RECOMMENDATIONIt is recommended that the City Council adopt the resolution entitled, “A RESOLUTION
OF THE COUNCIL OF THE CITY OF BEVERLY HILLS AUTHORIZING THE CITY
MANAGER TO APPROVE DESIGN PLANS AND SPECIFICATIONS FOR
CONSTRUCTION PROJECTS VALUED AT $100,000 OR LESS.”
INTRODUCTION
Government Code Section 830.6 grants public entities immunity for injury and damage caused by a dangerous condition of its property when the plan or design creating thatcondition is reasonably approved prior to construction. Government Code Section 830.6 further provides that design immunity can be created when an authorized employee ofthe public entity approves the plans and specifications for a project.
DISCUSSIONPursuant to Government Code Section 830.6, this resolution authorizes the City Council to vest authority in the City Manager to approve designs for a construction project if the estimated cost of the project does not exceed One Hundred Thousand Dollars ($100,000), the plans and specifications for such project were approved by a professional engineer prior to construction, and the City Manager finds that substantialevidence establishes the reasonableness of the design of the project.Page 1 of 2 B0785-0001\2969780v1 .doc 06/18/24

Section I. Section 3. The City Clerk shall certify to the adoption of this resolution, and shall cause this resolution and her certification to be entered in the Book of Resolutions of the Councilof this City.
