INTRODUCTION
Per California Public Contract Code Section 20169, the City Clerk’s Office opens an annual bidding process for legal notices and advertising. As defined in Section 6008 of the Government Code, locally adjudicated newspapers of general circulation are invited to participate in the City’s annual bid solicitation for newspaper advertising.

Legal advertisements must be placed in adjudicated newspapers within the City of Beverly Hills.

The Public Contract Code requires that an annual bid be conducted. However, it is silent with respect to the bidding methodology, hence, it is left to the discretion of the City Council to determine the best bid, considering price, newspaper circulation, and other matters affecting the value to the constituents.

While not a requirement, the City includes display advertising as part of the overall annual bid process. The City is not required to award the contract to the lowest bidder and may contract with any qualified newspaper if advertising in the publication will best suit the needs of the City. Per past City Council direction, the winning newspaper receives all legal and display advertisements.

The remaining two newspapers receive advertisements on an “as needed” basis.

2 DISCUSSION
The current City Council Newspaper/Advertising Ad Hoc Committee liaisons are Mayor Lester Friedman and Councilmember Craig Corman. A City Council Newspaper/Advertising Ad Hoc Committee Liaison meeting was held on February 26, 2024 with then liaisons Vice Mayor Lester Friedman and Councilmember Lili Bosse. At the meeting, the former Committee liaisons approved the proposed Newspaper Legal Notices and Display Advertising Services bid for Fiscal Year (FY) 2024-25. As part of the discussion regarding the upcoming bid, former Councilmember Bosse provided comments on elements related to social media metrics. Based on the discussion, it is proposed that next year’s bid will include the following online metrics (unless City Council or the current City Council Liaisons advise otherwise). The online metrics to be included in each newspapers’ independent verified circulation audit for the FY 2025-26 bid are the following:
 Audited Average Website Reporting
 Audited Online/Digital Edition Reporting
 Text Media (Distribution Reporting)
 Email Media (Distribution Reporting)
On March 29, 2024, the City Clerk’s office concluded Bid RFB# 25-070-01 which requested bids for legal and display advertising for FY 2024-25. All bidders were requested to provide the following eight major sections with their bid response:

1. Introduction Letter

2. Certificate of Legal Adjudication

3. Independent Verified Circulation Audit

4. Advertisement Samples

5. Project Management Plans

6. Cost Proposal

7. Map of Newspaper’s Delivery Service
Area

8. Additional information including up to five
(5) additional pages which may include
any deviations from the requirements
listed above.

The City received responses from BH Courier Acquisition, LLC (Courier), Beverly Hills Weekly (Weekly), and Beverly Press/Park La Brea News (Beverly Press). Each publishers’ bid response is attached. Bids specifically related to legal advertisements were requested from these publishers because they are the only adjudicated newspapers in the City of Beverly Hills.

The following should be noted:
 All three publications are legally adjudicated and are eligible to receive legal advertisements from the City (per Government Code Section 6008).  For last year’s FY 2023-24 bid the newspapers were required to submit new independent verified circulation audits. All three publishers provided audits conducted by the Certified Verification Council (CVC). For this year’s FY 2024-25 bid, the three publications were NOT required to submit new independent verified circulation audits because all three publications submitted audits within the twenty-four (24) months prior to the Date of Request of the FY 2024-25 Request for Bids. A new audit will be required for next year’s FY 2025-26 bid. The new audit period will cover October 2023 to September 2024.  The winning bidder receives all legal and display newspaper advertising. Upon City Council direction, the remaining two bidders may be awarded City advertisements on an as-needed basis.

Meeting Date: May 7, 2024

3 Circulation Rates
Based on the data provided in each publishers’ CVC audits (Section 7. “Distribution by Zip Code”), the City Council has for many years awarded the bid based on the highest circulation in Beverly Hills. Because all three publications were NOT required to submit new independent verified circulation audits, the circulation data from last year remains the same for this year.

Newspaper Circulation (Beverly Hills Only)
Feedback from Publishers
All circulation data has been taken from each publishers’ CVC audit report which were submitted last year. While the Weekly supports the circulation formula methodology, they are of the opinion that they should receive “61% of the total (display and legals) ad spend” (See Attachment 3).

Per City Council direction, in 2023 newspaper rates were approved based on Beverly Hills circulation and that the non-winning bidders would receive advertisements as needed (See Attachment 2).

The Beverly Press requests that the City consider paying for ads based on circulation inside and outside of the City’s zip codes (90210, 90211 and 90212). All rates for the three publications were based on circulation in Beverly Hills. If interested in revising this formula, the City Council will need to determine which outside circulation zip codes to include.

