RECOMMENDATION
Staff recommends approval of a Change Purchase Order to Ferreira Construction Co., Inc. (“Ferreira”) in the amount of $100,000 for a total not-to-exceed amount of $1,909,500.10, which includes funds for extra work due to the realignment of the new water main, contingency for unforeseen subsurface conditions, and additional street pavement along Loma Linda Drive as part of the Easement Water Mains Replacement contract.

INTRODUCTION
In July 2021, the City awarded a contract to Ferreira for the Water Main Replacement Project between Summit Drive and Laurel Way and the Water Main Replacement Project on Loma Linda Drive (Attachment 1). The work at Summit Drive and Laurel Way was completed in April 2022, and the utility investigation at Loma Linda Drive was completed by the first quarter of 2022. Due to unforeseen utility conflicts, design changes were required and an amendment to the State Division of Drinking Water permit was approved in October 2022.

Coincidentally, at around this time, a water main break occurred at the intersection of Coldwater Cañon Drive and Loma Linda Drive. A change order was issued to Ferreira to immediately repair the damaged pipe and re-establish water service to the affected 43 homes in November 2022 (Attachment 2). Following the emergency repair of the water main break, Ferreira successfully completed the replacement of 1,400 feet of the aged 6-inch cast iron pipes with new 8-inch ductile iron pipes by early June 2023. The final street restoration work remains and is currently scheduled for early August 2023.

DISCUSSION
In July 2021, City Council approved the issuance of the Purchase Order for the not-toexceed amount of $1,709,500.10 to Ferreira with the award of the contract.

In January 2023, Change Order 1 (Attachment 3) was executed, and the Purchase Order increased to $1,809,000.10, for extra work required between Summit Drive and Laurel Way, increased material cost with the supply chain restrictions, temporary bypass installation to continue water services to the residents along Loma Linda Drive during construction, and the emergency water main repairs at Loma Linda/Coldwater Cañon.

As the water main replacement at Loma Linda Drive continued in the first quarter of 2023, the project incurred costs due to extra time and material out of the authorized contingency due to unforeseen subsurface conditions and additional design changes with a fire hydrant relocation at the cul-de-sac to prevent impacts by the adjacent private development.

As the new water main is realigned closer to the center of Loma Linda Drive, additional trench areas (about 43% of the full street areas) are required to be restored compared to the original alignment which was closer to the curbs. Considering the street condition with numerous patches from previous utility work and the substantially increased quantity of street restoration due to the utility conflicts, City staff requested an alternative street restoration cost proposal for the full width of Loma Linda Drive.

Ferreira’s alternative proposal for the 2-inch asphalt grind and overlay of the full width of the street is about 10% lower than the estimate based on recent contract prices.

Because the alternative will provide a higher quality finished product and the cost proposal is favorable, staff recommends street restoration of the full width of Loma Linda Drive, excluding 200 feet near the cul-de-sac, which will be paved by the adjacent private development.

The requested change order amount of $100,000 includes the cost proposals estimated by Ferreira for the additional asphalt grind and overlay of full street restoration, the incidental extra time and material costs due to unforeseen subsurface conditions and design revision, and contingency (Attachment 4). This results in a purchase order not-toexceed value of $1,909,500.10.

FISCAL IMPACT
Staff requests City Council approve a change purchase order of $100,000 for a total notto-exceed amount of $1,909,500.10. Funds for this project are budgeted in Fiscal Year 2023/24 Capital Improvement Programs, with 70% of the cost coming from the Street and Sidewalk Improvements CIP #00195 and 30% from the Water Main and Hydrant Replacement CIP #00387, as follows.

INTRODUCTION
The City of Beverly Hills’ water distribution system consists of 170 miles of water mains.

To ensure that the water distribution system remains robust and to minimize future maintenance and replacement costs, the City is planning to replace approximately 540 feet of water main between Summit Drive and Laurel Way and another 1,400 feet of water mains on Loma Linda Drive.

The existing water main between Summit Drive and Laurel Way is an 8-in. cast iron pipe constructed in 1924. In December 2017, the water main ruptured and has since been taken out of service. Replacing the water main with a new 12-in. fusible High Density Polyethylene (HDPE) and Ductile Iron (DI) pipe will give the City the ability to provide the necessary circulation it needs to improve water quality and enhance fire flow requirements in the area of the project.

