INTRODUCTION
Each year, the City Clerk’s Office opens a bidding process for legal advertising and notices, per California Public Contract Code Section 20169. While not a requirement, the City has historically also included display advertising as part of the overall annual bid process. As defined in Section 6008 of the Government Code, locally adjudicated newspapers of general circulation are invited to participate in the City’s annual bid solicitation for newspaper advertising.

City Council Ad Hoc Committee Fiscal Year (FY) 2022-23 Newspaper/Advertising Bid Direction:

The City Council Ad Hoc Committee Liaisons (Vice Mayor Bosse and Councilmember Friedman) met with all three newspaper representatives on August 24, 2022 at which the following direction was provided for the FY 2022-23 Newspaper/Advertising Bid:

1. Ad Placement. The City’s Legal or display advertisements shall be inserted with best effort upfront within pages 1-10 or in the first half of the newspaper if the newspaper is greater than 20 pages. Exceptions include last minute advertisements in which case, placement can be based on availability of space and with the mutual agreement by City. Other exceptions include legal square inch/classified ads such as full length ordinances, full length resolutions, and certain Requests for Bids which are normally placed in the back pages/classified section of a newspaper.

2 2. FY 2022-23 Schedule of Rates. Based on staff’s review of invoices received for FY 2021-22, the City Council Ad Hoc agreed eliminate Price Per Column Inch rates and to request qualifying newspapers provide bids for:

1.) Display rates in both black and white and in color for ¼, ½ and full page advertisements (Modular Rates); and

2.) Back page/classified ads are not specifically requested to be printed using the modular rate and are only provided in black and white as they do not contain graphics (Per Legal Square Inch/Classified Rates).

3. Independent Verified Circulation Audit. As has been followed in previous bid solicitations, all proposers were required to furnish an independent verified circulation audit completed within the last twelve (12) months. Exempt from this requirement are any bidders who submitted a verified circulation audit to the City of Beverly Hills in connection with a previous bid if the previously submitted audit was completed within the twenty-four (24) months prior to the Date of Request of the Request for Bid.

The City Council Ad Hoc agreed that the results of each newspaper’s independent verified circulation audit will factor heavily in the evaluation criteria of the FY 2022-23 Newspaper/Advertising Bid. Any newly furnished audits must be for a period of one full year (12 months) and must include the following standard information:
a. Distribution by Zip Code
b. Distribution by County
c. Average Net Press Run
d. Controlled Distribution Data and Returns
e. Paid Distribution Data and Returns
f. Carrier Delivery Rate and average number of subscriptions g. Mail Rate and average number of subscriptions

4. Online Metrics. Given the challenges for all qualifying newspapers to provide online metrics data that can be fairly compared, the City Council Ad Hoc Liaisons agreed that if available in the independent verified circulation audit, it include the following online metrics. a. Audited Average Website Reporting
b. Audited Online/Digital Edition Reporting
c. Text Media
d. Social Media
e. Email Media
The City Council Ad Hoc Liaisons also agreed to require all independent verified circulation or (Certified Verification Council) CVC audits furnished for future Legal and Advertising Request for Bids to include the listed online metrics data beginning with the FY 2023-24 Legal and Advertising Request for Bids (RFB). The CVC is the auditor that provides the Courier’s and the Weekly’s audits.

5. Remaining Status Quo: The City Council Ad Hoc Liaisons agreed that each qualifying bidder must continue to provide:
a. A valid certificate of adjudication;
b. A map of the newspaper delivery area; and

3 c. Sample advertisements: notices of public hearing, notice to bidders, and an ordinance or resolution.

DISCUSSION
Background and FY 2022-23 Newspaper/Advertising Bid Results:

On September 9, 2022, the City Clerk’s office received three responses to Bid RFB# 23-070-01 with an option for Citywide display advertising for Fiscal Year (FY) 2022-23 from BH Courier Acquisition, LLC (Courier), the Beverly Hills Weekly (Weekly), and the Beverly Press/Park La Brea News (Beverly Press). There were no other bids received for consideration.