The Courier and the Weekly each submitted the same rates as they did for the FY 2023-24 bid.

The Press submitted slightly decreased rates compared to FY 2023-24. The following table provides a list of the submitted proposed FY 2024-25 rates by each local newspaper:

Courier Weekly Press
90210 13,090 7,274 5,235

FISCAL IMPACT
The City Clerk Office’s proposed FY 2024-25 budget for legal advertising and notices is $112,482.

The Citywide FY 2024-25 budget for display advertising is $554,258. The total advertising budget is $666,740.

The City is required to place legal advertisements in an adjudicated newspaper. It is at the City’s discretion to place non-legal (display) advertisements in any publication; and it is not required that the publication be adjudicated. Additionally, it should be noted that budgeted amounts for legal and display advertising reflect a NOT-TO-EXCEED amount which does not indicate the funds will be spent in their entirety.

After the June 6, 2023 City Council award direction, the City reserved a threshold of FY 2023-24 funds for advertising in the Courier, the Weekly, and the Beverly Press. Citywide Legal and Display advertising expenditures for the three newspapers totaled $612,243 in FY 2022-23 and $370,793 in FY 2023-24 (as of April 30, 2024). As mentioned, advertising expenditures fluctuate depending on the City’s needs.

RECOMMENDATIONS
Based on the information received during the FY 2024-25 Bid process, it is recommended that the City Council award the FY 2024-25 Newspaper Advertising Bid to the Courier because among the three newspapers, it continues to offer the most cost-effective pricing per reader with 1 The Weekly and Press proposed rates are based on their percentage of circulation in Beverly Hills relative to the Courier’s.

6 the highest circulation within Beverly Hills. It is also recommended that the City Council agree to enter into a separate legal and display advertising agreement with the Weekly and the Press.

The City has agreements with all three newspapers which each expire on June 30, 2024. Should the City Council approve any and/or all newspaper agreements, it/they will commence on July 1, 2024.

Request for Direction
Staff respectfully requests:
 The City Council accept the Legal Notices and Display Advertising bids from the Courier, Weekly and Press.
 Based on a combined formula of circulation and costs, the City Council award the Legal Notices and Display Advertising Bid to the Courier for FY 2024-25.  The City Council award a contract for all legal and display ads to the Courier.  The City Council contract with the Weekly and the Press for legal ads and display ads at a rate that mirrors the percentage of circulation in Beverly Hills compared with the Courier, for as needed additional advertising; or alternatively contract with the Weekly and the Press for display ads and legal ads at a rate determined by the City Council.

Pending City Council direction, it is requested that the City Council award the bid. The agreement(s) will be placed on the Tuesday, May 21, 2024, City Council Regular Meeting agenda for formal approval. The agreements will be effective July 1, 2024.

Newspaper Legal and Display Advertising Services
RFB-25-070-01
Due Date: Friday, March 29, 2024 by 5:00 p.m.

OVERVIEW AND BACKGROUND
The City of Beverly Hills (“CITY”) requests bids from qualified newspapers (“CONTRACTOR”) to publish legal notices and display advertisements as required by the CITY.

Beverly Hills is located in the middle of Los Angeles County, surrounded by the cities of Los Angeles, West Hollywood, Santa Monica, and Culver City. Within its 5.7 square mile area, Beverly Hills has approximately 35,000 residents, with a business and commercial base that ranks alongside cities with populations of several hundred thousand.

Internationally recognized for its alluring retail stores, hotels, and exclusive attractions, Beverly Hills attracts visitors from around the world. As a full-service city, police, fire, water treatment, refuse collection, and building inspections, among other municipal services, are provided directly by the CITY.

Throughout the year, CITY prints display advertising to promote CITY sponsored events. The CITY is also legally required to print public notices (legal advertisements) such as Public Hearing Notices, ordinances, resolutions, and certain Requests for Bids.

Per California Public Contract Code Section 20169 the City Clerk’s Office conducts an annual Bid for legal advertising and notices. While not a requirement, the City has historically also included display advertising in the Bid process.

MINIMUM QUALIFICATIONS
In order to qualify to submit a bid in response to this solicitation, CONTRACTOR must operate a newspaper that has been adjudicated as a newspaper of general circulation as defined in Section 6008 of the Government Code, for the CITY.

OBJECTIVES AND SCOPE OF WORK
The following Scope of Work shall apply to this project:

1. CONTRACTOR shall enter into an agreement with CITY for services from July 1, 2024 through June 30, 2025 (see Attachment A for sample agreement).

