RECOMMENDATION
Staff recommends that City Council:

1. Approve Amendment #2 to the agreement between the City of Beverly Hills and Fehr & Peers to provide traffic review support services for the One Beverly Hills project; and

2. Approve a corresponding change purchase order in the amount of $100,000.00 for a not-to-exceed amount of $200,000 for traffic review support services for the One Beverly Hills Overlay Specific Plan project. The cost of the services provided will be borne by the project applicant.

INTRODUCTION
Fehr & Peers has provided assistance to the City of Beverly Hills in reviewing transportation reports and traffic engineering design plans for the One Beverly Hills project since the entitlement process. Throughout the construction of the project, their team will review the traffic control plans submitted by the applicant to ensure compliance with the conditions of approval in the Overlay Specific Plan and Mitigation Monitoring and Reporting Program (MMRP), as well as all standards and best practices for traffic operation and safety.

DISCUSSION
The City had an agreement with Fehr & Peers (Agreement No. 452-23) with an original amount of $50,000.00. This agreement was amended via Agreement No. 268-24, to increase the not-to-exceed amount to $100,000.00.

As the One Beverly Hills project has progressed, various additional traffic related reviews and consulting services have been required, such as optimization of the signal near El Rodeo Elementary School, review of proposed loading dock operations, and other tasks that have resulted in the consultant using the authorized budget more quickly than originally anticipated. Considering the multi-year timeline of this project, staff estimates that an additional $100,000.00 will be needed to maintain traffic consulting services throughout the construction period. The new consideration amount will be collected from the developer in two payments of $50,000.00. The second payment will be collected when the initial deposit nears exhaustion.

FISCAL IMPACT
The applicant team deposited the first payment of $50,000.00 on December 3, 2024. The full amount of the contract will be collected prior to any additional services being provided.

The cost of providing these services will be fully funded by the applicant team, resulting in no fiscal impact to the City.