All bidders were requested to furnish the following major sections with their FY 2022-23 bid response:

1. Introduction Letter

2. Certificate of Legal Adjudication

3. Independent Verified Circulation Audit (and if available within the audit, online metrics)

4. Advertisement samples

5. Project Management Plans

6. Cost Proposal

7. Map of newspaper’s delivery service area

8. Additional information including up to five (5) additional pages which may include any deviations from the requirements listed above
Details for each of these items are provided in the Advertising and Notices Bid Results report (see Attachments 1, 2 and 3). The following should be noted:
 All three publications are legally adjudicated and are eligible to receive legal advertisements from the City of Beverly Hills.
 The Courier and the Weekly previously submitted an independent verified circulation audit with the FY 2021-22 Bid. The Press submitted an audit report via the Los Angeles Times from the Alliance for Audited Media (AAM), the newspaper in which their publication is inserted. For the FY 2022-23 Bid and per the City’s audit submission guidelines, those previously submitted audits must be no older than August 29, 2020.

Press 12 months ended March 31, 2019 (Same as FY 2020-21) The Courier and the Weekly were not required to provide independent verified circulation audits for the FY 2022-23 Bid.

At the May 4, 2021 City Council Study Session meeting, the City Council requested that the Press obtain an independent verified circulation audit for the FY 2022-23 Bid separate from the Los Angeles Times audit. The Press agreed, and at the time shared that their audit would be conducted from September through December 2021 with a final report in the first quarter of 2022.

4 Because the Press’s previously submitted bid expired prior to August 29, 2020 and belonged to the Los Angeles Times, a new independent verified circulation audit was expected for this year.

Subsequently, staff was informed that the Press is in the middle of a three-month audit which is scheduled to conclude at the end of September 2022. For the FY 2022-23 Bid, the Press provided with their bid a letter from the CVC verifying the audit is in progress.

The Press also submitted a partial audit report from the Alliance for Audited Media (AAM) via the Los Angeles Times. The documentation they provided was insufficient for this year’s bid.
 All three publications submitted on online readership data procured outside of their independent certified audits. We were unable to fairly compare the information because the data is retrieved from varying sources. However, copies are included under Attachment 8 of each newspaper’s bid.

FISCAL IMPACT
Total spent on Advertising for FY 2021-22 was $499,263 of which the Courier received 53%, the Weekly 28% and the Press 19%. The total spent for legal advertising for FY 2021-22 was $136,153 of which the Courier received 63%, the Weekly 28% and the Press 9%.

Graph 1 is a comparison of the City’s legal advertising expenditures for fiscal years 2019-20, 2020-21 and 2021-22. The Beverly Press was not adjudicated until 2021, which is why they are not included in FY’s 2019-20, 202021 on this chart. Graph 2 is the comparison of the total Citywide display advertising expenses with the Courier, Weekly, and Beverly Press for fiscal years 2019-20, 2020-21 and 2021-22.

The City Clerk’s FY 2022-23 legal advertising budget is $112,482. The City’s display budget is $452,858. The total budget inclusive of legal and display advertising is $565,340.

The budget for legal advertisement will continue to be managed through the City Clerk’s Office, while the budget for display advertisements will be managed through the Communications Office.

Funding is currently available for the City’s overall advertising expenses. Should there be a need for additional funding, an appropriation will be brought to Council at a future date.

RECOMMENDATIONS
Pricing and Billing
Staff recommends the following with regard to pricing and billing: For all Back Page/Classified ads the newspaper shall charge the City the lesser of two rate calculations:
a. The Per Legal Square Inch/Classified Rate for the entire ad; or b. A combination of the modular rate plus the Per Legal Square inch/Classified rate for any remainder of the ad that exceeds the modular space page.

Award of Contract Staff Recommendation
The City is not required to award the contract to the lowest bidder. The Public Contract Code requires annual bidding, but is silent with respect to the bidding methodology. Hence, it is left to the discretion of the City Council as the legislative body to determine the best bid, considering price and other matters affecting the value to the constituents, including newspaper circulation.

