AGENDA REPORT
Meeting Date: February 19, 2025
Item No.:

To: Honorable Mayor & City Council
From: Masa Alkire, City Planner / Assistant Director
Subject: A RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY

HILLS CONFIRMING CITY APPROACH TO GENERAL PLAN

AMENDMENT AND ZONING AMENDMENT REQUIREMENTS

FOR PROJECTS WITH PREVIOUSLY SUBMITTED AND VALID

PRELIMINARY APPLICATIONS, AND FINDING THE ACTION

EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT
Attachments: 1. Proposed Resolution

RECOMMENDATION
It is recommended that the City Council adopt the proposed “RESOLUTION OF THE

COUNCIL OF THE CITY OF BEVERLY HILLS CONFIRMING CITY APPROACH TO

GENERAL PLAN AMENDMENT AND ZONING AMENDMENT REQUIREMENTS FOR

PROJECTS WITH PREVIOUSLY SUBMITTED AND VALID PRELIMINARY APPLICATIONS” and find the resolution exempt from the California Environmental Quality Act.

DISCUSSION
Assembly Bill 1893, which took effect on January 1, 2025, revised the Housing Accountability Act (Government Code Section 65589.5) (“HAA”) in certain respects. The HAA now provides that for qualifying projects proceeding under the so-called “builder’s remedy” provision of the HAA, those projects “shall not be required to apply for, or receive approval of, a general plan amendment, specific plan amendment, rezoning, or other legislative approval.”
Based on and in compliance with the provisions in Assembly Bill 1893, since January 1, 2025, the City has not been requiring a general plan amendment or zoning amendment application for projects with a valid preliminary application (pursuant to Senate Bill 330) on file with the City, which was filed when the City did not have a certified housing element.

The City is continuing to otherwise process those projects. The City has notified applicants Meeting Date: February 19, 2025

of qualified projects that general plan amendment and zoning amendment applications are no longer required for these projects.

The proposed resolution confirms that for all qualifying projects proceeding as a “builder’s remedy” project under Government Code Section 65589.5(d), with what is determined to be a valid preliminary application already on file with the City, the City will not require any general plan amendment or zoning amendment application to be submitted in order for the project application to be deemed complete. These projects will continue to be evaluated for completeness based on the checklist for each application(s) submitted for each respective project.

ENVIRONMENTAL ASSESSMENT
The confirmation of the City’s approach to the processing of certain land use projects has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (“CEQA”) (Public Resources Code Section 21000, et seq.), the State CEQA Guidelines (California Code of Regulations, Title 14, Section 15000, et seq.), and the environmental regulations of the City. The City Council confirmation of the City’s approach to an aspect of processing certain land use project applications is not a project as defined in Public Resources Code Section 21065 because it will not cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Even if the action were construed as a project under CEQA, it would be exempt from any review under the “common sense” exemption set forth in Section 15061(b)(3) of the State CEQA Guidelines because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Thus, staff recommends that the City Council find that the action is not a project under CEQA or, in the alternative, is exempt from CEQA.

FISCAL IMPACT
There is no fiscal impact to the proposed action, which confirms an approach to processing of certain land use projects in compliance with state law.
