INTRODUCTION
After years of negotiations, national opioid settlements have been reached that resolves all litigation brought by states and local governments against some of the largest pharmaceutical distributors such as McKesson, Cardinal Health, and Cencora (previously AmerisourceBergen) (collectively, the Distributors), and one manufacturer, Janssen Meeting Date: December 10, 2024
Pharmaceuticals, Inc., and its parent company Johnson & Johnson, and other distributors such as Teva, Allergan, and pharmacies Walmart, Walgreens, and CVS (collectively, the Pharmacies) stemming from lawsuits filed between 2014 and 2020 against opioid manufacturers and distributors seeking to abate the opioid crisis and the impact on communities. Settlements also include bankrupt distributors such as Mallinckrodt Pharmaceuticals through the National Opioid Abatement Trust II and Endo Public Opioid Trust Abatement Fund.
DISCUSSION
The Police Department currently has the capability to deploy Naloxone (more commonly known as “Narcan”) by sworn officers who have been properly trained in its use. This product is available for use both in the field and in the BHPD jail and officers have deployed Naloxone several times over the past few years successfully saving many lives. The Police Department recently expanded its Naloxone program to non-sworn Traffic Control Officers (TCO’s).
With the program expanded, additional supplies are needed as part of on-going maintenance including the training of new personnel utilizing contractual services from an outside entity capable of training the additional staff on the use of Naloxone. There are also supply requirements such as AED devices, batteries, personal protective equipment, and safe packaging when suspected narcotics are encountered and need to be safely housed for further evaluation. With the rising concerns over fentanyl and other opioid substances, there are many other training opportunities available for recognition, evaluation, and prevention of opioid use.
Additionally, funds from the settlement will be used towards programs that educate/impact the community such as opioid education panels in the high school utilizing services from high profile experts and celebrities who have dealt with addictions. Partnerships with the Drug Awareness Foundation supporting their mission of preventing drug related deaths through outreach to schools and media campaigns featuring billboards and bus advertisement for public education at large.
FISCAL IMPACT
It is requested that opioid settlement funds received by the City from the National Opioid Settlements Distributions and Opioid Abatement Trust Distributions of $334,066.04 be appropriated into the Law Enforcement Grant Fund (Fund 190) to fund Police Department opioid-related programs, training, purchases, and related operations.
