RECOMMENDATION
Staff recommends the City Council:
1) Approve Amendment No. 8 to the Agreement between the City of Beverly Hills and Covered 6 LLC|DGP International (“Covered 6”) for armed uniformed security services (Attachment 1);
2) Approve Amendment No. 9 to the Agreement between the City of Beverly Hills and Nastec International, Inc. (“Nastec”) for armed uniformed security services (Attachment 2); and
3) Waive the bidding requirements per the Beverly Hills Municipal Code 3-3-204 (D) as it would be in the best interest of the City to continue to utilize these vendors due to their current experience with this project until the current RFP and evaluation of proposals is completed.

INTRODUCTION
This item requests the City Council approve an amendment to the agreements with Covered 6 and Nastec for armed uniformed security services to extend the term of the Agreement through February 29, 2024.

DISCUSSION
On October 13, 2020, the City Council approved agreements with Covered 6 and Nastec to provide armed uniformed security services due to the anticipation of continuance of unprecedented protest activity in the City along with heightened concerns around the November 3, 2020 general election. The report recommended, and the City Council approved, additional security support for the Business Triangle.

The initial agreements with Covered 6 and Nastec were entered into as a short-term solution to enhance public safety in the City by deploying armed uniformed security officers throughout Beverly Hills. These armed security officers were implemented as a way to augment the public safety services already provided by the Beverly Hills Police Department. The presence of both companies in the City has proved to be a force multiplier for the Beverly Hills Police Department to assist in the deterrence of crime.

Since entering into these agreements in 2020, the City has experienced various activities which require ongoing, supplemental armed uniformed security services. These events include, but are not limited to, repeated protests in the City including those protesting for animal rights, repeated smash-and-grab incidents at various retail stores in Southern California, and a rise in violent crime within the Los Angeles area. As such, these agreements have been amended from time to time to expand the scope of work, increase the consideration, and extend the termination date.

The City, including its residents and businesses, continue to express support for ongoing supplemental armed security officers. These armed security officers act as one of the many resources available to the Police Department to deter crime.

On August 1, 2023, staff released a request for proposal (RFP) to ensure the City is receiving the highest quality armed uniformed security services at a fair price. Proposals were due on September 15, 2023. The City received responses from 22 companies. The written submissions were evaluated and scored by City staff who then recommended seven companies move forward in the process. The seven companies were invited to participate in an oral interview process on November 28, 2023. Staff is now reviewing the scores and comments by the evaluators prior to moving forward with negotiations with the top firm/firms. Once this process is complete, staff will return to the City Council with a recommendation for which company/companies to enter into longer term agreements with.

FISCAL IMPACT
Funding for these services was approved by the City Council when the Fiscal Year 2023-2024 budget was adopted in June of this year. Therefore, no further appropriation is needed at this time. Furthermore, the purchase orders for both Covered 6 and Nastec are sufficient at this time to continue paying for their services until the City is able to award new agreements to the successful respondent / respondents of the armed uniformed security services RFP.

This Amendment No. 8 is to that certain Agreement between the City of Beverly Hills (hereinafter called “CITY’), and Covered 6 LLCIDGP International (hereinafter called “CONTRACTOR”) dated October 28, 2020 and identified as Contract No. 571-20, as amended by Amendment No. 1 dated December 16, 2020 and identified as Contract No. 621-20, as amended by Amendment No. 2 dated January 29, 2021 and identified as Contract No. 18-21, as amended by Amendment No. 3 dated February 3, 2021 and identified as Contract No. 25-21, as amended by Amendment No. 4 dated July 1, 2021 and identified as Contract No. 259-2 1, as amended by Amendment No. 5 dated February 8, 2022 and identified as Contract No. 121-22, as amended by Amendment No. 6 dated June 2, 2022 and identified as Contract No. 345-22, and as further amended by Amendment No. 7 dated June 27, 2023 (hereinafter collectively referred to as “Agreement”), copies of which are on file in the City Clerk’s Office.

RECITALS
A. CITY entered into a written agreement with CONTRACTOR for armed uniformed security services, which was previously amended.

B. CITY and CONTRACTOR desire to further amend the Agreement to extend the Termination Date.

NOW, THEREFORE, the parties agree as follows:

Section 1. The TERMINATION DATE is hereby amended as set forth on the cover page.

Section 2. Except as specifically amended by prior amendments and this Amendment No. 8, the remaining provisions of the Agreement shall remain in full force and effect.
