INTRODUCTION
Councilmember Mirisch has requested this item be placed on the Council’s agenda to determine if there is Council support to call the subject Planning Commission decision up for review. If the Council orders the review, staff recommends setting the hearing for Tuesday, February 7, 2023.
DISCUSSION
On December 8, 2022, the Planning Commission approved two Hillside R-1 Permits and a Tree Removal Permit associated with the development of a new residence at the project site located at 1510 Lexington Road. The project involves the construction of a new two-story single-family residence with an above-grade floor area of 13,315 square feet (SF) and a 7,824 SF basement. The cumulative floor area of the new residence is 21,139 SF, which includes exemptions for up to 1,600 SF of basement garage and 43 SF for basement mechanical areas. The project site is an approximately 43,860 SF corner lot located on the southeast corner of Lexington Road and Oxford Way, within the Hillside Area of the city, in the R-1.X One-Family Residential Zone.
The Planning Commission’s approval of the requested entitlements allowed for the following activities at the project site:
Hillside R-1 Permits
• The construction of a single-family residence in excess of 15,000 SF of total cumulative floor area, inclusive of the floor area of the basement, first floor, and second floor. The approval allowed for a maximum total cumulative floor area of 21,419 SF.
• The export of more than 3,000 cubic yards (CY) of earth material from the project site. The approval allowed for the export of 3,276.69 CY of earth material from the project site, approximately 276 CY over the maximum allowable export permitted within a five year period.
Tree Removal Permit
• The removal of two existing heritage trees within the front and street side yards of the project site. The approval allowed for the removal of a Victorian Box tree with a circumference of 69” and a Eugenia Tree with a circumference of 94”. The approval did not sanction the prior removal of eight heritage trees; such removals will be subject to administrative remedies outlined in the BHMC.
As part of the Planning Commission’s review of the project, the Commission evaluated whether the project qualified for the exemptions in Ordinance No. 18-O-2751 (the “Basement Ordinance”) for consideration as a “Pipeline Project”. At the Commission meeting on June 28, 2022, the Commission (3-2) determined that the project qualified as a Pipeline Project based on evidence available in the record.
A final, signed copy of the resolution approved by the Planning Commission on December 8, 2022 is attached for reference to provide a more detailed explanation of the Commission’s determination as to the approval that was granted (Attachment 3).
Pursuant to Beverly Hills Municipal Code Section 1-4-201, et seq., the City Council may order a review of any decision made by any commission, board, or official of the city.
Such review may be ordered by motion of the Council duly adopted within 30 calendar days after the issuance of the Planning Commission’s decision on the project, which was made on December 8, 2022. If a review is ordered, the Commission’s action will be stayed until the Council review is final. The process to initiate this review and set a hearing is specifically set forth in the municipal code, and those provisions are provided for reference (Attachment 1).
The decision to order a review at the January 3, 2023 City Council Study Session shall be limited to the question of whether to call the item up for a hearing before the City Council at a future formal meeting because the matter merits review by the Council, and shall not include any evaluation or assessment of the merits or circumstances of the case or the Planning Commission’s action. That discussion would take place at a noticed public hearing at an upcoming Council meeting.
FISCAL IMPACT
The recommendation in this report does not have significant budget or fiscal impacts for the City beyond staff time and noticing costs.
RECOMMENDATION
It is recommended that the City Council make a determination as to whether or not the subject Planning Commission action will be called up for review. If a majority of the Council votes to call the matter up, staff recommends setting the hearing for February 7, 2023.

