Dear Jordan Klein:
RE: City’s Application Intake and Processing – Letter of Technical Assistance The California Department of Housing and Community Development (HCD) received multiple requests for technical assistance requesting HCD to review the City of Berkeley’s (City) housing application intake procedures and application processing for compliance with the Permit Streamlining Act (PSA) (Gov. Code, § 65943.5). The purpose of this letter is to provide technical assistance on this matter.
Housing Element Program Commitments
As the City is aware, the City Council adopted Berkeley’s 6th Cycle Housing Element (2023 – 2031) on January 18, 2023, and HCD found the housing element in substantial compliance with State Housing Element Law on February 28, 2023. The City is obligated to implement the programs in the housing element to facilitate the City’s housing needs. The following two programs are responsive to this topic.:
• Program 33 (Zoning Code Amendment: Residential). This program requires amendments to the zoning code to reduce entitlement and permit processing time. It is intended to reduce administrative costs for the City and streamline housing projects.
• Program 34 (Permit Processing). This program addresses permit processing and acknowledges delays in processing development applications. Program 34 is intended to improve the streamlining of permit processing through updates to permitting software which would allow applications to be submitted online and provide on-demand reporting of project statuses.
Permit Streamlining Act – Completeness Review
The Legislature found and declared with the passing of the PSA that “there is a statewide need to ensure clear understanding of the specific requirements which must be met in connection with the approval of development projects and to expedite Jordan Klein, Director of Community Development
decisions on such projects” (Gov. Code § 65921). The intent of the PSA is to ensure that applicants are provided clear instructions and that local jurisdictions are processing projects in accordance with the specific timelines outlined in the statute to streamline development. Notably, the PSA requires that local jurisdictions determine in writing whether an application is complete within 30 days of application submittal. Considering the current housing crisis in California, delays in permitting processes and approval times add constraints to the cost of residential construction. Therefore, compliance with the PSA is even more pertinent today to meet the urgent housing needs across California.
It is HCD’s understanding that prior to a project’s full application submittal, the City conducts a unique local application intake review process. This process (which should not be confused with a typical pre-application process where a prospective applicant submits a conceptual plan for informal review and discussion) concludes in an application being found by staff to be “ready for review.” To achieve “ready to review” status, the applicant must submit all forms and materials required per the City’s development application checklist for review by the Planning Department. Once staff is satisfied that all forms and materials have been submitted as required, the applicant is invoiced and is authorized to officially submit the application. The City considers the 30-day PSA completeness clock to begin at the time when an applicant is issued an invoice and payment is made – and not at the time the application is originally submitted. Therefore, the time it takes for a project to achieve “ready to review” status is indefinite and may exceed 30 calendar days.
The PSA requires local jurisdictions determine in writing whether an application is complete within 30 calendar days after the application is received (Gov. Code § 65943, subd. (a), emphasis added). If the application is incomplete, the local jurisdiction must provide the applicant with a list of items that were not included in the application. That list must be limited to only those items contained within the local jurisdiction’s development application submittal checklist. The City’s application intake review process appears to be a completeness review consistent and subject to the PSA because the City requires all the application checklist items be provided in this process.
However, the City is not complying with the provisions of the PSA in that the City is not providing clear and transparent guidelines for what satisfies the application intake process and may take over 30 calendar days to complete the intake review.
Additionally, when the City ultimately accepts an application for review, HCD understands the City adheres to its own timing provisions contained in the City’s municipal code which states, “…when business days are referenced, they include only days when City Hall is open. The end of a time period is computed by excluding the first day and including the last day. If the last day is a holiday observed by the City or a City Hall non-business day, that day is excluded” (BMC § 23.104.030(F)). Based on this municipal code provision, it appears that the City excludes the day the application was submitted and excludes weekends, holidays, and days that City Hall is closed to the public. The practice of reviewing housing applications based on business days adds to Jordan Klein, Director of Community Development
constraints contributing to the housing crisis and is inconsistent with the provisions and intent of the PSA. The PSA explicitly states that local jurisdictions are required to determine whether an application is complete within 30 calendar days, and not business days.