The existing water main on Loma Linda Drive is a 6-in. cast iron pipe constructed in 1974.

The City no longer installs cast iron pipes in its distribution system and is in the process of phasing out existing cast iron with more resilient materials such as DI, steel or polyvinyl chloride (PVC) pipes. The proposed project in Loma Linda Drive will replace the existing 6-in. cast iron with a new 8-in. DI pipe to ensure additional reliability and enhance the overall distribution of water flows in the area.

BACKGROUND
The City’s 2002 Water System Master Plan established a water main replacement and rehabilitation program to minimize the effects of broken mains, including repair costs and unplanned service interruptions. Main breaks can occur in all types of pipes and in any area of the distribution system. The frequency of main breaks is often directly related to pipe location, age, material and break history.

Based on the criteria established by the City’s Water System Master Plan, it is recommended that the City replace the water main between Summit Drive and Laurel Way and the water main in Loma Linda Drive. These pipelines, constructed of cast iron materials, were installed in 1924 and 1974 respectively. The pipelines range from 6 to 8 inches in diameter, were made of materials the City no longer installs in its distribution system and have exceeded their expected service lives. The water main between Summit Drive and Laurel Way ruptured in December 2017, and has since been out of service.

Meeting Date: July 15, 2021

Page 3 of 3 ends

Engineering survey and design work for these two projects was performed between February 2018 and April 2021 by two firms, Cannon Corporation and CivilTec Engineering, Inc. The two projects were combined into one contract to simplify the bidding and construction management process and to allow for lower construction bids through economies of scale.

DISCUSSION
On June 3, 2021, a Notice Inviting Bids was published on the City’s online bidding portal on PlanetBids.com, in the Beverly Hills Courier and the Beverly Hills Weekly newspapers.

On June 24, 2020, six (6) bids were received online and opened as follows:

Ferreira Coastal Construction Co. $1,554,091.00
Engineer’s Estimate $1,500,000.00
Gentry General Engineering, Inc. $1,611,055.00
Dominguez General Engineering, Inc. $1,647,860.00
MNR Construction, Inc. $1,778,610.00
Cedro Construction $1,908,251.00
Colich & Sons, L.P. $2,256,540.00
Staff evaluated Ferreira Coastal Construction Co.’s bid and conducted reference checks with previous cities and agencies. Staff concludes that Ferreira Coastal Construction Co. is well qualified to perform the required work and all documents submitted are in order.

COMMUNITY ENGAGEMENT
The water main between Summit Drive and Laurel Way and the Loma Linda Drive water main are localized projects primarily impacting only two residents and nine residents respectively within those streets. Public Works staff has been in regular contact with the Summit Drive and Laurel Way property owners since the initial planning of the water main project. Residents at both locations who are impacted by the upcoming project will receive advance notices and continued updates throughout construction.

Staff recognizes the importance of keeping local residents informed of the construction impact of these types of projects. Planned outreach efforts will be conducted before and throughout construction to impacted residents including mailers, door hangers, social media postings and direct, in-person contacts.

ENVIRONMENTAL IMPACT
The project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), the State CEQA Guidelines (California Code of Regulations, Title 14, Section 15000 et seq.) and the environmental regulations of the City. This project qualifies for a Class 1(d) (15301) categorical exemption for existing facilities including rehabilitation of existing public structures to meet current standards of public health and safety such as the replacement of water mains, valves, fire hydrants and other appurtenances in the public right-of-way. Therefore, it is recommended that City Council find the project exempt from further review under the provisions of CEQA.

DISCUSSION
On November 15, 2022, at approximately 8 a.m., Public Works responded to a water main break at the intersection of Coldwater Cañon Drive and Loma Linda Drive.