The City can contract with any qualified newspaper if advertising in them will best suit the needs of the City. Legal advertisements must be placed in adjudicated newspapers within the City of Beverly Hills. 168,761

6 Based on the information received during the FY 2022-23 Bid process, it is recommended that the City Council award the FY 2022-23 Newspaper Advertising Bid to the Courier because it offers the most cost-effective pricing per reader with the highest circulation within Beverly Hills among the three newspapers. It is also recommended that the City Council agree to enter into a separate legal and display advertising agreement with the Weekly.

Additionally, staff recommends the City Council reject the bid received from the Press due to lack of information per the criteria listed as set forth. The City Council does have an option to enter into an agreement with the Press, separate from the bid for legal and display advertising should there be an interest.

The City had agreements with all three newspapers which expired on June 30, 2022. Should the City Council approve any and/or all newspaper agreements, it/they will be retroactive to July 1, 2022. If the City Council opts to reject the Press’s FY 2022-23 Bid, all monies owed to date will be paid, but no further ads will be placed until an agreement has been set with the City.

Request for Direction
Staff respectfully requests:
 The City Council accept the Advertising and Notices bids from the Courier and the Weekly.  The City Council reject the Advertising and Notices bid from the Press.  Based on a combined formula of circulation and costs, the City Council award the Advertising and Notices Bid to the Courier for FY 2022-23.  The City Council approve the pricing and billing recommendation.  The City Council contract with the Courier and Weekly by choosing one of the three options:
a. Option 1: Award a contract for all legal ads and display ads to the Courier. Contract with the Weekly only for display ads.
b. Option 2: Award a contract for all legal and display ads to the Courier. Contract with the Weekly for display ads and legal ads at the City’s option. c. Option 3: Distribute the rate based on average circulation criteria from the audits, award a contract for all legal and display ads to the Courier. Contract with Weekly for display ads and legal ads at 60% of the Courier’s rates.  The City Council direct the agreements with the Courier and the Weekly for FY 2022-23 be retroactive to July 1, 2022.
 The City Council direct to pay the Courier, Weekly, and Press for advertising invoices placed between July 1, 2022 and October 11, 2022.

Pending City Council direction, it is expected that the City Council will award the bid and formally approve the agreement(s) at the Tuesday, October 11, 2022 City Council Regular Meeting.

FY 2022-23 CIRCULATION AND PROPOSED OPTIONS
1 Prior to 2021, the City only had two qualified newspapers. The formula for awarding of the Bid and the separate agreements was historically based on total distribution within Beverly Hills. The City traditionally awarded a percentage of the winning Bidder’s rates to the other qualified paper based on weekly circulation within Beverly Hills. For example: if the Bid winner charges a rate of $100, and the other qualified paper has 65% the bid winner’s distribution, then the other qualified paper would be eligible to charge a rate of $65.

At the July 27, 2021 Study Session Meeting, City Council agreed to award the FY 2021/22 Bid to the Courier and opted to enter into separate legal and display advertising agreements with the Weekly and the Press. City Council also agreed to publish legal advertisements in the Press at half the frequency they are published in the Weekly.

Staff recommends the City Council choose one of the options presented in Attachment 1. The Press has not been included as they submitted a partial audit that not contain enough data.

It should be noted that the budget does not guarantee the full amounts listed be paid to any of the newspapers. Payments will be based on the advertisements placed and the agreed pricing for each type of advertisement.

Circulation: Based on the Circulation data, the Weekly is 60% (14,860) of the Courier’s (24,600) weekly distribution in Beverly Hills. Should City Council be interested in including audiences outside of Beverly Hills, the Weekly is 37% (14,860) of the Courier’s 40,000 weekly distribution.

The Courier and the Weekly will each receive their desired rates for legal and display ads. The Courier will receive 100% of the City’s legal ads. The City will have the option to place legal advertisements in the Weekly.

Option 3: Distribute the rate based on audited circulation.