Recommendations
As supported by the content of this letter, HCD makes the following recommendations to the City to best implement state law and housing element program commitments to streamline permit processing:
1. Completeness review begins at application submittal. When an application is submitted to the City for review, the City has 30 calendar days from the submittal date to determine completeness in writing per the PSA. Therefore, the City’s intake review process is a completeness review and is subject to the PSA and must be completed within 30 calendar days. The City should make it possible for an applicant to pay the application review fee at the time the application is submitted (e.g., via a written check, online payment portal, etc.)
2. Calendar days. The PSA requires the City to provide written comments to the applicant for a completeness review within 30 calendar days. This includes weekends, holidays, and any City Hall closures. The City’s Zoning Code provision and HCD’s procedures are not compliant with the PSA. Amendments to the City’s Zoning Code and internal procedures should be implemented consistent with the PSA.
Conclusion
HCD is aware that the City applied for the Prohousing Designation Program on August 17, 2023, to qualify for funding benefits. To qualify for the Prohousing Designation, the City must meet threshold requirements, including but not limited to, a compliant housing element and compliance with applicable state housing laws such as the PSA at the time of application. HCD recommends the City make the necessary streamlining improvements referenced above to fully comply with the PSA and to qualify for the Prohousing Designation Program.
HCD requests the City provide a written response by January 7, 2023. The Housing Accountability Unit will review the City’s response in coordination with the Prohousing Designation Division to ensure the City meets all requirements to obtain the Prohousing Designation. The written response should include details such as, but not limited to, a timeline of actions that the City will undertake to address the recommendations listed above.
Jordan Klein, Director of Community Development
HCD acknowledges the challenges with reduced staffing coupled with a high volume of development applications and applauds the City in its efforts to implement the City’s 6th Cycle Housing Element programs. HCD advises that the contents of this letter not be used to delay or otherwise unnecessarily complicate the intake and processing of entitlements. HCD reminds that the State of California is in a housing crisis, and the provision of housing is a priority of the highest order. RE: 140 South Camden Drive – Development Plan Review, Density Bonus Permit, Vesting Tentative Tract Map, and Tree Removal Permit for a Housing Development (PL2400348) Dear Mr. Leaderman:
The proposed project is a new 15-story housing development with 27 residential units with a height of approximately 194’-0”. The proposed building includes four subterranean levels designated for an automated parking facility to accommodate 44 vehicles.
In accordance with California Government Code §65589.5(j)(2), this memorandum outlines the inconsistencies of your housing development project with the applicable plans, programs, ordinances, standards, and requirements of the City of Beverly Hills. Below, you will find an explanation detailing the reasons your proposal is deemed inconsistent, non-compliant, or not in conformity.
Please note that the City considers the application incomplete at this time, maintains its position that its prior incompleteness determination for this project was timely made, and rejects any claims that the project has been deemed complete by operation of law.
A. Objective Standards: Beverly Hills Municipal Code (BHMC) a) Density
Pursuant to BHMC §10-3-2801, the zoning density requirement is: 1 Dwelling Unit per 1,300 SF of site area or 5 dwelling units.
General Plan base density: 50 du/acre (or 1 unit for every 871.2 SF of lot area). As such, the applicable density requirements would facilitate 8 dwelling units on the project site (6,375.82 / 871.2 = 7.32 units). Fractional figures are rounded up to the nearest whole number and would equate to a total of eight (8) units.
2 Standard Density Bonus: To qualify for an initial 50% standard density bonus increase, the project must provide at least 15% of the base units as very low-income units. The base density of 8 units is multiplied by 15%, which results in a total of two very low income units required in order to qualify for the 50% density bonus. The total number of additional units for the standard density bonus is calculated by multiplying the base density of 8 by 50%, resulting in 4 bonus units.
Stacked Density Bonus: To qualify for an additional 50% Density Bonus increase (“stacked”), the project must provide at least 15% of the base units as moderate income units. The base density of 8 multiplied again by 15%, results in a total of two moderate income units required in order to qualify for an additional 50% density bonus. An additional two of the 8 units must be designated as moderate income units. The total number of additional units for the additional density bonus is calculated by multiplying the base density of 8 by 50%, resulting in 4 additional bonus units.
The proposal, utilizing both the standard and stacked Density Bonus, would allow for a total of 16 units1
. However, the proposal includes 27 units, which exceeds the allowable limit under the Density Bonus request.
