INTRODUCTION
On February 20, 2024, Beverly Hills City Council convened a public hearing to deliberate Proposed Rate Adjustments concerning water and wastewater charges. These adjustments received formal approval with the Rate Adjustment ordinance (included as Attachment 1) subsequently passing its second reading on March 11, 2024. The implementation timeline for these adjustments is delineated in Table 1 below.
Table 1: Rate Implementation Schedule

Water Shortage Revenue Stabilization Factors* April 11, 2024 Wastewater Rates** July 1, 2024
Water Reliability Charge** July 1, 2024

* Approved for use (if needed) for an additional five years beginning 30 days after adoption of the ordinance. **Future adjustments will occur on January 1, 2025, 2026, 2027, and 2028. ***Future adjustments will occur on January 1, 2026, 2027, and 2028.
Contained within the ordinance is the reauthorization of automatic adjustments, enabling the City's Water Utility to pass through increases in wholesale water charges from the Metropolitan Water District (MWD) to water customers if these charges surpass the adopted budgeted costs. This mechanism ensures that actual needs dictate adjustments, rather than budgeting for potentially higher costs during rate studies.
Meeting Date: July 16, 2024
DISCUSSION
On April 9, 2024, the MWD Board of Directors approved a two-year budget aimed at sustaining safe water supplies in Southern California amid challenges posed by climate change and inflation. The $2.4 billion budget includes rate increases on January 1, 2025, and January 1, 2026, impacting the 26 member agencies, including Beverly Hills.
The unexpected rise in wholesale water rates has significant implications for the existing City rate structure, as the water utility spends over $10 million on water purchases each year, which is nearly one third of the water utility’s entire expenses. Currently, the City’s water rates are comprised of a fixed service charge for water and fire meters, alongside tier-based charges for water consumption. These charges encompass various expenses such as distribution system maintenance, labor, supplies, power, and water procurement. Table 2 below delineates the recent City rate study's water purchase costs and the corresponding cost per hundred cubic feet of water (HCF) integrated into the quantity charges. It is imperative to underscore that the $2.68 cost per HCF for FY24/25 represents the fundamental cost of purchased water only and not the whole quantity charge, which is uniformly applied across all tiers. Moreover, each tier incurs additional expenses linked to pipeline maintenance, which escalate with tier progression due to peaking. The escalating costs reflect the increased strain on larger pipelines designed to accommodate peak demand, resulting in higher maintenance expenditures as tiers advance.
Table 2: Calculation of Water Costs in Quantity Charge - Per Rate Study FY 2023-24 FY 2024-25 FY 2025-26
Water Purchase Costs $10,386,662 $10,716,357 $11,057,976 Annual Water Sales (HCF) 3,999,875 3,999,875 3,999,875 Cost per HCF (included in Qty Charges) $2.60 $2.68 $2.76 Table 3 below includes updated water purchase costs to include the recently-approved MWD increase and the corresponding cost per hundred cubic feet of water (HCF) integrated into the quantity charges. As a result of the increase by MWD, the quantity charges charged to City customers (both Beverly Hills and West Hollywood water customers) are proposed to increase by $0.12 in FY24/25 and by $0.31 in FY25/26.
Although the budget is approved every fiscal year, the City’s water rates are adjusted in January. Therefore, the $0.12 increase will become effective January 1, 2025, and the $0.31 increase will become effective January 1, 2026. Recommended quantity charge rates, which include the pass-through charge for FY24/25 and FY25/26, are included in this report as Attachment 2.
Table 3: Calculation of Water Costs - Per MWD Updated Rates (April 2024) FY 2023-24 FY 2024-25 FY 2025-26
Updated Water Purchase Costs $10,386,662 $11,191,039 $12,296,951 Annual Water Sales (HCF) 3,999,875 3,999,875 3,999,875 Cost per HCF (included in Qty Charges) $2.60 $2.80 $3.07 Pass-through Adjustment to Quantity Charges $0.00 $0.12 $0.31 Effective Date 1/1/2025 1/1/2026
Additionally, the recent water and wastewater rates adopted by City Council impact customers differently based on their water use. Customer bill impact comparison tables are a useful tool for customers to gauge how the new rates will impact them individually.
Included as Attachment 3 to this report are the customer bill impacts which include the pass-though charge for low, average and high water users. As an example, a single- Meeting Date: July 16, 2024
family home with a 1” water meter using 56 HCF bi-monthly (which is the average water use by single-family customers) will see a $6.06 cumulative increase for water and wastewater charges bi-monthly as opposed to the $0.66 cumulative decrease originally anticipated.
Upon City Council support, staff will prepare customer notifications, which must be distributed at least 30 days before the rate implementation date, as per City Ordinance.
FISCAL IMPACT
The proposed pass-through charges are projected to generate $474,681 in FY24/25 and $1,238,975 in FY25/26, aimed at covering the rising costs of water purchases.
Furthermore, staff seeks an on-going appropriation of $210,244.00 from the Water Enterprise Fund to meet the increased expenses for water purchases. The current balance in the water purchases account is $10,980,795.00, which includes an ongoing budget enhancement requested in FY23/24 in anticipation of higher wholesale water costs. This enhancement was financed by the Water Enterprise fund balance. With the additional $210,244.00, the account will total $11,191,039.00, adjusted to accommodate MWD’s rate increases.
RECOMMENDATION
Staff recommends that City Council support moving forward with the proposed water pass-through charges due to an increase in water purchases and authorize an on-going appropriation of $210,244.00 from the Water Enterprise Fund.

Attachment 2
Attachment 2: Recommended Quantity Charge Rates (with pass-through charge) * The Quantity Charge Rates starting on 1/1/2027 and 1/1/2028 do not currently incorporate a pass-through charge, as the Metropolitan Water District (MWD) budget was approved for FY24/25 and FY25/26.
However, staff will diligently monitor MWD rates in the upcoming years. If MWD rates surpass the City’s budgeted costs, the City may explore implementing pass-through charges in the future.
