Meeting Date; December 6, 2022

INTRODUCTION
Due to costs associated with changed conditions and necessary design changes, additional funding is required for the Burton Way Median Green Street and Water Efficiency Project. Staff is requesting City Council consider approving the change order to the Los Angeles Engineering, Inc. purchase order #22000877 in the amount of $800,000 and Amendment No. 1 to the contract with Ardurra Group, Inc. in the amount of $137,385 along with a change purchase order to #22001416

DISCUSSION
The Burton Way Median project was awarded to LAE on June 24, 2021 (agenda item attached). The major components included: two 2,300-ft. infiltration swales, three diversion structures, two pre-treatment systems, three pump stations, replacement of 3.7 acres of turf with drought tolerant plants and a 1.1 million gallon underground concrete storage tank. The basic concept behind this project is to divert urban runoff to irrigate the median. With the capacity provided by the storage tank, it is estimated that the system can collect, treat and use up to 19.6 million gallons (MG) of urban runoff per year. Of that amount, approximately 93% or 18.2 MG will be used to recharge the groundwater aquifer and the remaining 1.4 MG will be used for landscape irrigation.

Upon starling physical construction in the median in January 2022, the contractor and Staff began to encounter many project challenges. The major categories are listed below:
1) Soil Export - Special Disposal: The soil to be exported was discovered to have elevated arsenic levels. Therefore, excavated soils could not be exported per the original project scope. The City commissioned Leighton and Associates to perform additional testing of the soil at various locations in the median.

Mitigation of the soil called for the disposal of the top five feet above the storage tank and the top two feet from the drainage swales. Safety protocols were followed during the excavation and loading of the soil. 2) Shoring Modifications: Based on the proximity to other buildings. Staff required LAE to change the shoring for the Rexford diversion structure from a steel plate shoring system with vibratory installation to a beam and lagging system. This modification was done to reduce disturbance and protect buildings in the immediate area.
3) Utility conflicts: These conflicts were encountered when installing the diversion structures and storm drainpipes at Rexford and Foothill Drives, the drainage pipe crossings between infiltration swales at various locations. 4) Design Changes - Storm Drain, PLC, Electrical: Corrections and upgrades are needed in the design and construction of the storm drain system, PLC system including SCADA and the electrical system. The storm drain system required ' changes to the alignments and elevations and additions to the number of manhole structures. The PLC system was upgraded to include fiber connectivity, SCADA and upgraded equipment at the pump stations. The electrical system required modifications due to SCE change service plans and connections.

These modifications required substantial additions of conduit and wiring.

Page 2 of 4 ends

Meeting Date; December 6, 2022
Currently, construction of almost all underground concrete structures is complete including the underground storage tank, three diversion structures, three pump stations, two pretreatment structures, 18 catch basins and six manholes. Other major items completed or near completion include connector siphon pipes between the catch basins, piping for the recirculation system and excess soil export.

The major tasks remaining include:
• Rock swale - Excavation complete, final grading and rock installation remain. • Electrical system - Service to the pump stations and other miscellaneous items. • PLC/SCADA system - Pump station equipment, swale float sensors, fiber optic cables, programming and data connection to the Public Works Building. • Irrigations system - Pump system and valving from the underground water storage, drip system and related SCADA system.
• Landscaping - All planting areas.
• Civil and Traffic signal modifications at Rexford Drive.

Based on the current schedule projection, weather permitting, construction is anticipated to be completed in April 2023. Staff anticipates returning to City Council in June 2023, to accept the work and approve the Notice of Completion for the project.

FISCAL IMPACT
The LAE contract budget, approved on June 24, 2021, is summarized below:

Original Contract $10,175,000
Continoencv 1.017.500
P.O. Total $11,192,500
Proposed CPO 800,000
Proposed PO Total $11,992,500
Funding to accommodate this purchase order included approximately $6.8M in grant funding (Measure W and Prop 1 Dept. of Water Resources) and $4.4M in City funds.

The estimated construction change orders can be categorized as follows:

Shoring Modifications $341,010
Utility Conflicts 111,187
Soil Export - Special Disposal 644,162
Design Changes - Storm Drain, PLC, Electrical 374,358
Miscellaneous 52.691
Estimated Change Order Cost $1,523,408
The estimated total for change order costs to date ($1,523,408) exceeds the contract contingency, ($1,017,500) by approximately $505,908. Therefore, staff seeks a purchase order increase of $800,000 to accommodate the shortfall, other potential change order costs and final quantity adjustments at the conclusion of the project.