Therefore, based on the information above, the proposal is inconsistent with the multifamily zoning requirements for density as outlined in BHMC §10-3-2801 and the State Density Bonus regulations.
b) Minimum Floor Area for Dwelling Units
Pursuant to BHMC Section 10-3-2802, the minimum dwelling unit requirements for new development on properties located within a multi-family zone are as follows:
• Studio/Efficiency Unit: Minimum floor area of 600 SF
• One Bedroom Unit: Minimum floor area of 1,000 SF
• Two Bedroom Unit: Minimum floor area of 1,300 SF
• Three Or More Bedroom Units: Minimum floor area of 1,500 SF The proposed 27 dwelling units consists of the following dwelling unit types and sizes:
• Two-bedrooms: 26 units of 914 SF – 1,833 SF
• Three-bedrooms: 1 unit of 3,797 SF
Pursuant to the Density Bonus request, the applicant is seeking a waiver to reduce the minimum floor area requirements for two-bedroom units. However, the 27 proposed dwelling units is inconsistent with State Density Bonus regulations which would allow for 16 units. 1 The incomplete letter dated October 3, 2024, incorrectly lists the total allowable units as 12 after applying both the standard and stacked density bonus regulations.
3 Therefore, based on the information above, the proposal is inconsistent with the multifamily zoning requirements for minimum floor area of a two-bedroom unit as outlined in BHMC §10-3-2802.
c) Outdoor Living Space Required
a. Required Outdoor Living Space:
Pursuant to BHMC Section 10-3-2803, 200 SF of outdoor living space is required per dwelling unit for new developments in multi-family zones.
The project would need to provide 5,400 SF of open space for the number of units proposed.
The proposed project provides 4,194 SF of outdoor living space, which is 1,206 SF less than required.
b. Outdoor Living Space Dimensions:
The proposal is inconsistent with BHMC Sections 10-3-2803.A and 10-3-2803.B. Outdoor living spaces must either be private, with a minimum dimension of 6’ on all sides, or common, with a minimum dimension of 15’ on all sides.
The proposed private outdoor living spaces have a minimum width of approximately 5’, which does not meet the required 6’ dimension. Additionally, a portion of the common outdoor living space is as narrow as 6’-6”, below the required 15’ dimension. Thus, the outdoor living space area calculation would be less than 4,194 SF as cited in the application, as many identified areas do not qualify as compliant under the BHMC.
Pursuant to the Density Bonus request, the applicant is seeking a waiver to reduce the open space requirements. However, the 27 proposed dwelling units is not consistent with State Density Bonus regulations which would allow for 16 units.
Therefore, based on the information above, the proposal is inconsistent with the multifamily zoning requirements for outdoor living space as outlined in BHMC §10-3-2803. d) Height Limits of Buildings in Multiple-Family Residential Zones Pursuant to BHMC Section 10-3-2804, no building or structure located on a site that is less than or equal to sixty feet (60') in width shall exceed three (3) stories or thirty three feet (33') in height. Based on the survey provided for the project the project site has a width of 50’, which allows for development with a maximum of three stories and up to 33’ in height.
As proposed, the project is designed as a 15-story building with a height of 194’-0”. The proposed height and number of stories exceeds the allowable height limits in BHMC Section 10-3-2804. Pursuant to the Density Bonus request, the applicant is seeking waivers for height and number of stories. However, the 27 proposed dwelling units is not consistent with State Density Bonus regulations which would allow for 16 units. 4 Therefore, based on the information above, the proposal is inconsistent with building height and story limitations as outlined in BHMC §10-3-2804. e) Parking
a. Residential Parking
Pursuant to BHMC Section 10-3-2816, the parking requirements for properties in the City's multi-family zone are as follows:
• Two-bedroom units: 2.5 spaces per unit
• Three-bedroom units: 3 spaces per unit
The project includes 26 two-bedroom units and 1 three-bedroom unit, requiring:
• Two-bedroom: 65 spaces
• Three-bedroom: 3 spaces
• Total required: 68 spaces
b. Guest Parking
Pursuant to BHMC Section 10-3-2817, guest parking is required at a rate of 0.25 spaces per unit. For 27 units, this results in 7 guest spaces (rounded up), bringing the total parking requirement to 75 spaces.
The proposal includes a total of 44 parking spaces within an alternative parking facility.