3. Nothing in this Request for Bid (RFB) shall be construed to require CITY to place all advertisements, or any particular advertisement, with any CONTRACTOR to whom a contract is awarded. CITY retains the right to place advertisements in any publication or medium as required by law and as it determines to be in the best interests of the CITY.

4. Legally required advertisements can be display ads such as Public Hearing Notices and Summarized Ordinances which are normally placed in the “front pages”. Legally required advertisements can also be classified ads such as full length ordinances, full length resolutions, and certain Requests for Bids (RFBs) which are normally placed in the “back page(s)” of a newspaper.

5. If specified by CITY in writing, up to one full page of legal or display advertisements shall be inserted with best effort upfront within pages 1-10 or in the first half of the newspaper if the newspaper is greater than 20 pages. Exceptions include last minute advertisements in which case, placement can be based on availability of space and with the mutual agreement by CITY. Other exceptions include legal/classified ads such as full length ordinances, full length resolutions, and certain Requests for Bids and Requests for Proposals.

6. Unless CITY specifies a different font style and font size, CONTRACTOR shall publish CITY’s legal notices and advertising in the following font style and size:
serif= Times New Roman eight point font

Unless CITY specifies a different font style and font size, CONTRACTOR shall submit the proof of publication in the font styles and sizes listed above. All CITY advertisements shall be approved by CITY in writing prior to publishing. CONTRACTOR shall provide one affidavit of publication within two weeks of each publication.

If the newspaper is published on more than one day per week, then advertisements shall be placed on the publication date requested by CITY.

11. CONTRACTOR's deadline for publication of notices/advertising, space reservation and materials submission for publishing shall be as provided in the agreement between CONTRACTOR and CITY.

A deviation is material to the extent that a response is not in substantial accord with the requirements in this RFB.

Immaterial deviations may cause a bid to be rejected. The CITY may or may not waive an immaterial deviation or defect in a bid. The CITY's waiver of an immaterial deviation or defect shall in no way modify the RFB or excuse a CONTRACTOR from full compliance with the remaining RFB.

Bids that contain false or misleading statements may be rejected if in the CITY’s opinion the information was intended to mislead the CITY regarding a requirement of the RFB. Bids may be rejected in any case where it is determined that the bids are not truly competitive, or where the costs presented are not reasonable.

The circulation audit results will weigh heavily during the Evaluation and Criteria process.

INTRODUCTION
Per California Public Contract Code Section 20169, the City conducted its annual Bid for legal notices and included display advertising within the bid. This report discusses the City Council direction and staff’s recommendation to award bid no. RFB 24-070-01 to BH Courier Acquisition, LLC and approve agreements and purchase orders with BH Courier Acquisition, LLC, Beverly Hills Weekly and Michael Villalpando DBA Park La Brea News/Beverly Press to publish City of Beverly Hills legal and non-legal advertising and notices for Fiscal Year 2023/2024.

DISCUSSION
At the June 6, 2023 City Council Study Session, staff presented the Advertising and Notices Request for Bid 24-070-01 (RFB) responses received from BH Courier Acquisition, LLC (Courier), Beverly Hills Weekly (Weekly) and Beverly Press/Park La Brea News (Beverly Press). Representatives from all three papers were present. At the meeting, the following was determined:
 The City Council accepted the Advertising and Notices bids from all three newspapers.
 All three publications submitted new independent verified circulation audits which were each conducted by the Certified Verification Council (CVC).  The City Council has for many years awarded the bid based on the highest circulation in Beverly Hills. The circulation data was included in each newspaper’s new audit report. Based on this information, City Council unanimously agreed to award the Bid to the Courier because it continues to have the highest circulation in Beverly Hills amongst the three publications.
 The City Council also agreed to contract with the Weekly and the Press for display ads and legal ads at the Beverly Hills rate of circulation compared to the Courier’s for as-needed additional advertising.
 Finally, the City Council directed to require online metrics (including social media) as part of future audits of which the City Council Ad Hoc will discuss the details.

Meeting Date: June 27, 2023

FISCAL IMPACT
The City Clerk’s Office’s FY 2023-24 budget for legal advertising and notices is $112,482. The Citywide FY 2023-24 budget for display advertising is $537,058. The total advertising budget is $649,540, which includes a proposed ongoing budget enhancement of $75,0001 for display advertising. There are no set fixed amounts designated for each newspaper, ads are placed as needed. It is at the City’s discretion to place non-legal (display) advertisements in any publication.

The City places advertisements in local newspapers based on regulatory requirements or on an as needed basis. The current budget does not impact funding for the publications. The display advertising budget is not solely for the contracted publications in the report and can be used for newspapers and/or other advertisement purposes.

