RECOMMENDATION
Staff recommends that City Council approve an additional six-month extension of the temporary closure of North Cañon Drive at Wilshire Boulevard until December 31, 2024.
INTRODUCTION
On July 24, 2018, City Council approved the closure of North Cañon Drive for a minimum of two years and up to six years to mitigate the construction impacts of the Los Angeles County Metropolitan Transportation Authority (Metro) Purple (D) Line Extension – Section 2 project (Attachment 1). Per Article XII of the MOA with Metro, the street was closed and a cul-de-sac was created in September 2019, followed by the construction of the temporary sound wall with a mural designed by Tomokazu Matsuyama across North Cañon Drive at Wilshire Boulevard. The temporary street closure with the sound wall is currently in place through June 2024 and, per the original approval in 2018, may be continued until September 2025 with City Council approval.
DISCUSSION
On September 21, 2021, City Council approved a one-year extension of the temporary closure of North Cañon Drive until September 30, 2022 (Attachment 2). On September

Meeting Date: May 21, 2024
12, 2022, City Council approved a nine-month extension of the temporary closure until June 30, 2023 (Attachment 3). On June 6, 2023, City Council approved a six-month extension until December 31, 2023 (Attachment 4). On November 7, 2023, City Council approved a six-month extension until June 30, 2024 (Attachment 5).
Metro Section 2 construction is near completion of the underground main station structures along Wilshire Boulevard. In addition, multiple appendage structures at South Beverly Drive and South Cañon Drive have been under construction since summer of 2023 and near the alley within the Cañon Staging Yard east of North Cañon Drive since early 2024. The 20-foot-high sound wall has successfully mitigated the noise, dust, and traffic control disruption impacts of these major construction activities. The closure has also provided a safe and consistent traffic pattern and uninterrupted access for businesses located on North Cañon Drive.
Anticipated Construction in 2024
Within 2024, Metro will continue to set up cranes to access deck panels along Wilshire Boulevard for material deliveries and pump concrete to continue to construct below ground station’s entrance, roof deck, side structures, and other components. For these activities, Wilshire Boulevard between Beverly Drive and Crescent Drive is typically reduced to a minimum of two lanes in each direction during day shifts and a minimum of one lane in each direction during night shifts.
In addition, Metro will continue building multiple appendage structures through 2024 and 2025. Appendage structures include various features such as utility rooms, ventilation shafts, and emergency exits. They are located on the north and south sides of Wilshire Boulevard, extending into sidewalks between the alley west of Beverly Drive and Crescent Drive. A couple of appendage structures are located close to the North Cañon Drive and Wilshire Boulevard intersection and the southwest corner of Cañon Staging Yard. For any substantial continuous traffic closures related to the Section 2 project, Metro will be required to submit a traffic study to verify the minimal impact on the traffic flow along the arterial streets or seek alternative traffic control and/or mitigation options.
If the closure and sound wall remain in place until the end of 2024, traffic patterns will remain consistent. North and South Beverly Drive will remain accessible in both directions with intermittent traffic taper or soft closure of the southbound curb lane during multiple appendage construction near Beverly Drive. During this summer, the City plans to add an east crosswalk at the intersection of Wilshire Boulevard and Crescent Drive, and Crescent Drive will remain open in both directions with intermittent soft closure of the northbound curb lane. The 20-foot sound wall will continue to mitigate noise, dust, traffic control disruptions, and lighting from construction activities at the Cañon Yard entrance and Wilshire Boulevard. The Public Information Graphics with business wayfinding signs and the sound wall mural will remain in place to beautify the cul-de-sac and Wilshire Boulevard side of the sound wall.
If the closure and sound walls are removed post-June 2024, traffic patterns at North Cañon Drive and Wilshire Boulevard would require daily changes with closures and/or turn restrictions as the station construction continues. With continuous access to the Cañon Yard, daily access through the deck, and other activities along Wilshire Boulevard, implementation of daily traffic control will be necessary along North Cañon Drive as far north as Dayton Way using message boards, detour signage, and/or traffic cones near business entrances, permitted parklets, and valet as well as on-street parking restrictions. Removing the sound wall would also impact pedestrian paths to Meeting Date: May 21, 2024
North Cañon Drive with intermittent sidewalk closures. Noise, dust, and lighting impacts would be more noticeable to businesses on North Cañon Drive. It would also create an irregular traffic pattern as detours must be implemented daily and nightly traffic control, and crane setup for deck access on Wilshire Blvd and appendage work close to Cañon Yard. Finally, removing the cul-de-sac would increase the chance of Metro heavy construction vehicles driving along North Cañon Drive (though that would violate approved haul routes).
Environmental Considerations
The Final Environmental Impact Report (EIR)/Environmental Impact Statement (EIS) prepared by Metro covers the impacts of North Cañon Drive closure at Wilshire Boulevard until the end of Purple Line Extension – Section 2 construction.
Community Engagement
City staff completed the following stakeholder meetings and outreach to receive feedback on the proposal to extend the North Cañon Drive closure extension until December 2024.
Staff presented at the Monthly Chamber of Commerce Stakeholder Meeting on April 10, 2024; the Chamber shared a letter of support for the six-month closure extension on May 1, 2024.
Staff presented at the Beverly Hills Chamber of Commerce Government Affairs Committee meeting on April 11, 2024; no objection was received. Staff informed the Next Beverly Hills Committee and the Arts and Culture Commission representatives in April 2024; no objection was received. One-on-one contacts were made with stakeholders located along North Cañon Drive between Wilshire Boulevard and North Santa Monica Boulevard between April and May 2024. Some of the stakeholders include the Maybourne Beverly Hills, 9401 Wilshire, Spago, Nusr-Et, Hilton & Hyland, Brickstar Capital, Canon Properties, Mastro’s, Rodeo Realty, and 190 N Cañon Dr. Fred Hayman Building.
Overall, no objection was received to this 6-month extension until December 31, 2024.
Attachment 6 includes stakeholder comments. 9401 Wilshire and Spago shared support for the six-month extension of the closure. Canon Properties, while not opposing the six-month extension within the current timeframe, conveyed that they oppose any further extension beyond the end of 2024 due to the lease of 166 N. Cañon Drive, which is located just north of the sound wall. If an additional extension of the closure is considered in 2025, staff will explore alternative or additional mitigation options that might accommodate the visibility of the 166 N.
Cañon Drive building while maintaining construction mitigations. Cañon Drive Closure extension notices were hand-delivered to the residents and businesses bound by South Santa Monica Boulevard, North Cañon Drive, Dayton Way, Rexford Drive, Camden Drive, and Olympic Boulevard on May 1, 2024. These same notices were emailed to the City’s contact database on May 3, 2024. Links to this notice and upcoming City Council meeting agenda items Meeting Date: May 21, 2024
were posted on the City website and shared on social media platforms. No comments or questions were received.
Overall, staff has received support and/or no objection to the 6-month extension until December 2024 request from the residential and business communities.
Next Steps
If the extension of the closure is approved, staff will continue maintenance of the mural and Public Information Graphics on the sound wall and the landscaped planters to keep the cul-de-sac aesthetically pleasing. Staff will also monitor community concerns and work with Metro and appropriate City departments to mitigate any North Cañon Drive closure-related concerns or consider earlier re-opening of North Cañon Drive depending on the project progress. Near the expiration date of the closure, staff will provide updates on the Purple Line project to City Council to consider whether to further extend the temporary closure of North Cañon Drive at Wilshire Boulevard.
If this item is not approved, staff will schedule to remove the mural and coordinate with Metro to remove the temporary sound wall. With this decision, Public Works staff will coordinate with OpenBH staff and stakeholders to amend the outdoor dining permits to include necessary traffic control or other measures to avoid conflicts with construction activities near the dining parklet.
FISCAL IMPACT
There is no direct fiscal impact associated with approving this request. Per the MOA, Metro is to pay for the installation and removal of the sound wall and other work associated with the closure, as well as reimburse the City for its associated costs.
Funds are available in the approved budget for CIP No. 00050 for Metro project-related mitigation and engineering expenses, including the monitoring of North Cañon Drive closure and maintenance of Public Information Graphics and mural at the sound wall.