The application materials indicate that the project seeks to utilize parking relief under Government Code Section 65863.2 (AB 2097). However, the project proposes an alternative parking facility in a residentially zoned property, which is inconsistent with BHMC Section 10-3-2730.4, as this section allows alternative parking facilities only in commercially zoned properties. Further, the proposal includes compact spaces.
Therefore, based on the information above, the proposal is inconsistent with the alternative parking facility requirements as outlined in BHMC §10-3-2730.4 f) Multiple-Family Residential Zones; Front Setbacks and Modulation Requirements Pursuant to BHMC Section 10-3-2806, the proposal would be required to provide an area of modulation of 1,500 square feet.
The proposed project would provide a total of 1,200 square feet of area of modulation, although no modulation exhibits were provided in the application materials.
Pursuant to the Density Bonus request, the applicant is seeking a waiver to reduce the required modulation to 1,200 SF. However, the proposed number of dwelling units is inconsistent with State Density Bonus regulations and this specific waiver request was not included in the Preliminary Application.
5 Therefore, based on the information above, the proposal is inconsistent with the modulation requirements as outlined in BHMC §10-3-2806. g) Front Yard Paving
Pursuant to BHMC Section 10-3-2813, no portion of any front yard within the R-4 Zone shall be paved, except for not more than one walkway not exceeding five feet (5') in width and one driveway not exceeding the width of its curb cut.
The proposed project would provide one 8’-10” wide walkway, which exceeds the 5’ limitation.
Therefore, based in the information above, the proposed walkway is inconsistent with BHMC Section 10-3-2813.
h) Building Setbacks
a. Front Setback – Pursuant to BHMC Section 10-3-2806, the required front yard setback for the project site is 15’-0”.
The proposal includes a 5’ setback on floors 1 and 2, and a 0’ setback for floors 3 and above.
Pursuant to the Density Bonus request, the applicant is seeking a waiver to allow a reduction in the front yard setback from 15’ to 0’. However, the proposed number of dwelling units is inconsistent with State Density Bonus regulations.
Therefore, based on the information above, the proposed front yard setback is inconsistent with BHMC Section 10-3-2806.
b. Side Yard Setbacks – Pursuant to BHMC Section 10-3-2807, the applicable side yard setbacks for properties with more than four (4) stories or greater than 45’ in height shall be subject to a cumulative setback of 23’-0’, with a minimum setback of at least 9’ required on one side.
The proposal includes a cumulative setback of 5’, with a minimum setback of 2’-6”.
Pursuant to the Density Bonus request, the applicant is seeking a waiver to allow a reduction in the side yard setback to 2’-6”. However, the 27 proposed dwelling units is not consistent with State Density Bonus regulations which would allow for 16 units.
Therefore, based on the information above, the proposed side yard setback is inconsistent with BHMC Section 10-3-2807.
c. Rear Yard Setbacks – Pursuant to BHMC Section 10-3-2808, the applicable rear yard setback for the subject property is 15’.
The proposal includes a rear yard setback of 2’-6”. Pursuant to the Density Bonus request, the applicant is seeking a waiver to allow a reduction in the rear yard setback to 2’-6”. 6 However, the 27 proposed dwelling units is not consistent with State Density Bonus regulations which would allow for 16 units.
Therefore, based on the information above, the proposed rear yard setback is inconsistent with BHMC Section 10-3-2808.
i) Garage Encroachment in Front Setback
Pursuant to BHMC Section 10-3-2811, basement garages are allowed to encroach into the front yard setback area. However, as designed, the portion of the basement garage built into these setback areas needs to be 2'-0” lower than the grade of the adjacent sidewalk. Additionally, that 2'-0” depression shall be used to provide planting areas within the front yard setback area.
The proposed project includes a basement garage within the front yard setback designed to be at the same level as the adjacent sidewalk along South Camden Drive.
Therefore, as designed this proposal is inconsistent with BHMC Section 10-3-2811. j) Standards for Inclusionary Housing Units
Pursuant to BHMC Section 10-3-4806, to the maximum extent possible, all inclusionary units shall be:
1. Reasonably placed in the residential development with balanced consideration given to both the potential economic and physical design constraints as well as the impact that the location of the units may have on the quality of living for prospective tenants.