The CVC audit provided by the Courier and the Weekly focus on circulation in three categories:
(1) the number of publications distributed to City residents; (2) the number of publications distributed within Beverly Hills (residents and businesses); and (3) the number of publications distributed within and outside of the City. In each category the Courier has a higher circulation and the Weekly’s circulation, expressed as a percentage compared to the Courier’s circulation is summarized in the Circulation chart below.

On average from the three circulation criteria, the Weekly’s circulation is approximately 60% of the Courier’s circulation. This option involves awarding legally required and display ads to the Courier at the full rates they submitted, and contracting with the Weekly for the same ads, with the Weekly receiving 60% of the Courier’s submitted rates.

Beverly Hills Courier -Beverly Hills, CA -01-0989 -Supplemental Readership Study The Circulation Verification Council surveyed Beverly Hills Courier readers in the primary market areas indicated in publication’s CVC audit report. The purpose was to identify the number of individuals who indicate they have read at least two of the last four issues of the publication, and gather study information solely for advertising purchase evaluations. Market statistics estimates appearing in CVC reports, when available, are obtained from EASI Software. CVC study sources can include, but are not limited to, residential and cell phone surveys, online surveys, email surveys, and/or social media surveys. Study source data can include, but are not limited to, residential phone listings, cell phone exchanges, publisher delivery lists, opt-in email, online, and/or social media databases. Residential and cell phone survey populations consist of adults age 18 and over, living in households within the survey area. Within this area, each individual had a known (or “non-zero”) probability of being selected for the random sample. Surveys were conducted solely with pre designated respondents and no substitutions were permitted. Initial survey attempts were spread evenly across all survey days (i.e., Tuesday through Saturday). A minimum of 250 completed surveys, or 2.5% of net circulation for publications under 10,000 circulation is required with no more than one survey per household. Survey Procedures: To ensure the highest degree of comparability and to facilitate the survey process, a standard, consistent, specified list of questions was asked. Surveys were conducted over a minimum period of two weeks to minimize the impact of weather and/or special circumstances. Every effort was made to ensure that surveys were assigned randomly by day and that an approximately equal number of surveys were completed on each survey day. Where appropriate, data was balanced and/or weighted by ZIP code using up-to-date known demographics: gender, age, number of adults in household and ethnicity in those cases where one minority comprised no less than ten percent of the total population. Non-responses to any single question were eliminated from the survey. In all cases, at least four attempts were made to contact all pre-designated respondents. Every effort was made to surmount language, cultural, behavioral and other barriers to a successful survey; and to the extent feasible, contact attempts were scheduled on a random basis. During the survey process, no questions were asked prior to the readership question, with the exception of a qualifying question designed to determine the ZIP code of the individual; and a general warm-up call explanation designed to put the respondent at ease. Warm-up questions did not include any reference to a publication itself or the nature of the study information. The study followed recommended guidelines developed in part from established media usage and evaluation guidelines. Survey totals may not equal 100% due to rounding. The Circulation Verification Council estimates that all the information in this survey has a maximum error margin of +/-4% at the 95% confidence level. 278 Survey respondents were interviewed during the verification of carrier delivery and mail distribution. Four (4) survey respondents reported reading a minimum of two of the last four issues through single copy, controlled bulk, or pass along distribution. 124 Survey respondents responded to a geo-coded outbound email verification. The much-anticipated Louis Vuitton Men’s
Temporary Residency is here, and it couldn’t
have come at a more auspicious time. Beverly
Hills has come alive in the past week, as
outdoor dining returned after a two-month
stay. Sidewalks are busy, spirits are high and
the Louis Vuitton installation at 468 North
Rodeo Drive is a celebratory backdrop. The
Temporary Residency comes to Beverly Hills
as the last stop in a global rollout. Its raison
d'être is the Louis Vuitton Men’s SpringSummer 2021 Collection, a sensation in its live show debuts in Shanghai and Tokyo
last summer.

