AGENDA REPORT
Meeting Date: November 19, 2024
Item Number:

To: Honorable Mayor & City Council
From: Daren Grilley, Assistant Public Works Director/City Engineer Christine Chung, Project Manager
Subject: METRO PURPLE LINE SECTION 2 – REQUEST TO WORK
DURING THE 2024 HOLIDAY MORATORIUM BETWEEN
THANKSGIVING DAY THROUGH NEW YEAR’S DAY
Attachments: 1. Metro Holiday Moratorium Applications

2. Stakeholder Comments

RECOMMENDATION
Staff recommends that City Council (1) review the Los Angeles County Metropolitan Transportation Authority’s (Metro) request for a waiver of the holiday moratorium; (2) conditionally approve work within Metro’s project area or deny the waiver; and (3) provide feedback on recommended permit conditions, if applicable.

As of Thursday evening, the City and Metro continue to discuss the possibility of a Public Safety kiosk. Staff will provide an update at the City Council meeting.

INTRODUCTION
The Memorandum of Agreement (MOA) with Metro for Section 2 Station located under Wilshire Boulevard from Beverly Drive to Crescent Drive outlines allowable work hours and days in Article XIII. This agreement includes designated holiday moratorium dates during which no work is permitted. The MOA allows Metro to apply for a permit to waive the holiday moratorium, with City Council holding sole discretion to review, approve, or deny the request.

On July 11, 2024, City staff received Metro’s application to work during the 2024 holiday moratorium, which spans from Thanksgiving Day 2024 to New Year’s Day 2025 (November 28, 2024, to January 1, 2025). Additionally, on September 10, 2024, Metro submitted a supplementary request for further construction activities to facilitate concrete delivery into the tunnel.

DISCUSSION
Current and Future Work Activities
Construction of the Metro Purple (D) Line Extension Section 2 construction is near completion with the underground main station structures ready for backfill along Wilshire Boulevard. Construction of multiple appendage structures for equipment, ventilation, and emergency access is underway, and the ventilation structure at South Cañon Drive was completed by early November 2024. Larger appendage structures at South Beverly Drive and the Cañon Staging Yard are anticipated to be finished by early 2025. Work on additional appendage structures along Wilshire Boulevard began in September 2024 and will continue through 2025.

In 2025, Metro plans to undertake significant tasks, including the removal of deck panels and full roadway restoration of Wilshire Boulevard between Beverly Drive and Crescent Drive. Civil restoration and utility relocations over the station box would begin in early 2025 with installation of K-rails and a long-term reduction of Wilshire Boulevard to two lanes in each direction. Dewatering well and geotechnical instruments abandonment and surface restoration along the tunnel alignments will also progress from west to east through 2025.

Work Allowed During Moratorium
Per the MOA, Metro is allowed to continue to work within the staging yards and below ground 24 hours a day, 7 days a week, during the holiday moratorium. Metro will continue monitoring and maintaining the pre-installed and active geotechnical instruments and dewatering wells in the right-of-way for safe work and site conditions during the moratorium. City staff will evaluate temporary traffic control within the right-of-way on a case-by-case basis, provided Metro gives advanced notice for maintenance and emergency repair. City staff will continue to inspect and monitor the construction site to safeguard the public infrastructure and verify compliance with the MOA.

Holiday Moratorium Waiver Request
Metro and its Contractor, TPOG, have requested a waiver of this holiday moratorium to continue station and tunnel construction. The request includes delivering materials underground and placing structural concrete at the following locations, while maintaining one or two lanes in each direction along Wilshire Boulevard, depending on the hours of work:
 Wilshire Boulevard between Beverly Drive and Crescent Drive; and  Wilshire Boulevard between Willaman Drive and Carson Drive.

Metro proposes to implement the traffic control to achieve deck access during weekday night shifts (10:00 p.m. to 7:00 a.m.) when most retail and restaurant businesses are closed. Metro states that not allowing deck access or concrete delivery would delay essential activities, including deck removal, street restoration, and rail system testing.

Additionally, the contract between Metro and TPOG, signed in 2017, does not incorporate the moratorium, lane, and work hours restrictions outlined in the MOA with the City, executed in 2019. From 2019 to 2023, Metro incurred approximately $5.2 million in change orders to TPOG due to modified work conditions resulting from denied waivers or restricted work during the winter moratorium. If the 2024 waiver is fully denied, Metro estimates an additional change order of approximately $1.75 million. Conversely, if the waiver is approved with working night shifts only, this change order amount could be reduced to the range of $200,000.