On June 1, 2022, Staff approved an agreement with Ardurra Group, Inc. for as-needed construction support in the amount of $99,970. This contract would support the Burton

INTRODUCTION
The City of Beverly Hills is a co-permittee of the 2012 Municipal Separate Storm Sewer System Permit (MS4 Permit). Beverly Hills, Culver City, Inglewood, Los Angeles, Santa Monica, West Hollywood and unincorporated areas of Los Angeles County discharge stormwater runoff to Ballona Creek and are subject to the requirements of the MS4 permit. Collectively, the agencies formed the Ballona Creek Watershed Management Group and developed an Enhanced Watershed Management Program (EWMP) to serve as its regional guidelines for the MS4 permit compliance.

The Burton Way Median was identified in the EWMP as a candidate site for a green streets project for the City of Beverly Hills. The project is intended to demonstrate the functions of green streets and water efficient landscape to the community. The project is also necessary for the City to comply with its stormwater regulations and State mandates for water conservation and water use efficiency.

BACKGROUND
In June 2016, City Council awarded a consulting contract to CWE in the amount of $350,000 to conduct a feasibility assessment including geotechnical and hydrological evaluations and to develop preliminary design concepts for Burton Way median to capture urban runoff for infiltration, groundwater recharge and landscape irrigation reuse.

In August 2017, after CWE completed its feasibility assessment, the City issued a nocost Amendment No. 1 to CWE to further refine and develop additional engineering design alternatives to maximize the project site capacity to capture runoff from the surrounding areas and upgrade existing ADA ramps as part of the project.

On June 2018, City Council approved Amendment No. 2 in the amount of $288,046 for a total not-to-exceed amount of $638,046 to CWE to provide final design, consisting of:

Two (2) 15-ft wide by 2,300-ft. infiltration swales
Three (3) diversion structures (Rexford, Foothill and Oakhurst) Two (2) pre-treatment systems
Three (3) pump stations
Replacement of 3.7 acres of turf with drought tolerant plants

1.1 million gallon concrete underground storage tank
Traffic signals, ADA ramps and crosswalk improvements
Electrical control panels and related appurtenances
On June 27, 2019, City Council approved Amendment No. 3 in the amount of $43,953 for a not-to-exceed $688,046 to CWE to provide design plans for up to 36 curb ramps to meet ADA standards as part of the Burton Way median project.

Design for the project was completed in January 2020, but bidding and construction were placed on hold pending grant funding announcements. The City had applied for grant funding including Prop 1 Round 1 ($2M), Measure W ($5M) and Prop 1 Round 2 ($3.2M) to help fund the project's construction.

Meeting Date: June 24,2021

DISCUSSION
As part of the Burton Way median project, the City has proposed to construct three (3) diversion structures at the intersections of 1) Burton Way and Rexford Drive, 2) Burton Way and Foothill Drive and 3) Burton Way and Oakhurst Drive. Together, the three diversion structures (Rexford, Foothill and Oakhurst) are estimated to provide a total of

60.3 acre-feet ("ac-ft") (19.6 million gallons ("MG")) of urban runoff per year. Of that amount, approximately 93% or 56 ac-ft. (18.2 MG) will be used to recharge the groundwater aquifer and the remaining 4.3 ac-ft. (1.4 MG) will be used for landscape irrigation.

In order to tap into the Rexford, Foothill and Oakhurst storm drain channels and divert urban runoff, the City is required to submit engineering design plans to the Los Angeles County Flood Control District (LACFCD) for review and permit approval. Plans submitted to LACFCD have been approved with no objection. However, the LACFCD requires that the City enter into an agreement taking maintenance responsibilities for the diversion structures upon project completion. The agreement, included with this report, specifies that the City will take responsibility for maintaining the proposed Rexford, Foothill and Oakhurst diversion structures installed as part of the Burton Way median project for City use.

On January 14, 2021, staff presented results of the grants received to the Public Works Commission. The City was awarded $5.7M in total grant funding for two of the three grants - $715,000 for Prop 1 Round 1 and $5M for the Measure W Regional Program.

In addition to the grants from Prop 1 Round 1 and Measure W, the City will be utilizing the Measure W Municipal Program funds estimated at $1.1 M from FY 2019/20 and FY 2020/21 disbursement to supplement the funding for the project.

Overall, $6.8M of outside funding (non-General fund monies) will be used to pay for the Burton Way median project cost.

Upon receipt of the grant funding announcements, staff was directed to advertise the project for bidding. A Notice to Bidders was published in the Beverly Hills Courier and Beverly Hills Weekly on May 6 & 7, May 13 & 14, and May 20 & 21, 2021, including a specialized web-based eProcurement company, PlanetBids.com.

On May 26, 2021, the City received six (6) electronic bids online via PlanetBids. Results received were as follows;

CONTRACTOR BID GRAND TOTAL
Los Angeles Engineering, Inc. $10,175,000.00
Engineer's Estimate $10,200,000.00
C.S. Legacy Construction, Inc. $10,368,717.74