Staff is requesting the City Council approve the issuance of FY 2023-24 blanket purchase orders to the Courier totaling $331,922 based on the rates provided. Staff also requests the City Council also approve the issuance of FY 2023-24 blanket purchase orders based on the rates provided to the Weekly totaling $203,199 and the Press totaling $114,349. These amounts are provided based on Citywide departmental advertisement history, to be set aside and used as needed.

All Purchase Orders will automatically expire on June 30, 2024. The blanket purchase order amounts presented for approval are not-to-exceed amounts, and the City is under no obligation to spend any or all funds of any of the proposed blanket purchase orders.

The Courier and the Weekly’s FY 2023-24 Schedule of Rates are provided below. The rates are also listed in Exhibit B of each publication’s proposed agreement.

The purpose was to identify the number of individuals who indicate they have read at least two of the last four issues of the publication, and gather study information solely for advertising purchase evaluations. Market statistics estimates appearing in CVC reports, when available, are obtained from EASI Software. CVC study sources can include, but are not limited to, residential and cell phone surveys, online surveys, email surveys, and/or social media surveys. Study source data can include, but are not limited to, residential phone listings, cell phone exchanges, publisher delivery lists, opt‐in email, online, and/or social media databases. Residential and cell phone survey populations consist of adults age 18 and over, living in households within the survey area. Within this area, each individual had a known (or “non‐zero”) probability of being selected for the random sample. Surveys were conducted solely with pre‐ designated respondents and no substitutions were permitted. Initial survey attempts were spread evenly across all survey days (i.e., Tuesday through Saturday). A minimum of 250 completed surveys, or 2.5% of net circulation for publications under 10,000 circulation is required with no more than one survey per household. Survey Procedures: To ensure the highest degree of comparability and to facilitate the survey process, a standard, consistent, specified list of questions was asked. Surveys were conducted over a minimum period of two weeks to minimize the impact of weather and/or special circumstances. Every effort was made to ensure that surveys were assigned randomly by day and that an approximately equal number of surveys were completed on each survey day. Where appropriate, data was balanced and/or weighted by ZIP code using up‐to‐date known demographics: gender, age, number of adults in household and ethnicity in those cases where one minority comprised no less than ten percent of the total population. Non‐responses to any single question were eliminated from the survey. In all cases, at least four attempts were made to contact all pre‐designated respondents. Every effort was made to surmount language, cultural, behavioral and other barriers to a successful survey; and to the extent feasible, contact attempts were scheduled on a random basis. During the survey process, no questions were asked prior to the readership question, with the exception of a qualifying question designed to determine the ZIP code of the individual; and a general warm‐up call explanation designed to put the respondent at ease. Warm‐up questions did not include any reference to a publication itself or the nature of the study information. The study followed recommended guidelines developed in part from established media usage and evaluation guidelines. Survey totals may not equal 100% due to rounding. The Circulation Verification Council estimates that all the information in this survey has a maximum error margin of +/‐4% at the 95% confidence level. 242 Survey respondents were interviewed during the verification of carrier delivery and mail distribution. 12 Survey respondents reported reading a minimum of two of the last four issues through single copy, controlled bulk, or pass along distribution. 149 Survey respondents responded to a geo‐ coded outbound email verification. This publication did not participate in the CVC online research program.  Average estimated readers per edition during the audit period: 2.1 *Readership estimates compiled from 2023 CVC circulation & readership study data.

NOTICE OF

PUBLIC HEARING
The Council of the City of Beverly Hills, at its regular meeting to be held on Tuesday, February 6, 2024, at 7:00 p.m., or as soon thereafter as the matter may be heard, in the Council Chamber of the City Hall, 455 N. Rexford Drive, Beverly Hills, CA 90210, will hold a public hearing to consider:

The proposed Ordinance would amend the Section 10-3-1207 of the Beverly Hills Municipal Code to allow for the expansion of bar and dining areas of an existing ground floor hotel restaurant and the establishment of new restaurant uses with outdoor dining and bar areas that are open to the public on the rooftop of existing legally nonconforming hotels located in the City’s R-4, Multiple Residential Zone with established rooftop uses. The expansion and establishment of such restaurant uses would require the issuance of a Conditional Use Permit (CUP) by the Planning Commission. The proposed Ordinance is related to a request for amendments to existing CUP, Development Plan Review (DPR), and Extended Hours Permit (EHP) approvals to allow continued operation of existing restaurant and rooftop uses at the L’Ermitage Hotel, located at 9291 Burton Way (the “project site”), as well as to allow the expansion of the dining and area within the ground floor restaurant and establishment of a new rooftop restaurant with outdoor dining and bar area. The Planning Commission considered this ordinance at its meeting on December 14, 2023, at which time it recommended that the City Council adopt the amendments.

