RECOMMENDATION
Staff recommends that the City Council adopt a resolution conditionally approving a Certificate of Appropriateness to allow a new two-story, 6,883 square-foot addition (the basement is not counted towards floor area) and a new swimming pool for the property located at 910 North Bedford Drive (Anthony-Kerry House, Beverly Hills Landmark No.14), finding the project exempt from the California Environmental Quality Act, and modifying the Cultural Heritage Commission’s April 12, 2023 conditional approval of the Certificate.

INTRODUCTION
On April 12, 2023, the Cultural Heritage Commission (CHC) conditionally approved a Certificate of Appropriateness (C of A) to allow a new two-story addition and a new swimming pool to be added to the historic site located at 910 North Bedford Drive.

Subsequently, on May 2, 2023, the Council unanimously voted to call up the Certificate for a de novo hearing. At its formal hearing on June 6, 2023, the City Council unanimously voted to modify the previously issued conditions of approval memorialized in the resolution approved by the Cultural Heritage Commission. Council directed City staff to prepare a final resolution (Attachment 1 – edited, as directed) and revise the original conditions and grant final project approval, as amended.

DISCUSSION
The City Council held a de novo hearing on June 6, 2023 regarding the CHC’s conditional approval of a C of A to allow a new two-story rear addition and a new swimming pool for the historic site. At that meeting, the City Council considered the staff report and oral testimony and was able to make the necessary findings in support of the C of A. In addition, the Council reviewed the conditions of approval included in the CHC resolution for the project, particularly the condition regarding the removal/modification of a previously approved fence that is currently under construction on site. The City Council directed staff to prepare a resolution memorializing the Council’s approval of the Certificate and not include a condition requiring removal of the subject property fencing.

The resolution states that the perimeter fencing previously approved by the Director can proceed in conjunction with the addition to the property. Additionally, an edit was made to the resolution to provide the correct direction that certain Municipal Code sections were not applicable to the project.

ENVIRONMENTAL ASSESSMENT
The subject project has been reviewed pursuant to the provisions set forth in the California Environmental Quality Act (CEQA – Public Resource Code Sections 21000, et seq.), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.), and the City’s local CEQA Guidelines. The CHC concluded that the subject project is exempt from the California Environmental Quality Act (CEQA – Public Resources Code §§21000 – 21178), pursuant to Section 15331, Class 31 (Historical Resource Restoration/Rehabilitation) of the State CEQA Guidelines in that the project includes the maintenance, repair, stabilization, rehabilitation, restoration, preservation, conservation or reconstruction of historical resources in a manner consistent with the Secretary of the Interior’s Standards for Rehabilitation, the Secretary of the Interior’s Standards for the Treatment of Historic Properties, and the Illustrated Guidelines for Rehabilitating Historic Buildings.

PUBLIC OUTREACH AND NOTIFICATION
Notice of the June 6, 2023 City Council meeting was provided to the property owner and the owner’s representatives on May 3, 2023. No additional noticing is required for the adoption of the City Council resolution.

FISCAL IMPACT
The recommendation in this report does not have significant budget or fiscal impacts for the City.
