RECOMMENDATION
Mayor Lili Bosse and Councilmember John Mirisch are requesting the City Council consider sending a letter of opposition (Attachment 1) to the Los Angeles County Board of Supervisors (“Board of Supervisors”) for the July 26, 2022 Board of Supervisors meeting as they will consider calling a special election on November 8, 2022 for the purpose of voting on an amendment to the Los Angeles County (“County”) Charter which would grant the Board of Supervisors the authority to remove the Los Angeles County Sheriff, who is elected by the residents of Los Angeles County, by a four-fifths vote of the Board of Supervisors for cause.
INTRODUCTION
This report transmits a request by Mayor Bosse and Councilmember Mirisch for the City Council to consider sending a letter of opposition to the Board of Supervisors regarding a call for a special election on November 8, 2022, for the purpose of voting on an amendment to the County’s Charter, granting the Board of Supervisors the authority to remove the Los Angeles County Sheriff by a four-fifths vote of the Board of Supervisors for cause. The proposed charter amendment defines “for cause” as a violation of any law (
Meeting Date: July 19, 2022
related to the performance of their duties as Sheriff, flagrant or repeated neglect of duties, a misappropriation of public funds or property, willful falsification of a relevant official statement or document, or obstruction of any investigation into the conduct of the Sheriff by the Inspector General, Sheriff Civilian Oversight Commission, or any government agency with jurisdiction to conduct such an investigation.
DISCUSSION
Under the state constitution (“constitution”), the office of sheriff shall be filled by election along with other elective county officers. Elected county officials, including the sheriff, answer only to the electorate and not the governing board of the county nor to the state legislature under the constitution. Since the constitution defines the sheriff’s position as a county official, they cannot be impeached. However, sheriffs are subject to recall, with some distinctions between sheriffs in charter counties versus those in general law counties.
Article II, Section 19 of the constitution requires the legislature to “provide for recall of local officers,” but expressly exempts “cities and counties whose charters provide for recall.” Consistent with that constitutional distinction, the legislature established a statutory recall procedure for removing local officers that applies to general law county sheriffs and only applies to a charter county which does not have a statutory recall procedure in place.
For charter counties, removal of the sheriff may be done by recall; the sheriff may be removed either by charter provisions or charter amendment; or the sheriff can be removed under existing statutory law.
As an alternative to a recall, a charter county may empower its governing body to remove the sheriff for official misconduct. A county is not necessarily limited to just one procedure for removing the sheriff as the charter may provide for recall, governing-body removal, both, or some other procedure. Of California’s 58 counties, 44 are general law counties and 14 are charter counties. The charter counties are:
Alameda
Butte
El Dorado
Fresno
Los Angeles
Orange
Placer
Sacramento
San Bernardino
San Diego
San Francisco
San Mateo
Santa Clara
Tehama
After a very brief review of the charters for the fourteen counties mentioned above, staff could not locate a county charter, which empowers its governing body to remove the sheriff for official misconduct, with the exception of San Bernardino County. In the case of San Bernardino County, they adopted a charter amendment whereby all elected positions are subject to being removed from office for misconduct by a vote of the San Bernardino County Board of Supervisors. Further research would be required to say with certainty if any charter county in California has amended its charter to allow for the governing board to remove the sheriff and/or all elected officials.
In the fall of 2021, the Board of Supervisors directed County Counsel to research how Los Angeles County Sheriff Alex Villanueva could be impeached or removed, citing eroding community trust and their ongoing battles with Sheriff Villaneueva over transparency, accountability, deputy misconduct and other issues.
Meeting Date: July 19, 2022
In January 2022, County Counsel Rodrigo Castro-Silva outlined four possibilities to the Board of Supervisors as follows:
1) Recall the sheriff. The California Elections Code establishes the specific procedures for placing on the ballot the recall of an elected official, including the sheriff;
2) The state attorney general. Article V, Section 13 of the constitution provides that the state Attorney General has direct supervision over every district attorney, sheriff, or other law enforcement officers in all matters pertaining to the duties of their respective offices and may require any of these officers to make reports concerning investigation, detection, prosecution, and punishment of crime in their respective jurisdictions as determined by the Attorney General; 3) Amend the county charter. “The California Constitution allows a county charter to provide for the removal of an elected sheriff, as well as other elected officers.
And the attorney general has given an opinion that a county charter may grant a board of supervisors the authority to remove a sheriff for cause by a four-fifths vote,” according to County Counsel Castro-Silva; and
4) Civil grand jury. The grand jury can lodge an accusation of willful or corrupt misconduct that leads to a jury trial and conviction.
