RECOMMENDATION
Staff recommends City Council approval of an agreement with SGD Enterprises DBA Four Seasons Landscaping (Four Seasons Landscaping) for landscape maintenance services at the Burton Way Median. The initial purchase order for Fiscal Year 2023/24 (approximately six months) is in an amount not to exceed $59,423.

INTRODUCTION
For the Burton Way Median Green Street and Water Efficient Landscape Project (Burton Way Median), bioswales, new landscaping, and other structural improvements are being completed for stormwater compliance, water conservation and efficiency, and groundwater supply recharge. City staff completed a competitive request for proposals (RFP) process for landscape maintenance services at the Burton Way Median. After reviewing the proposals received, staff recommends awarding the new agreement to SGD Enterprises DBA Four Seasons Landscaping.

Meeting Date: December 11, 2023

DISCUSSION
The Burton Way Median Green Street and Water Efficient Landscape Project is part of the City’s efforts to meet water conservation and stormwater statewide regulations. This project replaces approximately three acres of turf lawn with approximately 24,000 drought tolerant plants and will save approximately 16 acre-feet (5.2 million gallons) of water annually for irrigation. The newly installed swales on the median are designed to naturally treat polluted urban run-off from a 211-acre drainage area. This project also promotes water efficiency and sustainability by using treated urban runoff to irrigate the newly landscaped median. The project is currently under construction and is expected to be completed by early 2024.

Ongoing/regular landscape maintenance will be needed at the project site. The City published RFP No. 24-350-13 for Landscape Maintenance Services at Burton Way Median on September 19, 2023. The project area includes the Burton Way Median between the east City limit (near Oakhurst Drive) and Rexford Drive. The RFP asked for monthly pricing for ongoing/regular services to include plant care, planter bed fertilization, debris removal, hardscape/pathway maintenance, and mulch maintenance. The RFP also asked for hourly rates and other pricing for as-needed services and supplies. Below is the list of contractors who submitted proposals.
 American Heritage Landscape LP
 DMS Facility Services
 JAS Landscape LLC
 Landcare USA L.L.C.
 SGD Enterprises DBA Four Seasons Landscaping
 Stay Green Inc.

Staff reviewed the proposals based on the evaluation criteria included in the RFP. City staff invited all proposers to interview. One proposer did not respond adequately to the invitation and was no longer considered. Public Works staff interviewed the remaining five firms.

After completing the proposal evaluations and interviews, staff determined that Four Seasons Landscaping presented the most advantageous combination of cost and highquality service. More specifically, some of the reasons that staff recommends awarding the new agreement to Four Seasons Landscaping are:
 High quality and complete proposal
 Landscaping experience working with municipalities and other clients  Demonstrated satisfactory performance on current City contract for other services (alley tree trimming and weed abatement)
 Favorable references (verified by City staff)
 Reasonable prices (e.g., ongoing/regular services pricing, as-needed mark-up)  High quality, professional presentation
o Demonstrated understanding of the scope of services
o Demonstrated knowledge of regulations
Proposed Agreement for Landscape Maintenance Services at the Burton Way Median Ongoing/regular services comprise the majority of the agreement cost. In addition, the proposed agreement contains an additional ten percent for as-needed landscape Meeting Date: December 11, 2023

maintenance services based on the monthly ongoing/regular costs in the agreement. An example of as-needed service is replacement of plants and irrigation heads after damage to the median caused by a vehicle accident.

Below are highlights of the proposed agreement:
 Scope of services consists of ongoing/regular landscape maintenance services at the Burton Way Median, including plant care, planter bed fertilization, debris removal, hardscape/pathway maintenance, and mulch maintenance  Defined standards of service include:
o Shrubs and ground covers shall be trimmed, thinned, and pruned on a regular basis to maintain a neat, groomed appearance that complements aesthetic and design intent.
o Contractor shall maintain mulching to a depth of three inches (3”) in all planted areas, which shall be replaced as needed.
o Contractor shall use compost and mulch in compliance with Senate Bill (SB) 1383, as practicable, produced from recovered Organic Waste for all landscaping maintenance performed for the City.
 Onsite work expected to start January 2, 2024
o Annual price escalations to occur July 1 each year
o Termination date of June 30, 2025, with the option of three one-year extensions
 After-hours and emergency response
 As-needed pricing included, 10% as-needed consideration  10% contingency amount – not used unless deemed necessary

FISCAL IMPACT
The total estimated value of the agreement is $584,286 (Attachment 2) for landscape maintenance services at the Burton Way Median with all three annual extensions exercised (beyond the first termination date). This amount includes 10 percent for asneeded landscape work and 10 percent for contingency. Funding for the agreement and purchase order comes from the Stormwater Operations budget.