Upon review, the project appears to qualify for a Class 5 (Minor Alterations in Land Use Limitations) in accordance with the requirements of Sections 15305 of the state CEQA Guidelines. Therefore, the City Council may find the project exempt from further review under CEQA.

REQUEST FOR PREQUALIFICATION

OF BIDDERS AND PREQUALIFICATION

INSTRUCTIONS FOR

POLICE FACILITY LUNCH ROOM MENS

LOCKER ROOM IMPROVEMENTS PROJECT
Notice is hereby given that the City of Beverly
Hills (“ CITY” ) has determined that all bidders for
the Police Facility Lunch Room & Men’s Locker
Room (“ Project” ) must be pre-qualified prior to
submitting a bid on that Project. It is mandatory
that all Contractors who intend to submit a bid,
fully complete the prequalification questionnaire,
provide all materials requested herein, and be
approved by the CITY to be on the final qualified
Bidders list.

No bid will be accepted from a Contractor that
has failed to comply with these requirements. If
two or more business entities submit a bid as
part of a Joint Venture, or expect to submit a
bid as part of a Joint Venture, each entity within
the Joint Venture must be sep&arately qualified
to bid. The last date to submit a fully completed
questionnaire is 5: 00 PM Thursday, March 28,
2024
Contractors must register as a vendor at the following website in order to download the prequalification package, and to receive clarificationss and notifications when issued.

The Prequalification package may be viewed on,
and downloaded from the City’s PlanetBids portal:
https://pbsystem.planetbids.com/portal/39493/
bo/bo-detail/115375
This item is listed as: Prequalification Police
Facility Lunch Room & Men’s Locker Room.

Answers to questions contained in the questionnaire are required. The CITY will use these documents as the basis of rating Contractors with
respect to whether each Contractor is qualified to
bid on the Project, and reserves the right to check
other sources available. The CITY’s decision will
be based on objective evaluation criteria.

The CITY reserves the right to adjust, increase,
limit, suspend or rescind the prequalification rating based on subsequently learned information.

Contractors whose rating changes sufficiently
to disqualify them will be notified, and given an
opportunity for a hearing consistent with the hearing procedures described below for appealing a prequalification rating.

While it is the intent of the prequalification questionnaire and documents required therewith to assist the CITY in determining bidder responsibility prior to bid and to aid the CITY in selecting the lowest responsible bidder, neither the fact of
prequalification, nor any prequalification rating,
will preclude the CITY from a post-bid consideration and determination of whether a bidder has the quality, fitness, capacity and experience to
satisfactorily perform the proposed work, and has
demonstrated the requisite trustworthiness.

All qualifications submittals are required to be
submit electronically via PlanetBids. The electronic submittal system will close exactly at the date and time set forth in this request for qualifications.

Any questions regarding the questionnaire and
qualification package should be submitted via
PlanetBids by 2:00PM, February 10, 2023.

Questions sent via email or over the phone; with
the exception of those related to accessing or
using PlanetBids, will not be answered.

Contractors are responsible for submitting and
having their documents accepted before the
closing time set forth in the request for qualifications. NOTE: Pushing the submit button on the electronic submittal system may not be instantaneous; it may take time for the Contractor’s documents to upload and transmit before the
documents are accepted. It is the Contractor’s
sole responsibility to ensure their documents are
uploaded, transmitted, and arrive in time electronically. The City of Beverly Hills will have no responsibility for documents that do not arrive in
a timely manner, no matter what the reason.

The prequalification packages submitted by
Contractors are not public records and are not
open to public inspection. All information provided will be kept confidential to the extent permitted by law. However, the contents may be disclosed
to third parties for purpose of verification, or
investigation of substantial allegations, or in
an appeal hearing. State law requires that the
names of contractors applying for prequalification
status shall be public records subject to disclosure, and the first page of the questionnaire will be used for that purpose.

Each questionnaire must be signed under penalty
of perjury in the manner designated at the end
of the form, by an individual who has the legal
authority to bind the Contractor on whose behalf
that person is signing. If any information provided by a Contractor becomes inaccurate, the Contractor must immediately notify the CITY and
provide updated accurate information in writing,
under penalty of perjury.

The CITY reserves the right to waive minor
irregularities and omissions in the information
contained in the prequalification application submitted, and to make all final determinations. The CITY may also determine at any time that the
prequalification process will be suspended for
the Project and the Project will be bid without
prequalification.

