Commissioner Meyer returned to the meeting at 1:56 PM.

Commissioner Meyer advised that while item #4 is less than 500 feet from properties in which he has a financial interest, those properties face North Beverly Drive and North Rodeo Drive, rather than Brighton Way. 2. POSSIBLE AMENDMENTS TO THE RENT STABILIZATION ORDINANCE (RSO)

REGARDING SURCHARGES AND THE AMOUNT OF ANNUAL MAXIMUM ALLOWABLE

RENT INCREASES
Staff seeks recommendations regarding possible amendments to the Rent Stabilization Ordinance for both Chapter 5 and Chapter 6 of Title 4 of the Beverly Hills Municipal Code regarding surcharges that allow housing providers to pass through costs to tenants relating to water service penalties and/or surcharges, refuse fees, and for Chapter 5 tenants only, capital expenditures, improvement expenses mandated by law, including seismic retrofit, utility expense, and for additional tenants. Staff also seeks recommendations regarding possible amendments to Chapters 5 and 6 regarding the amount of the maximum allowable annual rent increases. Continued from the August 3, 2022 Rent Stabilization Commission regular meeting.

Staff Presenter: Helen Morales, DPA, Deputy Director of Rent Stabilization Public Input: David Gingold, Michael Hartounian, Anonymous, Frances Harper, Ramin Zar
The Commission received the staff report and public comment, and continued its conversation regarding potential pass through costs. After some discussion, a straw poll was taken to determine if there was general support for recommending pass through costs. The poll result was split 4-4, therefore the discussion continued.

The Commission took a recess at 7:44 PM
The Commission reconvened at 7:56 PM
After continued discussion, the Commission worked toward motion language that would summarize its recommendation to the City Council.

Motion: MOVED by Commissioner Baseman, SECONDED by Chair Tryfman to recommend to the City Council that, with respect to legally mandated costs or improvements, landlords and tenants split such costs 50/50, with the tenants paying their portion over a straight-line depreciation schedule specific to the improvement, at 2% of the rent each month, with an exception for those tenants who are low-income, senior, or disabled.

After additional discussion, which included minor amendments and clarifications to the motion, City Attorney staff member Harris read back the amended motion for the Commission’s consideration.

3. North Canon Dr Closure Extension
Public Works Department Staff Will Update the Commission Christine Chung, Project Manager Public Works, updated the Commission on the North Canon Drive closure extension in addition to the background mural. - July 2018, City Council approved the closure for a minimum of two years to six years (2021 to 2025).
- September 12, 2022, Council approved an extension to June 2023 based on Staff recommendations and stakeholder’s feedback.

The future of the mural was reviewed:
- In April 2019, City commissioned Artist Tomokazu Matsuyama and executed the Artwork contract with the following terms:
o The Artwork is intended to be temporary and will be destroyed upon removal of the wall.
o If the City wishes to preserve, retain, sell, or relocate the Artwork, must first gain approval with the Artist with the request made a minimum 90 days prior to the removal.

o In September 2019, Council reviewed potential options for relocation or repurposing of the mural in the future. High cost of skinning the wall (up to $120,000) and delay in mural schedule.
o Repurposing and conservation of the Artwork in long term with significant expense, almost the same rough costs as the initial painting.
o As it was determined unfeasible with the Artwork Contract Terms, the mural was painted directly onto the wall without skin panels in November 2019. o In the Summer of 2023, City staff will request City Council to consider whether to maintain the N Cañon Dr. Closure with the Mural wall beyond June 2023. If elected not to extend the closure, the wall with the mural will be destroyed. o Wilshire/Rodeo Station is anticipated to open in-service by 2025. The mural will remain in place as long as the sound wall is in place.
o Chair Filipovic commented on the impossibility of creating a moveable wall piece for relocation and suggested the possibility of the City’s schools as they’re additionally going through construction.
o Vice Chair Maralee Beck thanked staff for researching the background on the mural and asked about future temporary sound walls for other street closures.

Staff explained the future areas will need surrounding fencing; not walls. o Ben Johnson, Arts & Culture Manager, recommended documenting a temporary piece of art prior to its leaving the City.
o Staff to return with information on payment of the mural in addition to the policy and protocol of City murals.
