Conditions Estimate

RECOMMENDATION
Staff recommends that City Council waive the bidding requirements pursuant to the professional services exception, Beverly Hills Municipal Code 3-3-112(G), approve the Agreement between the City of Beverly Hills and Matt Construction Corporation for project coordination and construction management services for 9510 Brighton Way – Phase I Seismic Upgrade Project, and approve a purchase order in the not-to-exceed amount of $260,280.

INTRODUCTION
Built in 1960, 9510 Brighton Way Parking Structure is the oldest of the City’s 19 owned and operated parking structures. The existing parking structure is a five-story reinforced concrete structure with retail tenants on the ground floor and four stories of parking use above. Based on the building’s age, the construction type is consistent with non-ductile concrete structures. A high-level structural evaluation was performed by the structural firm of Brandow & Johnston, and seismic strengthening of the building is recommended.

To align with one of the tenant’s major remodel project, seismic strengthening is proposed to be performed in two phases. Phase I will involve placement of a new concrete shear wall and foundation within the tenant space on the ground floor as well as application of fiber wrap on existing columns. Phase II will involve additional concrete

shear walls on the west side of the ground floor and all of the floors above to ensure overall seismic performance of the building.

DISCUSSION
Phase I of the proposed seismic upgrade involves the addition of a concrete shear wall within the northeast tenant space. The tenant is scheduled to undergo a major remodel of their space, and, to align with their schedule, seismic strengthening of the building is scheduled to be performed in two phases. The construction schedule for Phase I as a result of the tenant’s desired schedule is quite aggressive. Furthermore, due to proximity of the proposed shear wall located next to the demising wall, construction will have to be done with utmost care and almost surgically to avoid any potential damage to the adjacent tenant. Due to sensitivity of this project, the services of Matt Construction were performed under a current blanket agreement to assist with site exploratory work, project scheduling and assistance in prequalifying trade contractors for a multi-prime contract approach, which will allow for the selection of qualified building trade contractors with successful experience in similar work.

Staff proposes to contract with Matt Construction for construction management services to assure the project meets the project budget, is built within the timeframe, and is performed at the highest quality.

Construction management scope of services has been delineated in Attachment 2.

Total compensation for services under this agreement is $260,280, comprised of a fee of $219,120 for general conditions expenses, plus a contractor’s fee of $21,880, and an additional $19,280 for contingencies.

The construction management services scope is for a period of two months for installation of the shear wall, shear wall footing fire sprinkler relocation, and FRP fiber warp application. The construction manager’s fee is based on 6% of the project construction cost and represents the firm’s profit and general office overhead. Staff believes the fee is appropriate for the project.

The general conditions expenses are the direct costs for onsite project management services and include a full-time superintendent with miscellaneous costs for the full duration of the construction work.

Beverly Hills Municipal Code 3-3-112(G) allows an exception to the bidding requirement when the contract is for professional services such as attorneys, physicians, architects, engineers, consultants, accountants, specialized printers or other individuals or organizations possessing a high degree of professional, unique, specialized or technical skill or expertise. In this case, Matt Construction will provide specialized professional services which is an allowed exception to the bidding requirement.

Meeting Date: January 9, 2025

FISCAL IMPACT
The cost for construction management and general conditions is $260,280 for 9510 Brighton Way – Phase I Seismic Upgrade Project. Funding is currently available in CIP Project #00786 (Parking Program Upgrades and Improvements) in Fund 130 – In-Lieu Parking District), which could be used for this project. No appropriation is requested at this time.