RECOMMENDATION
That City Council approve the final recommended roadway designs for North Canon Drive and Clifton Way for the temporary closure of North Canon Drive at Wilshire Boulevard, authorizing the installation of the roadway changes.
INTRODUCTION
In response to stakeholder concerns, on June 27, 2017, the City Council approved a Memorandum of Agreement (MOA) for Metro utility relocation work related to Section 2 of the Purple Line Extension project that included the requirement for a feasibility analysis to study options for temporarily closing North Canon Drive at Wilshire Boulevard to vehicular traffic.
The feasibility analysis, completed by Fehr & Peers consulting firm, concluded that traffic operations during the closure could improve by providing advanced vehicle detour signage, updating traffic signal timings, and the signalization of the North Crescent Drive and Clifton Way intersection. On March 6, 2018, City Council approved the feasibility analysis and approved moving into the design development phase of the project.
City and Metro staff hosted a series of three stakeholder meetings with the businesses on North Canon Drive to discuss design priorities and review drafts of the roadway designs for North Canon Drive and Clifton Way, which are discussed in detail in this
Meeting Date: July 24, 2018
report. If approved, City Council would authorize Metro to install these roadway changes in conjunction with the sound wall.
DISCUSSION
On June 27, 2017, the City Council approved an MOA for Metro utility relocation work related to Section 2 of the Purple Line Extension project. The MOA (AG #348-17) authorized staff to issue Metro the necessary permits for Southern California Edison underground utility relocation work for the future Wilshire/Rodeo Station 1. The Wilshire/Rodeo underground station box will span Wilshire Boulevard between Beverly and Crescent Drives, with the on-street work zone spanning (approximately) west of El Camino Drive to east of Rexford Drive.
During public comment on June 27, 2017, representatives from Spago restaurant and other businesses advocated placing a tall sound wall, creating a cul-de-sac, and providing valet service to assist the businesses and restaurants on North Canon Drive during the disruption created by construction. Spago reported general support of a proposed street closure from adjacent businesses.
A key element highlighted for the approval of the MOA was the inclusion of a feasibility analysis to study options for a temporary closure of North Canon Drive at Wilshire Boulevard to vehicular traffic to address noise, vibration, and pollution generated by construction activity, and to mitigate possible driver confusion due to lane closures required during various construction activities.
Following City Council approval of the MOA (AG #348-17), City staff engaged Fehr & Peers consulting firm to conduct a more detailed transportation impact analysis (TIA) to evaluate construction related impacts to nearby intersections with a potential closure of North Canon Drive at Wilshire Boulevard (Attachment 1). The study area included 15 intersections that extend into the residential neighborhoods, bounded by Brighton Way to the north, North Beverly Drive to the west, Charleville Boulevard to the south, and North Rexford Drive to the east. The analysis concluded that traffic operations could improve by providing advanced vehicle detour signage, updating traffic signal timings, and the signalization of the North Crescent Drive and Clifton Way intersection. It also recommended a review of the striping of Clifton Way during design development to determine if opportunities exist for increasing the roadway capacity to further improve traffic operations.
City Council approved the feasibility analysis on March 6, 2018 and approved moving into the design development phase of the project. City and Metro staff hosted a series of three stakeholder meetings on April 19, 2018, May 10, 2018, and June 11, 2018 with the businesses on North Canon Drive to discuss design priorities and review drafts of the roadway designs for North Canon Drive and Clifton Way. The final recommended designs are shown in Attachment 2. At these meetings, stakeholders also discussed three concept designs that consulting firm Psomas - the company on contract with the City for work related to the Metro Purple Line extension - developed in conjunction with the feasibility analysis to start the conversation about potential design alternatives (presented to City Council on March 6, 2018 and shown in Attachment 3).
Throughout the meetings, stakeholders requested a design that prioritizes circulation through the cul-de-sac, retains the existing meters on North Canon Drive, and 1 City of Beverly Hills, City Council Adjourned Meeting ... Minutes, June 29, 2017, Item G-2.
Meeting Date: July 24, 2018
maxImIzes on-street parking as much as possible without inhibiting traffic flow. The majority of stakeholders did not support a design that included diagonal parking, either in the median or along the curb as shown in several of the initial concept designs prepared with the feasibility analysis, due to concerns of congestion through the cul-de-sac from drivers waiting for parking stalls.
The final recommended designs developed with stakeholders are discussed in detail below. The Beverly Hills Fire and Police Departments reviewed and approved the final recommended designs.
North Canon Drive
The future sound wall will be located along the northern boundary of the property at 160 North Canon Drive, the future Canon staging yard. Vehicles entering and exiting the staging yard will do so south of the sound wall.
The final recommended design for North Canon Drive between Clifton Way and Wilshire Boulevard converts to one southbound lane to accommodate turning vehicles around the cul-de-sac and retains two northbound lanes. Due to the width of North Canon Drive, the street cannot accommodate two turning lanes around the cul-de-sac. Staff determined with stakeholder feedback that a second northbound travel lane would provide more benefit to the project than a second southbound lane as it would provide sufficient travel space for drivers to go around the valet activity and help maintain traffic flow through the cul-de-sac.
The parking stalls on the east side of the street shift to the north to provide space for the sound wall and for vehicles traveling through the cul-de-sac. One 20 minute metered parking stall on the east side of North Canon Drive at Clifton Way is temporarily relocated to the west side of the street as there is not adequate space for all eight existing parking meters. This shift maintains the existing number of meters on North Canon Drive. The remaining seven stalls on the east side operate as valet parking for Citizen and Spago during certain hours of the day and retain their existing hours of operation, per stakeholder requests.
As the existing crosswalk across North Canon Drive at Wilshire Boulevard will be south of the sound wall, the cul-de-sac is delineated by planters and/or bollards to create a new 10-foot wide pedestrian crossing area, which includes new curb access ramps on each side of the street.
The existing two southbound travel lanes approaching Clifton Way convert to a left turn pocket for vehicles turning left onto Clifton Way and a shared through/right turn lane, maintaining access to the parking structure entrance located at the intersection of North Canon Drive and Clifton Way. Signage at the entrance to the cul-de-sac will alert drivers that there is "no outlet" and that truck traffic is prohibited, as large trucks will be too long to be able to safely travel through the cul-de-sac.
The following design elements are included at the request of the stakeholders:
• Retains existing seven valet spaces
• Retains a second northbound lane that valet drivers can use to more quickly move vehicles off of the cul-de-sac
• Retains a second northbound lane to minimize the possibility of southbound vehicle queuing that may block driveways as motorists wait to access the valet
Meeting Date: July 24, 2018
• Does not add more than one parking stall to the west side of the street, which could lead to vehicle queuing in front of driveways as motorists wait to park • Retains the existing metered parking for business patrons traveling to the area outside of valet hours
• Provides an approximately 10-foot wide pedestrian walkway between the cul-desac and the sound wall to maintain accessibility Clifton Way
The feasibility analysis projected an increase in traffic volumes on North Crescent Drive as a result of the closure. As part of the project, Metro will install a new traffic signal at the intersection of Clifton Way and Crescent Drive to improve traffic flow.
The feasibility analysis also recommended exploring opportunities to restripe Clifton Way between North Canon Drive and North Crescent Drive to add capacity to the block. The design temporarily removes parking on the south side of Clifton Way to allow the center line to be shifted south for wider travel lanes. Shifting the center line to the south will provide more space for large vehicles/vans accessing the existing loading zone on the north side of the street in front of Sunrise Senior Living and allow continued operation of the loading zone.
The one-way, southbound alley that intersects with Clifton Way will temporarily convert to two-way just north of the valet-only parking structure entrance, allowing valet drivers to make left turns onto westbound Clifton Way and return to the valet on North Canon Drive. When the closure is installed, valet drivers would no longer have access to the valet from Wilshire Boulevard. Allowing left turns onto Clifton Way from the alley will help valet drivers move vehicles off of North Canon Drive more quickly, which should improve traffic flow. Temporary parking removal on the south side of Clifton Way will also improve visibility for valet drivers making left turns from the alley onto westbound Clifton Way.
