INTRODUCTION
Per California Public Contract Code Section 20169, the City conducted its annual bid for legal notices and included display advertising within the bid. This report discusses the City Council direction and staff’s recommendation to award bid no. RFB 23-070-01 to BH Courier Acquisition, LLC and approve agreements and purchase orders with BH Courier Acquisition, LLC and Beverly Hills Weekly to publish City of Beverly Hills legal and nonlegal advertising and notices for Fiscal Year 2022-23.
DISCUSSION
At the September 20, 2022 City Council Study Session, staff presented the Advertising and Notices Request for Bid 23-070-01 (RFB) responses received from BH Courier Acquisition, LLC (Courier), Beverly Hills Weekly (Weekly) and Beverly Press/Park La Brea News (Beverly Press). Representatives from all three papers were present. At the meeting, the following was determined:
The City Council accepted the Advertising and Notices bids from the Courier and the Weekly.
The City Council rejected the Advertising and Notices bid from the Beverly Press due to its failure to submit an independent verified circulation audit report as required. The City Council unanimously agreed to award the Bid to the Courier (at the rates provided in their bid) because it has the highest circulation which was confirmed via their independent verified circulation audit.
Three pricing options were presented to City Council; however, they unanimously agreed to enter into a separate legal and display advertising agreement with the Weekly and directed to award a 4th option (Option D) which is to:
a. Award a contract for all legal and display ads to the Courier; and b. Contract with the Weekly for display ads and legal ads based on the rates that they provided in their bid. (See Schedule of Rates in the Fiscal Impact Section).
The City Council directed both newspapers charge the City the lesser of two rate calculations for all Back Page/Classified ads:
a. The Per Legal Square Inch/Classified Rate for the entire ad; or b. A combination of the modular rate plus the Per Legal Square inch/Classified rate for any remainder of the ad that exceeds the modular space page.
The City Council and both papers agreed to insert with best effort legal or display advertisements upfront in each of their publications within pages 1-10 or in the first half if the newspaper is greater than 20 pages. Exceptions include last minute Meeting Date: October 11, 2022
advertisements in which case, placement can be based on availability of space and with the mutual agreement by the City. Other exceptions include legal/classified ads such as full length ordinances, full length resolutions, Requests for Bids and Request for Proposals.
The City Council directed that all future independent verification circulation audits received from the newspapers have an audit period of the same one full year (12- month period), beginning with the FY 23-24 bid. Staff’s recommendation is that all newspapers obtain and provide an audit for the 12-month period of October 1, 2021 through September 30, 2022. This will not only allow for the same measurement period, but will allow enough time for all papers to complete the audit before next year’s bid process (bid solicitation currently estimated for February/March 2023 for FY 2023-24).
Based on the discussions, it was agreed that all future ads with the Beverly Press will be placed on hold until their audit has been completed. At which point, the City Council Liaisons would provide feedback regarding a separate advertisement agreement with the publication.
Finally, the City Council directed the FY 2022-23 agreements for both newspapers be retroactive to commence on July 1, 2023 and to pay the Courier, Weekly, and Press for advertising invoices placed between July 1, 2022 and October 11, 2022.
FISCAL IMPACT
The City places advertisements in local newspapers based on regulatory requirements or on an as needed basis. The display advertising budget is not solely for the contracted publications in the report and can be used for newspapers and/or other advertisement purposes but will not affect any payments owed to the Courier or Weekly.
Staff is requesting the City Council approve the issuance of FY 2022-23 blanket purchase orders to the Courier totaling $339,348 based on the rates provided. Staff also requests the City Council approve the issuance of FY 2022-23 blanket purchase orders to the Weekly totaling $208,620 based on the rates provided. All BPOs will automatically expire on June 30, 2023. It should be noted that blanket not-to-exceed purchase orders provide for a maximum spending authority and not a guarantee of the dollar value of future spending per vendor. There is funding in the Citywide operating budgets for legal and display advertising expenses.
The budget for legal advertisement will continue to be managed through the City Clerk’s Office, while the budget for non-legal/display advertising advertisement will be managed through the Communications office.
The Courier and the Weekly’s FY 2022-23 Schedule of Rates are provided below. The rates are also listed in Exhibit B of each publication’s proposed agreement.
