INTRODUCTION
In April 2024, the City Council adopted a Legislative Platform, which provides direction to the City’s legislative advocates and City staff as they work to secure clear and strategic initiatives locally, as well as in Sacramento and Washington, D.C.

This report is for information only and transmits updates from the City’s state lobbyist on legislative activities for the second year of the two-year, 2023-2024 state legislative session.

DISCUSSION
The second year of the two-year, 2023-2024 state legislative session, ended on August 31, 2024, at midnight, giving the Governor until September 30, 2024, to sign or veto legislation.

• Opposed – 25 bills
• Supported – 41 bills
• Neutral – 3 bills
• Watch – 1 bill
• Support if Amended – 2 bills
• Support, Seek Amendments – 1 bill
• Oppose Unless Amended – 2 bills
• Letter of Concern- 1 bill
Of the 41 bills the City supported, 38 were signed into law by the Governor, and three were vetoed by the Governor. Some of the more impactful bills signed by the Governor which the City supported include, but are not limited to:
• SBX1-2 – Energy: transportation fuels: supply and pricing: maximum gross gasoline refining margin – This bill allows the state to require oil refiners to

maintain a minimum inventory of fuel to avoid supply shortages that create higher gasoline prices for consumers and higher profits for the industry. • AB 3218 - Unflavored Tobacco List – This bill will help ensure the successful implementation of the flavored tobacco ban (SB 793, 2019) by enacting new enforcement efforts from the Attorney General’s office. Specifically, the bill would, effective January 1, 2025:
o Establish a publicly available list on the Attorney General’s website of all tobacco products that are permissibly unflavored and allowed to be sold in California.
o Authorize the Attorney General to seek civil penalties against sellers for selling products not appearing on the Unflavored List.
o Render products not appearing on the Unflavored List subject to seizure. • SB 268 – Crimes: serious and violent felonies - This bill includes the rape of an intoxicated person wherein the defendant drugged the victim in the list of violent felonies.

Of the 25 bills the City opposed, 21 were signed into law, and four were vetoed by the Governor. Some of the more impactful bills signed by the Governor which the City opposed include, but are not limited to:
• AB 2561 – Local public employees: vacant positions – This bill requires local public agencies to present the status of vacancies, recruitment, and retention efforts during a public hearing before the governing board at least once per fiscal year prior to budget adoption and identify any necessary changes to policies, procedures, and recruitment activities that may lead to obstacles in the hiring process.
• AB 2729 - Development projects: permits and other entitlements – This bill extends residential development entitlements for 18 months. • SB 7 – Regional housing need: determination – This bill prohibits a city or county from filing an objection to the regional housing need determination, repeal provisions allowing HCD to use an alternative process to determine existing and projected need for housing in a region, applies these changes to all cities including charter cities, among other provisions.

All three bills the City took a position of neutral on were signed by the Governor.

The single bill that the City took a position of watch on was signed by the Governor.

Of the two bill the City took a position of opposed unless amended on, one was signed and the other was vetoed by the Governor.

Finally, the single bill the City issued a letter of concern on was signed by the Governor.

A description of the bills, which the City took a position on during second year of the 2023-2024 legislative session, is attached for informational purposes and includes their status (Attachment 1). The letters the City sent on many of these bills may be found at www.beverlyhills.org/legislation.

Both the City Attorney’s Office and City staff are analyzing various bills that were signed into law to determine what affect they may have on the City.
