RECOMMENDATION
Staff recommends that the City Council continue the Project to a date uncertain. City staff will re-notice the Project in accordance with City requirements for a new hearing date.

INTRODUCTION
The owner of the property at 9150 Wilshire Boulevard submitted a request to modify a covenant applicable to the commercial building on the site. Specifically, the request is to remove the covenant’s prohibition on medical uses.

DISCUSSION
This request was scheduled for the City Council meeting on June 27, 2024. The City mailed the required public notice on June 7, 2024 to all property owners and residential occupants within 500 feet of the site extended to the block-face. However, the applicant was required to install on-site posted notices along Wilshire Boulevard, South Palm Drive, and South Oakhurst Drive by June 7, 2024. Staff had provided the noticing materials necessary to post the site on June 5, 2024, and informed the Applicant of the posting requirements on June 4, 2024 and June 5, 2024. After the mailed notice was distributed on June 7, 2024, staff reached out to the Applicant to confirm the installation of the on-site posted notices; however, no confirmation was provided by the Applicant.

On June 14, 2024, staff conducted a site visit and observed that the required on-site noticing was not posted. Due to the lack of the compliance with the City’s public noticing Meeting Date: June 27, 2024

requirements, the City Council cannot take action on the request at this time and the matter must be rescheduled.

FISCAL IMPACT
No fiscal impact to the City is anticipated beyond staff time required for future re-noticing and staff report preparation.
