RECOMMENDATION
Staff recommends City Council approve Amendment No. 5 for a one-year extension of the agreement with Paymentus Corporation to modernize utility billing payment and notification services and approve a Fiscal Year 2023-2024 purchase order in an amount not-to-exceed $175,000.
INTRODUCTION
The City has contracted with Paymentus Corporation to modernize utility billing payment and notification services since April 10, 2018. City staff recommends the Council approve the amendment to continue these professional services for an additional one year.
DISCUSSION
Paymentus modernizes the City’s customer experience by integrating with the City’s financial system (Tyler Munis), allowing utility billing customers to make payments on the web or using an automated phone system at any time of day. Paymentus provides the ability for utility billing customers to store credit card and e-check information in order to pay bills on a reoccurring basis, allows customers to securely pay over the web or phone 24/7 and provides other user-friendly options to pay and retrieve customer account information. Customers also now have the ability to view their bill image through the software portal. The Paymentus system also allows staff to make automated outbound E-30

reminder calls to customers with past due balances. By continuing services with Paymentus, customers will receive a higher level of service, reduce the number of phone calls customers are required to make, and reduce the amount of late fees customers incur.
Additionally, Paymentus services allow City staff to allocate more time to address complex customer concerns and inquiries. Per Article 3-3-113E of the Municipal Code, Staff believes it is in the City’s best interest to continue using Paymentus services without issuing an RFP since 1) this vendor provides services that are considered specialized and technical; 2) the City uses Paymentus software for utility billing and the software is currently being integrated into the City’s new water use and conservation software.
FISCAL IMPACT
Paymentus charges $0.75 per transaction for credit card/debit card transactions, and passes through all interchange and card carrier fees (Visa/Mastercard/Discover/ American Express). There is a flat fee of $0.50 per eCheck transaction. Annual fees paid are based on the volume of online and phone payment and have increased over time as more customers adopt this method of payment. Funds for these contracts are included within the Finance Department’s existing budget.

AMENDMENT NO. 5 TO THE AGREEMENT BETWEEN THE

This Amendment No. 5 is to that certain Agreement between the City of Beverly Hills (hereinafter called "CITY"), and Paymentus Corporation (hereinafter called "CONTRACTOR") dated April 10, 2018 and identified as Contract No. 144-18, as amended by Amendment No. 1, dated July 30, 2020 and identified as Contract No. 400-20, and as further amended by Amendment No. 2 dated April 1, 2021 and identified as Contract No. 86-21, and as further amended by Amendment No. 3 dated July 12, 2022 and identified as Contract No. 449- 22, and as further amended by Amendment No. 4 dated August 25, 2022 and identified as Contract No. 542-22 (hereinafter collectively referred to as “Agreement”).
RECITALS
A. CITY and CONTRACTOR desire to amend the Agreement, which was previously amended.
B. The parties desire to extend the Agreement for one additional year and compensate CONTRACTOR for the additional services.
NOW, THEREFORE, the parties agree as follows:
Section 1. The Termination Date is hereby amended as set forth on the cover page.
Section 2. The Consideration is hereby amended as set forth on the cover page.

Section 4. Except as specifically amended by prior amendments and this Amendment No. 8, the previous provisions of this Agreement shall remain in full force and effect.
