INTRODUCTION
This item provides the City Council with the certification of election results from the May 23, 2023 Special Municipal Election as provided by the office of the Los Angeles County Registrar-Recorder/County Clerk.
DISCUSSION
The City of Beverly Hills held a Special Municipal Election on May 23, 2023. There were two measures on the ballot: B and C regarding the Cheval Blanc hotel project.

There were 7,128 (32.17%) votes cast from 22,160 registered voters in the City of Beverly Hills.

This report requests the City Council approve the Resolution certifying the election of May 23, 2023 (see attached) as provided by the office of the Los Angeles County RegistrarRecorder/County Clerk.
On June 2, 2023, the Los Angeles County Registrar-Recorder/County Clerk and Beverly Hills City Clerk’s offices received a request for a recount. Per the Los Angeles County Registrar’s office, the recount does not affect the certification process.
FISCAL IMPACT
A final summary of costs associated with the election are pending receipt and will be provided as the information becomes available.
Additionally, as part of the City Council discussion at both the Study Session and Formal Sessions of February 21, 2023 the Friends of Cheval Blanc Beverly Hills have offered to reimburse the City of Beverly Hills for costs associated with the Special Election. A final invoice will be provided to them upon conclusion of the election process. The City will not need to provide funding for the Special Election.

RESOLUTION NO. 23-R-______
RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY HILLS
RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD IN THE CITY OF BEVERLY HILLS ON MAY 23, 2023, DECLARING THE
RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a Special Municipal Election was held and conducted in the City of Beverly Hills, California, on Tuesday, May 23, 2023, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that a vote center was established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the laws of the State of California for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution Nos. 23-R-1 3450 and 23-R-1 3451, adopted by the City Council on February 21, 2023, the Los Angeles Registrar-Recorder/County Clerk canvassed the returns of the election and has certified the results to the City Council. The results are received, attached and made a part hereof as Attachment 1.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BEVERLY HILLS, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the whole number of precinct ballots cast at the vote centers except vote by mail (absentee) ballots and provisional were 516.
That the whole number of vote by mail and provisional ballots cast in the City were 6,612, making a total of 7,128 ballots cast in the City.
Section 2. That the two measures voted on at the election are as follows:
Measure B: Shall Ordinance No. 22-0-2866 adopted by the City Council and enacting zone changes and corresponding map amendments to permit the Cheval Blanc Hotel which will contain up to 115 rooms, a 500 member private club, and restaurant and retail uses on an approximately 1.28 acre site in the northern portion of the business triangle, be adopted? Measure C: Shall Ordinance No. 22-0-2867 adopted by the Beverly Hills City Council approving a development agreement which vests development rights for the Cheval Blanc Hotel in exchange for public benefits, be adopted?

Section 4. The City Council does declare and determine that: Measure B was not passed and that Measure C was not passed.
Section 5. The City Clerk shall enter into the records of the City Council of the City, a statement of the results of the election, showing: (1) the whole number of ballots cast in the City; (2) the names of the measures voted for; (3) the number of yes votes on each measure; (4) the number of no votes on each measure; (5) the number of votes given at the vote center; and (6) the total number of votes given to each measure.
Section 6. That the City Clerk of this City shall certify to the passage and adoption of this Resolution and enter it into the Book of Resolutions of this City, which entry shall constitute the City Clerk’s statement of the results of the election.