Contractors may submit prequalification packages during regular working hours on any day that the offices of the CITY are open. Contractors
who submit a complete prequalification package
will be notified of their qualification status no later than ten business days after submission of the
information.

The CITY may refuse to grant prequalification
where the requested information and materials
are not provided by the due date indicated above.

There is no appeal from a refusal for an incomplete or late application, but re-application for a later project is permitted. Neither the closing time
for submitting prequalification packages for this
Project will be changed in order to accommodate
supplementation of incomplete submissions, or
late submissions, unless requested by the CITY
in its sole discretion.

In addition to a contractor’s failure to be pre-qualified pursuant to the scoring system set forth in the prequalification package, a contractor may
be found not prequalified for either omission of or
falsification of, any requested information.

Where a timely and completed application results
in a rating below that necessary to pre-qualify,
an appeal can be made by the unsuccessful
Contractor. An appeal is begun by the Contractor
delivering notice to the CITY of its appeal of
the decision with respect to its prequalification
rating, no later than two business days following
notification that it is not pre-qualified. The notice
of appeal shall include an address where the
Contractor wishes to receive notice of the appeal
hearing. Without a timely appeal, the Contractor
waives any and all rights to challenge the decision of the CITY, whether by administrative process, judicial process or any other legal process or proceeding.

If the Contractor gives the required notice of
appeal, a hearing shall be conducted no earlier
than five business days after the CITY’s receipt
of the notice of appeal and not later than five
business days prior to the date of the Notice
Inviting Bids for this Project. Prior to the hearing,
the Contractor shall, in writing, be advised of
the basis for the City’s pre-qualification determination.

The hearing shall be conducted by a panel
consisting of three members of the Public
Works Department senior management staff
(the “ Appeals Panel” ). The Appeals Panel
shall consider any evidence presented by the
Contractor, whether or not the evidence is presented in compliance with formal rules of evidence. The Contractor will be given the opportunity to present evidence, information and arguments as to why the Contractor believes it
should be pre-qualified. Within one day after
the conclusion of the hearing, the Appeals
Panel will render a written determination as
to whether the Contractor is pre-qualified. It
is the intention of the CITY that the date for
the submission and opening of bids will not be
delayed or postponed to allow for completion of
an appeal process.

of design.
“If we see something thatlooks good, but
it is di©cult to navigate, we're going to say

The Beverly Hills City Council voted 4-1 to
increase optional campaign spending limits
ahead of the 2024 election. The vote came
at the council’s formal meeting on Oct. 17.

Candidates on the Beverly Hills municipal
ballot who agree to the voluntary limits had
previously been allowed to accept a maximum
of $80,000 in campaign contributions, with
individual donations limited to $450 each.

The ordinance just passed raises the overall
ceiling to $100,000, and allows people or
entities to give as much as $500 per donation.

The old limits had been in place since
2014, following an ordinance approved in
2012. An ad hoc committee including Mayor
Dr. Julian Gold and Councilmember Lili
Bosse recommended raising the caps on
campaign spending to account for in‰ation
and general increases in costs over the past
decade.
“I was very comfortable with this,” Gold
said. “I don’t know if we have to address
this every year, but certainly every decade.”

New Housing
Element Will
Protect Local
Zoning Control
After two years of trying, and failing to meet
the state’s ambitious housing requirements,
the city of Beverly Hills is hoping that its
recently updated Housing Element plan will
’ nally satisfy Sacramento.

Every city in California is required to
submit a Housing Element outlining how
it will create capacity for a state-mandated
number of housing units by 2029.

VOL. LIX NO. 46 THE NEWSPAPER OF RECORD FOR BEVERLY HILLS NOVEMBER 24, 2023 BEVERLYHILLSCOURIER.COM A Ray of Hope in the Dark
On Nov. 19 and 20, survivors of the Oct. 7
Hamas attack and their family members
joined religious leaders at the Beverly Hills
Towers building at the corner of Canon Drive
and Santa Monica Boulevard as part of a
demonstration calling for the release of 240
Israeli hostages in Gaza. Dubbed “A Ray of
Hope for Every Hostage,” the demonstration featured 240 lights beaming into the sky, each representing one of the captives,
and included a musical performance and
speeches demanding the hostage’s release.

Beverly Hills City Councilmember Dr.

Sharona Nazarian addressed the crowd,
which stood across the street waving Israeli
— ags and cheering, urging residents to contact their representatives and demand they call for the hostages to be released.
“It’s been 45 days since the brutal and
barbaric slaughter of over 1400 innocent
civilians,” and the capture of Israeli hostages,
Nazarian said. “Call your elected o˜ cials and
demand they bring the hostages back now.”