In a brief Regular Meeting on Feb. 3, the
Beverly Hills City Council passed a series
of motions that included the extension of
contracts with two private armed security
companies for the next eight weeks. The price
tag for the extension comes out to nearly $1
million. The Council also heard updates on
Kindness Week, which will begin on Feb. 14.
“The City of Beverly Hills has experienced unprecedented protest activity since May 2020 and continues to experience protests for a variety of reasons throughout the Business Triangle and in Beverly Gardens
Park,” a staff report compiled for the meeting reads. “While the City is not anticipating extensive civil protests in Beverly Hills, staff
believes it would be benefi cial for the City
to remain alert and able to respond quickly
to civil protests.”

AN ORDINANCE OF THE CITY OF

BEVERLY HILLS ADOPTING A

MILITARY EQUIPMENT USE POLICY

IN ACCORDANCE WITH ASSEMBLY
BILL 481

THE CITY COUNCIL OF THE CITY OF

BEVERLY HILLS DOES HEREBY ORDAIN
AS FOLLOWS:

WHEREAS, on September 30, 2021,
the State Legislature enacted Assembly
Bill 481 (“AB 481”), adding sections 7070
et seq. to the Government Code, requir- ing law enforcement agencies to obtain approval from their governing body before
acquiring military equipment, as defined by
Government Code section 7070(c); and
WHEREAS, AB 481 requires law
enforcement agencies to obtain approval
from their governing body by an ordinance
adopting a “military equipment” use poli- cy, at a regular meeting held pursuant to open meeting laws, prior to taking certain
actions relating to the funding, acquisition,
or use of military equipment. AB 481 also
requires that in seeking the approval of the
governing body, a law enforcement agency
shall submit a proposed military equipment
use policy to the governing body at a public
meeting and at least 30 days prior to any
such public meeting, the law enforcement
agency shall make the military equipment
use policy available on the law enforcement
agency’s internet website; and
WHEREAS, the Beverly Hills Police
Department currently possesses equipment
that qualifies under the definition of military
equipment pursuant to Government Code
section 7070(c), and wishes to continue to
use such equipment in a responsible man- ner to ensure the safety of the community and its residents; and
WHEREAS, the adoption of the pro- posed military equipment use policy is nec- essary in order to continue the use of such equipment for the purpose of protecting the
safety of officers, residents and visitors in
the City of Beverly Hills; and
WHEREAS, in accordance with
Government Code Section 7071(a)(2), a
law enforcement agency seeking to contin- ue the use of any military equipment that was acquired prior to January 1, 2022, must
commence the governing body approval
process for the military equipment use poli- cy no later than May 1, 2022; and WHEREAS, in accordance with
Government Code Section 7071, the
Beverly Hills Police Department has com- menced the governing body approval pro- cess and has posted a copy of the pro- posed military equipment use policy on the Beverly Hills Police Department’s website
on March 10, 2022. Said posting is more
than 30 days prior to the April 12, 2022 City
Council meeting.

WHEREAS, Ordinance No. 22-O2859 and the proposed military equipment use policy were presented and introduced
to the City Council at the public meeting
held on April 12, 2022, at which time the
public had the opportunity to comment on
Ordinance No. 22-O-2859 and the pro- posed military equipment use policy.

NOW, THEREFORE,
Section 1. The City Council hereby
finds that all of the facts set forth in the
Recitals above are true and correct.

Section 2. Legislative Findings.

Pursuant to Government Code Section
7071, the City Council commenced the gov- erning body approval process prior to May 1, 2022 and considered the adoption of
this Ordinance at a regular, public meeting
on April 12, 2022, and based on the facts
set forth above, the Agenda Report, the
information provided to the City Council at
the public meeting, and the record thereof
which is incorporated by this reference, the
City Council hereby determines and makes
the following findings:

A. The military equipment identified
in Beverly Hills Police Department Policy
706 is necessary because there is no
reasonable alternative that can achieve
the same objective of officer and non-offi- cer safety for the reasons identified in the Beverly Hills Police Department Military
Equipment Inventory; and
B. The proposed military equipment
use policy (Beverly Hills Police Department
Policy 706) will safeguard the public’s wel- fare, safety, civil rights, and civil liberties for the reasons identified in the Beverly
Hills Police Department Military Equipment
Inventory; and
C. The military equipment identified
in Beverly Hills Police Department Policy
706 is reasonably cost effective compared
to available alternatives that can achieve
the same objective of officer and non-offi- cer safety for the reasons identified in the Beverly Hills Police Department Military
Equipment Inventory; and
D. Prior to the adoption of Beverly
Hills Police Department Policy 706, the
Beverly Hills Police Department was
not required to have and did not have
a specific policy relating to the use of
military equipment. Any improper use of
Departmental equipment or alleged viola- tions of Department policies were evalu- ated and reviewed with corrective action taken pursuant to Policy 1010 when appro- priate. After the adoption of this Policy, the designated Military Equipment Coordinator
will ensure future compliance with this
Policy.

Section 3. Pursuant to Government
Code Section 7071, the City Council hereby
adopts the military equipment use policy
entitled Beverly Hills Policy Department
Policy 706 as set forth in the attached
Exhibit A and incorporated by this refer- ence.

Section 4. Severability. If any sec- tion, subsection, subdivision, paragraph, sentence, clause or phrase of this ordi- nance or its application to any person or circumstance, is for any reason held to
be invalid or unenforceable by a court of
competent jurisdiction, such invalidity or
unenforceability shall not affect the validity
or enforceability of the remaining sections,
subsections, subdivisions, paragraphs,
sentences, clauses or phrases of this ordi- nance, or its application to any other person or circumstance. The City Council declares
that it would have adopted each section,
subsection, subdivision, paragraph, sen- tence, clause, phrase hereof, irrespective of the fact that any one or more sections,
subsections, subdivisions, paragraphs,
sentences, clauses or phrases hereof be
declared invalid or unenforceable.

Section 5. Publication. The City
Clerk shall cause this Ordinance to be
published at least once in a newspaper of
general circulation published and circulated
in the City within fifteen (15) days after its
passage in accordance with Section 36933
of the Government Code, shall certify to the
adoption of this Ordinance, and shall cause
this Ordinance and this certification, togeth- er with proof of publication, to be entered in the Book of Ordinances of the Council of
this City.

Section 6. Effective Date. This
Ordinance shall go into effect and be in full
force and effect at 12:01 a.m. on the thir- ty-first (31st) day after its passage.

Section 7. Certification. The City
Clerk shall certify to the adoption of this
Ordinance and shall cause the same to be
published in the manner prescribed by law.

Effective: May 27, 2022

the Civic Center Chilled Water Lines Replacement

responsible bidder, neither the fact of prequalification, nor any prequalification rating, will preclude the CITY from a post-bid consideration and determination of whether a bidder has the quality,
fitness, capacity and experience to satisfactorily
perform the proposed work, and has demonstrated
the requisite trustworthiness.

All qualifications submittals are required to be
submitted electronically via PlanetBids. The
electronic submittal system will close exactly at the
date and time set forth in this request for qualifications.

Any questions regarding the questionnaire
and qualification package should be submitted
via PlanetBids by 2:00PM, September 1, 2022.

Questions sent via email or over the phone; with
the exception of those related to accessing or using
PlanetBids, will not be answered.

Contractors are responsible for submitting and having their documents accepted before the closing time set forth in the request for qualifications.

NOTE: Pushing the submit button on the electronic
submittal system may not be instantaneous; it may
take time for the Contractor’s documents to upload
and transmit before the documents are accepted. It
is the Contractor’s sole responsibility to ensure their documents are uploaded, transmitted, and arrive in
time electronically. The City of Beverly Hills will have no responsibility for documents that do not arrive in a timely manner, no matter what the reason.

The prequalification packages submitted by
Contractors are not public records and are not
open to public inspection. All information provided
will be kept confidential to the extent permitted by
law. However, the contents may be disclosed to
third parties for purpose of verification, or investigation of substantial allegations, or in an appeal hearing. State law requires that the names of
contractors applying for prequalification status
shall be public records subject to disclosure, and
the first page of the questionnaire will be used for
that purpose.