In addition, the design temporarily removes one parking stall on the north side of the street at the intersection with North Canon Drive to improve traffic flow by providing space for right-turning vehicles, which should help move vehicles off of Clifton Way more quickly.
Community Outreach
City and Metro staff completed the following community meetings and stakeholder outreach to determine the final recommended designs for North Canon Drive and Clifton Way:
1. Monthly community outreach meetings were held on April 4, 2018, May 2, 2018, and June 6, 2018, and staff presented the final recommended designs at the meeting on July 11, 2018.
One resident asked if there would be coordination between the potential closure and construction traffic control for the proposed 100 North Crescent Drive development. Spago suggested removing an additional parking stall on the north side of Clifton Way or shifting the center line farther south to assist valet drivers in making left turns.
Meeting Date: July 24, 2018
2. Monthly presentations were provided to the Traffic and Parking Commission on April 5, 2018, May 3, 2018, and June 7, 2018. The Commission reviewed the final recommended designs on July 12, 2018 and provided their comments to be forwarded to the City Council.
The Commission received one written comment from Coldwell Banker in support of the final recommended designs due to the revised parking configurations on North Canon Drive and Clifton Way.
Commissioners Meshkaty and So/nit expressed concern that left turns from the alley onto westbound Clifton Way could conflict with through traffic, and that making the traffic signal permanent may not benefit the neighborhood in the longterm.
Commissioner Manaster expressed that he did not support the design in its entirety. He believes the second northbound lane will cause congestion through the cul-de-sac and has concern about making the traffic signal permanent.
Commissioner Seidel expressed support of the designs, but expressed concern about making the traffic signal permanent.
3. Three "Stakeholders" meetings were held on April 19, 2018, May 10, 2018, and June 11, 2018. Stakeholders included the Beverly Hills Chamber of Commerce, Conference and Visitor's Bureau, Spago Beverly Hills, Citizen, the Montage Hotel, Coldwell Banker, and Douglas Emmett. Staff emailed the final recommended designs to stakeholders on July 9, 2018.
In response to the email, staff received one comment from Douglas Emmett in support of the final recommended designs. Staff did not receive any stakeholder comments in opposition to the final recommended designs.
4. Staff presented design concepts and accepted feedback at the May 10, 2018 Chamber of Commerce Government Affairs Committee meeting and the June 12, 2018 Chamber of Commerce Brokers Roundtable meeting.
Staff answered questions about the designs, but meeting attendees did not provide any comments in support of or opposition to the designs.
5. City staff met with business stakeholders individually to review the designs and answer questions, upon request.
Noticing
City staff mailed public notices (shown in Attachment 4) citywide on July 3, 2018, which included announcements that the North Canon Drive Closure would be discussed at the July 12, 2018 Traffic and Parking Commission meeting and the City Council Formal Meeting on July 24, 2018. City staff also emailed the public notice to stakeholders involved in the design development process on July 3, 2018.
On July 6, 2018, notices (Attachment 4) were hand delivered to the properties below, announcing that the North Canon Drive Closure would be discussed at the July 12, 2018 Traffic and Parking Commission meeting.
• All businesses on North Canon Drive between Wilshire and North Santa Monica Boulevards
Meeting Date: July 24, 2018
• Properties between the alleys to the east and west of North Canon Drive on South Santa Monica Blvd, Brighton Way, Dayton Way, Clifton Way, and Wilshire Blvd
• Properties on Crescent Drive between Dayton Way and Wilshire Boulevard On July 19, 2018, follow-up notices (Attachment 4) were hand delivered to the following properties, announcing that the North Canon Drive Closure would be discussed at the July 24, 2018 City Council Formal Meeting.
• All businesses on North Canon Drive between Wilshire and North Santa Monica Boulevards
• Properties between the alleys to the east and west of North Canon Drive on South Santa Monica Blvd, Brighton Way, Dayton Way, Clifton Way, and Wilshire Blvd
• Properties on Crescent Drive between Dayton Way and Wilshire Boulevard • Businesses on Wilshire Boulevard between Beverly Drive and Crescent Drive Next Steps
City Council approval of the final recommended designs for the North Canon Drive closure authorizes Metro to install the roadway changes in conjunction with the sound wall, cul-de-sac, striping changes on Clifton Way, and traffic signal at Clifton Way/North Crescent Drive. Per the feasibility analysis, implementation will also include installation of advanced vehicle detour signage (such as at the intersections of North Canon Drive at North Santa Monica Boulevard and South Santa Monica Boulevard) to alert drivers of the closure and instruct them to take other streets, and an update of existing signal timing to account for shifts in traffic flow. Implementation is anticipated to occur in fall 2018, prior to commencement of major construction activities like piling and decking.
Sound Wall Aesthetics
On March 6, 2018, along with approval to begin the design development phase of the North Canon Drive closure, City Council approved Public Information Graphics concepts for the Wilshire/Rodeo Station (Attachment 5). Since approval of both, City staff has worked with business stakeholders, the Next Beverly Hills committee, and partner agencies to determine a process for applying art work on the north side of the sound wall on North Canon Drive, with the goal of creating an aesthetically pleasing cul-de-sac that fosters a sense of place and identifies North Canon Drive as a destination.
Due to uncertainty of the exact construction timeline for sound wall installation, the project team is working on the following options for covering the wall:
• Develop mural program with the Next Beverly Hills committee • Use the wall to showcase past winners of the Beverly Hills Art Show • Create a graphic design to incorporate elements of the Winter Bold graphics • Create a graphic associated with the previously approved public information graphics that will be applied to the other sound walls in the Wilshire/Rodeo station area
The design will require funding, which will be brought to the City Council separately for consideration.
Meeting Date: July 24, 2018
ENVIRONMENTAL CONSIDERATIONS
The Final Environmental Impact Report (EIR)/Environmental Impact Statement (EIS) prepared by Metro concluded that there would be significant unavoidable traffic impacts as a result of construction of the Purple Line Extension, including in the vicinity of the Wilshire/Rodeo station. Metro adopted a statement of overriding considerations for the temporary construction impacts and adopted mitigation measures intended to reduce, but that would not eliminate the significant impacts. A decision to proceed with the temporary closure of Canon Drive would be considered an action of the City, as a responsible agency, to implement the mitigation measure as contemplated in the Final EIR/EIS, and although the Fehr & Peers study identifies potentially significant impacts at certain intersections, the potential for these unavoidable impacts were disclosed in Metro's EIR/EIS. Thus, the impacts were also covered by Metro's statement of overriding considerations.
After City Council approval of the feasibility analysis on March 6, 2018, the City Council found that it considered the Final EIR/EIS analysis of construction traffic impacts, that the closure and its impacts are covered by Metro's Final EIR/EIS, and directed staff to file a notice of determination in reliance on the Final EIR. It should be noted that, as a responsible agency, the City does not have to state that Metro's EIR complies with CEQA, per CEQA Guidelines Section 15096(i). Staff filed the notice of determination with the Los Angeles County Clerk's office on April 16, 2018 for posting, which commences a 30 day statute of limitations for legal challenges to the approval. The City did not receive any legal challenges during this period, thus the statute of limitations has ended. Council approval of the final recommended roadway designs for North Canon Drive and Clifton Way for the temporary closure of North Canon Drive at Wilshire Boulevard, authorizing the installation of the roadway changes, represents implementation of mitigation measure and feasibility action of the City Council and direction to proceed with the closure and related actions, and is within the scope of the City's prior environmental determination.
FISCAL IMPACT
The terms of the MOA include provisions to provide reimbursement of costs for all staff and consultants performing work associated with the Third Party Advance Utility Relocation Phase of the Westside Purple Line Extension - Section 2 in Beverly Hills.
The City is currently negotiating the Design-build MOA for the Rodeo Station and Metro has committed to pay for the North Canon Drive improvements as part of the future approval of the MOA.
RECOMMENDATION
That City Council approve the final recommended roadway designs for North Canon Drive and Clifton Way for the temporary closure of North Canon Drive at Wilshire Boulevard, authorizing the installation of the roadway changes.