Unsigned Planning Commission Resolution
RESOLUTION NO. 2010
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF BEVERLY HILLS CONDITIONALLY APPROVING A
HILLSIDE R-1 PERMIT TO ALLOW THE TOTAL
CUMULATIVE FLOOR AREA DEVELOPED ON A SITE TO
EXCEED 15,000 SF, A HILLSIDE R-1 PERMIT TO ALLOW
MORE THAN 3,000 CUBIC YARDS OF EARTH MATERIAL TO
BE EXPORTED, AND A TREE REMOVAL PERMIT TO
REMOVE TWO PROTECTED HERITAGE TREES IN THE
FRONT AND STREET SIDE YARDS OF THE PROPERTY
LOCATED AT 1510 LEXINGTON ROAD. (PL1623294)
The Planning Commission of the City of Beverly Hills hereby finds, resolves and determines as follows:
Section 1. Russell Linch, on behalf of Lexington Prime Estate LLC, (collectively the “Applicant”) has submitted applications requesting approval of two (2) Hillside R-1 Permits to: 1) allow the total of the cumulative floor area developed on a site to exceed 15,000 square feet (SF); and 2) allow more than 3,000 cubic yards (CY) of earth material to be exported from a site in the Hillside Area. Additionally, the Project includes an application for a Tree Removal Permit to allow for the removal of two existing protected heritage trees located within the front and street side yard setback areas. The Project involves construction of a new two-story single-family residence with an above-grade floor area of 13,315 SF and a 7,824 SF basement.
The requested Hillside R-1 Permits will facilitate the construction of a new two-story single-family residence with a total cumulative floor area 21,139 SF and the export of 3,276.69 CY of earth material from the Project site.
Section 2. The Project site is a 43,860 square-foot corner lot that is currently improved with an existing two-story single-family residence and accessory structures located at 2 the southeast corner of Lexington Road and Oxford Way. The Project site is surrounded by singlefamily residential properties to the north, south, east, and west, which consist of one and two-story single-family dwellings within the Hillside Area of the City’s R-1.X, One-Family Residential Zone.
Section 3. This Project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.), and the environmental regulations of the City. The Project qualifies for a Class 3 Categorical Exemption (New Construction or Conversation of Small Structures Facilities) in accordance with the requirements of Section 15303 of the State CEQA Guidelines. This exemption is applicable to the construction of a single-family residence and accessory structures.
The Project consists of the construction of a new single-family residence with a basement, and site improvements consisting of a pool, paving, site walls, and landscaping. Therefore, the Planning Commission finds the Project exempt from further review under CEQA.
Section 4. Notice of the Project and public hearing was mailed on July 8, 2022, to all property owners and residential occupants within a 1,000-foot radius of the property, extended to the block face. An on-site posted notice was displayed on the property beginning on July 8, 2022. On July 28, 2022, August 11, 2022, October 13, 2022, and December 8, 2022, the Planning Commission considered the application at duly noticed public hearings. Evidence, both oral and written, was presented at said hearings.
Section 5. In considering the request for approval of a Hillside R-1 Permit to allow the total of the cumulative floor area developed on a site, in combination with the floor area 3 of all basements on that site, to exceed 15,000 SF, pursuant to Sections 10-3-2502.B. and 10-3- 2550.E. of the Beverly Hills Municipal Code (BHMC), the Planning Commission considered whether it could make the following finding in support of the Project:
1. The development will not have a substantial adverse impact on the scale, integrity, or character of the area
2. The development will not have a substantial adverse impact on the privacy of neighboring properties.
Section 6. Based on the foregoing, the Planning Commission hereby finds and determines as follows with respect to the Hillside R-1 Permit, pursuant to Sections 10-3-2502.B. and 10-3-2550.E of the BHMC:
1. The Project site is located on the southeast corner of Lexington Road and Oxford Way, within the Hillside Area of the city. Development along Lexington Road and Oxford Way is characterized by a mix of one- and two-story single-family residences with level pads at higher elevations than the adjacent streets due to general increasing topography to the north. The Project site is developed with an existing residence that is built to a height of approximately 32’, as measured from the existing level pad of the Project site. The request to allow the Project to exceed 15,000 SF of cumulative floor area will facilitate the construction of a new two-story single-family residence with a subterranean basement. The first and second floors comply with maximum allowable floor area applicable to the Project site for those portions located above grade. The additional floor area will be located within the basement area of the development and will be constructed below grade and out view from adjacent streets. The basement area does not contribute to the overall scale and massing of the streetscape because it will not be visible 4 from Lexington Road or Oxford Way. Additionally, to minimize potential view impacts associated with the height of the Project, the level pad of the Project site will be graded to allow the new residence to sit lower on the Project site than it otherwise would with the current elevation of the existing level pad. Overall, the lowered level pad that the new building will be built on has the effect of reducing the overall scale and massing of the development as viewed from Lexington Road and Oxford Way. Additionally, because of the lowered level pad, the new residence will also appear smaller in scale to neighboring properties in the vicinity of the Project site that are developed with two-story residences, as several of these properties are built on level pads that are higher than the proposed level pad of the Project site. In comparison to the height of the existing residence that is currently developed on the Project site, the new building will be lower by approximately 5’ to 7’ when the grade of the existing level pad is lowered. Therefore, due to the proposed site improvements, location of the additional floor area in the basement, and the reduced height of the residence as a result of a lower level pad, the Project will not have an adverse impact on the scale, integrity, or character of the area.