On July 12, 2022, Board of County Supervisors Holly J. Mitchell and Hilda L. Solis, made a motion (Attachment 2) instructing the Acting County Counsel to take the following actions for the July 26, 2022 Board Meeting:
1) Draft the necessary documents, including an ordinance, to call a special election to be held on November 8, 2022 for the purpose of voting on an amendment to the County Charter that would grant the Board the authority to remove the Sheriff, by a four-fifths vote, for cause defined as a violation of any law related to the performance of their duties as Sheriff, flagrant or repeated neglect of duties, a misappropriation of public funds or property, willful falsification of a relevant official statement or document, or obstruction of any investigation into the conduct of the Sheriff by the Inspector General, Sheriff Civilian Oversight Commission, or any government agency with jurisdiction to conduct such an investigation;
2) Ensure that the proposed County Charter Amendment is clear that it shall not affect the independent and constitutionally designated functions of the Sheriff, and the Board shall not obstruct the investigative function of the Sheriff in criminal matters and any other statutory or constitutional authority or jurisdictional responsibility, nor shall the Sheriff’s exercise of investigative or prosecutorial discretion in criminal matters provide cause for removal; 3) Ensure that the proposed County Charter Amendment clarifies that the Sheriff may be removed for cause, after such Sheriff has been served with a written statement of alleged grounds for such removal and such Sheriff has been given a reasonable opportunity to be heard in the way of explanation or defense; 4) Ensure that the proposed County Charter Amendment is clear that should any provision or part of the proposed County Charter Amendment be found unconstitutional or invalid, it would be severable, and its invalidity or unconstitutionality shall not affect the remaining provisions or application, which would be implemented without the invalid or unconstitutional part; and Meeting Date: July 19, 2022
5) Ensure that the proposed County Charter Amendment is clear that should another proposed County Charter Amendment with conflicting provisions appear on the same ballot, and each proposed County Charter Amendment receives a majority of votes, the proposed County Charter Amendment with the highest affirmative vote shall prevail. (22-2661)
The motion on July 12, 2022 passed by a 4-1 vote, with Supervisor Barger dissenting.
This item is expected to return on July 26, 2022 for the Board of Supervisors to decide whether or not a special election will occur on November 8, 2022 to amend the County’s Charter.
Mayor Bosse and Councilmember Mirisch are requesting the City Council consider sending a letter of opposition to the proposed County Charter amendment as there are already processes in place for removing a duly elected official, including the Sheriff, from service.
FISCAL IMPACT
The resources required to implement the recommended action are contained within the City of Beverly Hills adopted FY 2022-23 budget.

RE: Oppose Conducting a Special Election on November 7, 2022 for the Purpose of Amending the Los Angeles County Charter Granting the Los County Board of Supervisors the Authority to Remove the Sheriff by a Four-Fifths Vote for Cause Dear Chair Mitchell:
The City of Beverly Hills strongly opposes the motion before the Los Angeles County Board of Supervisors (“Board of Supervisors”) on July 26, 2022, which would authorize a special election on November 7, 2022, for the sole purpose of amending the Los Angeles County Charter granting the Board of Supervisors the authority to remove a duly elected Sheriff from their office by a four-fifths vote for cause. Our City believes the proposed charter amendment usurps the will of the registered voters in Los Angeles County by providing an anti-democratic process for removing a duly elected Sheriff from their position.
By state law, the Sheriff is an elected positon in all 58 counties in California. All elected officials are subject to recall in the state of California, including the Sheriff. For Los Angeles County, any qualified voter can initiate the recall of an elected official by following the steps outlined by the Los Angeles County Registrar’s Office. This includes gathering 567,857 valid signatures on a petition calling for the recall of the elected official. Additionally, there are three other ways to remove a Sheriff from office. They are:
1) Through the election process whereby the Sheriff is not reelected; 2) Convening a civil grand jury; and
3) Using the authority vested in the state attorney general, who has legal authority over all 58 sheriffs and district attorneys in the state.
Many of the “just cause” statements outlined in the charter amendment are overly broad, and undefined which could lead to the Board of Supervisors, who politically disagree with the Sheriff, to remove the Sheriff from office. This is a cause for great concern to our City as the voters of Los Angeles County place the Sheriff in office, not the Board of Supervisors.
In a county with 5.7 million registered voters, consolidating the ability to remove the Sheriff by a fourfifths vote of the Board of Supervisors is an affront to democracy and akin to overriding the will of the people. By placing this charter amendment on the November ballot, the Board of Supervisors is granting themselves broad latitude to override the choice of the voters in Los Angeles.
Additionally, the proposed charter amendment appears to undermine the role of the Sheriff and renders the office subordinate to the Board of Supervisors. If the Board of Supervisors truly believes the Sheriff has conducted any of activities listed under the “just cause” statements, then it has several other avenues for ending a Sheriff’s term early without needing a charter amendment.
For these reasons, the City of Beverly Hills must OPPOSE the motion before the Board of Supervisors on July 26, 2022 to authorize a special election on November 7, 2022, for the sole purpose of amending the DRAFT
July 19, 2022
Los Angeles County Charter granting the Board of Supervisors the authority to remove a duly elected Sheriff from their office by a four-fifths vote for cause.
As such, our City respectfully requests you vote “NO” on this item when it comes before you.
Sincerely,
Lili Bosse
Mayor