OVERVIEW
A transportation impact analysis (TIA) was prepared for the potential closure of N. Canon Drive at Wilshire Boulevard during construction of the Rodeo Drive Purple Line Station in Beverly Hills. A feasibility analysis was conducted to evaluate potential operational impacts to nearby intersections during peak morning and afternoon commute hours and midday business hours with the potential closure of N. Canon Drive at Wilshire Boulevard.
The potential closure of N. Canon Drive would occur just north of Wilshire Boulevard. Vehicles would no longer be able to access Wilshire Boulevard directly from N. Canon Drive, or access N. Canon Drive directly from Wilshire Boulevard. Instead, vehicles would be rerouted to adjacent roadways, such as N. Beverly Drive and N. Crescent Drive. Local vehicle access to the southern end of N. Canon Drive prior to the closure would be provided on Clifton Way and Dayton Way. The following study intersections were selected for analysis based on the locations most likely to be impacted due to the closure of N. Canon Drive:

N. Canon Drive Closure Transportation Impact Summary
ANALYSIS SCENARIOS
The operations of the study locations were analyzed for the following scenarios:
■ Existing (2017) Conditions: The analysis of existing conditions was based on traffic counts collected in Fall 2016 and September 2017.
■ Existing Plus Roadway Closure Conditions: This scenario reflects the potential closure of N.
Canon Drive and the rerouting of vehicles based on existing traffic volumes and travel demands. • Mid-Construction (Year 2022) Baseline Conditions: Future traffic projections without the roadway closure were developed for the Year 2022. The objective of this scenario was to forecast future traffic growth and operating conditions that could be expected to result from regional growth and related projects in the vicinity of the project site mid-construction. Year 2022 reflects the time period four years into construction assuming an eight-year construction duration beginning in 2018 and ending in 2026.
■ Mid-Construction (Year 2022) Plus Roadway Closure Conditions: This scenario reflects the potential closure of N. Canon Drive and the rerouting of vehicles based on forecasted Year 2022 traffic volumes and travel demands.
The traffic impact analysis was prepared in accordance with the Beverly Hills Traffic Thresholds of Significance (Planning Commission of the City of Beverly Hills, October 2010).
DOWNTOWN TRIANGLE ACCESS
With the potential closure of N. Canon Drive, vehicles would be rerouted to adjacent roadways, such as Beverly Drive and Crescent Drive. Additional roadway characteristics that factor into the route choices that drivers use when traveling to/from the Golden Triangle are as follows:
■ S. Canon Drive is restricted to right-turns only onto Wilshire Boulevard; therefore, vehicles traveling north on S. Canon Drive cannot continue directly into the Golden Triangle on N. Canon Drive. ■ Dayton Way provides eastbound only travel through the downtown triangle and two-way travel east of N. Crescent Drive.
■ Brighton Way provides westbound only travel through the downtown triangle between N. ■
Crescent Drive and Wilshire Boulevard.
N. Beverly Drive does not permit vehicles to make a southbound left-turn movement from N.
Beverly Drive onto eastbound Wilshire Boulevard.

N. CANON DRIVE LOCAL ACCESS
Local vehicle access would continue to be provided on N. Canon Drive south of Clifton Way. The southern end of N. Canon Drive just prior to Wilshire Boulevard would serve as a cul -de-sac to al low vehicles traveling southbound to make a U-turn and continue northbound on N. Canon Drive. Figure ES-2 displays the on - street parking, valet operations, and local access driveways along N. Canon Drive in the vicinity of the potential closure.
The following travel patterns were considered in the development of the traffic diversions with the roadway closure. Figure ES-3 displays the potential trip diversions with the N. Canon Drive closure. • Turning Movement Restrictions at N. Canon Drive & Wilshire Boulevard: With the closure of N. Canon Drive just north of Wilshire Boulevard, the following turning movements will no longer be permitted: eastbound left-turn and westbound right-turn from Wilshire Boulevard onto N.
Canon Drive; and southbound left-turn and right-turn from N. Canon Drive onto Wilshire Boulevard. • N. Canon Drive Local Access Needs between Clifton Way and Closure: South of Clifton Way, N.
Canon Drive has on-street metered parking on both sides of the roadway. Several of the parking spaces on the east side of N. Canon Drive operate as valet parking zones for the Spago and Citizen restaurants. Other than the on-street parking spaces and valet zones, no other uses have direct access to/from this block of N. Canon Drive.
• Parking Structure at N. Canon Drive & Clifton Way: The west leg of the intersection of N. Canon Drive & Clifton Way provides direct access to a private parking structure for the building at 9401 Wilshire. With the closure of N. Canon Drive, vehicles would exit the garage onto Clifton Way or make a left-turn onto N. Canon Drive. To enter the garage, vehicles would be routed to N. Crescent Drive to utilize Clifton Way, or travel on N. Beverly Drive to Dayton Way to access N. Canon Drive. • N. Canon Drive Local Access Needs between Clifton Way and Dayton Way: North of Clifton Way, the Montage Beverly Hills Hotel 's motor court is accessed to/from N. Canon Drive. Just north of the hotel, a public parking garage also has direct inbound and outbound access on N. Canon Drive. In addition, N. Canon Drive has on-street metered parking on both sides of the roadway and several of the parking spaces operate as valet parking zones during designated time periods. • N. Canon Drive Access Needs between Dayton Way and S. Santa Monica Boulevard: N. Canon Drive provides access to two parking structures (one public and one private) between Dayton Way and S. Santa Monica Boulevard, and has on-street parking with valet zones during designated times.

MID-CONSTRUCTION TRAFFIC FORECASTS
The mid-construction plus roadway closure condition evaluates the traffic volumes for Year 2022 with the rerouting of vehicles due to the closure of N. Canon Drive. The following sources were utilized to develop the mid-construction traffic forecasts:
■ Existing traffic counts
■ Traffic from approved and pending projects in the City of Beverly Hills, City of Los Angeles, and City of West Hollywood
■ Ambient growth in existing traffic volumes to reflect growth in regional traffic; a growth rate of one (1) percent per year was applied to reflect this ambient growth POTENTIAL IMPACTS WITH N. CANON CLOSURE
Impacts to intersection operations, active transportation facilities and transit service with the potential closure of N. Canon Drive are described below:
■ Traffic Operations of Study Intersections: The study intersections were analyzed during existing and mid -construction (Year 2022) conditions with the vehicle trip diversions and rerouting due to the potential N. Canon Drive closure. The City of Beverly Hills traffic impact criteria consider the following changes in V/C at signalized intersection or delay at unsignalized to be a significant impact:

N. Canon Drive Closure Transportation Impact Summary
The following intersections would experience an increase in V/C or delay greater than the thresholds above during one or more analysis periods:
o Wilshire Boulevard & Beverly Drive during the AM peak hour o Wilshire Boulevard & Crescent Drive during the AM and PM peak hours o Clifton Way & N. Crescent Drive during the AM, midday and PM peak hours o Dayton Way & N. Canon Drive during the PM peak hour
Based on the City's threshold guidelines, the project impact would be potentially significant to intersection operations in the vicinity of the N. Canon Drive closure.
The following measures are recommended to improve traffic operations with the N. Canon Drive closure:
a Provide Advanced Vehicle Detour Signage: The impact analysis assumes that the majority of vehicles currently utilizing N. Canon Drive will shift to the closest nearby intersections, such as N. Beverly Drive and N. Crescent Drive. While these intersections are expected to experience an increase in vehicle delay with the N. Canon Drive closure, drivers have multiple access options to/from the Downtown Triangle. Therefore, drivers are likely to select alternate routes further to the east and west to avoid overly congested locations. o Update Traffic Signal Timings: Traffic signal timings should be modified along N. Canon Drive and on the parallel roadways of N. Beverly Drive and N. Crescent Drive to accommodate the shift in vehicle flows with the N. Canon Drive closure and provide additional green time to the heaviest turning movements. o Signalization of Clifton Way & N. Crescent Drive Intersection: With the closure of N. Canon Drive at Wilshire Boulevard, vehicles will shift to N. Crescent Drive. This will result in traffic volume increases along N. Crescent Drive and also at the intersection of Clifton Way & N.
Crescent Drive as vehicles utilize Clifton Way to access local uses along the southern portion of N. Canon Drive. With the additional traffic volumes with the potential closure, the increase in vehicle delay will result in a significant impact based on City thresholds, and the increase in traffic volumes will also result in the intersection meeting the peak hour traffic volume warrant for the installation of a traffic signal. The installation of a traffic signal would result in LOS C or better operations during peak travel hours. • Bicycle Facilities & Access: The potential closure may restrict direct bicycle access between N.
Canon Drive and Wilshire Boulevard, depending on the ultimate design of the cul-de-sac. While bicyclists would have the ability to walk their bikes utilizing the pedestrian pathway, they may not ES-8
N. Canon Drive Closure Transportation Impact Summary
be able to ride between the two roadways with the closure. As part of the data collection effort, bicyclists were counted during peak hours. The volumes indicate a fairly low bicycle demand between N. Canon Drive and Wilshire Boulevard with approximately 5 bicyclists traveling from N.
Canon Drive onto Wilshire Boulevard, or from Wilshire Boulevard onto N. Canon Drive in both the AM and midday peak hours (no bicyclists were observed during the PM peak hour). The City is beginning the process of preparing a Complete Streets Plan that will provide guidance on new active transportation facilities throughout the City. At this time, no additional bicycle facilities are planned adjacent to the project site. Therefore, the project impact is less than significant and no mitigation is required.
• Pedestrian Facilities & Access: The closure of N. Canon Drive would maintain pedestrian access between Wilshire Boulevard and N. Canon Drive. At the stop controlled intersection of N. Canon Drive and Clifton Way, high visibility continental crosswalks along with additional pedestrian crossing signage are planned by the City and are expected to be implemented within the next few months. These pedestrian enhancements will benefit those walking along N. Canon Drive. There are no additional planned pedestrian facilities in the vicinity of the roadway closure. Therefore, the project impact is less than significant and no mitigation is required. • Transit Service: Several transit lines operate within the study area with service provided by Metro.
Metro has already made minor route adjustments to Line 14/37 in conjunction with the advanced utility work being conducted for the Metro Purple Line construction project and the intermittent closure of the eastbound left-turn lane from Wilshire Boulevard onto N. Canon Drive. In addition, Metro relocated several bus stops in the area due to on-going construction activities on Wilshire Boulevard in January 2018. The bus stops were relocated outside of the Metro Purple Line construction zone with the new eastern bus stops on Wilshire Boulevard between Rexford Drive and Crescent Drive and the new western bus stops on Wilshire Boulevard between Camden Drive and Rodeo Drive. The closure of N. Canon Drive would not result in any additional changes to bus service routes or stop locations. Therefore, the project impact is less than significant and no mitigation is required.
ENVIROMENTAL CONSIDERATIONS
The Final EIR/EIS prepared by Metro concluded that there would be significant unavoidable traffic impacts as a result of construction of the Purple Line Extension, including in the vicinity of the Wilshire/Rodeo station. The potential closure, including the results of the feasibility study, is consistent with the conclusions and mitigations identified in Metro's Final EIR/EIS, which found significant unavoidable traffic impacts ES-9
N. Canon Drive Closure Transportation Impact Summary
resulting from construction in the areas of the intersections of Wilshire Boulevard & Beverly Drive and Wilshire Boulevard & Canon Drive. The EIR/EIS includes mitigation measures TCON-1 for preparation of Traffic Control Plans and TCON-4 for Transportation Management Plans to help address the significant and unavoidable traffic impacts caused by construction activities. Specifically, TCON-1 contemplates that traffic control plans developed in close coordination with local agencies, which will have various features including, but not limited to, temporary street closures, detour routes, and temporary traffic signals. Further, TCON4 contemplates transportation management plans that could include the N. Canon Drive Closure.
Metro adopted a statement of overriding considerations for the temporary construction impacts. A decision to proceed with the temporary closure of N. Canon Drive would be considered an action of the City, as a responsible agency, to implement the mitigation measure as contemplated in the Final EIR/EIS. Although the transportation feasibility study identifies potentially significant impacts at certain intersections, the potential for these unavoidable impacts were disclosed in Metro's EIR/EIS. Thus, the impacts were also covered by Metro's statement of overriding considerations. Should the City decide to proceed with the N.
Canon Drive closure, the Council should also find that it considered the Final EIR/EIS analysis of construction traffic impacts, that the closure and its impacts are covered by Metro's Final EIR/EIS, and direct staff to file a notice of determination in reliance on the Final EIR. It should be noted that, as a responsible agency, the City would not have to state that Metro's EIR complies with CEQA, per CEQA Guidelines Section 15096(i).

INTRODUCTION
STAFF REPORT
September 21, 2021
Honorable Mayor & City Council
Daren Grilley, City Engineer
Robert Welch, Engineering Manager
Christine Chung, Associate Project Manager
North Canon Drive Closure Extension Consideration
1. July 24, 2018, Agenda Report with Attachments
2. Stakeholder Feedback Letter(s)
On July 24, 2018, City Council initially approved the closure of North Canon Drive for a minimum of two years and up to six years to mitigate Metro Purple Line Extension - Section 2 construction impacts. Per the Article XI I of the MOA with Metro, the closure and conversion to a cul-de-sac were implemented in September 2019, followed by the construction of the temporary sound wall across North Canon Drive at Wilshire Boulevard.
City Council approved a mural designed by Tomokazu Matsuyama, completed in November 2019.
DISCUSSION
Since the cul-de-sac was established at North Canon Drive in 2019, Metro continued construction of Wilshire/Rodeo Station along Wilshire Boulevard between Beverly Drive and Crescent Drive. Over the last two years, installation of piles, decking and station box excavations have been completed. The 20-foot tall North Canon Drive sound wall has successfully mitigated noise and dust impacts of these major construction activities. In addition, the closure provided a safe and consistent traffic pattern and uninterrupted access for businesses located on North Canon Drive.
Anticipated Construction between 2021 and 2022
For the remaining months of 2021 and through 2022, Metro will continue to set up cranes to access deck panels along Wilshire for material deliveries and pump concrete for building below ground station slabs, platforms and walls. For these activities, Wilshire Boulevard between Beverly Drive and Crescent Drive is typically reduced to a minimum Meeting Date: September 21, 2021
of two lanes in each direction during day shifts and a minimum of one lane in each direction during night shifts. In addition, Metro anticipates starting construction of multiple appendage structures along Wilshire as early as mid-2022, which would also require traffic lane reconfiguration for additional piling and excavation.
Anticipated Construction post-2022
While Section 2 construction continues until 2025, City staff anticipates construction of the North Portal, the second entrance for the Wilshire/Rodeo Station, to start as early as 2023 for approximately 2.5 to 3.5 years. Through the certified Environmental Impact Report, a full street closure of North Beverly Drive between Beverly Canon Gardens and Wilshire Boulevard may be expected due to the limited work area and available staging areas for contractors. During 2022, additional constructability and traffic studies will be developed along with the North Portal design progress to identify alternative feasible traffic control options in order to optimize traffic flows and parking operations in the area during construction.
If the closure and sound wall remain in place until September 2022, traffic patterns will remain consistent along North Canon Drive, with all mapping applications up to date to reflect current closure and turn restrictions. No overlapping construction nor traffic impacts at North Beverly Drive, associated with the North Portal, are expected in 2022.
The 20-foot sound wall will continue to mitigate noise, dust and lighting spillage from construction activities at the Canon Yard entrance and Wilshire Boulevard. The Public Information Graphics with business wayfinding signs and mural will remain in place to beautify the cul-de-sac and Wilshire Boulevard side of the sound wall. In addition, the two-way lane conversion from one-way eastbound of Dayton Way, between Crescent Drive and North Canon Drive, will remain in place until the removal of the North Canon Drive cul-de-sac. The two-way conversion has allowed more convenient access to businesses and parking structures near North Canon Drive since early 2020.
If the closure and sound walls are removed post-September 2021, traffic patterns would no longer remain consistent along North Canon Drive near Wilshire Boulevard due to the intermittent left or right turn restrictions for the station building activities. With continuous access to the Canon Yard and other activities along Wilshire Boulevard, implementation of daily traffic control along North Canon Drive as far north as Dayton Way will be necessary with message boards and/or traffic cones near business entrances and valet as well as on-street parking restrictions. Due to dynamic changes in traffic configurations, real-time updates to mapping applications would be challenging. Also, removing the sound wall would impact pedestrian paths to North Canon Drive with intermittent sidewalk closures. Noise, dust and lighting impacts would be more noticeable to businesses on North Canon. Finally, removal of the cul-de-sac would increase the chance of Metro heavy construction vehicles potentially driving through North Canon Drive (though that would be a violation of approved haul routes).
Additionally, since March 2021, two restaurants on the 100 block of North Canon Drive, Spago and Nusr-Et, have been approved for outdoor dining tents through the COVID-19 response OpenBH program with temporary Special Event Permits. City Council is reviewing any extension to these expansions and if this North Canon Drive closure item is not approved and the OpenBH expansions recommended to remain up, staff will coordinate on the necessary traffic control and other mitigation measures to avoid conflicts with Metro construction activities near the outdoor dining tents.
Meeting Date: September 21, 2021
Community Engagement
City and Metro staff completed the following community meetings and stakeholder outreach to receive feedback on the proposed North Canon Drive closure extension until September 2022.
• Item discussed at the monthly community outreach meetings held on August 4, 2021, and September 2, 2021; no comments nor questions were received. • Item discussed at the monthly Chamber of Commerce Stakeholder Meetings held on August 11, 2021, and September 8, 2021; no objection was received. • Small Business Assistance Task Force Committee Liaison and Beverly Hills Chamber of Commerce Government Affairs Committee meetings were held on August 11, 2021, and August 12, 2021; no objection was received. • Staff held a joint meeting with leadership representatives from the Next Beverly Hills Committee and the Arts and Culture Commission on August 24, 2021; no objection was received on the extension of the North Canon closure for another year. Staff answered questions about potential opportunities to maintain aesthetic site conditions of the North Portal project.
• One-on-one meetings with stakeholders located along North Canon Drive between Wilshire Boulevard and North Santa Monica Boulevard were held, either virtually or by in-person visits, in July and August 2021. Some of the stakeholders include the Maybourne Beverly Hills, 9401 Wilshire, Spago, Nusr-Et, Hilton & Hyland, Brickstar Capital, Canon Properties, Mastro's, the Beverly Hills Chamber of Commerce, Rodeo Realty, 190 N Canon Dr. Fred Hyman Building and The Standard Oil Investment Group. All stakeholders support the extension of the North Canon Drive closure for another year and staff answered questions about the North Portal project. A support letter from the Beverly Hills Chamber of Commerce is labeled as Attachment 2. The Canon Properties did not share any opinion to the extension of North Canon Drive closure.
• Completed hand delivery of Canon Closure Drive extension notices to the residents and businesses bound by Clifton Way, Gregory, El Camino Dr. and Rexford Dr., and emailed the notices to Metro's and the City's databases. Links to this notice and upcoming City Council meeting agenda items were posted on both the City and Metro websites and shared on social media platforms. No comments nor questions were received.
Overall, staff has received support and/or no objection to the request from the residential and business communities. Staff will monitor resident and business concerns and work with Metro and appropriate City departments to mitigate any North Canon Drive closurerelated concerns.
Next Steps
Based on public feedback and anticipated construction impacts, Staff recommends considering the extension of North Canon Drive closure for an additional one (1) year until September 2022.
Meeting Date: September 21, 2021
If approved, staff will continue maintenance of the mural and Public Information Graphics on the sound wall and the landscaped planters to upkeep the cul-de-sac aesthetically pleasing. Also, in September 2022, staff will provide updates of the North Portal project to City Council to consider whether to extend the temporary closure of North Canon Drive at Wilshire Boulevard.
If not approved, staff will schedule to remove the mural and coordinate with Metro to remove the temporary sound wall. With this decision, if the outdoor dining tents at the North Canon cul-de-sac are approved to be extended beyond December 2021, the Public Works Project staff will coordinate with OpenBH staff and stakeholders to amend the OpenBH permits to include necessary traffic control and other mitigation measures to avoid conflicts with construction activities near the outdoor dining tents. Also, City staff will continue to monitor Metro construction for compliance with the MOA and the outdoor dining operation for compliance with OpenBH permits.
Environmental Considerations
The Final Environmental Impact Report (EIR) /Environmental Impact Statement (EIS) prepared by Metro covers the impacts of North Canon Drive closure at Wilshire Boulevard until the end of Purple Line Extension - Section 2 construction.
FISCAL IMPACT
There is no direct fiscal impact associated with approving this request. The terms of the Memorandum of Agreement (MOA) with Metro include provisions to provide reimbursement of costs for all staff and consultants performing work associated with the Purple Line Extension - Section 2 (Wilshire/Rodeo Station) in Beverly Hills, including the installation and removal of the temporary sound wall at North Canon Drive.
The Fiscal Year 2022 CIP budget includes an appropriation of $3,086,887 for Metro project related mitigation and engineering expenses. Such expenses include the monitoring of North Canon Drive closure and maintenance of Public Information Graphics and mural at the sound wall.
RECOMMENDATION
Staff recommends that City Council move to approve an additional one (1) year extension of the temporary closure of North Canon Drive at Wilshire Boulevard until September 30, 2022.