2. Proportional in number of bedrooms, to the extent practicable, to the market rate units, unless the number of bedrooms for affordable units is dictated by requirements of state law, in which case the state law requirements shall be followed.
3. Comparable with the market rate units in terms of the base design and appearance The proposed project concentrates the inclusionary units on levels 2 and 3, only two-bedroom inclusionary units are provided, while the proposal includes a three-bedroom unit, and the proposed inclusionary units are smaller in size than the market rate units.
Pursuant to the Density Bonus request, the applicant is seeking an incentive request to allow “relief from BHMC §10-3-4806 to allow affordable units to be located in a separate lot structure in the areas depicted on the plans, and in the sizes proposed.” However, the 27 proposed dwelling units is not consistent with State Density Bonus regulations which would allow for 16 units.
Therefore, as outlined above, the proposal is inconsistent with BHMC Section 10-3-4806.
2. Incentive and Waivers
As summarized above, the following incentive and waivers have been requested by the applicant:
7 • “Incentive: Relief from BHMC §10-3-4806 to allow affordable units to be located in a separate lot structure in the areas depicted on the plans, and in the sizes proposed. • Waiver 1: Height: an additional 161'-0" of overall height above the 33-foot height limit as set forth in BHMC §10-3-2804 consisting of 194’ building height. • Waiver 2: Stories: an additional 12 stories above the three-story limit as set forth in BHMC §10-3-2804 for a total of 15 stories.
• Waiver 3: Setbacks: BHMC §10-3-2806 a reduced front yard from 15’ to 0’, BHMC §10-3- 2807 a reduced side yard from 9' to 2-6”; BHMC §10-3-2808 a reduced rear yard from 15' to 2'-6".
• Waiver 4: Modulation: Reduction of the required 10’ set back to 5’ and a reduction of 1,500 SF setback face to 1,200 SF.
• Waiver 5: Outdoor Living Space: Per BHMC §10-3-2803 (Modulation Requirements) and BHMC §10-3-2803 (Outdoor Living Space), a reduction of the required 5,400 SF to 4,194 SF.
• Waiver 6: Minimum Floor Area for Dwelling Units: BHMC §10-3-2802, a reduction of minimum floor area requirements from the required 1,300 SF to 914 SF.” B. Other Standards
The following standards are identified for the applicant’s information and consideration related to the proposed project, and will be taken into account in the City processing of the applications:
a. General Plan Policies:
i. L.U. 2.1 City Places: Neighborhoods, Districts, and Corridors. Maintain and enhance the character, distribution, built form, scale, and aesthetic qualities of the City's distinctive residential neighborhoods, business districts, corridors, and open spaces.
The proposed building would not maintain or enhance the character, distribution, built form, or scale of the residential neighborhood as the proposed height of 15 stories disrupts the established scale and massing of the surrounding neighborhood, which is characterized by two-story multi-family buildings. Furthermore, the existing building has been identified in the city’s December 2023 multi-family residential survey report as a contributor to a potential historic district and demolishing the existing building would detract from the neighborhood’s identity.
ii. LU 2.6 City History. Acknowledge the City’s history of places and buildings, preserving historic sites, buildings, and districts that contribute to the City's identity while accommodating renovations of existing buildings to maintain their economic viability, provided the new construction contextually “fits” and complements the site or building. 8 The existing building has been identified in the city’s December 2023 multi-family residential survey report as a contributor to a potential historic district and demolishing the existing building would detract from the neighborhood’s identity by removing a contributing structure.
iii. LU 2.10. Development Transitions and Compatibility. Require that sites and buildings be planned, located, and designed to assure functional and visual transitions between areas of differing uses and densities by addressing property and height setbacks, window and entry placement, lighting, landscape buffers, and service access.
The proposed project does not provide functional or visual transition between areas of differing densities, as the proposal includes a 15-story building into a residential neighborhood characterized by two-story buildings. The proposal’s significant reductions in front, side, and rear yard setbacks, along with reduced modulation, contrast with the scale of surrounding properties.
The inclusion of balconies would encroach upon the privacy of neighboring residents with the proposed reduced setbacks. The rooftop amenities would introduce potential impacts to the surrounding properties in this residential neighborhood, such impacts could include additional noise sources from the rooftop area as well as light sources. Finally, the reduced setbacks leave insufficient space for landscape buffering that could help provide privacy or a visual transition between differing densities.
iv. LU 5.1 Neighborhood Conservation. Maintain the uses, densities, character, amenities, and quality of the City's residential neighborhoods, recognizing their contribution to the City's identity, economic value, and quality of life.