Community Engagement
City staff completed the following stakeholder meetings and outreach to receive feedback on Metro’s request to waive the winter holiday moratorium and continue working at two locations.
 Staff presented at the Monthly Chamber of Commerce Stakeholder Meeting on October 10, 2024; no comment or objection was received.  Staff presented at the Beverly Hills Chamber of Commerce Government Affairs Committee (GAC) meeting on October 10, 2024; the GAC did not object the waiver request if the construction can be expedited.
 Staff informed the Rodeo Drive Committee and the Beverly Hills Conference & Visitors Bureau representatives in October 2024. Metro and City staff addressed their questions about the proposed work hours, traffic control, and mitigation measures during the moratorium. No objection was received.  One-on-one contacts were made with stakeholders located near the project sites in October 2024. Some of the stakeholders include Twigs & Thyme Floral Studio, Razi Law, Ardy Bath Collection, Sterling Plaza, the Maybourne Beverly Hills, 9401 Wilshire, Spago, East West Bank, 9420 Wilshire Boulevard – Rolex Building, Sixty Hotel, AKA, Brickstar Capital, Canon Properties, and 190 N Cañon Dr. Fred Hayman Building. Overall, no comments or opposition were received in regard to the holiday moratorium waiver request.
 Notices regarding the holiday moratorium waiver request were mailed on October 18, 2024, to residents and businesses in the following areas:
o Near the main station site: bounded by South Santa Monica Boulevard, Wilshire Boulevard, Camden Drive, Olympic Boulevard, and Rexford Drive. o Within 500 feet of the concrete pour site at Wilshire Boulevard between Willaman Drive and Carson Drive.

These same notices were emailed to the City’s contact database in October 2024.

Links to this notice and upcoming City Council meeting agenda items were posted on the City website and shared on social media platforms. A resident from South Crescent Drive expressed concerns about noisy work during nighttime hours. Staff clarified that Metro’s proposed activities are limited to non-noisy tasks and have coordinated with the Independent Compliance Monitor to ensure that there will be no impacts from Metro construction activities at night. Another resident objected to granting the waiver, citing a desire to enjoy the holidays without disruptions from Metro construction. In response, staff clarified that the proposed work would be limited to late-night hours on weekdays.
 Metro’s November lookahead notices were handed out to the residents and businesses bound by Wilshire Boulevard, Camden Drive, Olympic Boulevard, Hamel Drive, Rexford Drive, South Santa Monica Boulevard, and Crescent Drive on October 31, 2024.

Meeting Date: November 19, 2024

Staff Review
If City Council is interested in waiving the Holiday Moratorium, then staff recommends authorizing Metro to work during the upcoming 2024 Holiday Moratorium with the following conditions.
 If Metro adopts a systemwide public restroom policy and installs restrooms at station plazas within Beverly Hills, Metro will work with the City to ensure the restroom design and aesthetics align with the City’s Connect Beverly Hills design standards.
 Section 2 will refrain from implementing any traffic control or road closure in the Right-of-Way during the Los Angeles Marathon weekend (March 15 and 16, 2025) or any other regional events that may raise safety concerns at the City’s request.  Work hours restricted to Monday to Friday, 10:00 p.m. to 7:00 a.m. when most businesses are closed.
 Wilshire Boulevard to be maintained at minimum one lane in each direction during the work hours.
 No work allowed on Thanksgiving Day, the Friday after Thanksgiving, the first night of Hanukkah (December 25, 2024), Christmas Eve, Christmas Day, New Year’s Eve, and New Year’s Day.
 No impacts to the Santa Display and other holiday decorations.  Address concerns from the public and stakeholders, compliance monitoring per the MOA, and Traffic Control Officers as needed.

City Council Ad Hoc
On November 1, 2024, the Metro Ad Hoc Committee, which includes Mayor Friedman and Councilmember Wells, was briefed on Metro’s request to work during the 2024 Winter Holiday Moratorium at the two specified locations. The Committee reviewed the proposed work. Following this evaluation, the Committee recommended that the Holiday Moratorium only be waived if the Public Safety Kiosk be built in accordance with the City’s design, including a staff restroom. Metro has not agreed to these conditions.

FISCAL IMPACT
There is no direct fiscal impact associated with approving or denying this request. The terms of the MOA include provisions for Metro to reimburse costs for all staff and consultants performing work associated with design-build construction activities of the Purple Line Extension – Section 2 in Beverly Hills.

----------
I hope you are doing well. Are you able you meet to discuss the N Canon closure extension and the Holiday Moratorium Waiver requests.

Both items will be going before City Council for consideration on November 7, 2024.

