of Senate Bill (SB 1), which the Governor authorized in April 2017. Since the program’s inception, the City has received a total of approximately $1.7 million dollars in RMRA funding, with payments received on a monthly basis. The Fiscal Year 2022/23 (FY 22/23) allocation for the City of Beverly Hills is projected to be $676,744. This projection was prepared in May 2022, by the California Local Government Finance Almanac based on California Department of Finance statewide revenue.

The RMRA program provisions allow agencies to accumulate SB 1 funding from multiple years to help cover the cost of planned projects. The City is currently using a combination of RMRA, Gas Tax, County Transportation Tax and General Fund monies to fund street repaving projects at various locations.

INTRODUCTION
The adoption of SB 1 increased the gallon fuel excise taxes, increased diesel fuel sales taxes and vehicle registration fees and provided for inflationary adjustments to tax rates in future years; these monies are a funding source for agencies to fund maintenance of local street and infrastructure projects. Since November 2017, the State Controller has been depositing portions of these funds into the Road Maintenance and Rehabilitation Account (RMRA). The funds are apportioned by formula to eligible cities and counties for basic road maintenance, rehabilitation and critical safety needs on the local streets and roads system. The California Transportation Commission (CTC) is the agency responsible for administering this program in accordance with the Streets and Highway Code provisions as outlined in SB 1.

DISCUSSION
The SB 1 program guidelines require that eligible cities and counties submit a Resolution each year that includes a project list, even if the project list is the same from prior years.

The table below shows the resolutions previously approved by the City Council:

Resolution # Council Date
17-R-13161 October 3, 2017
18-R-13193 July 17, 2018
19-R-13231 April 16, 2019
20-R-13293 June 16, 2022
21-R-13351 June 24, 2021
A project from the prior year’s project list—Crescent Drive between Sunset Blvd. and Lexington Rd—was recently completed and has been removed from the list. Staff recommends the following projects be submitted for FY 22/23  N. Linden Drive between Whittier Drive and Santa Monica Blvd.  Burton Way (westbound) between N. Rexford Drive and Oakhurst Drive.  Burton Way (eastbound) between N. Rexford Drive and North Robertson Blvd.  Rexford Drive between Whitworth Drive and Olympic Blvd.  Copley Place near Copley Drive and Sunset Blvd.  Linden Drive between S. Santa Monica Blvd. and Charleville Blvd.  Rexford Drive between Olympic Blvd. and Wilshire Blvd.  Almont Drive between Charleville Blvd. and Olympic Blvd.

These locations are in accordance with the City’s Pavement Management Plan, which identifies locations in need of street rehabilitation work. In addition to pavement rehabilitation, the Burton Way improvements will include replacing the existing bike lanes with buffered, green bike lanes with protective bollards at certain locations and enhanced intersection treatments.

The City must submit its FY 22/23 project list via an approved Resolution to CTC no later than July 1, 2022, to be eligible for funding. The project list does not restrict the flexibility of an eligible city or county to fund projects in accordance with local needs and priorities, so long as the projects are consistent with RMRA priorities.

Meeting Date: June 21, 2022
