RECOMMENDATION
Staff recommends that the City Council approve the salary schedule reflecting all City job classifications and associated salaries in order to meet the California Public Employees’ Retirement System requirements of Government Code Section 20636 (b)(1) and California Code of Regulations, Title 2, Section 570.5. Staff also recommends that the City Council approve a one-time appropriation from various funds detailed in the Fiscal Impact section below totaling $350,850 for Fiscal Year 2024-25.
INTRODUCTION
CalPERS requires that one comprehensive salary schedule be established and approved by the agency’s governing body (City Council) which indicates the pay rate for each job classification in the member agency to be reportable as compensation earnable (for the purposes of establishing an employee’s pensionable income).
The City Council has approved salary ranges for each City job classification represented in the City’s nine (9) bargaining units by way of approval of the respective Memoranda of Understanding (MOU) or, for the executive group, the Executive Compensation Plan.
Additionally, the City Council may approve salary ranges for new job classifications, title changes, and reclassifications recommended as part of the annual budget process; otherwise, such modifications are recommended and approved by way of this report. In order to meet CalPERS requirements, the City Council must approve a comprehensive Meeting Date: November 19, 2024
pay schedule for all City job classifications (including appointed and elected positions), independent from the salary schedules attached to the Memoranda of Understanding, Executive Compensation Plan, or included in an Employment Agreement. Therefore, Staff is requesting that the City Council approve the comprehensive salary schedule, which will fulfill the CalPERS requirement for “publicly-available pay schedules” approved by the governing body.
DISCUSSION
CalPERS requires that all member agencies have publicly-available pay schedules for all job classifications. California Code of Regulations (CCR), Title 2, Section 570.5 outlines the requirements to satisfy CalPERS’ definition of “publicly-available pay schedules”, as follows:
“(a) For purposes of determining the amount of “compensation earnable” pursuant to Government Code Sections 20630, 20636, and 20636.1, payrate shall be limited to the amount listed on a pay schedule that meets all of the following requirements:
(1) Has been duly approved and adopted by the employer’s governing body in accordance with requirements of applicable public meeting laws; (2) Identifies the job classification title for every employee position; (3) Shows the payrate for each identified position, which may be stated as a single amount or as multiple amounts within a range;
(4) Indicates the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually; (5) Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website;
(6) Indicates an effective date and date of any revisions; (7) Is retained by the employer and available for public inspection for not less than five years; and
(8) Does not reference another document in lieu of disclosing the payrate.” The comprehensive pay schedule for all City job classifications (including appointed and elected positions) must be independent from the salary schedules attached to the Memoranda of Understanding (MOUs) or Executive Compensation Plan, or the salary included in an employment agreement or resolution for an appointed or elected official.
Following are the methods by which changes to titles and/or salaries are recommended.
Not all of these methods may be applicable to changes in this salary schedule. The method utilized for each change in the salary schedule recommended for approval in this report are noted in the charts below, along with an appropriation request if applicable.
Memorandum of Understanding (MOU) Adoption:
When the City prepares to enter into the collective bargaining process to negotiate an MOU, the City Council provides direction to their designated labor negotiator in closed session regarding authority for salary increases. Once the terms of the MOU are Meeting Date: November 19, 2024
negotiated, they are reflected in the proposed MOU’s, which are posted on the City’s website two (2) weeks in advance of the Council meeting at which they will be adopted.
Any negotiated salary increases then apply to all job classifications represented by the respective bargaining units. These scheduled salary increases are reflected in the respective MOU for each of the nine (9) bargaining units. The current MOUs can be found on the City’s website at www.beverlyhills.org/mou.
Budget Enhancement Request:
As part of the budget adoption process, City Staff can request the addition or upgrade of authorized job classifications through budget enhancement requests. These requests are subsequently vetted by the City Manager. The job classifications that the City Manager recommends to be considered by the City Council are brought forward for review as part of the budget process. If the budget enhancement is approved, it will be reflected in the budget prospectively. If the approved job classification is not an already established job classification (already approved in the MOU), Human Resources will create and establish a new job classification with a proposed salary range approved as part of the budget process. Should there be a change to the proposed salary range based on negotiations with the respective employee association, the new salary range will be brought forward to the City Council for approval in a future salary schedule report, with an appropriation request if applicable.
Reclassification Process:
An employee, a labor association, or the employee’s department may request a review of an employee’s duties and job responsibilities in relation to their job classification. The position and the employee’s responsibilities are then studied by Human Resources. If the employee is performing work outside of the scope of their current classification, a reclassification may be recommended. The recommendation for a reclassification may be into an existing job classification or to a new job classification. Any new classifications recommended as part of this process are accompanied by a recommendation for a new job description and salary range.
Classification Study:
A classification study is the evaluation of a position or group of positions to establish uniform job descriptions that describe the nature, scope, and level of work performed by each job classification. As needed, classification studies are conducted to update job descriptions and/or to ensure consistency in classification and compensation.
Reorganization:
Throughout the year as departments evaluate their staffing and organizational structure, new or modified job classifications can be recommended to replace or amend existing job classifications. When this requires the establishment of a new job classification, Human Resources assists the departments with the development of job description and salary range recommendations, and conducts negotiations with the respective employee associations regarding job description, title, and salary.

Title and/or Compensation Change:
Once a job classification and/or salary have been approved through one of the means described above, there may be a subsequent recommendation for a title and/or compensation change to more accurately reflect the scope and nature of work being performed.
CHANGES SINCE LAST SALARY SCHEDULE
The attached salary schedule reflects changes since the last salary schedule update on July 2, 2024 through one or more of the processes described above. These changes are reflected in the charts below:
Annual MOU Salary Increases:
The attached salary schedule reflects the negotiated MOU salary increases reflected in the Memoranda of Understanding for the Management and Professionals (M&P), Supervisors, Confidential, Safety Support, Municipal Employees Association (MEA), and MEA Part-Time Associations, all with MOU terms of October 7, 2023 – October 2, 2026.
The Salary Schedule also includes associated changes to the Executive Compensation Plan (“Plan”) as provided by the Plan approved by the City Council on June 18, 2024. The salary increases were effective September 21, 2024 which is the first day of the pay period that includes October 1, 2024. The salary increases, which were budgeted, are as follows:

FISCAL IMPACT
The changes resulting from the new salary schedule since the last salary schedule update are detailed in the Discussion section above. The negotiated changes to the Non-Sworn MOUs, and associated changes to Executive Compensation, for the current fiscal year were included in the proposed FY 2024-25 budget.
The compensation changes resulting from a classification/compensation study listed in this item give rise to retroactive pay of approximately $154,840 and an additional $196,010 to cover the increased cost for FY 2024-25, as these compensation changes were not included in the budget process. As such, additional appropriations of $350,850 are required for the Fiscal Year 2024-25 budget and will be accounted for in future years’ budgets, if approved. A breakout by fund of amounts recommended to be approved by City Council are shown below.

On June 18, 2024, the City Council approved the Fiscal Year 2024-25 Capital and Operating Budgets, which indicated potential financial challenges on the horizon, including forecasted deficits within the next five years. The forecasted General Fund surplus for Fiscal Year 2024-25 is due to scheduled one-time public benefit contributions of $12.5 million less the utilization of $2.0 million toward the operating deficit. The chart below displays the adjusted forecasted General Fund results for Fiscal Year 2024-25, incorporating both approved and proposed mid-year appropriations.
