RECOMMENDATION
The City Attorney’s Office recommends that the City Council approve Amendment No.3 to the Employment Agreement between Huma Ahmed and the City.
INTRODUCTION
This Amendment will amend the Employment Agreement between City Clerk Huma Ahmed and the City of Beverly Hills made on June 4, 2019 and amended on April 20, 2021 and April 1, 2023 (the “Agreement”). The Amendment will award Ms. Ahmed performance pay of 6% of her base salary.
DISCUSSION
The terms and conditions of Ms. Ahmed’s employment by the City as City Clerk are specified in the Agreement. The Agreement provides that the City Council will review Ms. Ahmed’s performance annually and provides the City Council with the option of granting performance pay up to 10% of the City Clerk’s annual base pay. Following this year’s review, this proposed Amendment to the Employment Agreement provides for a 6% performance pay award, in the amount of $13,200.

FISCAL IMPACT
The performance pay will have a fiscal impact of $13,200 during this fiscal year.

AMENDMENT NO. 3 TO THE EMPLOYMENT AGREEMENT
BETWEEN THE CITY OF BEVERLY HILLS AND HUMA AHMED
The Employment Agreement, made as of June 4, 2019, identified as Agreement No. 279-19, as previously amended by Amendment No. 1 and Amendment No. 2 (referred to in its entirety as the “Agreement”), between the City of Beverly Hills (“City”) and Huma Ahmed (“Employee”) is hereby amended by this Amendment No. 3 (“Amendment”), effective as of June 18, 2024.
A. On June 4, 2019, the City and Employee entered into the Agreement providing for employment of Employee as City Clerk.
B. Section 4.A(2) of the Agreement provides that the City Council may award performance pay to Employee, in an amount up to and including 10% of Employee’s annual base salary, based on the level of Employee’s completion of goals identified by the City Council.
C. After conducting an annual performance review, the City Council has decided to award Employee performance pay in the amount of 6% of her annual base salary.
D. The City and Employee have agreed to amend the Agreement to reflect Employee’s performance pay for the 2023-24 fiscal year. .
NOW, THEREFORE, the parties amend the Agreement as follows:
1. Sub-paragraph (a) is hereby added to Section 4.A(2), as follows:
“Based on its annual performance evaluation, the City grants Employee a one time, lump sum 6% pay-for-performance award pursuant to Section 4.A(2) of the Agreement for fiscal year 2023-24.
The parties agree that the gross amount of performance pay is $13,200. The performance pay will be paid as part of the next available payroll cycle. The performance pay is not an addition to base pay and does not alter the City’s salary schedule.”
2. Except as expressly amended by this Amendment, all of the provisions of the Agreement shall remain in full force and effect.
