RECOMMENDATION
It is recommended that the public hearing to be conducted by the City Council regarding adoption of the resolution amending the City’s Schedule of Taxes, Fees, and Charges for Fiscal Year (or “FY”) 2023-2024 be continued to the second meeting in May 2023 to allow for notification requirements pursuant to Government Code Section 66016 (Procedure for Adopting Various Fees) to be met.
INTRODUCTION
The public hearing to adopt the resolution amending the Schedule of Taxes, Fees, and Charges for FY 2023-2024 was to be conducted on April 18, 2023, but is recommended to be continued to allow for notification required by Government Code Section 66016 for certain application and processing fees to be met.
Meeting Date: April 18, 2023
Government Code Section 66016 requires that notice of the time and place of the meeting for the adoption of new fees or increase of existing fees shall be mailed at least 14 days prior to the meeting to any interested party who files a written request with the local agency for mailed notice of the meeting. This notification requirement is in addition to the public noticing via the newspaper or other media required for other types of fees.
DISCUSSION
Prior notification of the public hearing date of April 18, 2023, amending the Schedule of Taxes, Fees, and Charges for FY 2023-2024 was provided to the Beverly Hills Courier on April 6, 2023, and they included this notification in its April 7th publication.
On April 7, 2023, Finance was made aware of a written request previously filed in February 2023 from the Building Industry Association of Southern California, Inc. (BIA) that did not receive 14 days advance written notice of the public hearing on April 18, 2023. Therefore, the meeting must be continued to a date certain to ensure the requested parties receive required notification in compliance with the California Government Code.
Development application processing and similar fees become effective 60 days from the date of adoption. As a result of the request for notification by the BIA and the need to move the public hearing date to the second meeting in May 2023, if approved all development fees will become effective 30 days later in July 2023. All other fees would become effective July 1, 2023, unless otherwise stated.
FISCAL IMPACT
The postponement of development-related fees by fifteen days may result in a small reduction of potential revenue collected for these fees based on the inability to increase these fees by CPI until mid-July 2023.
