AGENDA REPORT
Will Hamilton, Senior Management Analyst
Subject: RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY

HILLS ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR
2023-24 FUNDED BY SB 1: THE ROAD REPAIR AND
ACCOUNTABILITY ACT OF 2017
Attachments: 1. Resolution

RECOMMENDATION

INTRODUCTION
The adoption of SB 1 increased the gallon fuel excise taxes, increased diesel fuel sales taxes and vehicle registration fees and provided for inflationary adjustments to tax rates in future years; these monies are a funding source for agencies to fund maintenance of local street and infrastructure projects. Since November 2017, the State Controller has been depositing portions of these funds into the Road Maintenance and Rehabilitation Account (RMRA). The funds are apportioned by formula to eligible cities and counties for basic road maintenance, rehabilitation and critical safety needs on the local streets and roads system. The California Transportation Commission (CTC) is the agency responsible for administering this program in accordance with the Streets and Highway Code provisions as outlined in SB 1.

DISCUSSION
The SB 1 program guidelines require that eligible cities and counties submit a Resolution each year that includes a project list, even if the project list is the same from prior years.

The table below shows the resolutions previously approved by City Council:

A project from the prior year’s project list – Crescent Drive between Sunset Blvd. and Lexington Rd – was recently completed and has been removed from the list. Staff recommends the following projects be submitted for Fiscal Year 2023/24. • Copley Place Reconstruction
o Project Description: Full reconstruction including demolition of existing roadway, full depth excavation, installation of 8-inch Portland Cement Concrete over 8-inch aggregate base, and replacement of all adjacent curb and gutter.
o Project Location: Copley Place near Copley Drive and Sunset Boulevard • Burton Way Street Improvements
o Project Description: Grind and overlay 2 to 3 inches, replace damaged curb and gutter (as needed), reconstruct ADA ramps, bikeway striping improvements, and pedestrian crossing improvements.
o Project Location:
▪ Burton Way (North side) between North Rexford Drive and Oakhurst Drive
▪ Burton Way (South side) between South Rexford Drive and South Robertson Boulevard
These locations are in accordance with the City’s Pavement Management Plan, which identifies locations in need of street rehabilitation work. In addition to pavement rehabilitation, the Burton Way improvements will include replacing the existing bike lanes with buffered, green bike lanes with protective bollards at certain locations and enhanced intersection treatments.

The City must submit its Fiscal Year 2023/24 project list via an approved Resolution to CTC no later than July 1, 2023, to be eligible for funding. The project list does not restrict the flexibility of an eligible city or county to fund projects in accordance with local needs and priorities, so long as the projects are consistent with RMRA priorities.

Eligible RMRA projects can include, but are not limited to, the following:
• Road maintenance and rehabilitation;
• Safety projects;
• Railroad grade separations;
• Complete street components, including active transportation purposes, pedestrian and bicycle safety projects, transit facilities and drainage and storm water capture projects in conjunction with any other allowable project; and • Traffic control devices.

FISCAL IMPACT
The RMRA program provisions allow agencies to accumulate SB 1 funding from multiple years to help cover the cost of planned projects. The City is currently using a combination of RMRA, Gas Tax, County Transportation Tax and General Fund monies to fund street repaving projects at various locations.

Director of Public Works

The Road Maintenance and Rehabilitation Account (RMRA) funding is an additional revenue source for the maintenance of local streets and roads as a result of SB 1, which the Governor authorized in April 2017. Since the program’s inception, the City has received a total of approximately $3.22 million dollars in RMRA funding, with payments received on a monthly basis. The Fiscal Year 2023/24 allocation for the City of Beverly Hills is projected to be $808,574. This projection was prepared in January 2023, by the California Local Government Finance Almanac based on California Department of Finance statewide revenue.