Each questionnaire must be signed under penalty of
perjury in the manner designated at the end of the
form, by an individual who has the legal authority to
bind the Contractor on whose behalf that person is
signing. If any information provided by a Contractor
becomes inaccurate, the Contractor must immediately notify the CITY and provide updated accurate information in writing, under penalty of perjury.

The CITY reserves the right to waive minor irregularities and omissions in the information contained in the prequalification application submitted, and
to make all final determinations. The CITY may
also determine at any time that the prequalification
process will be suspended for the Project and the
Project will be bid without prequalification.

Contractors may submit prequalification packages
during regular working hours on any day that the
offices of the CITY are open. Contractors who
submit a complete prequalification package will be
notified of their qualification status no later than ten business days after submission of the information.

The CITY may refuse to grant prequalification
where the requested information and materials
are not provided by the due date indicated above.

There is no appeal from a refusal for an incomplete or late application, but re-application for a later project is permitted. Neither the closing time
for submitting prequalification packages for this
Project will be changed in order to accommodate
supplementation of incomplete submissions, or late
submissions, unless requested by the CITY in its
sole discretion.

In addition to a contractor’s failure to be pre-qualified pursuant to the scoring system set forth in the prequalification package, a contractor may be
found not prequalified for either omission of or falsification of, any requested information.

Where a timely and completed application results
in a rating below that necessary to pre-qualify,
an appeal can be made by the unsuccessful
Contractor. An appeal is begun by the Contractor
delivering notice to the CITY of its appeal of the
decision with respect to its prequalification rating,
no later than two business days following notification that it is not pre-qualified. The notice of appeal shall include an address where the Contractor wishes to receive notice of the appeal hearing. Without a timely appeal, the Contractor waives any and all
rights to challenge the decision of the CITY, whether by administrative process, judicial process or any other legal process or proceeding.

If the Contractor gives the required notice of
appeal, a hearing shall be conducted no earlier
than five business days after the CITY’s receipt of
the notice of appeal and not later than five business
days prior to the date of the Notice Inviting Bids for
this Project. Prior to the hearing, the Contractor
shall, in writing, be advised of the basis for the
City’s pre-qualification determination.

The hearing shall be conducted by a panel consisting of three members of the Public Works Department senior management staff (the
“Appeals Panel”). The Appeals Panel shall consider any evidence presented by the Contractor, whether or not the evidence is presented in
compliance with formal rules of evidence. The
Contractor will be given the opportunity to present evidence, information and arguments as to why the Contractor believes it should be pre-qualified. Within one day after the conclusion of the hearing, the Appeals Panel will render a written
determination as to whether the Contractor is
pre-qualified. It is the intention of the CITY that
the date for the submission and opening of bids
will not be delayed or postponed to allow for completion of an appeal process.

The verified petition of Michael Villalpando to have the Beverly Press ascertained and established as a newspaper of general circulation came on regularly for hearing by the court on December 8, 2020 in Department 24 of the above-entitled court, the Hon. Patricia D. Nieto presiding.

Petitioner appeared by his attorney, Scott Talkov. Contestant Beverly Hills Weekly appeared through its attorney, Lisa Grace-Kellogg. Contestant Beverly Hills Courier appeared through its attorney, Mark Egerman.

The court finds that the substance of the verified petition and notice of intention of Petitioner to apply to the court on a specifically named day for an order declaring the Beverly Press to be a newspaper of general circulation was duly published pursuant to Sections 6021, 6022 and 6062 of the Government Code.

Evidence having been introduced in support of the verified petition, the matter was submitted for decision and on proof made to the satisfaction of the court, the court finds that Petitioner has met all requirements for adjudication of the Beverly Press in the City of Beverly Hills and County of Los Angeles under Section 6008 of the Government Code as follows:

1. Petitioner is the Publisher of the newspaper known as Beverly Press.

2. The Beverly Press is a newspaper published for the dissemination of local or telegraphic news and intelligence of a general character in the City of Beverly Hills, County of Los Angeles, State of California.