In the midst of ongoing housing issues, two

construction is scheduled to begin.

Rodeo Drive Holiday
Lighting Celebration
Dazzles Thousands
Rodeo Drive was bedecked, bedazzled and
bejeweled for its annual Holiday Lighting
Celebration on Nov. 16. As in previous
years, thousands converged on the world-famous thoroughfare to enjoy an evening of Crowds converged on Rodeo Drive for the Holiday Lighting Celebration on Nov. 16.

Approximately 1,000 people expressed
support for Israel while attending “One
People, One Heart: Solidarity with Israel,”
a community event held Nov. 19 at Sinai
Temple in Westwood.

At the Sunday evening gathering in
Sinai’s Ziegler Sanctuary, participants
included Sinai Temple Co-Senior Rabbis
Erez Sherman and Nicole Guzik; Jewish
Federation of Greater Los Angeles CEO and
President Rabbi Noah Farkas; Consul General
of Israel in Los Angeles Israel Bachar; State
Assemblymember Jesse Gabriel; 14-year-old
Ela Shani, an Israeli survivor of the Oct. 7
attack on Israel; and Pastor John-Paul Foster
of Faithful Central Bible Church.

Sinai Temple and the Jewish Federation
of Greater Los Angeles co-organized the
program.

More than 40 days after the attack on
Israel, when Hamas in£ ltrated Israel’s border
and massacred more than 1,200 Israeli
civilians and kidnapped approximately 240
people, the community was struggling with
how to keep the tragedy in their hearts and
minds while continuing with day-to-day life,
said Farkas of the Federation.

The Council of the City of Beverly Hills, at its meeting to be held on Monday, March 18, 2024, starting at 7:00 p.m., or as soon thereafter as the matter may be heard, in the Council Chamber of the City Hall, 455 N. Rexford Drive, Beverly Hills, CA 90210, will hold a public hearing to consider:

RESOLUTION TO ADOPT AMENDMENTS TO THE HOUSING ELEMENT OF THE GENERAL PLAN ADOPTED FOR THE 6TH CYCLE PLANNING PERIOD FROM 2021 TO 2029; AND AN ADDENDUM

TO AN ADOPTED MITIGATED NEGATIVE DECLARATION FOR

THE HOUSING ELEMENT AMENDMENTS
The Project involves amendments to the City’s General Plan Housing Element as adopted on February 23, 2023 for the planning period from 2021 to 2029 (6th Cycle). No physical development nor construction is currently proposed as part of the Project. The Housing Element is a planning document that contains programs and policies to guide housing development in the City. The Housing Element includes the following topics: analysis of the City’s demographic characteristics and housing needs; evaluation of resources and opportunities available to address current and future housing needs; analysis of potential constraints on meeting the City’s housing needs; a review of the City’s accomplishments during the previous planning period; and updated policies and programs intended to address the City’s housing needs for the period through 2029. Additionally, the Housing Element discusses how the City’s land use and zoning regulations and programs will accommodate the City’s Regional Housing Needs Assessment (RHNA), which is the number of housing units expected to be needed for the next planning period (2021-2029), and includes a list of suitable sites to accommodate housing at various levels of affordability. The Project area covers the entire City of Beverly Hills since the Housing Element addresses housing conditions throughout the City. The City Council will consider adoption of a General Plan Amendment to adopt a revised and amended version of the adopted 2021-2029 Housing Element of the General Plan. The City Council will also consider adoption of an addendum to the Initial Study/Mitigated Negative Declaration (MND) prepared for the Project. The revised Housing Element document is available at: www.beverlyhills.org/housingelementupdate.

The revisions to the Housing Element have been made in response to the comments provided in letters from the state Housing and Community Development Department (HCD), and primarily consist of changes to the policies and programs in the Housing Plan, such as the addition of greater details and specific timelines, the addition of further information of local knowledge and data within the Affirmatively Furthering Fair Housing (AFFH) section of Appendix A, and revisions to the suitable sites inventory to add criteria to determine suitable sites and realistic capacity of these sites to accommodate housing units. In addition, more information and analysis has been added regarding potential sites for adaptive reuse/conversion mixed use projects and research to support this trend. The Planning Commission reviewed the Housing Element at a special meeting on Thursday, February 29, 2024, received public comments, and provided comments on the Housing Element. At the end of their deliberations, the Commission unanimously voted to adopt a resolution (4-0) recommending the adoption of the amended and revised 2021-2029 Housing Element and the addendum to the previously adopted MND to the City Council.

