AGENDA REPORT
Meeting Date: January 3, 2023
Item Number:

To: Honorable Mayor & City Council
From: David Yelton, Assistant Director/City Building Official Arlen Eskandari, Supervising Plan Review Engineer
Subject: RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY HILLS

MAKING EXPRESS FINDINGS AND DETERMINATIONS THAT
MODIFICATIONS TO THE 2022 CALIFORNIA BUILDING

STANDARDS CODE ARE REASONABLY NECESSARY BECAUSE

OF LOCAL CLIMATIC, GEOLOGICAL OR TOPOGRAPHICAL

CONDITIONS
Attachments: 1. Resolution

2. Original Resolution No. 22-R-13434

RECOMMENDATION
Staff recommends that the Council repeal Resolution 22-R-13434 and adopt the updated Resolution making express findings and determinations that modifications to the 2022 California building standards code including appendices, are reasonably necessary because of local climatic, geological, or topographical conditions, and instruct the City Building Official or his designee to file the most recent adopted Resolution of findings with the California Building Standards Commission (CBSC).

INTRODUCTION
findings and determinations that modifications to the 2022 California building standards code, including appendices, are reasonably necessary because of local climatic, geological, or topographical conditions, which were filed with the CBSC.

As required by State law, staff filed the adopted Ordinance and Resolution with the CBSC. The CSBC notified the City that the Resolution with findings was received.

The CBSC requested the City also make express findings for those specific model code appendix chapters that the City Council adopted by Ordinance on November 15, 2022. Staff has prepared an updated Resolution that includes the findings and determinations for all modifications to the 2022 California Building Standards codes including the appendix chapters.

DISCUSSION
As part of a triennial cycle, the State adopts and publishes a new California Building Standards Code in the California Code of Regulations (Title 24) every three years which includes the following:
2022 California Administrative Code CCR Title 24 Part 1 2022 California Building Code CCR Title 24 Part 2
2022 California Residential Code CCR Title 24 Part 2.5
2022 California Electrical Code CCR Title 24 Part 3
2022 California Mechanical Code CCR Title 24 Part 4
2022 California Plumbing Code CCR Title 24, Part 5
2022 California Energy Code CCR Title 24 Part 6
2022 California Historical Building Code CCR Title 24 Part 8 2022 California Fire Code CCR Title 24 Part 9
2022 California Existing Building Code CCR Title 24 Part 10 2022 California Existing Building Code CCR Title 24 Part 11 2022 California Referenced Standards Code CCR Title 24 Part 12 State law establishes that the latest edition of Title 24 is the applicable code for all building occupancies throughout the state. The 2022 edition of Title 24 was published on July 1, 2022 by the California Building Standards Commission (CBSC) with an effective date of January 1, 2023.

The state allows the City of Beverly Hills to amend provisions of Title 24 provided that any amendments to building standards are more restrictive than Title 24 building standards and an express finding is made that each such amendment is reasonably necessary because of local climatic, geological, or topographical conditions. The City's amendments must be specific to an edition of Title 24. Thus, with each new edition of Title 24, the City Council is required to adopt these amendments by local ordinance. After adoption, these amendments with the required findings must be filed with the California Building Standards Commission to become effective.

On November 15, 2022, the City Council held a public hearing and adopted Ordinance 22-O-2868, containing all of the City’s amendments to the building standards. At that same meeting, City Council approved Resolution 22-R-13434, which made findings for each of the amendments but not for the adoption of model code appendices. Based on recent litigation, the CBSC has advised that cities with local amendments to the State’s 2022 California building standards code to also adopt findings for the model code appendices.

To provide for improved consistency, recordkeeping, and public transparency, staff is recommending that rather than submit a new addendum Resolution with findings for only the appendices, that the City Council repeal the original Resolution Meeting Date: January 3, 2023

Page 3 of 3 ends

No. 22-R-13434 and adopt a new comprehensive Resolution containing all findings and determinations.

Once adopted, Staff will file the new Resolution with the Building Standards Commission at which time the City’s local amendments will become effective.

DocuSign Envelope ID: 7D5FF4DA-5B8B-45BC-9BB2-F1 41 CFAB236D RESOLUTION NO. 22-R- 13434
RESOLUTION OF THE COUNCIL OF THE CITY OFBEVERLY HILLS MAKING EXPRESS FINDINGS ANDDETERMINATIONS THAT MODIFICATIONS TO THE 2022CALIFORNIA BUILDING STANDARDS CODE AREREASONABLY NECESSARY BECAUSE OF LOCALCLIMATIC, GEOLOGICAL OR TOPOGRAPHICALCONDITIONS.

THE CITY COUNCIL OF THE CITY OF BEVERLY HILLS DOES FIND AND RESOLVE AS FOLLOWS:

Section 1. Recitals
A. Certain building standards and other related model code provisions are adopted and amended by the State of California as the California Building Standards Code and becomeapplicable in the City unless amended by the City pursuant to Health and Safety Code Section 17958.

B. Health and Safety Code Section 17958.5 authorizes the City Council to make reasonably necessary changes or modifications to the State adopted building codes, including the California Building Standards Code, based on certain local conditions.