3. The Beverly Press has a bona fide subscription list of paying subscribers in the City of Beverly Hills, County of Los Angeles, State of California.

4. The Beverly Press has been established under that name during the whole of the threeyear period preceding the filing of this petition.

5. The Beverly Press has been published at regular intervals of not less than weekly in the City of Beverly Hills, County of Los Angeles, State of California during the whole of the three-year period preceding the filing of this petition.

6. The Beverly Press has a substantial distribution to paid subscribers in the City of Beverly Hills, County of Los Angeles, State of California.

7. The Beverly Press has maintained a minimum coverage of local or telegraphic news and intelligence of a general character of not less than 25 percent of its total inches during each year of the three-year period preceding the filing of this petition.

8. The Beverly Press’ principal office of publication is within the jurisdiction of the City of Beverly Hills, County of Los Angeles, State of California for which it is seeking adjudication.

WHEREFORE, IT IS ORDERED, ADJUDGED, AND DECREED that the Beverly Press is a newspaper of general circulation, as defined in section 6008 of the Government Code, for the City of Beverly Hills and County of Los Angeles, California.

The Council of the City of Beverly Hills, at its regular meeting to be held on Monday, September 12, 2022 at 7:00 p.m., or as soon thereafter as the matter may be heard, in the Council Chamber of the City Hall, 455 N. Rexford Drive, Beverly Hills, CA 90210, will hold a public hearing to consider:

AN ORDINANCE OF THE CITY OF BEVERLY HILLS

TO AMEND BEVERLY HILLS MUNICIPAL CODE

SECTIONS RELATED TO MEDICAL USE

REGULATIONS APPLICABLE TO CERTAIN

COMMERCIAL ZONES IN THE CITY
Per the direction of the City Council, a draft ordinance to amend the City’s medical use regulations will be presented for first reading. This ordinance is intended to replace the Medical Urgency Ordinance (Urgency Ordinance No. 20-O-2826), which will expire in November 2022. The Planning Commission previously reviewed the draft ordinance at their July 28, 2022 meeting, and adopted a resolution to recommend approval of this ordinance to the City Council. The following is a summary of the regulations that are included in the draft ordinance:
• Allow the conversion of existing commercial space to medical space, and allow medical spaces in newly constructed buildings upon meeting required criteria;
• The conversion of commercial floor area to medical floor area would be permitted ministerially (via a building permit) in the C3, C-3T-1, C-3T-2, C-3T-3, C-R-PD, C-R, C-3A, C-3B, or E-OPD zones; • Require one parking space per 350 square feet of floor area for medical uses (as allowed under the urgency ordinance);
• Prohibit ground floor medical uses located on the ground floor of a building; and
• Prohibit “specialty clinics” in which the primary function is to perform surgeries, but allow a maximum of one operating room for surgical uses that is no more than 10% of the floor area of the entire medical suite in which it is located.

In addition, the ordinance includes language to clean up the medical use code sections and ensure consistency with other sections of the zoning code.

Per the request of the City Council, the ordinance also adds a requirement for these regulations to be reviewed by the Council in approximately five years from its adoption date.

This project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. Since the project is not related to any specific development proposal and do not enable any physical changes in the environment, there is no possibility that it may have a significant effect on the environment. In addition, the project reflects minor changes in land use limitations, and do not result in changes to land use or density. Accordingly, the City Council will consider a recommendation to find the project categorically exempt from CEQA pursuant to Sections 15061(b)(3) and 15305 of Title 14 of the California Code of Regulations because it can be seen with certainty that there is no possibility that a change to the regulations related to medical uses would have a significant effect on the environment.

Written comments will be allowed with a maximum of 350 words, which corresponds to approximately 3 minutes of speaking time. If a comment is received after the agenda item is heard, it will not be a part of the record. Public comment via video conference will be 3 minutes per each individual comment, subject to City Council discretion. Any interested person may participate in the meeting and be heard or present written comments to the City Council.
