RECOMMENDATION
Staff recommends that the City Council approve an agreement with Housekeys, Inc. to provide affordable housing program consulting services. Staff is also recommending that City Council approve a purchase order for a total not-to-exceed amount of $137,300 for the services to be provided for one year, with the option to extend for two additional one-year terms. It is also recommended that the City Council waive the bidding requirements pursuant to Beverly Hills Municipal Code Section 3-3-112 (G), as this agreement is for the provision of professional services.
INTRODUCTION
The agreement between the City and Housekeys, Inc. is to provide consulting services to aid in the administration of the City’s affordable housing program. The need for an affordable housing program is directed by the 2021-2029 Housing Element of the General Plan. The services provided by Housekeys, Inc. will include necessary tasks that need to be completed for the affordable housing program such as: updating the City’s affordable housing guidelines, developing program application and compliance guides for the affordable housing rental and homeownership program, updating Meeting Date: November 7, 2023
preference and priority criteria with the lottery process, including confirmation documentation and procedures, completing annual compliance certification for existing projects and tenants, and ongoing day-to-day program administrative services during a one-year contract term (Attachment 1, Exhibit A).
Housekeys, Inc. consulting services will provide the necessary support for the affordable housing program to ensure the City is efficiently accommodating placement of qualified tenants into deed-restricted affordable housing units throughout the City.
DISCUSSION
The 2021-2029 Housing Element identifies goals, policies, and programs to ensure the City appropriately accommodates its existing and projected housing needs. The Housing Element is consistent with state legislative directives to facilitate and accommodate all community members' needs, including all income and special housing needs. The Housing Element includes discussion and direction to establish an affordable housing program to maintain and monitor existing and new deed-restricted affordable housing units.
The on-going functioning of the City’s affordable housing program is consistent with the policies and programs in the Housing Element, and also provides needed services as the City’s affordable housing stock grows. The City’s existing Inclusionary Housing Ordinance requires developers to provide a minimum percentage of units to be deedrestricted as affordable to lower- and moderate-income households within new multifamily residential and mixed-use developments (apartments or condominiums); therefore the number of affordable housing units that the City will be responsible to administer will continue to grow. The City also anticipates that additional deed-restricted units will be developed with the implementation of SB 330/SB 8 requirements (which require the replacement of protected multi-family residential units in a new development) and state Density Bonus Law. Currently, a total of 158 deed-restricted housing units in private developments have been constructed throughout the city and the total number of affordable units in the city will increase in the near future as a result of the aforementioned regulations.
The affordable housing program ensures that the developer complies with the affordable housing guidelines, which outline the appropriate process for accepting and processing applications for an affordable housing unit. In 2023, the City allocated $150,000 for a contract with a third-party housing administrator to implement this program, as the Housing Element include action items that require maintenance of a contract with an affordable housing program administrator to assist with placing households into affordable housing units.
The proposed agreement with Housekeys, Inc. includes a scope-of-work to review of the City’s existing affordable housing guidelines, development of an application for the affordable housing program, a compliance guide, participation guide, and completion of an annual compliance certification for existing projects and tenants. The scope-of-work also includes day-to-day program administration services that includes, but is not limited to, tasks such as: addressing applicant and developer inquiries, onboarding new applications, orientation for new applicants, and renter eligibility screening.
Housekeys, Inc. is committed to provide these consulting services by a well-qualified team. Housekeys, Inc. is currently the administrator of affordable housing programs in several cities in California including the cities of Mountain View, Santa Clara, West Meeting Date: November 7, 2023

FISCAL IMPACT
The cost to perform these consulting services for the affordable housing program in the amount of $137,300 for one year has been approved in the Council approved budget for the Community Development Department. No appropriation is requested at this time.