The proposed building includes 15 stories with a total building height of 194’ and it would significantly alter the established character, density, and quality of life within the residential neighborhood. The proposal exceeds the allowable density and height limitations in the area. The proposed reduction in setbacks and modulation is inconsistent with the pattern of development and identity of the area. v. Policy LU 7.1 Character and Design. Require that multi-family dwellings and properties be designed to reflect the high level of architectural and landscape quality that distinguishes existing neighborhoods. These may provide for:
1. Building facades and entrances that directly address the street, including the use of stoops, porches, and recessed entries;
2. Modulation of building volume and masses, avoiding the effect of blank continuous walls; and
3. Setback of the ground floor from the sidewalk to provide privacy, a sense of security, and to leave room for landscaping while being open and contributing to a quality pedestrian environment.
9 Due to the proposed reduced front yard setback, the project does not have a building entrance that allows for the use of stoops, porch or recessed entry. The proposed design does not modulate building volume and mass, and therefore appears as a blank continuous wall. Furthermore, the proposed ground floor setbacks do not provide privacy or leave room for landscaping contributing to the pedestrian experience. vi. CIR 3.1 Neighborhood Traffic Control Measures. Incorporate traffic control measures in residential neighborhoods as part of proposed roadway improvement or development projects to mitigate traffic impacts to residents and reduce the negative impacts of motor vehicle traffic on quality of life. Require development projects to mitigate traffic impacts to residents and reduce the negative impacts of motor vehicle traffic on residential roadways.
Any use of the public right-of-way will require separate approvals from the City, and would be subject to the incorporation of neighborhood traffic control measures into the overall construction plan. At this time, the applicant has not provided a Construction Management Plan detailing measures to mitigate potential traffic impacts on residents, and consistent with policies designed to reduce the negative effects of motor vehicle traffic on residential roadways. The applicant must implement strategies to minimize disruptions and maintain the quality of life in surrounding neighborhoods, ensuring that the use of the right-of-way does not negatively impact local traffic flow or residential environments. Consequently, the proposed project is inconsistent with this policy.
vii. S 3.4 Fire Department Access. Design private and public access drives and roadways to preserve and maintain Fire Department access to properties.
The proposed project is inconsistent with this policy as the proposal includes 2’6” setbacks and would need to be increased to at least 3 feet wide, pursuant California Building Code requirements.
viii. S 5.1 Safety Standards. Require new development and redevelopment to be in compliance with seismic and geologic hazard safety standards, including design and construction standards that regulate land use in areas known to have or to potentially have, significant seismic and/or other geologic hazards.
a) In compliance with the abovementioned requirement, the City of Beverly Hills policy DSP-003, dated June 29, 2022, mandates a site-specific investigation of fault rupture in accordance with the California Building Code and the procedures outlined by the California Geological Survey in its latest Special Publication 42 (Revised 2018).
10 Due to the project's proximity to the Santa Monica Fault line, it is crucial to conduct this investigation and submit the findings to the city for review to ensure public health, safety, and welfare. The study's results may lead to construction restrictions or project scope changes.
b) A Geotechnical investigation of the project site’s soil condition is also required to identify the type of soil, its characteristics, and the requirements for designing below-grade structural elements. The submitted package is missing this key element of design; therefore, the city has no means of verifying the feasibility of this project in the proposed location.
b. Complete Streets Plan:
i. B2-8: Require new development projects on existing and potential bikeways to facilitate bicycle and pedestrian access to and through the project.
The proposed project is inconsistent with the above policy because it does not include short-and long-term bicycle parking or any other accommodations/support facilities on site.
ii. P1-2: Design and maintain sidewalks, streets, and intersections to emphasize pedestrian safety and comfort through a variety of street design and traffic management solutions.
P2-2: Create high quality sidewalks with appropriately sited seating, landscaping, pedestrian-scale lighting, and other streetscape amenities.
P2-7: Promote the health of residents by developing streetscapes, bikeways, accessible parklands that encourage pedestrian activity.
