RECOMMENDATION
Staff recommends that City Council (1) approve the agreement with American Heritage Landscape, LP for Landscape Maintenance of Specified Areas Within and Near City Limits, (2) approve a purchase order for Fiscal Year (“FY”) 2024/25 in the not-to-exceed amount of $898,613, and (3) authorize the City Manager to approve change purchase orders in an amount not to exceed the total value of the agreement for the five-year term.
INTRODUCTION
Park Operations maintains a variety of City assets (landscaping, lawns, athletic fields, etc.) at numerous locations totaling 101.5 acres throughout the City. The City maintains three active recreational parks (Coldwater Canyon Park, La Cienega Park, and Roxbury Park) Meeting Date: June 18, 2024
and five passive recreational parks (Beverly Gardens Park, Beverly Cañon Gardens, Greystone Mansion, Dog Park, and Will Rogers Park). This group also maintains two active recreational mini parks (Arnaz and Reeves), five passive recreational mini parks (Crescent, Hamel, Maltz, Oakhurst, and Rexford Rest), and landscaping for several nonpark City properties (Business Triangle, City Hall, City Yards, Cultural Center, eight reservoir locations, and medians). The maintenance is performed by both in-house employees and contractors. The proposed landscape maintenance services agreement helps staff provide the following benefits to the community:
Keep the City’s landscaped areas safe for use by the public. Support sustainability efforts through proactive monitoring and repair of irrigation, upkeep of drought tolerant plant material, and Senate Bill (SB) 1383 compliant green waste recycling and mulch.
Provide the landscape aesthetic standards expected of a world-class city.
After a competitive bidding process and evaluation of proposals, staff recommends a new agreement (Attachment 1) with American Heritage Landscape, LP (“American Heritage”) based on pricing, experience, and proposed staffing/maintenance schedules, among other factors.
BACKGROUND
The current agreement for landscape maintenance services ends on June 30, 2024. This agreement’s scope of services includes turfgrass maintenance, plant care, and irrigation maintenance. Turfgrass maintenance includes mowing, edging, trimming, fertilization, weed control, aeration, and dethatching. Plant care includes trimming, care, and cultivation of vegetation, ornamental shrubbery, groundcovers, and perennial and annual flowers. Additional services include annual flower rotation and holiday flower overdressing at the Rodeo Median between Wilshire Boulevard and Santa Monica Boulevard, as well as weed abatement at various locations.
DISCUSSION
The City published Request for Proposals (RFP) No. 24-350-26 on February 21, 2024 on PlanetBids. After review of proposals received, staff recommends that the City enter into an agreement with American Heritage for landscape maintenance services. The current contractor, LandCare USA, LLC (“LandCare”), has worked under contract with the City since at least 2002.
Similar to the current agreement, the proposed agreement provides ongoing/regular services including irrigation maintenance, planting annual flowers, turfgrass maintenance, plant care, weed abatement for fire suppression, hardscape/pathway maintenance, and debris removal. This work is done throughout the City, including at City parks and facilities; mini parks; Greystone Park; medians, traffic islands, easements, and gateways; parking facilities; reservoirs and other water sites; the Business Triangle; and non-park City facilities.
The RFP also asked for pricing for as-needed services. Recent examples of as-needed services include: replenishing landscaping at crosswalks and tree wells in the Business Triangle, installing additional landscaping at Wilshire Boulevard medians and gateway entrances, installing additional sod at the Reeves mini park and City Hall, and planting additional infill plants near tenant spaces (e.g., Crate & Barrel) and at selected parking facilities. Some of these as-needed services are a result of high pedestrian use of Meeting Date: June 18, 2024
landscaped areas or damage during City events, or to further enhance the City’s landscaped areas.
The RFP included pricing for watering of Sunset Boulevard medians with a water truck using non-potable water. The State requires that non-functional turf be watered with nonpotable water. The State considers non-functional turf to be generally mowed grass that is not used for recreational or other community activities at commercial, industrial, and institutional properties. Currently, staff does not anticipate changes to the watering requirements for non-functional turf. Staff is exploring options to replace the nonfunctional turf on the Sunset medians with drought-tolerant plant material, similar to the approach on the Burton Way medians.
City staff hosted a pre-proposal meeting to review the locations and scope of work. The City received seven proposals as follows: American Heritage, Greenfield Landscaping & Maintenance, LandCare, Landsystems-Monarch Landscape Companies, Mariposa Landscapes ("Mariposa”), Priority Landscape Services, and SGD Enterprises.
Evaluation criteria were defined in the RFP and are included in Attachment 2.
After reviewing the proposals, City staff invited five of the proposers to interview based on cost and meeting submittal requirements. The interview panel included Public Works and Finance staff.
