Item Number:

To: Honorable Mayor & City Council
From: Chief Mark Stainbrook
Subject: AN ORDINANCE OF THE CITY OF BEVERLY HILLS

AUTHORIZING THE BEVERLY HILLS POLICE
DEPARTMENT’S MILITARY EQUIPMENT USE INVENTORY IN
ACCORDANCE WITH GOVERNMENT CODE SECTION 7071
Attachments: 1. Draft City Ordinance

RECOMMENDATION
It is recommended that the City Council move to waive the full reading and introduce the following ordinance entitled:
“AN ORDINANCE OF THE CITY OF BEVERLY HILLS AUTHORIZING THE BEVERLY HILLS POLICE DEPARTMENT’S MILITARY EQUIPMENT USE INVENTORY IN ACCORDANCE WITH GOVERNMENT CODE SECTION 7071.” Staff recommends that the City Council review the attached “BHPD Military Equipment Inventory,” which outlines the items requested by the Beverly Hills Police Department (“BHPD”).

This item is being reintroduced by staff with the correct attachment.

INTRODUCTION
On September 30, 2021, Governor Newsom signed Assembly Bill 481 (“AB 481”), adding sections 7070 et seq. to the Government Code, to address the funding, acquisition, and use of military equipment by California law enforcement agencies.

Effective January 1, 2022, AB 481 requires law enforcement agencies to obtain approval from their governing body to obtain any new or additional military equipment.

The BHPD discussed its request to acquire new military equipment and restock previously-approved types of equipment during its “community engagement meeting”

held during the City Council Study Session on May 7, 2024, pursuant to Government Code § 7072(b).

DISCUSSION
AB 481 has designated certain equipment as “military equipment” under Government Code § 7070(c). The BHPD seeks approval to add new and additional equipment to the Military Equipment Inventory, as outlined in the attachment and listed below.

In order to approve the items, City Council must determine the following pursuant to Government Code § 7071(d)(1):
 The military equipment is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.  The proposed military equipment use policy will safeguard the public’s welfare, safety, civil rights, and civil liberties.
 If purchasing the equipment, the equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.
 Prior military equipment use complied with the military equipment use police that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance.

FISCAL IMPACT
The cost of the requested items are outlined below. No additional funding is requested for these purchases.