Coldwater Cañon Drive was reduced to a single lane that was controlled by Traffic Control Officers (TCOs). Staff immediately requested Underground Service Alert markings for utilities in the street, which is a requirement to safely begin excavation of the area. Staff also placed changeable message signage at two locations leading north onto Coldwater Cañon Drive and at one location in the City of Los Angeles leading into Beverly Hills warning drivers of the traffic impacts. Water Operations notified the Los Angeles Department of Water and Power that the interconnect to their system would be opened ensuring water pressure in the area. Public Works staff started isolating the leak by 10 a.m. and started to begin excavation at approximately 1 p.m.

Following staff’s assessment of the extent of work it was determined that the scope of work required specialized equipment and resources to safely perform the work. Staff quickly negotiated a change order with Ferreira Construction Co., Inc.1 (Ferreira) to perform this work. At 3 p.m., after meeting with Ferreira and briefing them on the scope of work, Ferreira began mobilization from their Orange County location and were onsite at approximately 7:30 p.m. Ferreira was able to pinpoint the leak around 10 p.m. and commenced excavation. The 50-year-old 12” steel line was located at a depth of approximately nine feet and situated below two other water lines (12” and 18”) as well as in proximity to a sewer line. The excavation had to be conducted primarily by hand using chiseling tools due to the fact that the backfill consisted of hard cement slurry. The contractor was able to reach the top of the leaking pipe at approximately 6 a.m. on Wednesday November 16.

The contractor continued excavation around the pipe, but was then struggling with water intrusion resulting in the need for Public Works staff to utilize one of the City’s large vacuum tanker trucks in order to keep the excavation clear from water. The contractor completed excavation and cleaning of the pipe and installation of a large clamp on the ruptured area at 5 p.m. on November 16. Public Works staff immediately began flushing the water line for water quality purposes. After proper flushing, which took two hours, staff performed necessary water quality sampling before beginning to restore water service to customers. Beginning at 8 p.m., on Wednesday, November 16, affected residents’ water service was restored with full water service restored by approximately 10 p.m. The contractor completed backfill and temporary paving around 11 p.m. that evening. On Thursday, November 17, final street restoration occurred between 8 a.m. and 4 p.m.

Staff estimates that approximately 211,000 gallons of water was lost during this main line break.

The pipeline will be replaced starting in early 2023, with the Coldwater Cañon Water Main Replacement project; City Council awarded the contract for this work on November 1, 2022. It is critical that the City continue its efforts in replacing aging pipeline infrastructure to ensure there is a reliable system to deliver water to the community.

1 The City currently has a contract with Ferreira for water main replacement projects between Summit Drive and Laurel Way and on Loma Linda Drive.

Meeting Date: December 6, 2022

Page 3 of 3 ends

The water service interruption was resolved as quickly as possible due to the collaborative effort of the Police Department, Policy and Management and Public Works.

Public Outreach
During the duration of this work, staff utilized several methods of communications and outreach to inform the public of the progress.
• Changeable Message Sign trailers placed in Beverly Hills and the City of Los Angeles warning motorists of traffic impacts.
• Door to door notification.
• Nixle alerts.
• Everbridge phone notification system.
• Customer Service call center extending hours.
• Direct calls to residents by Customer Relations staff. • City website updates.

Staff also offered bottled water to those without service and provided over twenty cases of bottled water to residents.

ENVIRONMENTAL ASSESSMENT
The Project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), the State CEQA Guidelines [1] (California Code of Regulations, Title 14, Section 15000 et seq.), and the environmental regulations of the City. The project is exempt from the California Environmental Quality Act pursuant to Public Resources Code Section 21080(b)(2), State CEQA Guidelines Section 15269(b) for emergency repairs to public service facilities necessary to maintain service, and Public Resources Code Section 21080(b)(4) as an action necessary to prevent or mitigate an emergency.

Therefore, it is recommended that City Council find the Project exempt from further review under the provisions of CEQA.

FISCAL IMPACT
The emergency work to be performed will be included as a change order to Ferreira’s contract in the amount of approximately $90,000. The City awarded a contract to Ferreira on July 15, 2021, for the Water Main Replacement project between Summit Drive and Laurel Way and the Water Main replacement project on Loma Linda Drive in the amount of $1,554,091. The existing purchase order, with a contingency of $155,409.10, amounted to $1,709,500.10. Funds to complete this emergency work are available in the existing purchase order through CIP No. 0387.