1. N Cañon Dr Closure Extension
The City Council will discuss extending the current N Cañon Dr. closure for an additional 9 months, until September 2025. This closure, which began in September 2019, helps mitigate the construction impacts of the Metro Purple (D) Line project. The closure extension would mitigate continued work in 2025, including removing deck panels on Wilshire Blvd and long-term lane reductions needed for street restoration along Wilshire Blvd.

2. Waiver for Work During the Winter Holiday Moratorium Metro has requested a waiver to allow construction during the 2024 Holiday Moratorium period, from Thanksgiving Day to New Year’s Day.

This waiver would allow Metro to continue material and concrete deliveries into the tunnel, critical for advancing street restoration along Wilshire Blvd and completing rail installation within the tunnel. Metro is willing to adjust work hours to reduce any potential disruption to the community during this time.

Please let me know if you have any questions.

Regards,
Perla

Good morning, Jessica and David,
Do you have any concerns with Metro’s waiver request for the 2024 Holiday Moratorium period, from Thanksgiving Day to New Year’s Day? The waiver will enable Metro to continue material and concrete deliveries into the tunnel, which is essential for progressing with street restoration along Wilshire Blvd and completing rail installation within the tunnel. Good morning, Nyla and Kerri,
I hope you are doing well. Are you available to meet to discuss the N Canon closure extension and the Holiday Moratorium Waiver requests.

Regards,
Perla

Hi Mike,
Please find additional details regarding Metro’s request.

Metro requests a holiday moratorium waiver to continue critical delivery work on Wilshire Boulevard between Thanksgiving and New Year’s Day. This work is essential to maintain progress on the tunnel construction and street restoration efforts along Wilshire Blvd. The specific activities during this period include:

1. Material and concrete deliveries to the tunnel between Beverly Dr and Crescent Dr (with access near Reeves Dr).

2. Concrete deliveries to the tunnel between Willaman Dr and Carson Dr.

These deliveries will take place overnight from 10:00 PM to 7:00 AM, Monday through Friday, excluding weekends and holidays. To facilitate the work, Wilshire Blvd will be limited to one lane in each direction during delivery hours.

Please note:

No noisy activities are anticipated, and an Independent Compliance Monitor will be present to oversee the operations.

No aboveground work or traffic disruptions will occur between 7:00 AM and 10:00 PM or during weekends.

We understand the importance of minimizing disruption during the holidays and are committed to keeping impacts on residents and businesses as minimal as possible.

If you have any questions or concerns, please do not hesitate to reach out. Also, I would be happy to schedule a call to discuss further or address any feedback you may have.

Thank you for your consideration.

Re: Metro request (2) -- waiver for work during winter holiday moratorium.

I OBJECT to granting the waiver.

It's bad enough the whole year, so let us at least have holidays with less Metro disruptions.

Please do not grant waiver.

Thanks in advance.

Hi Maria,
Thanks for your comment. I understand Perla reached out to you this morning to obtain further information, and she clarified typical daily night operations by Metro.

During the moratorium, from Thanksgiving Day to New Year’s Day, Metro proposes to continue the material and concrete delivery work only; no loud work is anticipated.

We will verify with the Independent Compliance Monitor to address your concerns about night hours, ensure minimal impact from Metro, and check for any other unpermitted operation at night.

Also, please feel free to contact Perla or me directly if there is no response from the hotlines.

Some people who received this message don't often get email from [email protected]. Learn why this is important
I live on South crescent Drive , just one block from Wilshire and it has been very hard to cope with the noise of the metro workers at night. The drilling, the dropping of heavy equipment has made it very challenging for me and my family to get a good night of sleep. I feel that residents so close to the area of work have been forgotten, I have Resident at S Crescent Dr.
called the hotline a few times even at night and nobody has ever gotten back to me. i understand that work needs to be done, but I also work every day and so the rest of my family and my neighbors and we deserve to sleep peacefully and quietly at least from midnight to 7 ( not feel is too much to ask) I invite you to come and sleep here to see from yourself. Noise during your sleep ( especially the constant drilling sound) impacts you physically and mentally so I definitely would like work to stop during the holidays at least to enjoy the season, but I also encourage you to make sure that you enforce quiet time at least between midnight and 7a.m. since it is becoming a health issue
Thanks for listening

Hello Perla
No concerns on behalf of these items, I just want to make sure we still have the parking in front of Ferrari during this time as we are going to have renovation starting soon and will have shipping containters that need to park in front of this space to make deliveries to us. We have also been noticing a lot of dust due to the work being done is their anyway to have the dust levels kept down it really covers the rooftop bar and pool area in a layer of dust.
