> After attending a community presentation and reviewing the plans proposed by L’Ermitage, I expressed my support to the Planning Commission. I think their approval was right on point, and I hope you will approve this ZTA so those plans may proceed. You all know better than anyone how important it is to support our local Beverly Hills businesses, especially one with a long standing history of driving significant revenue to our city. >

Public comment for Agenda item F-2 - Beverly Hills City Council Meeting 2-6-24 To the Mayor and City Councilmembers:
I wish to address the issue before the Council regarding the zone text amendment for the L’Ermitage Hotel. As a member of the Planning Commission during the tumultuous period when the hotel was in violation of its CUP, I am very familiar with the issues that you are reviewing this evening.
In 2016, the hotel was deemed a “bad actor” with all sorts of violations that infringed upon the neighbors’ rights to peaceful enjoyment of their homes. The Planning Commission devised many regulations to enable the hotel to peacefully co-exist with its neighbors. Noise abatement, extremely strict delivery regulations, and refuse pickup are just a few of the provisions that were imbedded into the CUP. Since that time, the hotel has changed management. That, coupled with the strict CUP, have, in my opinion improved the hotel-community relationship.
While I understand that no one likes change, most particularly the immediate neighbors, we cannot punish the hotel for misdeeds of the past that were performed under different management. If the provisions of the CUP that were enacted in 2016 are working, they should absolutely remain in place.
However, I have reviewed the request that the hotel is making to enable indoor and rooftop dining, and I am fully in support of it. These simple enhancements will go a long way to ensure that the L’Ermitage will be the premiere boutique hotel in Beverly Hills. And they are truly minor and do not appear to be impactful. As the city prepares to be center stage for tourism during the World Cup and Olympics, it is important that our hotels are welcoming and enjoyable places for all to visit. This will be the case for the L’Ermitage.
I wholeheartedly encourage you to review and support this ZTA.
Thank you.

Beverly Hills City Council
RE: BH Council Meeting February 6, 2024, L’Ermitage Hotel Honorable City Council,
My name is Matti Bialer, I am a full time resident and a 50+ year owner of the property next door to the L’ermitage on the corner of Burton Way and Foothill Rd.
Roof activities on the southwest corner of the hotel building, where the new public rooftop bar and restaurant is proposed is directly above my top floor unit. When parties are now held in that area, I can hear the loud music, and loud patrons. A full time bar and restaurant open to the public will affect my unit and the whole neighborhood.
The Hotel never considered any sound mitigation for the rooftop dining area. They talk about putting a 10 inch new railing on the roof. That is not noise mitigation.
There shouldn’t be any noise coming from an open air outdoor space at the Hotel. This is a residential area.
I am concerned about having a restaurant that will be open to the public full time both next to me and above me.
I currently have to live with the constant back beeping of delivery trucks, late night guests and partiers leaving the Hotel and waking us up in the late hours, under our bedroom windows laughing, drunk and boisterous on Foothill Road. Ubers and Lyfts picking up and dropping off under our bedroom windows.
I object to allowing the L’ermitage have a Zone Text Amendment to add additional public dining facilities on the roof of the Hotel.
These proposed uses and noise will absolutely adversely affect the neighborhood.
Shouldn’t we have the benefit of quiet enjoyment in our homes? Thank you for considering my concerns,
Matti Bialer

Dear Mayor Gold and fellow City Council Members,
As a resident and business owner in Beverly Hills, I have witnessed the many incarnations of the L’Ermitage over the past two decades. With its recent change of ownership, our cherished city hotel has experienced a remarkable renaissance providing impeccable service under the stewardship of Scott Berger, and now under Frederic Zemmour. I wholeheartedly support their efforts to elevate the guest experience and to solidify their standing among the ultra-luxury hotels in our city.
In light of the hotel's commitment and its vital role in the Beverly Hills community, I earnestly urge the City Council to approve the Zone Text Amendment granting the approvals sought by the L’Ermitage.
Sincerely,
David Mirharooni

Good evening.
Mark and I wanted to show continued support for the L’Ermitage Hotel.
The Public process for this project has been very comprehensive.
Commissioners, as well as city staff have worked diligently to assess the proposed changes and to review the details at length to ensure our community will be best served by what is in front of the council now.
The outreach to the public was very extensive. We attended one of the community outreach presentations, and are very excited about what has been approved by the planning commission.
The public support for these enhancements have been very positive.
We hope that the city council will act on the commission’s recommendations and the community sentiment to move forward with the zone text amendment, which is required in order for the planning Commission approval to take place.
