RECOMMENDATION
Staff recommends City Council move to approve Amendment No. 1 to Agreement No. 237-24 between the City of Beverly Hills and Xenophon A. Gikas. Jr. dba CommGeek Tech Services LLC for specialized Information Technology professional services focused on Fire Department operations, and approval of a Fiscal Year 2024/25 change purchase order in the amount of $146,000 for work through June 30, 2025, for a total not to exceed amount of $240,000.
INTRODUCTION
In May 2024, the City of Beverly Hills entered into agreement 237-24 with Xenophon A.
Gikas. Jr. dba CommGeek Tech Services LLC for $94,000 to provide specialized Information Technology professional services focused on Fire Department operations.
Specialized services are in support of various Fire Department workplan initiatives including the upgrade of the apparatus video system, mobile CAD and fire permit automation.

DISCUSSION
The proposed Amendment No. 1 is requested to ensure uninterrupted specialized Information Technology professional services through June 30, 2025, and to approve a Fiscal Year 2024/25 change purchase order for $146,000 and a total not to exceed amount of $240,000.
The professional services provided under this Agreement and proposed amendment are exempt from the City’s bidding requirements, in accordance with Beverly Hills Municipal Code (BHMC) Section 3-3-112 (G).
FISCAL IMPACT
The costs associated with this Amendment will be funded from the approved Fiscal Year 2024/25 Information Technology Department budget.

COMMGEEK TECH SERVICES LLC
This Amendment No. 1 is to that certain Agreement between the City of Beverly Hills (hereinafter called "CITY"), and Xenophon A. Gikas. Jr. dba CommGeek Tech Services LLC (hereinafter called "CONSULTANT") dated July 1, 2024, and identified as Contract No. 237-24 (“Agreement”).
RECITALS
A. CITY entered into a written agreement with CONSULTANT to provide public safety systems consulting services and project management.
B. CITY and CONSULTANT desire to amend the Agreement to increase the consideration due to a greater than anticipated need for services.
NOW, THEREFORE, the parties agree as follows:
Section 1. The Consideration shall be amended as set forth on the cover page above.
Section 2. Exhibit B, “SCHEDULE OF PAYMENT AND RATES,” shall be amended and restated as attached hereto and incorporated herein.
Except as specifically amended by this Amendment No. 1, the remaining provisions of the Agreement shall remain in full force and effect.

EXHIBIT B
SCHEDULE OF PAYMENT AND RATES
CITY shall pay CONSULTANT for the services required by the Agreement an amount not to exceed Two Hundred Forty Thousand Dollars ($240,000.00) which shall include CONSULTANT’s fee for the Services as well as reimbursement for the actual cost of any equipment, materials and supplies necessary to provide the Services, including labor, materials, delivery, tax, assembly, and installation, as applicable.
CITY shall pay CONSULTANT compensation at the following rates per hour for scheduled service during normal business hours.

Principal Project Manager $ 125.00
CONSULTANT shall submit to CITY a detailed invoice, on a monthly basis or less frequently, for the Services performed pursuant to this Agreement. Each invoice shall itemize the Services rendered during the billing period and the amount due. Within 30 days of receipt of each invoice, CITY shall pay all undisputed amounts included on the invoice. CITY shall pay CONSULTANT said Consideration in accordance with the schedule of payment set forth in this Exhibit.