City staff then requested Best and Final Offers (BAFOs) from American Heritage and Mariposa based on proposals, presentations, staffing plan (including irrigation technician), and costs.
Staff determined that American Heritage presented the most responsive and cost-effective proposal. Most importantly, staff was satisfied with American Heritage’s pricing, experience, and proposed staffing/maintenance schedules. In summary, some of the reasons that staff recommends awarding the proposed agreement to American Heritage are:
Reasonable pricing
Demonstrated understanding of the scope of services
Extensive landscaping experience working with municipalities (e.g., City of Westlake Village), other government agencies, and other clients Many years of experience of supervisory and executive team Proposed staffing/work schedules
Proposed initial comprehensive irrigation audit
Demonstrated knowledge of laws and regulations, including SB1383 Communication (e.g., weekly meetings with City staff; committed involvement of multiple levels of management/executive staff)
Initial implementation of small battery-powered electric equipment; subsequent roll-out of larger battery-powered electric equipment
High quality, professional presentation and complete proposal Emphasis on safety
Staff negotiated a minor change to the scope of services to add services at an additional median (at North Santa Monica Boulevard and Civic Center Dive, east of the police station).
Meeting Date: June 18, 2024
Below are highlights of the proposed agreement:
Start date July 1, 2024
o Initial termination date of June 30, 2025, with the option of four one-year term extensions
Requirement for the contractor to maintain an annual renewable performance bond $612,807 year-one cost for primary ongoing/regular services $46,000 year-one cost for additional ongoing/regular services consisting of Sunset medians watering
24% as-needed consideration (percentage based on current contract) 10% contingency amount – not used unless deemed necessary If extended, annual escalations of 3%, 3%, 5%, 5%
Liquidated damages provisions
Ongoing/regular services include tasks such as weeding, monitoring the function of the irrigation system and making adjustments, and mowing. As-needed tasks could include installing plants for infill, replacing plants/sod due to reasons not under the control of the contractor (e.g., damage caused by high pedestrian use), and major irrigation repairs.
Examples of recent as-needed work are listed above. Based on experience, City staff anticipates a certain amount of as-needed work will occur each year. Staff estimated a dollar amount based on the percentage of as-needed work in past years.
In addition, it is possible there may be unforeseen circumstances and costs (as in any project or contract), and staff has included a “contingency” amount to cover this.
Contingency amounts could be used for emergencies or unforeseen accidents (e.g., vehicle running over the landscape and damaging plant material and irrigation delivery devices). This contingency amount is on reserve and may or may not be used.
City staff anticipates a smooth transition from the current vendor to the new vendor because of, among other things, the contractor’s experience, proposed preliminary work schedule, and expected consistent communication. American Heritage’s staff is familiar with the City’s central irrigation system and current landscape maintenance needs. Their staff has extensive experience managing and maintaining landscapes with similar scope including acreage, types, and methods for other cities such as the City of Santa Clarita and City of Westlake Village. American Heritage also indicated that they walked the locations identified in the agreement before the interview. They presented their knowledge of the City’s landscapes, demonstrating that they knew where all of the unique sites were located within the City, without looking at a map, as well as details of certain sites.
American Heritage presented a preliminary work schedule for the first 30/60/90 days, which includes implementing job sequences per color-coded maps and daily schedules, conducting an irrigation evaluation at each irrigation station, and focusing on areas of concern. City staff expects effective communication with the contractor. Prior to starting work onsite, the City’s Parks Superintendent will meet with their Director of Maintenance and their Branch Manager to review the contractor’s responsibilities at all the sites. In this meeting, there will be a focus on reviewing unique areas such as easements, medians, the Business Triangle, and other City facilities and water sites. Furthermore, American Heritage stated they will strive for consistent communication with the City by doing the following: participating in weekly meetings with the City, giving weekly updates on maintenance crew activities, providing a monthly schedule and horticultural calendar, and supplying digital pictures of horticultural and other technical issues.
Meeting Date: June 18, 2024
FISCAL IMPACT
The total estimated value of the agreement over the five-year term of the agreement is $4,829,585 (Attachment 3).
It is anticipated that there will be sufficient funds within the FY2024/25 respective budgets, which includes three funding sources, as detailed below.
Program Fund Amount
Park Maintenance and
Operations (Public Works)
General Fund $823,294
Water Supply and
Distribution Maintenance
and Repair (Public Works)
Water Fund (for
maintenance at reservoirs,
pump stations, water wells,
etc.)