The proposed project is inconsistent with the above policies because the sidewalk is not designed to fully encourage pedestrian activity.
iii. T1-1: Increase multi-modal access to transit stops and stations.
T3-1: Promote the use of bus and rail to residents, employers/employees, and visitors.
V1-1: Encourage residents, employers/employees, and visitors to commute to work by modes other than driving alone.
V1-2: Enable access to jobs, shopping, entertainment, services, and recreation by walking, bicycling, or taking public transit, thereby reducing automobile use, energy consumption, air pollution, and greenhouse gases.
V1-3: Reduce single-occupant motor vehicle travel in the City through Transportation Demand Management.
V1-4: Shift travel from private passenger vehicles to alternative modes, including public transit, ride sharing, car-sharing, bicycling, personal mobility devices, and walking.
V1-11: Reduce or regulate demand for curb parking.
V3-9: Reduce pollution and emissions associated with driving to improve air quality. 11 The proposed project is inconsistent with the above policies meant to encourage residents to use non-driving modes, as it does not provide infrastructure/programs that would help achieve this.
c. Construction Means and Methods:
Construction projects typically affect neighboring properties and surrounding neighborhoods.
To address and minimize these impacts, a construction means and methods plan must be included.
However, the submitted package lacks this document, making verifying the project’s constructability and impact on adjacent properties impossible. Below are some of the concerns that were not addressed in the Development Plan Review package and will affect the project:
a) The proposed drawings show a 4-level basement that needs to be excavated to a depth of almost 50 feet. It is necessary to design a detailed shoring system and associated tiebacks to provide temporary structural support, preventing the collapse of surrounding walls and adjacent properties. The shoring system's tiebacks encroach on the adjacent properties' subgrade, create noise and vibration, and may result in public safety concerns. Additionally, to allow the encroachment into the neighboring properties, their approval and consent are required. The submitted package doesn’t include any document to address these concerns. b) The foundation’s deep excavation requires means and methods of ingress and egress for hauling trucks and excavation equipment without impacting the normal traffic flow in the neighborhood. The submitted package does not show the location and means of accessing the construction site in that manner.
c) The proposed plan includes 15 stories above and four below grade. Therefore, a tower crane is necessary. Installing a tower crane will require traffic interruptions and road closures.
Additionally, operating the tower crane over neighboring properties will require their consent. d) Given the project's complexity and limited space, the effects of material loading, storage, and construction activities on the neighboring properties will be significant. The submitted package does not address this issue.
d. California Building Code Requirements:
According to the City of Beverly Hills Municipal Code, the 2022 edition of the California Building Code (CBC) is adopted by reference, excluding all appendices except I, J, and P. This adoption is subject to the amendments outlined in section 9-1-202. Below are some issues highlighted in the Building and Safety memo dated September 30, 2024:
a) The drawings show two ladders as means of egress from the basement; 2022 CBC Chapters 4 & 10 require two means of egress from the basement and additionally prohibit the use of ladders. This is a life and safety issue.
12 b) Openings on the exterior sides of buildings are regulated by 2022 CBC Chapter 7 table 705.8.
The submitted plans show openings on the sides with a side setback of 2.5 feet. Per the building code's table 705.8, no opening is permitted in those areas. c) Per 2022 CBC section 1205, all yards and courts shall be at least 3 feet wide. The submitted plans only show 2.5 feet.
e. City of Beverly Hills Standard Detail Drawings and Street Tree Master Plan Per City of Beverly Hills Public Works/Engineering Standard Drawing BH 101 in the Standard Detail Drawings, no portion of a proposed driveway approach shall be constructed closer than ten (10) feet from the center of any city tree without a written approval of the city arborist.
The proposed project includes the removal of a City tree, a Chinese Flame Tree (Koelreuteria bipinnata), to accommodate the new driveway. However, this species is specifically designated as a selected species for Camden Drive in the City’s Street Tree Master Plan. Removing the Chinese Flame Tree would directly conflict with the goals and objectives of the Street Tree Master Plan. f. City of Beverly Minimum Parking Standards
Per City of Beverly Hills Minimum Parking Standards, the minimum stall size in all zones shall be 9’-0” X 19’-0”.
The proposed project includes compact parking spaces and is therefore inconsistent with these standards.
Please contact me directly at (310) 285-1192, or by email at [email protected] for any questions related to this memorandum.
Sincerely,