ENVIRONMENTAL REVIEW
The City of Beverly Hills has previously adopted a Mitigated Negative Declaration (MND) for the updates to the Housing Element of the General Plan (Project). The City of Beverly Hills was the lead agency, pursuant to the California Environmental Quality Act (CEQA), and was responsible for the preparation of the MND and related initial study. The previously adopted MND document is available at www.beverlyhills.org/environmental. If a digital copy cannot be obtained by an interested party, please contact the staff listed in this notice and alternate arrangements will be made.

The previously adopted MND indicated that the Project would not result in significant impacts to Agricultural and Forestry Resources, and Mineral Resources, and less than significant impacts, with certain mitigations, related to Aesthetics, Air Quality, Biological Resources, Cultural Resources, Energy, Geology and Soils, Greenhouse Gas Emissions, Hazards and Hazardous Materials, Hydrology and Water Quality, Land Use and Planning, Noise, Population and Housing, Transportation/Traffic, Public Services, Recreation, Tribal Cultural Resources, Utilities and Service Systems, and Wildfire. An addendum to the previously adopted MND for the revisions to the adopted Housing Element document has been prepared, pursuant to California Code of Regulations, Title 14, §15164. A copy of the addendum will be available as part of the agenda materials and City Council packet for this meeting date, on www.beverlyhills.org/citycouncilmeetings, at least 72 hours before the meeting. The Project description and location are described above, and the adoption of amendments includes changes that are limited to technical revisions and the addition of information. The primary changes to the adopted Housing Element that will be evaluated in the addendum include:
changes to the policies and programs in the Housing Plan, such as the addition of greater details and specific timelines, the addition of a more extensive section on Affirmatively Furthering Fair Housing (AFFH), and changes to the sites inventory to add further detail regarding the selection of included sites and to remove possible sites to accommodate housing.

Since these changes consist of technical changes and the addition of information that will not result in significant impacts to the areas of study in the adopted MND, and none of the conditions in California Code of Regulations, Title 14, §15162 have occurred, the City Council will consider the adoption of the addendum to the previously adopted MND.

A copy of the addendum will be available as part of the agenda materials and City Council packet for this meeting date, on www.beverlyhills.org/citycouncilmeetings, at least 72 hours before the meeting. changes to the policies and programs in the Housing Plan, such as the addition of greater details and specific timelines, the addition of a more extensive section on Affirmatively Furthering Fair Housing (AFFH), and changes to the sites inventory to add further detail regarding the selection of included sites and to remove possible sites to accommodate housing.

Since these changes consist of technical changes and the addition of information that will not result in significant impacts to the areas of study in the adopted MND, and none of the conditions in California Code of Regulations, Title 14, §15162 have occurred, the City Council will consider the adoption of the addendum to the previously adopted MND.

(CITY UTILITY SERVICES) OF TITLE 6 (UTILITIES AND FRANCHISES) OF THE BEVERLY

HILLS MUNICIPAL CODE AND RENUMBERING
THE REMAINING SECTIONS OF ARTICLE 3

ACCORDINGLY

THE CITY COUNCIL OF THE CITY OF BEVERLY HILLS

charges for water services and facilities furnished
by the City (the “water service charges”) and the
rates and charges for wastewater services and facilities furnished by the City (the “wastewater service charges”), as provided in Exhibit A. c. The City Council identified the parcels upon
which the proposed water service charges and the
proposed wastewater service charges would be
imposed and calculated the amount of the proposed water service charges and the proposed wastewater service charges.
d. The City Clerk caused a notice of the time and
place of a public hearing on the proposed water
service charges and proposed wastewater service
charges to be mailed as required by Section 6 of
Article XIIID of the California Constitution.

water service charges and proposed wastewater
service charges, the basis upon which the
amounts of the proposed water service charges
and proposed wastewater service charges were
calculated, the reason for the proposed water
service charges and proposed wastewater service charges, and the date, time, and location of a public hearing on the proposed water service
charges and proposed wastewater service

EMAIL BLAST!
Our email blast program features an unparalleled data base from our media partners the Los Angeles Times.

We can target virtually any geographic area and demographic desired. For example, if you are looking for a potential customer that is within any particular zip code, like 90210, or wish to reach a person who might drive a Tesla, be a patron of the arts, or a dog owner, we can target that potential customer. In addition, we can break down earnings, education, home ownership and laser target that customer base. The email comes from YOU not the LA Times or the Beverly Press. It is a highly effective and cost efficient way to reach your audience.
