DISCUSSION
On November 15, 2022, at approximately 8 a.m., Public Works responded to a water main break at the intersection of Coldwater Cañon Drive and Loma Linda Drive.

Coldwater Cañon Drive was reduced to a single lane that was controlled by Traffic Control Officers (TCOs). Staff immediately requested Underground Service Alert markings for utilities in the street, which is a requirement to safely begin excavation of the area. Staff also placed changeable message signage at two locations leading north onto Coldwater Cañon Drive and at one location in the City of Los Angeles leading into Beverly Hills warning drivers of the traffic impacts. Water Operations notified the Los Angeles Department of Water and Power that the interconnect to their system would be opened ensuring water pressure in the area. Public Works staff started isolating the leak by 10 a.m. and started to begin excavation at approximately 1 p.m.

Following staff’s assessment of the extent of work it was determined that the scope of work required specialized equipment and resources to safely perform the work. Staff quickly negotiated a change order with Ferreira Construction Co., Inc.1 (Ferreira) to perform this work. At 3 p.m., after meeting with Ferreira and briefing them on the scope of work, Ferreira began mobilization from their Orange County location and were onsite at approximately 7:30 p.m. Ferreira was able to pinpoint the leak around 10 p.m. and commenced excavation. The 50-year-old 12” steel line was located at a depth of approximately nine feet and situated below two other water lines (12” and 18”) as well as in proximity to a sewer line. The excavation had to be conducted primarily by hand using chiseling tools due to the fact that the backfill consisted of hard cement slurry. The contractor was able to reach the top of the leaking pipe at approximately 6 a.m. on Wednesday November 16.

The contractor continued excavation around the pipe, but was then struggling with water intrusion resulting in the need for Public Works staff to utilize one of the City’s large vacuum tanker trucks in order to keep the excavation clear from water. The contractor completed excavation and cleaning of the pipe and installation of a large clamp on the ruptured area at 5 p.m. on November 16. Public Works staff immediately began flushing the water line for water quality purposes. After proper flushing, which took two hours, staff performed necessary water quality sampling before beginning to restore water service to customers. Beginning at 8 p.m., on Wednesday, November 16, affected residents’ water service was restored with full water service restored by approximately 10 p.m. The contractor completed backfill and temporary paving around 11 p.m. that evening. On Thursday, November 17, final street restoration occurred between 8 a.m. and 4 p.m.

Staff estimates that approximately 211,000 gallons of water was lost during this main line break.

The pipeline will be replaced starting in early 2023, with the Coldwater Cañon Water Main Replacement project; City Council awarded the contract for this work on November 1, 2022. It is critical that the City continue its efforts in replacing aging pipeline infrastructure to ensure there is a reliable system to deliver water to the community. 1 The City currently has a contract with Ferreira for water main replacement projects between Summit Drive and Laurel Way and on Loma Linda Drive.

The water service interruption was resolved as quickly as possible due to the collaborative effort of the Police Department, Policy and Management and Public Works.

Public Outreach
During the duration of this work, staff utilized several methods of communications and outreach to inform the public of the progress.
• Changeable Message Sign trailers placed in Beverly Hills and the City of Los Angeles warning motorists of traffic impacts.
• Door to door notification.
• Nixle alerts.
• Everbridge phone notification system.
• Customer Service call center extending hours.
• Direct calls to residents by Customer Relations staff. • City website updates.

Staff also offered bottled water to those without service and provided over twenty cases of bottled water to residents.

ENVIRONMENTAL ASSESSMENT
The Project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), the State CEQA Guidelines [1] (California Code of Regulations, Title 14, Section 15000 et seq.), and the environmental regulations of the City. The project is exempt from the California Environmental Quality Act pursuant to Public Resources Code Section 21080(b)(2), State CEQA Guidelines Section 15269(b) for emergency repairs to public service facilities necessary to maintain service, and Public Resources Code Section 21080(b)(4) as an action necessary to prevent or mitigate an emergency.

Therefore, it is recommended that City Council find the Project exempt from further review under the provisions of CEQA.

FISCAL IMPACT
The emergency work to be performed will be included as a change order to Ferreira’s contract in the amount of approximately $90,000. The City awarded a contract to Ferreira on July 15, 2021, for the Water Main Replacement project between Summit Drive and Laurel Way and the Water Main replacement project on Loma Linda Drive in the amount of $1,554,091. The existing purchase order, with a contingency of $155,409.10, amounted to $1,709,500.10. Funds to complete this emergency work are available in the existing purchase order through CIP No. 0387.

RESOLUTION NO. 22-R-____

A RESOLUTION OF THE COUNCIL OF THE CITY OF

BEVERLY HILLS DECLARING THAT THE PUBLIC

INTEREST AND NECESSITY REQUIRES CERTAIN WORK
(WATER MAIN REPAIR) TO BE PERFORMED WITHOUT

COMPETITIVE BIDDING PURSUANT TO PUBLIC
CONTRACT CODE SECTIONS 22035 AND 22050, AND

FINDING THE PROJECT EXEMPT FROM THE

CALIFORNIA ENVIRONMENTAL QUALITY ACT
The Council of the City of Beverly Hills does hereby resolve as follows:

Section 1. A water main break on a water line at the intersection of Coldwater Cañon Drive and Loma Linda Drive resulted in the loss of water service to 43 homes in the City of Beverly Hills. The City requires work to be performed immediately to the damaged pipe and reestablish water service to the affected homes.

Section 2. The City entered into an agreement with Ferreira Construction Co., Inc. (“Contractor”) dated July 15, 2021, Agreement No. 283-21 for the Water Main Replacement project between Summit Drive and Laurel Way and the Water Main replacement project on Loma Linda Drive which was awarded to Contractor by competitive written bid. Due to the similar nature of the work under the Agreement, City obtained an estimate based on the Agreement pricing via a written change order to complete these additional emergency services.

Section 3. Due to the emergency situation caused by the water main failure and the loss of water service to 43 homes, pursuant to Public Contract Code Sections 1102, 22035, and 22050, the City Council hereby finds that a situation exists that requires the declaration that the public interest and necessity demand the immediate expenditure of public money for such repair work to safeguard life, health, property, and essential public services without complying with the competitive bidding requirements of the Public Contract Code. This emergency situation will not permit (1) a delay resulting from a competitive solicitation for bids; and (2) the preparation of adequate plans and specifications to allow competitive bidding. These findings are based on the agenda report accompanying this item, and any additional information presented at the City Council meeting when this resolution was considered.

Section 4. The City Council hereby acknowledges that it must approve this resolution by a four-fifths vote of the entire City Council.

Section 5. The City Council hereby waives competitive bidding under Public Contract Code 22050 and authorizes the City Manager to execute all necessary contracts and documents with a qualified contractor(s) or vendor(s) for installation of water mains.

Section 6. The City Council hereby finds that the project is exempt from the California Environmental Quality Act pursuant to a) Public Resources Code Section 21080(b)(2) as an action necessary to make emergency repairs to public service facilities necessary to maintain service, and, as a separate and independent basis b) State CEQA Guidelines Section DocuSign Envelope ID: AF4128E3-747B-4EA5-BDA8-8A9DF61CBE7C B0785-0001\2747599v3.doc
15269(b) because the emergency repairs to publicly owned service facilities are necessary to maintain service essential to the public health, safety or welfare, and, as a separate and independent basis. c) Public Resources Code Section 21080(b)(4) as an action necessary to prevent or mitigate an emergency.

Section 7. The City Clerk shall certify to the adoption of this resolution and shall cause this resolution and this certification to be entered into the Book of Resolutions of the Council of the City.