C. The City ofBeverly Hills has determined and recommended that the modifications to the California Building Standards Code, 2022 Edition, contained herein, are reasonably necessary due to local conditions.

D. Health and Safety Code Section 17958.7 requires the City Council to make express findings of the necessity for modifications to the building standards contained in the California Building Standards Code, 2022 Edition.

Section 2. The City Council of the City of Beverly Hills hereby expressly finds that the amendments and modifications to building standards contained in the 2022 California Building Code, the 2022 California Residential Code, the 2022 California Electrical Code, the 2022California Plumbing Code, the 2022 California Fire Code, the 2022 California Green Building Standards Code, and the 2021 International Property Maintenance Code, as adopted by the City, are reasonably’ necessary due to the following local climatic, geological or topographicalconditions:

A. Climatic Conditions:The City of Beverly Hills is located in an area climatically classified as “semi-arid” and prone to hot and dry Santa Ana winds of high velocity. Moreover, due to the arid nature of thearea, the weather during the windy period tends to be very warm and dry. Furthermore, the CityB0785-000I\27341 85 DocuSign Envelope ID: 7D5FF4DA-5B8B-45BC-9BB2-F141 CFAB236D of Beverly Hills is a densely populated area having buildings and structures constructed within a climate system capable of producing major winds, fire and rain related disasters, including but not limited to those caused by the Santa Ana winds and El Nino (or La Nina) subtropical-like weather.

Because ofthe described climatic conditions, the City and the surrounding cities have historicallysuffered from occasional structural fires. These have often been difficult to control due to the dry winds carrying sparks and cinders to surrounding structures. These winds constitute a contributing factor, which causes small fires originating in high-density development presently being constructed in the City of Beverly Hills, which spread quickly and create the need for an increased level offire protection. This added protection, including, but not limited to on-site protection, will supplement normal fire Department response available in new development, and provide immediate fire protection for life and safety of multiple-occupancy occupants during fire occurrence. The proposed modification delete the exceptions in the code that allows deletion of sprinklers and therefore need to be incorporated into the code to assure that new buildings andstructures and additions or alterations to existing buildings or structures are designed andconstructed in accordance with the scope and objectives of the California Building StandardsCode.

B. Topographical Conditions:

The City of Beverly Hills is a densely populated area having buildings and structures constructed within relatively flat and hilly topography causing structures close to develop heat island conditions due to urban development and therefore needs to be incorporated into the code to assure that new buildings and structures and additions or alterations to existing building or structures are designed and constructed in accordance with the scope and objectives of the California Codes. Traffic and circulation congested in urban areas often place Fire Department response time to emergencies at risk. This condition makes the need for enhanced on-site protection for property occupants necessary. The dry weather conditions, combined with therelatively hilly topography ofthe City is very hazardous to the surrounding highly populated areas in as far as flame spread is concerned. Because of the above-described topographic conditions, the City and the surrounding cities have historically suffered from occasional structural fires. These have often been difficult to control due to the dry winds carrying sparks and cinders to surrounding structures. The proposed modification delete the exceptions in the code and therefore need to be incorporated into the code to assure that new buildings and structures and additions oralterations to existing buildings or structures are designed and constructed in accordance with the scope and objectives ofthe California Building Standards Code.

C. Geological Conditions:

The City of Beverly Hills is a densely populated area located in the greater Los Angeles/Long Beach region having buildings constructed over and near a vast array of fault systems capable of producing major earthquakes, including but not limited to the 1994 Northridge Earthquake. During a major earthquake, emergency resources would be extremely taxed, and theability to respond to such emergencies would be complicated. Local standards in excess ofstatewide minimums will assist in reducing risks associated with earthquakes and the consequent disruption of traffic flow. Due to the large number of tall buildings in this region as well as the increased fire-life safety associated with such a seismic failure, the proposed modification to have -2-
DocuSign Envelope ID: 7D5FF4DA-5B8B-45BC-9BB2-F1 41 CFAB236D a higher minimum base seismic shear consistent with previous editions ofthe building codes need to be incorporated into the code to assure that new buildings and additions or alterations to existing buildings are designed and constructed in accordance with the scope and objectives of the International Codes.

Section 3. Specific Amendments and References to Findings Local climatic, geological, and topographical conditions impact fire prevention efforts, and the frequency, spread, acceleration, intensity and size of fire involving buildings in this community. Further, they impact potential damage to all structures from earthquake and subsequent fire. Therefore, it is found to be reasonably necessary that certain building standards contained in the California Building Standards Code be modified to mitigate the effects of theabove conditions.

California Health and Safety Code Section 17958.7 requires that the modification or change be expressly marked and identified as to which each finding refers. Therefore, the CityCouncil finds that the following table sets forth 2022 California Building and related Codeprovisions constituting building standards that have been modified pursuant to Ordinance No. 22-0-2868, and the associated local climatic, geological and/or topographical conditions described above in Section 2 supporting modification. Administrative revisions are also set forth forclarification. 2022 California Building Code Section Specific Finding-- climatic, added or amended: topographical and/or geological conditions (Section 2):