Daren Grilley, Assistant Public Works Director/City Engineer Christine Chung, Project Manager
North Canon Drive Closure Extension Consideration
1. September 21, 2021, Agenda Report with Attachments
2. Stakeholder Feedback Letter(s}
On July 24, 2018, City Council initially approved the closure of North Canon Drive for a minimum of two years and up to six years to mitigate the construction impacts of the Los Angeles County Metropolitan Transportation Authority (Metro} Purple (D} Line Extension project.
DISCUSSION
Per Article XII of the MCA with Metro, the street was closed and a cul-de-sac was created in September 2019, followed by the construction of the temporary sound wall across North Canon Drive at Wilshire Boulevard. City Council approved a mural designed by Tomokazu Matsuyama, which was completed in November 2019. On September 21, 2021, City Council approved a one-year extension of the temporary closure of North Canon Drive until September 30, 2022.
Over the last three years, the installation of piles, decking, station box excavations, station slabs and portions of the station walls and platform have been completed. The 20-foot tall North Canon Drive sound wall has successfully mitigated the noise and dust impacts of these major construction activities. The closure has also provided a safe and consistent traffic pattern and uninterrupted access for businesses located on North Canon Drive.
Anticipated Construction between 2022 and 2023
For the remaining months of 2022 and through 2023, Metro will continue to set up cranes to access deck panels along Wilshire Boulevard for material deliveries and pump Meeting Date: September 12, 2022
concrete to continue to construct below ground station's entrance, platform, walls, concourse level and other components. For these activities, Wilshire Boulevard between Beverly Drive and Crescent Drive is typically reduced to a minimum of two lanes in each direction during day shifts and a minimum of one lane in each direction during night shifts.
In addition, Metro anticipates starting construction of multiple appendage structures along Wilshire Boulevard as early as 2023, which would also require traffic lane reconfiguration for additional piling and excavation. Appendage structures include various features such as utility rooms, ventilation shafts, and emergency exits. They are located on the north and south sides of Wilshire Boulevard, extending into sidewalks between the alley west of Beverly Drive and Crescent Drive. They are also located on South Beverly Drive and South Canon Drive and extend up to approximately 170 feet south of Wilshire Boulevard.
As part of the appendage construction, the MOA allows for a full closure of South Beverly Drive (north of the alley south of Wilshire) for decking and piling for up to five weekends. Full closure of South Canon Drive at Wilshire Blvd (north of the alley south of Wilshire Boulevard) is also allowed for decking and piling on weekends from 7:00am to 10:00pm.
Anticipated Construction post-2023
While Metro Section 2 construction continues until 2025, the construction of the North Portal (the second entrance for the Wilshire/Rodeo Station) may begin as early as 2024.
On May 10, 2022, City Council approved an agreement for the North Portal design, which is anticipated to take approximately 18 months. Once potential constructability constraints are proofed by late 2022, the schematic design package with traffic studies and construction staging plans will be available by the first Quarter of 2023. In 2023, the design would progress enough to identify tentative traffic impacts of North Beverly Drive between Beverly Canon Gardens and Wilshire Boulevard.
If the closure and sound wall remain in place until 2023, traffic patterns will remain consistent. No construction or traffic impacts associated with the North Portal at North Beverly Drive will occur before 2024, at the earliest. The 20-foot sound wall will continue to mitigate noise, dust and lighting from construction activities at the Canon Yard entrance and Wilshire Boulevard. The Public Information Graphics with business wayfinding signs and the sound wall mural will remain in place to beautify the cul-de-sac and Wilshire Boulevard side of the sound wall.
If the closure and sound walls are removed post-September 2022, traffic patterns at North Canon Drive and Wilshire Boulevard would require changes each day with closures and/or turn restrictions as the station construction continues. With continuous access to the Canon Yard and other activities along Wilshire Boulevard, implementation of daily traffic control along North Canon Drive as far north as Dayton Way will be necessary with message boards and/or traffic cones near business entrances and valet as well as on-street parking restrictions. Removing the sound wall would also impact pedestrian paths to North Canon Drive with intermittent sidewalk closures. Noise, dust and lighting impacts would be more noticeable to businesses on North Canon Drive.
Finally, removing the cul-de-sac would increase the chance of Metro heavy construction vehicles driving along North Canon Drive (though that would be a violation of approved haul routes).
Meeting Date: September 12, 2022
Since March 2021, restaurants on the 100 block of North Canon Drive have operated outdoor dining through the COVID-19 response OpenBH program with temporary Special Event Permits. The current OpenBH permit for Spago's outdoor dining tent is approved by City Council through December 31, 2022. The OpenBH permit for NusrEt's outdoor dining parklet was recently approved with an estimated installation date in midSeptember. If the North Canon Drive closure is not extended, staff will coordinate on the necessary traffic control and other mitigation measures to avoid conflicts with Metro construction activities near the outdoor dining areas with the impacted OpenBH businesses.
Community Engagement
City and Metro staff completed the following community meetings and stakeholder outreach to receive feedback on the initial proposal to extend the North Canon Drive closure extension until September 2023.
• Monthly Chamber of Commerce Stakeholder Meetings held on July 13, 2022, and August 10, 2022.
• Metro community outreach meeting held September 7, 2022 • Staff informed Beverly Hills Chamber of Commerce Government Affairs Committee in July 2022, City and County Policy Subcommittee on August 25, 2022, and Small Business Assistance Task Force Committee Liaison in September 2022. The Chamber of Commerce supports the extension of the closure up to 9 months and requests the City staff to evaluate the need for the closure and the wall by June 2023.
• Staff held a meeting with the Next Beverly Hills Committee and the Arts and Culture Commission representatives on September 1, 2022; no objection was received.
• One-on-one meetings with stakeholders located along North Canon Drive between Wilshire Boulevard and North Santa Monica Boulevard were held, either virtually or by in-person visits, in July and August 2022. Some of the stakeholders include the Maybourne Beverly Hills, 9401 Wilshire, Spago, Nusr-Et, Hilton & Hyland, Brickstar Capital, Canon Properties, Mastro's, Rodeo Realty and 190 N Canon Dr. Fred Hayman Building. All stakeholders support the extension of the North Canon Drive closure for another year and staff answered questions about the North Portal project. Support letters from the 9401 Wilshire, Nusr-Et, and a resident at South Camden Drive are included as Attachment 2. • Canon Closure Drive extension notices were hand delivered to the residents and businesses bound by Clifton Way, Gregory, El Camino Dr., and Rexford Dr.
These same notices were emailed to Metro and the City's contact database in August 2022. Links to this notice and upcoming City Council meeting agenda items were posted on both the City and Metro websites and shared on social media platforms. No comments nor questions were received.
Overall, staff has received support and/or no objection to the request from the residential and business communities. Based on feedback received from stakeholders, staff revised the proposed closure extension to nine months instead of one year.
Meeting Date: September 12, 2022
Next Steps
If the extension of the closure is approved, staff will continue maintenance of the mural and Public Information Graphics on the sound wall and the landscaped planters to upkeep the cul-de-sac as aesthetically pleasing. Staff will also monitor community concerns and work with Metro and appropriate City departments to mitigate any North Canon Drive closure-related concerns. Near the expiration date of the closure, staff will provide updates on the North Portal project to City Council to consider whether or not to further extend the temporary closure of North Canon Drive at Wilshire Boulevard.
If this item is not approved, staff will schedule to remove the mural and coordinate with Metro to remove the temporary sound wall. With this decision, Public Works staff will coordinate with OpenBH staff and stakeholders to amend the outdoor dining permits to include necessary traffic control or other measures to avoid conflicts with construction activities near the outdoor dining tent and/or parklet.
Per the MOA, Metro is to pay for the installation and removal of the sound wall and other work associated with the closure, as well as reimburse the City for its associated costs.
Funds are available in the approved budget for CIP No. 00050 for Metro project-related mitigation and engineering expenses, including the monitoring of North Canon Drive closure and maintenance of Public Information Graphics and mural at the sound wall.
RECOMMENDATION
Considering the anticipated work and outreach comments, Staff recommends that City Council move to approve an additional nine-month extension of the temporary closure of North Canon Drive at Wilshire Boulevard until June 30, 2023.

