OF THE CITY OF BEVERLY HILLS ADOPTING AND AMENDING THE STATE Meeting Date: June 18, 2024
MID-CYCLE UPDATES TO THE 2022 CALIFORNIA GREEN BUILDING STANDARDS CODE, AND AMENDING TITLE 9 OF THE BEVERLY HILLS MUNICIPAL CODE; AND
Pursuant to the provisions of the California Environmental Quality Act (CEQA), the City Council will also consider finding the Ordinance exempt from CEQA.
INTRODUCTION
Every three years, the California Building Standards Commission adopts updated versions of the California Building Standards Code (Title 24 of the California Code of Regulations). The Building Standards Code incorporates a variety of codes including the California Green Building Standards Code (GBSC). Midway through each three-year code cycle, the Building Standards Commission adopts mid-cycle revisions to the Building Standards Code through an Intervening Code Adoption Cycle Supplement.
The City must adopt the updated Building Standards Code by ordinance every three years and is authorized by State law to make certain local amendments to the code if desired. In 2022, the City Council adopted by reference the 2022 code with local amendments, which became effective January 1, 2023. The City Council typically does not consider mid-cycle code revisions because they are automatically implemented through state law and do not require further action by the City, unless there is a need for local amendments to the mid-cycle revisions.
The Building Standards Commission has adopted mid-cycle revisions to the GBSC and other codes that will become effective July 1, 2024. The City has determined that it is reasonably necessary to modify certain provisions of the revised GBSC through local code amendments in order to provide for greater availability of electric vehicle (EV) charging infrastructure in new construction.
DISCUSSION
In order to approve local amendments to the GBSC and other building codes, the City must demonstrate that the amendments are more restrictive than the requirements of state law and must make an express finding that each amendment is reasonably necessary because of local climatic, geological, topographic, or environmental conditions. After adoption, these amendments must be filed with the California Building Standards Commission to become effective.
Resolution of Findings
Staff is recommending that the City Council adopt local amendments to the mid-cycle GBSC to impose more stringent requirements related to EV charging infrastructure, as described below.
The purpose of the proposed requirements is to assist with meeting greenhouse gas reduction targets, while increasing the resiliency of the City of Beverly Hills community in responding to effects of climate change.
Climate impacts in Beverly Hills include an increase in temperature, extended drought, wildfires, and extreme heat. Ensuring an equitable response to climate change means both protection from climate-induced hazards, as well as access to environmental benefits for all. The reduction of Meeting Date: June 18, 2024
greenhouse gas emissions resulting from the recommended amendments will help reduce the rise in the City’s average temperatures and resulting risks.
Proposed Green Building Standards Code Amendments
The mid-cycle GBSC revisions change the manner in which the required type and amount of EV charging infrastructure are determined. Depending on the type of project and number of parking spaces, the revised GBSC is more restrictive than the City’s existing local amendments. The proposed ordinance would amend the Beverly Hills Municipal Code (BHMC) to incorporate the revised EV charging infrastructure requirements while adding new local amendments to ensure that Beverly Hills remains a leader in requirements for EV charging infrastructure.
The proposed Ordinance amends BHMC Section 9-1-1102 by revising Section 4.106.4 of the GBSC pertaining to standards for installation of EV charging infrastructure in new one- and twofamily dwellings and townhomes with attached private garages, multi-family dwellings, hotels, and motels. The Ordinance includes requirements for charging hardware and signage, and for allocating parking spaces for EV charging, including accessible EV charging station spaces. The Ordinance further establishes minimum dimensions for EV parking spaces and parking aisles.
The Ordinance also amends BHMC Section 9-1-1102 by adopting and amending Tables
5.106.5.3.1, A5.106.5.3.1 Tier 1, and A5.106.5.3.3 Tier 2, of the GBSC.
Additionally, the Ordinance establishes minimum numbers of EV parking spaces required for residential and non-residential parking facilities.
For administrative efficiency, the Ordinance carries over, without amendment, all other provisions of BHMC Section 9-1-1102.
Table 1 below represents the existing GBSC and the corresponding City of Beverly Hills code amendments. The City’s amendments represent a more stringent EV requirement than those from the State.

Table 2 below represents the new GBSC requirements for EV charging infrastructure that will become effective July 1, 2024 along with staff’s recommended amendments. Since the new GBSC requirements are more stringent than the existing requirements, staff recommends adopting the new requirements as-is, except that staff recommends removing the specified cap on the maximum number of EV charger parking spaces to be provided. This amendment means that EV charging receptacles would be located in at least one assigned parking space per dwelling unit where assigned parking is provided.

Climatic Conditions:
Vehicle pollutants harm our health and contain greenhouse gases that cause climate change.
Burning gasoline and diesel fuel creates harmful byproducts like nitrogen dioxide, carbon monoxide, hydrocarbons, benzene, and formaldehyde. In addition, vehicles emit carbon dioxide, the most common human-caused greenhouse gas.
Motor vehicles are one of the largest sources of air pollution in the City of Beverly Hills.
The City of Beverly Hills has been embarking on an ambitious plan to build a resilient community that is better prepared for the impacts of climate change and to drastically reduce local greenhouse gas emissions including CO2 in line with state targets. That reduction will bring many benefits to the community once implemented, including improved public health outcomes, improved air quality, equitable protection from climate-induced hazards, and equitable access to environmental benefits.
Implementation of the proposed amendments will contribute to meeting the greenhouse gas reduction targets, while preparing the City of Beverly Hills community to increase resilience in responding to effects of climate change. The City has established targets to reduce greenhouse gas emissions to 40 percent below 1990 levels by 2030, and carbon neutrality by 2045.
Climate impacts in Beverly Hills include an increase in temperature, heavy rain events, extended drought, wildfires, and extreme heat. Vulnerable populations across the city, which include unemployed, low-income, youth, older adults, and linguistically isolated people are often the most exposed to and impacted by the effects of climate change. Ensuring an equitable response to climate change means both protection from climate-induced hazards, as well as access to environmental benefits for all.
The City of Beverly Hills is located in an area climatically classified as “semi-arid” and prone to hot and dry Santa Ana winds of high velocity. Moreover, due to the arid nature of the area, the weather during the windy period tends to be very warm and dry. Furthermore, the City of Beverly Hills is a densely populated area having buildings and structures constructed within a climate system capable of producing major winds, fire and rain related disasters, including but not limited to those caused by the Santa Ana winds and El Nino (or La Nina) subtropical-like weather. The City is projected to experience more frequent and damaging wildfires by the mid-21st century. The effects of future wildfires on Beverly Hills could range from the direct impacts on residences and businesses, to wildfire smoke and associated air pollution and potential communication network outages. The reduction of greenhouse gas emissions resulting from the City’s Code modifications will help minimize the rise in the City’s average temperatures and resulting risk of fires.
Section 3. Specific Amendments and References to Findings California Health and Safety Code Section 17958.7 requires that the modification or change be expressly marked and identified as to which each finding refers. Therefore, the City Council finds that the following table sets forth provisions in the 2022 Intervening Code Adoption Cycle Supplement to the 2022 California Building Standards Code provisions constituting building standards that have been modified pursuant to Ordinance No. ________, and the associated local climatic conditions described above in Section 2 supporting modification.
