RECOMMENDATION
Staff recommends City Council move to approve Amendment No. 1 to Agreement No. 492-23 between the City of Beverly Hills and Xenophon A. Gikas. Jr. dba CommGeek Tech Services LLC for specialized Information Technology professional services focused on Fire Department operations, and approval of a Fiscal Year 2023/24 change purchase order in the amount of $69,000 for work through June 30, 2024, for a total not to exceed amount of $168,000.
INTRODUCTION
In September 2023, the City of Beverly Hills entered into agreement 492-23 with Xenophon A. Gikas. Jr. dba CommGeek Tech Services LLC for $99,000 to provide specialized Information Technology professional services focused on Fire Department operations. Specialized services are in support of various Fire Department workplan initiatives including the upgrade of the fire station toning system, installation of apparatus computer and video equipment, build-out of the new state of the art battalion vehicle, automation of fire permit applications etc.

DISCUSSION
The proposed Amendment No. 1 is requested to ensure uninterrupted specialized Information Technology professional services through June 30, 2024, and to approve a Fiscal Year 2023/24 change purchase order for $69,000 and a total not to exceed amount of $168,000.
FISCAL IMPACT
The costs associated with this Amendment will be funded from the approved Fiscal Year 2023/24 Information Technology Department budget.

INITIATIVES
This Amendment No. 1 is to that certain Agreement between the City of Beverly Hills (hereinafter called "CITY"), and Xenophon A. Gikas. Jr. dba CommGeek Tech Services LLC (hereinafter called "CONSULTANT") dated September 15, 2023, and identified as Contract No. 492-23 (“Agreement”).
RECITALS
A. CITY and CONSULTANT entered into a written agreement for project consulting services for public safety technology initiatives.
B. CITY and CONSULTANT desire to amend the Agreement to increase the Consideration to compensate CONSULTANT for continuing services.
NOW, THEREFORE, the parties agree as follows:
Section 1. The Consideration shall be amended as set forth on the cover page.
Section 2. Exhibit B, “SCHEDULE OF PAYMENT AND RATES,” shall be amended and restated as attached hereto and incorporated herein.
Except as specifically amended by this Amendment No. 1, the remaining provisions of the Agreement shall remain in full force and effect. [Signatures Follow]

SCHEDULE OF PAYMENT AND RATES
CITY shall compensate CONSULTANT for the satisfactory performance of the work as described in Exhibit A in an amount not to exceed One Hundred Sixty-Eight Thousand Dollars ($168,000), which shall include CONSULTANT’s fee for the Services as well as reimbursement for the actual cost of any equipment, materials and supplies necessary to provide the Services, including labor, materials, delivery, tax, assembly and installation, as applicable.
CIT shall pay CONSULTANT compensation at the following rates per hour for scheduled service during normal business hours.

CONSULTANT shall submit to CITY a detailed invoice, on a monthly basis or less frequently, for the Services performed pursuant to this Agreement. Each invoice shall itemize the Services rendered during the billing period and the amount due. Within 30 days of receipt of each invoice, CITY shall pay all undisputed amounts included on the invoice. CITY shall pay CONSULTANT said Consideration in accordance with the schedule of payment set forth in this Exhibit.