On July 24, 2018, City Council initially approved the closure of North Canon Drive for a minimum of two years and up to six years to mitigate the construction impacts of the Los Angeles County Metropolitan Transportation Authority (Metro) Purple (D) Line Extension project.
DISCUSSION
Per Article XII of the MOA with Metro, the street was closed and a cul-de-sac was created in September 2019, followed by the construction of the temporary sound wall across North Canon Drive at Wilshire Boulevard. City Council approved a mural designed by Tomokazu Matsuyama, which was completed in November 2019. On September 21, 2021, City Council approved a one-year extension of the temporary closure of North Canon Drive until September 30, 2022. On September 12, 2022, City Council approved a nine-month extension of the temporary closure until June 30, 2023.
The Wilshire/Rodeo station construction along Wilshire Blvd is underway and made nearly 60% progress in building the station structure. The 20-foot tall North Canon Drive sound wall has successfully mitigated the noise and dust impacts of these major construction activities. The closure has also provided a safe and consistent traffic pattern and uninterrupted access for businesses located on North Canon Drive.
Anticipated Construction between 2023 and 2024

concrete to continue to construct below ground station's entrance, concourse level, walls, roof deck, side structures and other components. For these activities, Wilshire Boulevard between Beverly Drive and Crescent Drive is typically reduced to a minimum of two lanes in each direction during day shifts and a minimum of one lane in each direction during night shifts.
In addition, Metro begins construction of multiple appendage structures at South Beverly Drive and South Canon Drive in late May 2023 until early 2024. Appendage structures include various features such as utility rooms, ventilation shafts, and emergency exits.
They are located on the north and south sides of Wilshire Boulevard, extending into sidewalks between the alley west of Beverly Drive and Crescent Drive. They are also located on South Beverly Drive and South Canon Drive and extend to approximately 170 feet south of Wilshire Boulevard.
As part of the appendage construction, the MOA allows for a full closure of South Beverly Drive (north of the alley south of Wilshire) for decking and piling up to five weekends from Friday 8:00pm to Monday 7:00am. Full closure of South Canon Drive at Wilshire Blvd (north of the alley south of Wilshire Boulevard) is also allowed for decking and piling on weekends. For any long-term traffic reconfiguration proposal for the appendage work, Metro will require a traffic study to verify the minimal impact on the traffic flow along the arterial streets or seek alternative traffic control and/or mitigation options.
If the closure and sound wall remain in place until the end of 2023, traffic patterns will remain consistent. No construction or traffic impacts associated with the North Portal at North Beverly Drive will occur before 2025, at the earliest, based on the preliminary design review. Also, North Beverly Drive will remain accessible with a traffic taper partially extended from South Beverly Drive during the appendage construction.
If the closure and sound walls are removed post-June 2023, traffic patterns at North Canon Drive and Wilshire Boulevard would require daily changes with closures and/or turn restrictions as the station construction continues. With continuous access to the Canon Yard and other activities along Wilshire Boulevard, implementation of daily traffic control will be necessary along North Canon Drive as far north as Dayton Way using message boards, detour signage, and/or traffic cones near business entrances, permitted parklets, and valet as well as on-street parking restrictions. Removing the sound wall would also impact pedestrian paths to North Canon Drive with intermittent sidewalk closures. Noise, dust and lighting impacts would be more noticeable to businesses on North Canon Drive. It would also create an irregular traffic pattern as detours must be implemented daily due to day and night traffic control and crane setup for deck access on Wilshire Blvd. Finally, removing the cul-de-sac would increase the chance of Metro heavy construction vehicles driving along North Canon Drive {though that would violate approved haul routes).
Community Engagement
City and Metro staff completed the following community meetings and stakeholder outreach to receive feedback on the proposal to extend the North Canon Drive closure extension until December 2023.

