RECOMMENDATION
Staff recommends that City Council approve the attached amendment to the Joint Powers Agreement (JPA) between the City of Beverly Hills and the Beverly Hills Unified School District for the first quarter of fiscal year 2023-24 and approve the purchase order for fiscal year 2023-24 for a total not-to-exceed amount of $2,952,981.63. The purpose of the amendment is to extend the current agreement for one quarter into the new fiscal year with the School District while negotiations for a three-year agreement continue to take place.
INTRODUCTION
Both the City and the District have enjoyed a beneficial and respectful relationship over the years through the use of District facilities that benefit both organizations. Much of the formal relationship between the two entities is addressed in an agreement that specifies E-29
Meeting Date: June 27, 2023
mutual responsibilities, uses, compensation, and related issues agreed to and memorialized within a Joint Powers Agreement which, historically, has been termed for three or four years.
A staff working group comprised of key City and District staff was created in December of 2022 with the purpose of meeting regularly January 2023 through May 2023 to review every section of the agreement closely. After months of meetings, both parties are ready to bring forward a draft agreement to their respective Liaisons for review. City Council Liaisons and BHUSD Board members will meet to discuss the terms of the agreement as well as the funding request brought forward by the Beverly Hills Unified School District. The current JPA will expire on June 30, 2023. Staff is recommending extending the current agreement for one quarter while negotiations continue to take place.
DISCUSSION
The amendment which will extend the current agreement will require that core terms of the agreement remain the same. This amendment will extend the current JPA until September 30, 2023, allowing for a City Council Liaison meeting to take place with the BHUSD Board to bring forward the terms of the new JPA to the full City Council for approval. The District will receive a quarter payment of the amount previously negotiated for a total of $2,875,000.00 with an additional $77,981.63 to cover crossing guard expenses for a total not to exceed amount of $2,952,981.63 for the first quarter in fiscal year 2023-24.
FISCAL IMPACT
Staff is requesting for an approval of Amendment No. 1 to the agreement and a purchase order totaling $2,952,981.63 for the first quarter of fiscal year 2022-23.