Based on an onsite work start date of January 2, 2024, the purchase order for Fiscal Year 2023/24 is calculated at $59,423, including contingency. The 10 percent contingency will not be added to the purchase order unless necessary to continue providing services.

4-9. Work Statement and Quality Control Plan
SGD Enterprises DBA Four Seasons Landscaping has reviewed the entire RFP to ensure that we have the full capacity to properly handle a contract of this size. Four Seasons Landscaping understands the high level of quality that the City of Beverly Hills is requesting. The City of Beverly Hills consists of about 8 square miles of land. There is an approximate population of 32,000 residents. These residents deserve to have their city glisten from the hills to the streets.

This famous City is in LA County and sits under the Hollywood Hills. The hilly backdrop of this City is a beautiful place to call home. Additionally, the City offers a high level of police, fire, animal control, medical aid, building and safety, street lighting, zoning, housing and community development, street improvements and recreational programs.

In putting this RFP out to bid, the City is understandably looking to pair with a contractor that can ensure the highest level of service to maintain and exceed the already high-quality landscape and parks maintenance.

Four Seasons Landscaping has a clear understanding of the scope of work to be done. It will include but will not be limited to maintenance services for Beverly Hills owned property. The contractor will also be responsible for landscape maintenance. The contract also includes a high level of irrigation knowledge and the ability to maintain all the timers throughout the property and be responsible for fixing and maintaining the irrigation system.

In order to properly complete the scope of work, we believe we will need to have a minimum staff of 4 employees devoted to this contract. This will include 2 landscapers, 1 irrigator and 1 supervisor. Further details on staffing will be discussed later in this proposal.

Landscaping Crew: This crew will be responsible for maintaining all grounds. A big priority is to prevent weeds at all costs. This crew will be responsible for all maintenance related activities.

All areas will be properly trimmed, pruned, edged, and weeded. Additionally, all hard surfaces will be inspected and maintained in clean condition. We will dispose of all trash or unwanted material. We will make sure the plants thrive and receive the proper amount of irrigation. All trees under 12 feet will be properly pruned according to ANSI 9000 standards. We will make sure no tree interferes with any right of way and gives all the proper clearances to pedestrians and vehicles. Additionally, all planter areas will be trimmed to maintain the most natural and healthy look while maintaining the neatness of the area. Weed control is a top priority. We implement all necessary steps of herbicide application to get rid of unwanted weeds throughout the year. We also will remove human/animal waste, glass, or any other objects that could be harmful to human life. Drainage will also be kept free of any obstruction and debris.

These crews will make sure to adhere to all safety protocols by wearing safety vests when working in the right of way. We will report any issues to the City when and if needed. 7 33

lrrigator: This crew will be responsible for the irrigation systems in the areas. They will work hand in hand with our other crew to constantly be on top of the systems. The crew in the field will notify them immediately of any breaks in the system to which they will be immediately dispatched. We will have them visit all the controllers throughout the month and ensure that all the stations are being properly irrigated. Our irrigator will also be responsible for all irrigation management for this contract including but not limited to inspection of all the systems on a routine basis, adjusting all timers at the appropriate times and seasons, and making any necessary repairs. All systems will be shut off in preparation for upcoming inclement weather.

We will ensure that there is always proper coverage to the system, minimum runoff, elimination of hazardous conditions and prevention of flood irrigation. Our teams will work by going timer to timer and checking for breaks in the system and ensuring that there is proper coverage.

Supervisor: We will have one supervisor who will oversee the entire process. He/she will make their rounds throughout the area visiting all the locations to ensure the maintenance is exceeding expectations. He/she will work with the crew leaders of each crew on training and safety. The supervisors will also work with the district representative in order to ensure that they are fully satisfied with the work being done. He/she will also prepare all daily and monthly reports and facilitate appropriate levels of communication.

Please note that if Four Seasons receives this contract award, we will be looking to add individuals to our team who are from the City of Beverly Hills area. We would love to work with individuals who want to take pride in helping their district look the best it can be. We will specifically try to hire individuals who have suffered job loss due to the pandemic or other recent problems.