The Government Affairs Committee supports the extension of the closure up to 6 months and requests the City staff to evaluate the potential impacts of appendage work with the closure. North Beverly Drive will remain accessible during the appendage work and Staff will require a traffic study for any long-term traffic reconfiguration. • Staff informed the Next Beverly Hills Committee and the Arts and Culture Commission representatives on May 18, 2023; no objection was received. • One-on-one contacts made with stakeholders located along North Canon Drive between Wilshire Boulevard and North Santa Monica Boulevard between March and May 2023. Some of the stakeholders include the Maybourne Beverly Hills, 9401 Wilshire, Spago, Nusr-Et, Hilton & Hyland, Brickstar Capital, Canon Properties, Mastro's, Rodeo Realty and 190 N Canon Dr. Fred Hayman Building.
Majority of the stakeholders support the additional six-month extension of the North Canon Drive closure. Support emails from the Nusr-Et and Fred Hayman Building are included as Attachment 2.
• Canon Drive Closure extension notices were hand-delivered to the residents and businesses bound by Dayton Way, Gregory Way, El Camino Dr., and Rexford Dr on May 18, 2023. 2. Stakeholder Comments
RECOMMENDATION
Staff recommends that City Council ( 1 ) approve an additional one-year extension of the temporary closure of North Canon Drive at Wilshire Boulevard until December 31, 2024, or sooner when the street closure and soundwall are no longer necessary to mitigate construction impacts in 2024 or alternatively (2) approve an additional six-month extension until June 30, 2024 and each future extension to consider up to six months until September 2025, which is when the closure extension expires.
INTRODUCTION
On July 24, 2018, City Council initially approved the closure of North Canon Drive for a minimum of two years and up to six years to mitigate the construction impacts of the Los Angeles County Metropolitan Transportation Authority (Metro) Purple (D) Line Extension - Section 2 project.
On September 12, 2022, City Council approved a nine-month extension of the temporary closure until June 30, 2023.
Meeting Date: November 7, 2023
On June 6, 2023, City Council approved a six-month extension of the temporary closure until December 31, 2023.
The Metro Section 2 project is actively building the station structure along Wilshire Boulevard and began constructing multiple appendage structures at South Beverly Drive and South Canon Drive in the summer of 2023. The 20-foot-high sound wall has successfully mitigated the noise and dust impacts of these major construction activities.
The closure has also provided a safe and consistent traffic pattern and uninterrupted access for businesses located on North Canon Drive.
Anticipated Construction in 2024
Within 2024, Metro will continue to set up cranes to access deck panels along Wilshire Boulevard for material deliveries and pump concrete to continue to construct the below ground station's entrance, concourse level, walls, roof deck, side structures, and other components. For these activities, Wilshire Boulevard between Beverly Drive and Crescent Drive is typically reduced to a minimum of two lanes in each direction during day shifts and a minimum of one lane in each direction during night shifts.
In addition, Metro will continue building multiple appendage structures through 2024.
Appendage structures include various features such as utility rooms, ventilation shafts, and emergency exits. They are located on the north and south sides of Wilshire Boulevard, extending into sidewalks between the alley west of Beverly Drive and Crescent Drive. A couple of appendage structures are located close to the North Canon Drive intersection and the southeast corner of Canon Staging Yard.
No construction or traffic impacts associated with the North Portal at North Beverly Drive will occur before 2025, at the earliest, based on the preliminary design review. Also, North Beverly Drive will remain accessible with a traffic taper partially extended from South Beverly Drive during the appendage construction. The 20- foot sound wall will continue to mitigate noise, dust, and lighting from construction activities at the Canon Yard entrance and Wilshire Boulevard. If the closure and sound walls are removed post-December 2023, traffic patterns at North Canon Drive and Wilshire Boulevard would require daily changes with closures and/or turn restrictions as the station construction continues. Noise, dust, and lighting impacts would be more noticeable to businesses on North Canon Drive. It would also create an irregular traffic pattern as detours must be implemented daily and nightly traffic control, and crane setup for deck access on Wilshire Boulevard and appendage work close to Canon Yard. Finally, removing the cul-de-sac would increase the chance of Metro heavy construction vehicles driving along North Canon Drive (though that would violate approved haul routes).
Meeting Date: November 7, 2023
Environmental Considerations
The Final Environmental Impact Report (EIR}/Environmental Impact Statement (EIS) prepared by Metro covers the impacts of North Canon Drive closure at Wilshire Boulevard until the end of Purple Line Extension - Section 2 construction.
Community Engagement
City and Metro staff completed the following stakeholder meetings and stakeholder outreach to receive feedback on the proposal to extend the North Canon Drive closure extension until December 2024.
• Monthly Chamber of Commerce Stakeholder Meeting held on October 11, 2023 o One stakeholder shared concern about traffic back-up at the parking structures near Dayton Way and Beverly Drive since the closure. Per observation of the garage exits and this intersection between October 12th and 20th, the traffic continues to flow with minimal backup and cars can leave the garages within one traffic signal cycle at the adjacent intersections. BHPD and staff will continue to monitor adjacent intersections to determine if additional mitigation measures are required. o Beverly Hills Chamber of Commerce submitted a letter in support of a sixmonth extension for the City to present findings and changes in the project status to have more transparency related to the temporary closure (Attachment 2).
• Staff informed the Next Beverly Hills Committee and the Arts and Culture Commission representatives in October 2023; no objection was received. • One-on-one contacts made with stakeholders located along North Canon Drive between Wilshire Boulevard and North Santa Monica Boulevard between March and May 2023. Some of the stakeholders include the Maybourne Beverly Hills, 9401 Wilshire, Spago, Nusr-Et, Hilton & Hyland, Brickstar Capital, Canon Properties, Mastro's, Rodeo Realty, and 190 N Canon Dr. Fred Hayman Building.
Overall, no objection was received on the extension. 9401 Wilshire shared support of the one-year extension of the closure (Attachment 2) and Brickstar Capital rep, David Mirahooni, verbally commented that he supports a six-month extension.
• Canon Drive Closure extension notices were hand-delivered to the residents and businesses bound by South Santa Monica Boulevard, North Canon Drive, Dayton Way, Rexford Drive, Camden Drive, and Olympic Boulevard on October 20, 2023. Links to this notice and upcoming City Council meeting agenda items were posted on both the City and Metro websites and shared on social media platforms. No comments or questions were received.
Overall, staff has received support and/or no objection to the extension request from the residential and business communities. Based on the feedback received from stakeholders, staff included an alternative recommendation to consider a six-month extension until June 30, 2024 and each future extension to consider up to six months until September 2025, which is when the closure extension expires.
Meeting Date: November 7, 2023
Next Steps
If the extension of the closure is approved for either six-month or one-year, staff will continue maintenance of the mural and Public Information Graphics on the sound wall and the landscaped planters to keep the cul-de-sac aesthetically pleasing. Staff will also monitor community concerns and work with Metro and appropriate City departments to mitigate any North Canon Drive closure-related concerns or consider earlier re-opening of North Canon Drive depending on the project progress. Near the expiration date of the closure, staff will provide updates on the Purple Line project to City Council to consider whether to further extend the temporary closure of North Canon Drive at Wilshire Boulevard.
00050 for Metro project-related mitigation and engineering expenses, including the monitoring of North Canon Drive closure and maintenance of Public Information Graphics and mural at the sound wall.

Re: Recommendation for North Cañon Wall Extension
Dear Mayor Friedman and City Council,
The Beverly Hills Chamber of Commerce supports the staff’s recommendation that City extend the wall and street closure at North Cañon Drive and Wilshire for an additional six months.
The North Canon Wall has significantly protected the business community from the impacts of the D Line (formerly Purple Line) Subway Extension. However, it is vital, if the North Canon Wall involves future closure and/or lane restrictions on North Beverly Drive at Wilshire, that the business and residential community have more insight into the reasons. A six-month extension allows City staff adequate time to present findings and changes in their study.
The Chamber does support extending the North Canon Wall for an additional six months.
Sincerely,
Todd Johnson

Good morning Barbara and Steve,
I hope this email finds you well. The Beverly Hills City Council will consider extending the closure of North Canon Drive with the existing 20-foot sound wall at an upcoming May meeting. North Canon Drive at Wilshire Boulevard was initially closed in 2019 to mitigate construction impacts from the Metro Purple Line Extension project. With the City Council's approval, this closure can be maintained for up to six years, until 2025.
City staff recommends extending the closure by six months, until the end of 2024, to continue mitigating ongoing construction impacts in the area.
Once the May meeting date is determined, I will contact you again.
If you have comments or questions about this agenda item before the meeting, please contact the project team at [email protected] before noon on April 30, 2024.
Also, please let me know if you want to schedule a call to discuss these items further.

As I shared previously with Perla Berry, we are quite concerned about the continued blockage at the end of Canon Drive at Wilshire. It has made it virtually impossible for us to lease our property at 166 Canon and those potential tenants that have shown interest have asked for significant discounts in rent and correspondingly high commitments in terms of tenant improvement allowances and free rent.
Absent some financial compensation for our loss and a compelling noise/safety argument, my partners and I are strongly opposed to any extension that goes beyond the end of this year (2024).
I hope you appreciate our situation. I am available should you wish to discuss this further.

Perla, to be very clear, it is extremely disappointing to hear of yet another extension. Having the wall has made it virtually impossible for us to rent 166 Canon. I need to talk with my partners but my personal position would be to vigorously oppose any extension absent compensation for the material loss of income we are suffering.
It would be a good idea to schedule a call in the next couple weeks to discuss further. I have copied my EA, Jackie Martin, who can help find a mutually convenient time.
