2. Agreement for Water Services
INTRODUCTION
This report is an update on the City’s Water Will Serve process and development guidelines. Staff is seeking feedback and approval on the general form of the Agreement for Water Services (AWS), which is a part of the City’s development Water Will Serve guidelines and process.
DISCUSSION
The City serves all developers in Beverly Hills and a portion of the City of West Hollywood as part of its Water Service Area. The Water Will Serve process provides guidelines for water services requests to developers. As part of the process, developers complete a Water Will Serve application, which delineates the type of water services (domestic, irrigation, and fire) being requested and their associated demands. All development within the City of Beverly Hills as well as within the West Hollywood water service area is equally required to adhere to this process.
Water demands determined through the Water Will Serve process are utilized by the City to size meters and determine the appropriate fees. The City water fees consist of connection, water capacity, and water supply fees for all development. Connection fees are the installation costs including labor, heavy equipment, and materials for City staff to field install the water services. Water capacity fees are one-time fees collected for staff to operate and maintain the water services in perpetuity once the water services have been installed. Finally, water supply fees are the fees that each developer pays for their proportional share to develop future water supplies.
Additionally, water demands are also utilized to determine if there is a need for the developer to construct offsite water infrastructure due to the additional demands exacted by the new development. These impacts are determined using a calibrated water July 16, 2024
hydraulic model that could result in additional requirements for infrastructure such as pipelines, pressure-reducing stations, or other associated appurtenances.
If water infrastructure is required by the developer, the City will require the developer’s engineer to design and the developer’s contractor to build the required infrastructure as a condition of approval. The attached AWS (Attachment 2) is an agreement that all developers will be required to complete identifying what offsite water infrastructure is being conditioned by the City to design and build (i.e., upsized water mains, pressurereducing stations, pump station/reservoirs, and other associated infrastructure).
The AWS is not associated with any entitlement process or parcel map approval and, thus, would not require Planning Commission approval. The AWS is an agreement that delineates the conditions of approvals for the planning, design, and construction of additional water infrastructure by mainly larger, more complex private developments.
Lastly, it outlines requirements for conformance to the City’s design standards and specifications, construction management, and inspection requirements for the installation of said infrastructure by the developer. Although this agreement can apply to larger Beverly Hills’ development projects, when applicable, this agreement would be most useful when contending with larger development projects in the City of West Hollywood, as the City’s water-related development projects are not part of the City of West Hollywood’s formal planning process.
Staff presented an update of the Water Will Serve process including the AWS at the June 13, 2024 Public Works Commission (PWC) meeting. The PWC was supportive of Water Will Serve process, the AWS, and the item moving forward to the City Council Study Session.
FISCAL IMPACT
There are no fiscal impacts; however, fees for the planning, design, and construction management of the proposed additional water infrastructure improvements by the developer will be collected via deposits from the developer prior to the commencement of construction. These fees pay for the City’s costs associated with review, plan check of the design plans, and providing as-needed technical support during the construction phase for the proposed water infrastructure improvements.
RECOMMENDATION
It is recommended that City Council provide approval of the blanket form of the Agreement for Water Service (AWS) to be used for developments primarily in the West Hollywood service area and that City Council grant authority to the Public Works Director or designee to execute the AWS as part of the Water Will Serve approval process when required.

Director of Public Works