2. The first and second floors of the Project will be constructed with substantial building setbacks along the Lexington Road and Oxford Way street frontages that assist in reducing the overall scale and mass of the development while providing opportunities to provide additional landscape street in these front and street side yard areas.
A 50’ front setback will be provided along front facing Lexington Road and a 40’ streetside setback will be provided along the Oxford Way frontage. Along the east side of the property, the Project will provide a setback of over 21’ from 1508 Lexington Road to the east and a rear setback of over 114’ from the neighboring property to the south at 916 5 Oxford Way. In addition to the substantial setbacks proposed from the new residence, a new site-wide comprehensive landscaping plan for the project site incorporates new trees, hedges, and site walls to provide increased privacy to neighboring properties and along Lexington Road and Oxford Way. Trees, hedges, and other planting materials will be densely planted throughout the Project site to assist in screening the development and site walls from the street. As such, the development will not have a substantial adverse impact on the privacy of neighboring properties.
Section 7. In considering the request for approval of a Hillside R-1 Permit to allow for the export of more than 3,000 CY of soil from the Project site, pursuant to Section 10-3- 2521 and 10-3-2550.A of the Beverly Hills Municipal Code (BHMC), the Planning Commission considered whether it could make the following finding in support of the Project:
1. The import or export will not create a substantial adverse impact on the surrounding neighborhood. As part of this determination, the reviewing authority shall consider the street widths and street configuration in the neighborhood. The reviewing authority shall also consider haul routes, scheduling, the total number of constructionrelated vehicle trips associated with the Project as a whole, phasing and safety precautions proposed, and any other factors that may impact in the public’s health, safety and welfare.
Section 8. Based on the foregoing, the Planning Commission hereby finds and determines as follows with respect to the Hillside R-1 Permit, pursuant to Sections 10-3-2521 and 10-3-2550.A of the BHMC:
1. The construction of the new single-family dwelling, basement area, pool, retaining walls, and site grading will result in the export of 3,276.69 CY of compacted earth material from the Project site. Based on the information provided in the Construction 6 Traffic Management Plan (CTMP), the excavation of earth material and hauling will occur over a 15-day period using 10-wheel super dump trucks with a capacity of 18 cubic yards.
Hauling activities will occur between the hours of 9:00 A.M. and 3:00 P.M., with each truck filled with approximately 18 cubic yards of earth material. Based on the amount of export proposed, an estimated 183 hauling trips are anticipated to occur. The placement of flaggers along Lexington Road is expected to manage the flow of construction vehicles while providing priority access and maneuvering to motorists within the vicinity of the Project site. The segment of Lexington Road abutting the Project site maintains a street width of 42’ and will provide adequate area for staging of flaggers and vehicular circulation. A review of the construction trip summary for all construction vehicles, including hauling trucks and worker shuttle vans, will conform to the City Traffic Engineer’s recommendations to limit the frequency of trips to eight (8) one-way trips per hour during Phases 1, 3, and 4 of the Project, and 16 one-way trips during Phase 2. As conditioned, the proposed export of earth material from the Project site will not create a substantial adverse impact on the surrounding neighborhood and construction related traffic will be adequately controlled through the construction traffic management plan so that the Project construction traffic will not significantly impact the public’s health, safety and welfare.