$62,281
Tourism and Marketing
(Policy & Management)
General Fund (for holiday
flower overdress)
$13,038
TOTAL $898,613
Although the estimated amount for FY25 under the new agreement is larger than that for FY24, it is anticipated that staff can absorb the difference in the FY 2024/25 budgets. To the extent that future agreement escalations cannot be absorbed by the Park Operations budget, staff may bring forward budget enhancement request(s) to cover contractual escalations.
The requested purchase order authorization for FY 2024/25 is estimated at $898,613, which includes primary ongoing/regular services, Sunset medians watering (an additional ongoing/regular service), as-needed services, and contingency.

EXHIBIT A
SCOPE OF WORK
I. SCOPE OF WORK
Under the direction of the Deputy Director of Public Works – Operations Division or their designee, CONTRACTOR shall provide landscape maintenance of specified areas within and near City of Beverly Hills (or “CITY”) limits. Locations are identified in Attachments 1-8 to Exhibit B.
PART 1. TECHNICAL SPECIFICATIONS
The following sections A-H contain the detailed services and materials necessary to provide the landscape maintenance services under the Agreement and shall be included in the base price and shall not result in additional charges to CITY.
SECTION A – IRRIGATION HEADS/NOZZLES
A-1. CONTRACTOR will assume all responsibility for the proper operation and function of irrigation heads and nozzles in any area that is within the scope of work to be performed by CONTRACTOR as more specifically described in the tasks listed in this Part 1, unless damage is proven to be the result of some cause other than wear or damage by CONTRACTOR (e.g. vandalism, automobile accident). (Wear or damage caused by CONTRACTOR is the responsibility of CONTRACTOR.)
Irrigation tasks described herein are considered part of the base price.
A-2. CONTRACTOR shall be responsible for monitoring the function of all irrigation systems within any area under the care of CONTRACTOR to include adjusting for coverage, removal of clogs and removal of obstacles including the reasonable trimming of plant materials that obstruct coverage, spray coverage and the drip line distribution.
A-3. At the completion of work in any area (e.g., mowing operations), CONTRACTOR shall verify that no irrigation delivery apparatus was damaged, and that all irrigation drip lines, spray heads and indicators are clear in order to maintain unblocked function. Trimming around any irrigation components should never result in the plant material being trimmed in such a way as to result in an unsightly appearance of the landscape. For example, trimming around sprinkler heads should never result in the turfgrass being scalped to the dirt or in depressions that could be dangerous or unsightly. Restoration and reestablishment of scalped areas with sod of the appropriate type will be at CONTRACTOR’s expense.
A-4. CITY has been in Water Conservation Stage C since 2017. As of June 2022, outdoor watering is restricted to only TWO days per week. The approved landscape watering days for areas north of N. Santa Monica Boulevard are Monday and Friday. The approved watering days for areas south of N. Santa Monica Boulevard are Tuesday and Saturday. There shall be no watering of landscapes (sprinklers or hose) at any time between the hours of 9:00 AM and 6:00 PM. There shall be no watering of landscapes on Wednesdays, Thursdays, and Sundays. In the event that irrigation system repairs or inspections require system activation outside of the described watering days and time DocuSign Envelope ID: 88DAD7AA-C6B8-43E7-BDE0-E7874C4D32CF 10 B0785-0001\2958730v3.doc
windows, system operation must be manned. No system shall be left to run unattended on watering days that are not approved and/or at times outside of the prescribed watering window times. CONTRACTOR shall be responsible for fines resulting from violations of these directives. CONTRACTOR shall request, in writing (subject to the written approval of the Deputy Director of Public Works – Operations Division or their designee), any variance from the defined watering day and/or window times, which are necessary for the establishment of newly installed plant material or seeded turfgrass areas.
A-5. CITY will not reimburse CONTRACTOR for repair of any damages to any CITY property, including sprinkler systems, caused by CONTRACTOR’s staff or equipment. Broken and/or damaged irrigation delivery devices will be replaced at the expense of CONTRACTOR.
A-6. Minor irrigation system repairs: All minor irrigation repairs within any area defined as within the scope of work to be performed by CONTRACTOR are considered to be part of the Agreement, and, therefore, CONTRACTOR will not receive additional compensation for minor repairs. Minor repairs include the replacement of irrigation heads, nozzles, risers, connecting fittings, swing joints and drip lines.
A-7. Major irrigation system repairs: Major irrigation system repairs are outside of the scope of work provided by CONTRACTOR under ongoing/regular services. If requested by CITY, before any work commences, CITY will review and, if appropriate, sign a work order authorizing CONTRACTOR to perform the work. Examples of major repairs include replacing or repairing backflows, concrete pads, control valves, controllers, flow meters, master valves, mainlines, protection cages/boxes, piping and valves. CITY may, at any time, enter the project area to make a major repair.
