RECOMMENDATION
Staff recommends that City Council:
1. Approve the award of a contract to the lowest responsible bidder, Concept Consultant, Inc. for Rodeo Drive Bollards in the amount of $808,888;
2. Approve a contingency in the amount of $80,888 (10%);
3. Approve a purchase order to Concept Consultant, Inc. in the amount of $889,776; and
4. Approve the plans and specifications as detailed in the bid documents, which are adopted and approved with respect to design criteria; and
5. Find the project to be categorically exempt from further review under CEQA.

INTRODUCTION
Starting in summer 2017, 24 protective sidewalk security barriers (K-rails) were installed along Rodeo Drive as part of a temporary seating initiative, which also included 48 bistro tables, 192 chairs placed at 24 locations, and 96 planter boxes. This temporary seating was originally scheduled for removal on September 1, 2017. At its August 22, 2017 meeting, City Council approved the continuation of the Rodeo Drive temporary seating through December 31, 2017. At its December 19, 2017, Study Session meeting, City Council approved the continuation of the Bistro seating amenities and granted authority to the City Manager to amend and enter into contracts necessary to continue the Bistro Seating amenities. By late 2019, the Bistro Seating (tables, chairs, planters) was removed at the request of the Rodeo Drive business and property owners; however, the green concrete K-Rails were left in place. The K-rails remain today, seven years later, and have been a recurring topic of discussion for both business and property owners on Rodeo Drive. The Rodeo Drive Committee (RDC) proposed replacing the K-rails with spherical bollards. On April 24, 2023, the RDC-proposed bollard design was reviewed by the Rodeo Drive Special Events / Holiday Program Liaison Committee (City Council Liaisons), and then on May 2, 2023, the selection was reviewed and approved by City Council.
Attachment 2 is a photo rendering of the bollards.
DISCUSSION
Staff evaluated existing conditions on Rodeo Drive, Brighton Way and Dayton Way and determined that the project would require two phases. The first phase includes spherical bollards along the streets. The second phase will install cylindrical bollards at each curb ramp and driveway. The second phase will be brought to the City Council at a future date.
In the first phase, 300 sphere barriers are required to cover the requested streets at appropriate spacing (approximately 5-feet apart) to allow pedestrian access and prevent cars from passing between the barriers. Attachment 3 includes the details of the sphere barriers and placement along the street. Along with the bollards, the Public Works Department will be acquiring a larger forklift to allow staff to quickly and safely move the bollards, as well as the green K-rails, for special events or emergencies when necessary.
On December 19, 2023, a Notice to Bidders was published on the City’s web portal PlanetBids (planetbids.com) and published in the Beverly Hills Courier and the Beverly Press. An optional pre-bid meeting was conducted online on January 4, 2024, and an optional site visit was held on January 4, 2024. On January 23, 2024, nine (9) bids were received, and the bid results were as follows:

All documents submitted by these bidders were in order, and the lowest responsible bidder is Concept Consultant, Inc. Concept Consultant, Inc. is a general contractor in good standing based in Los Angeles, California.
Staff recommends that the bid submitted by the lowest responsible bidder be accepted and a contract awarded to Concept Consultant, Inc.
ENVIRONMENTAL ASSESSMENT
The Project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), the State CEQA Guidelines[1] (California Code of Regulations, Title 14, Section 15000 et seq.), and the environmental regulations of the City. The project meets the requirements for a Class 1 Categorical Exemption (Existing Facilities), in accordance with the requirements of Section 15301 of the state CEQA Guidelines. This exemption is applicable to the maintenance or minor alteration of existing public facilities involving negligible or no expansion of existing or former use. Therefore, it is recommended that City Council find the project exempt from further review under the provisions of CEQA.
FISCAL IMPACT
A construction contingency allowance in the amount of $80,888 (10%) has been included in the total purchase order amount of $889,776. Any change orders that require expenditures from this allowance shall be made only upon written request in accordance with the Beverly Hills Municipal Code §3-3-110 regarding change orders.
Funding available in the Tourism and Marketing budget will be transferred to the Infrastructure Fund CIP budget to cover the cost of this contract.

THIS AGREEMENT, made and entered into this 6th day of February, 2023, by and between the CITY OF BEVERLY HILLS, a municipal corporation, hereinafter referred to as “City”, and Concept Consultant, Inc.

In this consideration of their covenants the parties hereto agree as follows:
1. Contractor shall furnish all labor, materials and equipment necessary to perform the following work in the City of Beverly Hills, California, strictly in accordance with the Notice to Bidders, Proposal form, Plans and Specifications for such improvement, Standard Contractual Requirements and inclusive of Addendums, each of which documents are made a part of this Contract as though fully set forth herein:

In consideration of such work City agrees to pay Contractor and Contractor agrees to accept the sum of Eight Hundred Eight Thousand Eight Hundred Eighty-Eight Dollars and Zero Cents ($808,888.00) in the manner provided in subject Plans and Specifications and subject to adjustment provided therein.
3. Concurrently with the execution of this Contract, Contractor shall file with the City the bonds and certificates of insurance specified in said Standard Contractual Requirements.
4. This Contract shall not be assigned without the written permission of the City Council.