Quality Control:

Additionally, Four Seasons Landscaping will be paying their staff the appropriate prevailing wages as per the california Code Article 2 Section 1770 through 1780 inclusive Article 5 Section 1810 through 1861 inclusive. 4-10. Proposed Innovations
Maintaining a median in its current state is of paramount importance. In order to preserve and enhance its functionality, a meticulous approach is imperative. Therefore, it is essential to conduct comprehensive soil tests to gain a thorough understanding of the soil composition and its specific requirements. Once we have ascertained the precise nutrient needs, our strategy is to meticulously select organic and slow-release fertilizers.

Given the significant role this median plays in acting as a water filtration system for the surrounding street, monitoring runoff becomes a critical component of our maintenance efforts. This practice ensures that the overall ecosystem remains in equilibrium and that the median continues to fulfill its vital function effectively.

Our commitment to efficiency and sustainability is underpinned by a modern fleet of state-ofthe-art equipment. This strategic investment ensures that our operations are conducted with the utmost efficiency, resulting in minimal emissions and waste. Additionally, our advanced equipment enables precise control over water usage, reducing any excessive waste. Through this modernization, we remain steadfast in our dedication to environmentally responsible practices while delivering top-tier landscaping services. 14 40

4-16. Use of Chemicals
Our firm is acutely aware of the city's commendable commitment to minimizing the use of chemicals within its urban landscape. In alignment with this environmentally responsible approach, we prioritize the practice of mechanical w eeding when ever and wherever possible.

M echanical weeding involves the use of non-chemica l methods such as manual removal or specialized equipment to control and eradicate weeds. By implementing this strategy, we not only contribute to the reduction of chemical usage but also support the city's broader goals of promoting a healthier and more sustainable urban environment. Our dedication to minimizing chemical interventions demonstrat es our shared commitment to eco-conscious landscaping practices and our efforts to maintain the Burton Way Median in harmony with the city's vision of environmental stewardship.

If we need we would supplement with 'Weed Whacker' brand selective broad lead weed control.

4-19. Green Waste
At Four Seasons Landscaping, our commitment to sustainable landscaping goes beyond mere maintenance; it extends to our conscientious approach to waste management. We recognize that green waste, including yard trimmings, branches, and other organic materials, deserves a second life rather than becoming a burden on landfills. To achieve this, we actively engage with local green waste recycling services.

Through our collaboration with these recycling facilities, we ensure that the green waste generated from our landscaping projects is expertly processed and repurposed. Rather than becoming waste, these materials find a second life as compost, mulch, or other valuable resources. This eco-conscious practice not only reduces the environmental impact but also aligns with California's goals of minimizing waste and promoting a circular economy. 22 48

Pursuant to Labor Code section 1815, work performed by employees of CONTRACTOR in excess of eight hours per day, and 40 hours during any one week shall be permitted upon public work upon compensation for all hours worked in excess of eight hours per day at not less than one and one-half times the basic rate of pay.

Section 10. California Labor Code Sections 1860 and 3700 provide that every employer will be required to secure the payment of compensation to its employees. In accordance with the provisions of California Labor Code Section 1861, CONTRACTOR hereby certifies as follows:
“I am aware of the provisions of Section 3700 of the Labor Code which require every employer to be insured against liability for workers’ compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract.”
Section 11. For every subcontractor who will perform work on the project, CONTRACTOR shall be responsible for such subcontractor’s compliance with Chapter 1 and Labor Code Sections 1860 and 3700, and CONTRACTOR shall include in the written contract between it and each subcontractor a copy of those statutory provisions and a requirement that each subcontractor shall comply with those statutory provisions. CONTRACTOR shall be required to take all actions necessary to enforce such contractual provisions and ensure subcontractor’s compliance, including without limitation, conducting a periodic review of the certified payroll records of the subcontractor and upon becoming aware of the failure of the subcontractor to pay his or her workers the specified prevailing rate of wages. CONTRACTOR shall diligently take corrective action to halt or rectify any failure.

Section 12. To the maximum extent permitted by law, CONTRACTOR shall indemnify, hold harmless and defend (at CONTRACTOR’s expense with counsel reasonably acceptable to the CITY) the CITY, its officials, officers, employees, agents and independent contractors serving in the role of CITY officials, and volunteers from and against any demand or claim for damages, compensation, fines, penalties or other amounts arising out of or incidental to any acts or omissions listed above by any person or entity (including CONTRACTOR, its subcontractors, and each of their officials, officers, employees and agents) in connection with any work undertaken or in connection with the Agreement, including without limitation the payment of DocuSign Envelope ID: E07A0692-055A-4396-B295-69C4315BE4E5 68 B0785-0001\2891506v2.doc