Section 9. In considering the request for approval of a Tree Removal Permit to allow for the removal of two (2) existing protected trees within the front and street-side yard area of the Project site, pursuant to Sections 10-3-2901.F and 10-3-2901.G of the BHMC, the Planning Commission considered whether it could make the following findings in support of the Project:
7 1. The removal of the protected tree cannot be reasonably avoided by redesigning the location or nature of any proposed improvements on the property which have caused the need to remove the protected tree.
2. The removal of the protected tree will not have any significant environmental effects or otherwise harm the public health or general welfare.
3. The removal of the protected tree will not significantly and adversely affect erosion, soil retention, or the flow of surface water.
4. The removal of the protected tree will not significantly and adversely affect the aesthetic quality and appearance of the surrounding neighborhood.
Section 10. Based on the foregoing, the Planning Commission hereby finds and determines as follows with respect to the Tree Removal Permit:
1. The protected trees were identified as being in fair to poor condition by the licensed arborist commissioned by the City to prepare a report assessing the health and vigor of existing trees at the Project site. One of the trees to be removed is Victorian Box trees that is located at the corner of the property along Lexington Road and Oxford Way.
The second is a Eugenia tree located in the street-side yard along Oxford Way. The arborist report prepared for the City details that the existing trees are in declining condition, with decay areas throughout the trees and a significant lean due to improper pruning that could make the trees prone to failure. The Victorian Box tree has a trunk circumference of 69” and the Eugenia tree has a circumference of 94”. As such, the declining condition of these trees do not make them suitable candidates for preservation. Furthermore, the proposed site-wide landscape plan includes replacement trees within the front and street side yards to replace the trees that were previously removed and those that are requested for removal, 8 upgrading the overall appearance of the Project site from public view. Therefore, the removal of the protected trees cannot be reasonably avoided by redesigning the location or nature of any proposed improvements on the property, as the extensive site work will further contribute to declining health and condition of the trees.
2. The removal of the protected trees will facilitate the replacement of trees in declining health with new mature trees within the front and street-side yards of the Project site, as well as several other smaller trees of varying species. The replacement trees are conditioned to be of a minimum 84” box size and of a species that is allowable in the City’s Very High Fire Hazard Severity Zone (VHFHSZ). As documented in the arborist report, the existing protected trees are in decline and are experiencing decay throughout.
Additionally, the Eugenia tree proposed for removal has matured with a severe lean that has contributed to its poor structure and has created a hazard in the event that the tree were to fail. The removal of the requested trees and the planting of the front yard with new healthy trees will not create a significant environmental effect to the Project site and properties within the vicinity of the site, and will not cause harm to the public health or general welfare.
3. The Project and associated site improvements will perform land clearing activities and physical upgrades that will provide for improved site drainage systems and on-site water infiltration areas. The removal of the protected trees will not cause erosion of the site or impact the flow of surface water, as any excavation related to tree removal will be remediated through the proposed site grading activities at the Project site. The planting of new site landscaping and trees within the front and street-side yards will include the installation of improved irrigation systems to serve the proposed new planting areas. As 9 such, the removal of the two protected trees will not significantly and adversely affect erosion, soil retention, or the flow of surface water.
4. The landscaping plan for the Project proposes the replacement of the two protected trees with new mature healthy trees within the front and street-side yard setback, as well as a variety of smaller trees throughout the Project site. The replacement trees are conditioned to be of a minimum 84” box size and of a species that is allowable in the City’s Very High Fire Hazard Severity Zone (VHFHSZ). The new trees and associated site-wide landscaping plan will improve the appearance of the site by providing a denser and more substantial amount of trees and planting material. As such, the removal of the protected trees from within the front and street side yards will not significantly and adversely affect the aesthetic quality and appearance of the surrounding neighborhood.
Section 11. Based on the foregoing, the Planning Commission hereby approves the two requested Hillside R-1 Permits and Tree Removal Permit associated with the construction of a new single-family dwelling and associated site improvements at 1510 Lexington Road, subject to the following conditions:
